السؤال

ما حكم من وجد مالاُ في الطريق ؟ هل يجوز له أن يأخذه ؟
نص الجواب
الحمد لله
هذا السؤال يتعلّق بباب اللُّقَطة وهو من أبواب الفقه الإسلامي و
اللُّقَطة : هي مال ضل عن صاحبه ، وهذا الدين الحنيف جاء بحفظ المال ورعايته ، وجاء باحترام مال المسلم والمحافظة عليه ، ومن ذلك اللُّقَطة .
فإذا ضل مال عن صاحبه ؛ فلا يخلو من ثلاث حالات :
الحالة الأولى : أن يكون مما لا تتبعه همة أوساط الناس ، كالسوط ، والرغيف ، والثمرة ، والعصا ، فهذا يملكه آخذه وينتفع به بلا تعريف ، لما روى جابر قال " رخص رسول الله صلى الله عليه وسلم في العصا والسوط والحبل يلتقطه الرجل " رواه أبو داود .قال الشيخ الألباني:

إسناده ضعيف.
الحالة الثانية : أن يكون مما يمتنع من صغار السباع ، إما لضخامته كالإبل والخيل والبقر والبغال ، وإما لطيرانه كالطيور ، وإما لسرعة عدوها كالظباء ، وإما لدفاعها عن نفسها بنابها كالفهود ، فهذا القسم بأنواعه يحرم التقاطه ، ولا يملكه آخذه بتعريفه لقوله صلى الله عليه وسلم لما سئل عن ضالة الإبل " مالك ولها ؟! معها سقاؤها وحذاؤها ترد الماء ، وتأكل الشجر ، حتى يجدها ربها" متفق عليه ، وقال عمر" من أخذ الضالة فهو ضال " أي مخطئ ، وقد حكم صلى الله عليه وسلم في هذا الحديث بأنها لا تلتقط ، بل تترك ترد الماء وتأكل الشجر حتى يلقاها ربها .
ويلحق بذلك الأدوات الكبيرة ، كالقدر الضخمة والخشب والحديد وما يحتفظ بنفسه ولا يكاد يضيع ولا ينتقل عن مكانه ، فيحرم أخذه كالضوال ، بل هو أولى .
الحالة الثالثة : أن يكون المال الضال من سائر الأموال : كالنقود والأمتعة وما لا يمتنع من صغار السباع ، كالغنم والفصلان والعجول ، فهذا القسم إن أمن واجده نفسه عليه ، جاز له التقاطه ، وهو ثلاثة أنواع :
النوع الأول : حيوان مأكول ، كفصيل وشاة ودجاجة .. فهذا يلزم واجده إذا أخذه الأحظّ لمالكه من أمور ثلاثة :
أحدها : أكله وعليه قيمته في الحال .
الثاني : بيعه والاحتفاظ بثمنه لصاحبه بعد معرفة أوصافه .
الثالث : حفظه والإنفاق عليه من ماله ، ولا يملكه ، ويرجع بنفقته على مالكه إذا جاء واستلمه ، لأنه صلى الله عليه وسلم لما سئل عن الشاة قال "خذها ، فإنما هي لك أو لأخيك أو للذئب " متفق عليه ، ومعناه : أنها ضعيفة ، عرضة للهلاك ، مترددة بين أن تأخذها أنت أو يأخذها غيرك أو يأكلها الذئب .
قال ابن القيمفي الكلام على هذا الحديث الشريف"وفيه جواز التقاط الغنم ، وأن الشاة إذا لم يأت صاحبها ، فهي ملك المتلقط ، فيخير بين أكلها في الحال وعليه قيمتها ، وبين بيعها وحفظ ثمنها ، وبين تركها والإنفاق عليها من ماله ، وأجمعوا على أنه لو جاء صاحبها قبل أن يأكلها الملتقط ، له أخذها " ا.هـ.
النوع الثاني : ما يخشى فساده ؛ كبطيخ وفاكهة ، فيفعل الملتقط الأحظّ لمالكه من أكله ودفع قيمته لمالكه ، وبيعه وحفظ ثمنه حتى يأتي مالكه .
النوع الثالث : سائر الأموال ما عدا القسمين السابقين ، كالنقود والأواني ، فيلزمه حفظ الجميع أمانة بيده ، والتعريف عليه في مجامع الناس .
- ولا يجوز له أخذ اللقطة بأنواعها إلا إذا أمن على نفسه عليها وقوي على تعريف ما يحتاج إلى تعريف ، لحديث زيد بن خالد الجهني رضي الله عنه ، قال : سُئل النبي صلى الله عليه وسلم عن لقطة الذهب والورق ؟ فقال" اعرف وكاءها وعفاصها ، ثم عرفها سنة ، فإن لم تعرف ، فاستنفقها ، ولتكن وديعة عندك ، فإن جاء طالبها يوماً من الدهر ، فادفعها إليه ) ، وسأله عن الشاة ؟ فقال : ( خذها ، فإنما هي لك أو لأخيك أو للذئب )، وسئل عن ضالة الإبل ، فقال : ( مالك ولها ؟! معها سقاؤها وحذاؤها ترد الماء ، وتأكل الشجر ، حتى يجدها ربها ) متفق عليه .

"جَاءَ رَجُلٌ إلى رَسولِ اللَّهِ صَلَّى اللهُ عليه وسلَّمَ، فَسَأَلَهُ عَنِ اللُّقَطَةِ، فَقالَ: اعْرِفْ عِفَاصَهَا ووِكَاءَهَا، ثُمَّ عَرِّفْهَا سَنَةً، فإنْ جَاءَ صَاحِبُهَا وإلَّا فَشَأْنَكَ بهَا، قالَ: فَضَالَّةُ الغَنَمِ؟ قالَ: هي لكَ أوْ لأخِيكَ أوْ لِلذِّئْبِ، قالَ: فَضَالَّةُ الإبِلِ؟ قالَ: ما لكَ ولَهَا، معهَا سِقَاؤُهَا، وحِذَاؤُهَا تَرِدُ المَاءَ، وتَأْكُلُ الشَّجَرَ حتَّى يَلْقَاهَا رَبُّهَا.

- ومعنى قوله صلى الله عليه وسلم "
اعْرِفْ عِفَاصَهَا ووِكَاءَهَا: الوكاء : ما يربط به الوعاء الذي تكون به النفقة ، والعفاص ، الوعاء الذي تكون فيه النفقة .
- ومعنى قوله صلى الله عليه وسلم " ثم عرِّفها سنة ، أي اذكرها للناس في مكان اجتماعهم من الأسواق وأبواب المساجد والمجامع والمحافل ، سنة : أي : مدة عام كامل ، ففي الأسبوع الأول من التقاطها ينادى عليها كل يوم ، لأن مجيء صاحبها في ذلك الأسبوع أحرى ، ثم بعد الأسبوع ينادى عليها حسب عادة الناس في ذلك .
" وإذا كانت هذه طريقة التعريف في العهد الماضي فإنّ الملتقط يعرّف اللقطة بالطرق المناسبة في هذا العصر ، والمهم حصول المقصود وهو بذل ما يُمكن للوصول إلى صاحبها " .
- والحديث يدل على وجوب التعريف باللقطة ، وفي قوله صلى الله عليه وسلم " اعرف وكاءها وعفاصها " دليل على وجوب معرفة صفاتها ، حتى إذا جاء صاحبها ووصفها وصفًا مطابقًا لتلك الصفات ، دُفعت إليه ، وإن اختلف وصفه لها عن الواقع لم يجز دفعها إليه .
- وفي قوله صلى الله عليه وسلم " فإن لم تعرف ، فاستنفقها" دليل على أن الملتقط يملكها بعد الحول وبعد التعريف ، لكن لا يتصرف فيها قبل معرفة صفاتها : أي حتى يعرف وعاءها ووكاءها وقدرها وجنسها وصفتها ، فإن جاء صاحبها بعد الحول ، ووصفها بما ينطبق على تلك الأوصاف ، دفعها إليه ، لقوله صلى الله عليه وسلم"فإن جاء طالبها يوماً من الدهر ، فادفعها إليه " .
وقد تبين مما سبق أنه يلزم نحو اللقطة أمور :
أولًا : إذا وجدها ، فلا يُقْدم على أخذها إلا إذا عرف من نفسه الأمانة في حفظها والقوة على تعريفها بالنداء عليها حتى يعثر على صاحبها ، ومن لا يأمن نفسه عليها ، لم يجز له أخذها ، فإن أخَذَها ، فهو كغاصب ، لأنه أخذ مال غيره على وجه لا يجوز له أخذه ، ولما في أخذها حينئذ من تضييع مال غيره .
ثانيًا : لا بد له قبل أخذها من ضبط صفاتها بمعرفة وعائها ووكائها وقدرها وجنسها وصنفها ، والمراد بوعائها ظرفها الذي هي فيه كيساً كان أو خرقة ، والمراد بوكائها ما تُشدّ به ؛ لأن النبي صلى الله عليه وسلم أمر بذلك ، والأمر يقتضي الوجوب .
ثالثًا : لابد من النداء عليها وتعريفها حولاً كاملاً في الأسبوع الأول كل يوم ، وبعد ذلك ما جرت به العادة ، ويقول في التعريف مثلاً : من ضاع له شيء ونحو ذلك ، وتكون المناداة عليها في مجامع الناس كالأسواق ، وعند أبواب المساجد في أوقات الصلوات ، ولا ينادي عليها في المساجد لأن المساجد لم تبن لذلك ، لقوله صلى الله عليه وسلم" من سمع رجلاً ينشد ضالة في المسجد ، فليقل لا ردها الله عليك ".
رابعًا : إذا جاء طالبها ، فوصفها بما يطابق وصفها ، وجب دفعها إليه بلا بينة ولا يمين ، لأمره صلى الله عليه وسلم بذلك ، ولقيام صفتها مقام البينة واليمين ، بل ربما يكون وصفه لها أظهر وأصدق من البينة واليمين ، ويدفع معها نماءها المتصل والمنفصل ، أما إذا لم يقدر على وصفها ، فإنها لا تدفع إليه ، لأنها أمانة في يده ، فلم يجز دفعها إلى من لم يثبت أنه صاحبها .
خامسًا : إذا لم يأت صاحبها بعد تعريفها حولًا كاملًا ، تكون ملكًا لواجدها ، لكن يجب عليه قبل التصرف فيها ضبط صفاتها ، بحيث لو جاء صاحبها في أي وقت ، ووصفها ردها عليه إن كانت موجودة ، أو ردَّ بدلها إن لم تكن موجودة ، لأن ملكه لها مراعى يزول بمجيء صاحبها .
تنبيه : من هدي الإسلام في شأن اللقطة تدرك عنايته بالأموال وحفظها وعنايته بحرمة مال المسلم وحفاظه عليه ، وفي الجملة ندرك من ذلك كله حث الإسلام على التعاون على الخير ، نسأل الله سبحانه أن يثبتنا جميعًا على الإسلام ويتوفانا مسلمين .

My question is: What is the ruling on finding money on the street, is one allowed to keep it?
Answer




Praise be to Allaah.
This question has to do with al-luqtah, which is one of the categories of Islamic jurisprudence or fiqh. Al-luqtah is property that has gone missing from its owner. This pure religion teaches that property is to be protected and preserved, and that the property of the Muslim is sacred and is to be protected. This includes al-luqtah or lost property.
If property goes missing from its owner, it has to be one of the following three scenarios:
The first scenario: it is something to which most people would not attach much value, such as a whip, or a loaf of bread, or some fruit, or a stick. In these cases, the person who finds the property may keep it and use it without having to announce it, because of the report narrated by Jaabir, who said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) made exceptions in the case of a stick or a whip or a rope that a man picks up.”
(Reported by Abu Dawood). The second scenario: (animals) that are unlikely to be harmed by small predators, either because of their size, such as camels, horses, cattle and mules, or because they can fly, like birds, or because they move swiftly, like gazelles, or because they can defend themselves with their fangs, like leopards. This is the category which it is haraam to keep. These things do not become the property of the finder after he announces it for a year, because when the Prophet (peace and blessings of Allaah be upon him) was asked about a lost camel, he said: “What has it got to do with you? It has its water, it can walk to find water and it can eat trees until its owner finds it.”
(Agreed upon). ‘Umar said, “Whoever takes a lost animal is misguided” i.e., he is a sinner. The Prophet (peace and blessings of Allaah be upon him) ruled in this hadeeth that the lost animal should not be taken, it should be left to find its own water and to eat from the trees until its owner comes across it. This also applies to large implements, such as big pans, wood, iron and anything that can be left alone without getting damaged. Such things can hardly be lost and cannot move from where they are, so it is haraam to take them just as it is haraam to take lost large animals, and in fact it may be more haraam to do so.
The third scenario: any other kind of lost property, such as money, luggage, and any animals that need to be protected from small predators, such as sheep, young camels and calves. If the one who finds them can trust himself not to harm or damage these things, then it is permissible for him to pick them up. These things are of three types:
The first type: animals that are eaten, such as young camels, sheep, chickens, The one who finds these must do what is in the best interests of the owner, which may be one of three things:
  1. He can eat it, in which case he owes the price of the animal straight away.
  2. He may sell it and keep the price of it to give to the owner once he has claimed it by describing the animal.
  3. He may keep it and spend on it from his own wealth, but he does not own it, and he can claim back what he has spent on it if the owner comes and claims the animal back, because when the Prophet (peace and blessings of Allaah be upon him) was asked about the sheep, he said: “Take it, because either it is for you, or your brother, or the wolf.”
(Agreed upon). The meaning is that the sheep is weak and is vulnerable to attack, so either you take it, or your brother takes it, or the wolf will eat it. Ibn al-Qayyim said in his discussion of the hadeeth: “This includes permission to take lost sheep, and if the owner of the sheep does not come to claim it, then it belongs to the one who found it. Then he has the choice to eat it immediately, and then he will owe the price of it, or he can sell it and keep the price, or he can keep it and spend on it from his own money. The scholars agreed that if the owner comes before the finder eats it, he has the right to take it.”
The second type: things that could become spoiled, such as watermelons and fruits. The finder in this case should do what is in the owner’s best interests, whether this is eating it and paying for its value, or selling it and keeping its price until the owner comes.
The third type: all other kinds of wealth that are not covered by the first two types, such as money and vessels. All of these must be kept as a trust and announcements should be made in the places where people gather.
  1. It is not permissible for anyone to pick up any kind of lost property unless he can be sure that he will deal with it properly and that he is able to make the necessary announcements, because of the hadeeth of Zayd ibn Khaalid al-Juhani (may Allaah be pleased with him), who said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) was asked about lost gold and silver. He said, ‘Know the details of the purse and the string, then announce it for a year. If no one claims it, then dispose of it, and it is like a trust in your hands. Then if the owner comes along some day, give it to him.” He was asked about the sheep, and he said, “Take it, because either it is for you, or your brother, or the wolf.” He was asked about lost camels, and he said, “What has it got to do with you? It has its water, it can walk to find water and it can eat trees until its owner finds it.”
(Agreed upon). The meaning of the phrase “Know the purse and the string” refers to the kind of purse or wallet that money is kept in and the way it is fastened or tied up.
The meaning of the phrase “then announce it for a year” is that it should be mentioned to people in the places where they gather, such as in market places and by the doors of the mosque etc. “A year” means for one full year. In the first week after it is found, it should be announced every day, because it is more likely that the owner will come in that first week. After that it should be announced as often as is customary among the people.
This was the method of announcing lost property in the past. Nowadays people should make lost and found announcements in whatever way is appropriate. What matters is achieving the desired result, so one must do whatever it takes to return property to its rightful owner.
The hadeeth indicates that it is obligatory to know exactly what the lost property is. The phrase “Know the purse and the strings” indicates that it is obligatory to know what it looks like, so that if the owner comes and describes it properly, it can be given to him, but if his description is at odds with the true description, then it is not permissible to give it to him.
The phrase “If no one claims it, then dispose of it” indicates that the finder takes possession of the property after one year has passed and after announcing it, but he should not dispose of it before he knows exactly what it is, i.e., until he knows “the purse and the string”, and he knows its value, nature and description. If the original owner comes along some time later, and describes it accurately, he should then give it to him, because the Prophet (peace and blessings of Allaah be upon him) said: “If someone comes looking for it some day, then give it to him.”
The above discussion makes it clear that there are certain obligations with regard to lost property:
  1. When it is found, the finder should not take it unless he is certain that he can be trusted to keep it and is able to make the necessary announcements until he finds the owner. Whoever does not feel that he can trust himself to do this is not allowed to pick it up. If he does pick it up, then he is like one who takes something wrongfully, because he took the property of someone else in a manner that is not permissible, and because by taking it he is causing the property of another person to be lost.
  2. Before he takes it, he must be sure of its exact details, by knowing its “purse and string”, and its value, type and appearance. What is meant by its “purse” is knowing the appearance of the container it is in, whether it is a bag or a cloth, and what is meant by its “string” is what it is tied up with, because the Prophet (peace and blessings of Allaah be upon him) commanded this, and a command implies that something is obligatory.
  3. It must be announced for a whole year, every day in the first week and then as frequently as is customary. In such announcements one can say for example, “Who has lost something?” and so on. The announcements should be made in places where people gather, such as in marketplaces or at the doors of mosques at prayer time. Announcements should not be made in the mosques themselves, because the mosques are not built for that, and the Prophet (peace and blessings of Allaah be upon him) said: “Whoever hears a man making an announcement about lost property in the mosque, let him say, ‘May Allaah never return it to you!’”
  4. If someone comes looking for it and describes it properly, it must be given to him without asking him for proof or to swear an oath, because of the command of the Prophet (peace and blessings of Allaah be upon him) to that effect, and because his precise description is sufficient in the place of proof or an oath. Indeed, his description may be more clear and more honest than proof or an oath. He should also be given any increase, whether attached or separate. But if he is not able to describe it, then it should not be given to him, because it is a trust in the hands of the finder, and it is not permissible for him to give it to someone who cannot prove that he is the owner.
  5. If the owner does not come forward after it has been announced for an entire year, it becomes the property of the finder, but before he disposes of it he must be sure of its exact description, so that if the original owner comes along some day and describes it, he can give it back to him if it is still there, or he can give him something else if it is no longer there, because his possession of it is limited and expires when the original owner comes along.
Note: it is part of the Islamic teachings on lost property that we should understand how Islam pays attention to the issue of ownership and the sanctity of the Muslim’s property. From all of this we learn that Islam urges us to cooperate in goodness. We ask Allaah to help us all to stand firm in Islam and to die as Muslims.

Que doit faire celui qui trouve un bien sur la voie publique ? Lui est-il permis de le perdre ?

Louange à Allah
Cette question intéresse les objets perdus et le sujet est traité dans le cadre d’un chapitre du droit musulman. Il s’agit d’un bien perdu par son propriétaire.
Cette religion droite se préoccupe de la garde et de la protection des biens et prône la sauvegarde des biens du musulman y compris ceux perdus.
Quand un bien est perdu par son propriétaire, trois cas se présentent. Le premier est le cas où l’objet perdu est insignifiant tel qu’une cravache, un pain, un fruit et un bâton. Ces objets peuvent devenir la propriété de celui qui les ramasse et il n’a pas besoin de les annoncer en raison de ce hadith rapporté par Djabir : Le Messager d’Allah (bénédiction et salut soient sur lui ) nous a autorisé à ramasser le bâton, la cravache et la corde que l’on trouve . (Rapporté par Abou Dawoud). Le deuxième cas est celui dans lequel il s’agit d’un animal capable de se défendre soit à cause de sa force comme le chameau, le cheval, le boeuf et le mulet, soit pour sa capacité de s’envoler comme les oiseaux, soit pour sa rapidité comme les gazelles, soit pour sa férocité comme le léopard. Il est interdit de prendre ces animaux, et celui qui les prend ne deviendra pas leur propriétaire après les avoir annoncé en raison des propos du Prophète (bénédiction et salut soient sur lui) quand il a été interrogé à propos des chameaux perdus : En quoi vous concerne-t-il ? Il dispose d’un gros ventre et de solides pieds et peut trouver de l’eau pour s’abreuver et des arbres pour se nourrir jusqu’à ce que son propriétaire le retrouve (rapporté par Boukhari et Mouslim). Omar dit : Quiconque ramasse un objet perdu est un égaré c’est--à-dire qu’il se trompe. Dans le hadith qui vient d’être cité, le Prophète (bénédiction et salut soient sur lui) juge que ce genre d’animaux perdus ne doit pas être récupéré et qu’il faut les laisser chercher de l’eau pour s’abreuver et des arbres pour se nourrir jusqu’à ce que leur maître les retrouve. On leur assimile les gros instruments comme les grandes écuelles, le bois, le fer et tout ce qui se conserve de lui-même et ne se déplace pas. Il est interdit de prendre ces choses là comme il l’est pour les grands animaux ou plus encore. Le troisième cas intéresse le reste des biens comme l’argent, les bagages et les petites bêtes incapables de se défendre tels les moutons, les chamelets sevrés et les veaux. Si celui qui trouve une chose perdue relevant de ce cas se sait capable de la garder, il lui est permis de la ramasser. Là aussi, il y a trois distinctions à faire. La première concerne les animaux consommables comme le chamelet sevré, le mouton et le poulet. Celui qui les ramasse doit opter pour la solution la plus favorable pour le propriétaire, soit il les consomme et en rembourse la valeur au moment de leur ramassage, soit il les vend et conserve le prix pour le remettre au propriétaire une fois identifié, soit il les garde et dépense de ses propres biens pour assurer leur entretien sans en faire une propriété. Si le propriétaire se présente, il lui remet son bien et lui réclame le remboursement de ses dépenses d’entretien. Il en est ainsi parce que quand le Messager d’Allah (bénédiction et salut soient sur lui ) a été interrogé à propos du mouton, il a dit : Prends le car il est soit pour toi, soit pour ton prochain, soit pour un loup (rapporté par Boukhari et Mouslim). Ces propos signifient que cette bête est faible et vulnérable et susceptible de tomber soit dans les mains de l’interlocuteur ou d’un autre ou être dévorée par un loup.
Dans le cadre de son commentaire de ce noble hadith, Ibn al-Qayyim dit : « Il autorise la récupération du mouton et indique que si le propriétaire ne se présente pas, celui qui l’a ramassé a le choix entre sa consommation immédiate, quitte à en rembourser la valeur, sa vente et la garde de son prix, et sa conservation avec la dépense de ses propres biens pour en assurer les frais d’entretien. Tous les ulémas soutiennent que si le propriétaire se présentait avant qu’il ne soit consommée, il pourrait la reprendre. La deuxième distinction concerne les denrées périssables telles que les fruits. Là, le ramasseur doit prendre la mesure la plus profitable au propriétaire, soit la consommation suivie du remboursement de la valeur, soit la vente et la conservation du prix pour le propriétaire. La troisième distinction intéresse les biens autres que ceux déjà mentionnés comme l’argent et les ustensile. Ces choses doivent être bien gardées et annoncées dans les lieux publics.
Il n’est permis de ramasser un objet perdu que si l’on est sûr de pouvoir le garder et en assurer l’annonce pour ce qui le mérite. Cela s’atteste dans le hadith de Zayd Ibn Khalid al-Djuhani (P.A.a) qui dit : « Le Prophète (bénédiction et salut soient sur lui) a été interrogé à propos de l’or et de l’argent perdus et il a dit : Identifie bien la bourse et ce qui l’attache (ifas) puis annonce le durant une année. S’il n’est pas reconnu, utilise le tout en le considérant comme un dépôt qui t’est confié. Si jamais son propriétaire se présentait, remets-le lui Puis on lui a interrogé sur le mouton et il a dit : Prends le car il est soit pour toi, soit pour ton prochain, soit pour le loup . Puis on l’a interrogé sur les chemeaux perdus et il a dit : En quoi te concernent-ils ? Ils disposent d’un gros ventre et de solides pieds et peuvent chercher de l’eau pour s’abreuver et des arbres pour se nourrir jusqu’à ce que leur propriétaire les retrouve (rapporté par Boukhari et Mouslim. Quant aux propos du Prophète (bénédiction et salut soient sur lui) « Identifie son wika et son ifas, le premier terme désigne le fils qui attache et le second la bourse qui contient la dépense. Quant à ses propos: Faites le connaître durant un an ils signifient qu’il faut en informer les gens dans leurs lieux de rassemblement pendant toute une année. Au cours de la première semaine, l’annonce doit être quotidienne car c’est le temps dans lequel l’apparition du propriétaire est la plus attendue. Après la première semaine, l’annonce se fait selon les habitudes courantes du milieu.
Ceci était la méthode d’annonce suivie dans le passé. Aujourd’hui, il est permis d’utiliser les voies et moyens appropriés, l’important étant de restituer le bien à son propriétaire.
Le hadith montre le caractère obligatoire de l’annonce des objets retrouvés. Les propos du Prophète (bénédiction et salut soient sur lui ) : Identifie la bourse et ce qui l’attache indiquent la nécessité de l’identification des caractéristiques de l’objet afin de demander à celui qui vient le réclamer d’en faire une description correcte avant de pouvoir le récupérer. Si la description n’était pas correcte, on ne le lui remettrait pas. Les propos du Prophète (bénédiction et salut soient sur lui ) : Si vous ne le connaissez pas, utilisez-le indiquent que le ramasseur peut entrer en possession de l’objet après une année d’annonce. Mais il ne doit pas l’utiliser avant d’en connaître les caractéristiques : le contenant, les attaches, la quantité, l’espèce et les aspects... Si le propriétaire se présente après un an et en fait une description exacte, on le lui remet en application des propos du Prophète (bénédiction et salut soient sur lui ) : Si quelqu’un vient un jour le demander, qu’on le lui donne...
Il se dégage de ce qui précède que les objets perdus nécessitent ce qui suit :
Premièrement, celui qui les retrouve ne doit les ramasser que s’il est sûr de pouvoir les garder et continuer de les annoncer jusqu’à ce qu’on retrouve leur propriétaire. Celui qui n’en est pas capable n’est pas autorisé à les prendre. Si, malgré tout, il les prend, il est assimilable à un usurpateur car il s’est emparé du bien d’autrui d’une façon qui ne lui est pas permise et parce que la prise du bien dans ce cas peut aboutir à se spoliation.
Deuxièmement, avant de prendre le bien, il faut en noter les caractéristiques et connaître le contenant, les attaches, la quantité, l’espèce et la variété. Par contenant, on entend l’enveloppe, qu’il s’agisse d’une caisse ou d’un sac. Par attache, on entend ce qui serre à l’attacher. Ceci, conformément à l’ordre du Prophète (bénédiction et salut soient sur lui) qui implique une obligation.
Troisièmement, il faut l’annoncer durant une année entière. Dans la première semaine, l’annonce doit se faire quotidiennement. Ensuite, elle se fera selon l’usage en cours. Dans l’annonce, on doit dire : quelqu’un a-t-il perdu une telle ou telle chose ? Cela doit se dérouler dans les lieux de rassemblement des gens comme les marchés et aux portes des mosquées au moment des heures de prière. Toutefois, il n’est pas permis de faire les annonces à l’intérieur des mosquées car elles ne sont pas construites pour cela et parce que le Prophète (bénédiction et salut soient sur lui ) a dit : « Quiconque entend quelqu’un demander des renseignements dans la mosquée au sujet d’un objet perdu qu’il lui dise : Puisse Allah ne vous le restituer .
Quatrièmement, si quelqu’un vient les réclamer et en fait une description exacte, il faut les lui remettre conformément à l’ordre du Prophète (bénédiction et salut soient sur lui ) et parce que la description tient lieu de la preuve et du serment. Bien plus, elle peut être plus évidente et plus vraie que la preuve et le serment. En plus de la restitution de l’objet retrouvé, il faut aussi restituer le surplus direct ou indirect qui résulte de l’objet. Si celui qui réclame l’objet n’est pas capable de le décrire, on ne doit pas le lui remettre car c’est un dépôt que le ramasseur a le devoir de garder et il n’est autorisé à le donner qu’à celui qui prouve qu’il en est le propriétaire .
Cinquièmement, si le propriétaire ne se manifeste pas après une année d’annonce, l’objet devient la propriété de celui qui le détient. Mais, il doit en noter les caractéristiques avant de l’utiliser. C’est pour en demander la description à celui qui viendra le réclamer. Si la description est exacte, on lui remet l’objet ou une compensation si l’objet n’existe plus, car la propriété conférée au ramasseur prend fin dès l’apparition du propriétaire originelle.
Avertissement
Les prescriptions de l’Islam relatives aux objets perdus traduisent le soin dont cette religion les entoure et la manière dont il assure et préserve les biens du musulman. En somme, nous en déduisons que l’Islam exhorte à la coopération dans le bien. Nous demandons à Allah de nous raffermir dans l’Islam et de ne nous faire mourir qu’en tant que musulmans.
