إذا امتنع رب البيت من الأضحية فهل للمرأة أن تضحي عن نفسها وأهل بيتها ؟

السؤال

إذا امتنع رب الأسرة عن أداء الأضحية في عيد الأضحى دونما سبب ، فهل يجوز لزوجته أن تطلب من شخص أخر أن يشتري أضحية فيضحي بالنيابة عن الأسرة ؟ وهل هذا مُجزئ ؟ أرجو توضيح ذلك على ضوء الكتاب والسنة .
نص الجواب
الحمد لله

الأضحية عبادة من العبادات رغب الشرع فيها ، من غير فرق بين الرجل والمرأة ، ولا بين المتزوجة وغير المتزوجة ، وقد دل على ذلك عمومات النصوص الواردة بشأن الأضحية ، من غير تخصيص ولا تقييد .
فإذا كانت المرأة عندها القدرة المالية ، سُن لها أن تضحي عن نفسها وأهل بيتها من مالها ، خاصة إذا امتنع ربُّ البيت من أداء هذه الشعيرة .
قال ابن حزم رحمه الله في "المحلى"6/37 " والأضحية للمسافر كما هي للمقيم ولا فرق, وكذلك المرأة ؛ لقول الله تعالى" وَافْعَلُوا الْخَيْرَ" والأضحية فعل خير ، وكل من ذكرنا محتاج إلى فعل الخير مندوب إليه , ولما ذكرنا من قول رسول الله صلى الله عليه وسلم في التضحية ولم يخص عليه السلام بادياً من حاضر, ولا مسافراً من مقيم , ولا ذكراً من أنثى , فتخصيص شيء من ذلك باطل لا يجوز" انتهى باختصار.
وجاء في " الموسوعة الفقهية " 5/81 " وليست الذكورة من شروط الوجوب ولا السنية, فكما تجب على الذكور تجب على الإناث؛ لأن أدلة الوجوب أو السنية شاملة للجميع" . انتهى باختصار.

وعليه : فإن امتنع ربُّ البيت من أداء هذه الشعيرة ، فللزوجة القيام بها بنفسها ، أو عن طريق شخص توكله في شرائها وذبحها نيابة عنها ، سواء كان بعلم زوجها أو بغير علمه ، بإذنه أو بغير إذنه ؛ لأن الأضحية سنة في حق الجميع ، فإذا امتنع رب البيت من أدائها ، فللزوجة القيام بها .
قال صلى الله عليه وسلم " يَا أَيُّهَا النَّاسُ إِنَّ عَلَى أَهْلِ كُلِّ بَيْتٍ فِي كُلِّ عَامٍ أَضْحَاةً .." . رواه أحمد :17216" وأبو داود:2788- وحسنه الألباني في " صحيح أبي داود ".

ونقل الخطيب الشربيني رحمه الله عن صاحب "العُدة" قوله : " وهي سنة على الكفاية إن تعدد أهل البيت , فإذا فعلها واحد من أهل البيت كفى عن الجميع , وإلا فسنة عين" .

Question

If the head of the family refuses to do the udhiyah on Eid al-Adha for no reason, is it permissible for his wife to ask someone else to buy an udhiyah and slaughter it on behalf of the family? Is this acceptable? I hope that you can explain that in the light of the Qur’an and Sunnah.

Praise be to Allah
The udhiyah is an act of worship that is encouraged in Islamic teaching, with no differentiation between men and women, or between married or unmarried women. This is indicated by the general meaning of the texts which speak of the udhiyah, without any restrictions or limitations.
If a woman can afford it, it is Sunnah for her to offer an udhiyah on behalf of herself and on behalf of her household, from her own wealth, especially if the head of the household refuses to perform this ritual.
Ibn Hazm (may Allah have mercy on him) said in al-Muhalla (6/37): The udhiyah for a traveller is the same as it is for one who is not travelling, and there is no differentiation; the same applies in the case of a woman, because Allah, may He be exalted, says (interpretation of the meaning): “and do good” [al-Hajj 22:88], and offering the udhiyah is a good deed. All of those whom we have mentioned need to do good deeds, and are encouraged to do so. If we remember what the Messenger of Allah (blessings and peace of Allah be upon him) said concerning the udhiyah, without differentiating between Bedouin and town dweller, traveller and non-traveller, male and female, we will see that limiting it to any such category is invalid and is not permissible. End quote.
It says in al-Mawsoo‘ah al-Fiqhiyyah (5/81):
Being male is not one of the conditions of it being obligatory or Sunnah. Just as it is obligatory for males, it is also obligatory for females, because the evidence for it being obligatory or Sunnah applies to all. End quote.
Based on that, if the head of the household refuses to perform this ritual, then the wife may undertake it herself, or through another person whom she appoints to buy it and slaughter it on her behalf, whether that is with or without the knowledge of her husband, and with or without his permission, because the udhiyah is a Sunnah for everyone, so if the head of the household refuses to perform it, then his wife may undertake it.
The Prophet (blessings and peace of Allah be upon him) said: “O people, verily the people of every household must offer an udhiyah every year…” Narrated by Ahmad (17216) and Abu Dawood (2788); classed as saheeh by al-Albaani in Saheeh Abi Dawood.
Al-Khateeb ash-Sharbeeni (may Allah have mercy on him) narrated from the author of al-‘Uddah that he said: It is a communal obligation if there are several members of the household; if one of the members of the household does it, that suffices on behalf of all of them, otherwise it is an individual Sunnah.
End quote from Mughni al-Muhtaaj (6/123)

Si le chef de famille refuse sans raison de s’occuper de la fourniture du sacrifice à faire lors de la Fête, sa femme peut-elle demander à une autre personne d’aller acheter la bête à sacrifier et l’égorger au nom de la famille ? Serait-ce suffisant ? J’espère qu’on m’explique la question à la lumière du livre et de la Sunna.

Louanges à Allah
Le sacrifice est un acte cultuel encouragé par la loi religieuse. On n’y fait aucune distinction entre l’homme et la femme ni entre la mariée et la célibataire. Ceci s’atteste dans la portée générale des textes relatifs au sacrifice qui ne comportent ni restriction ni spécification.
Si la femme en est financièrement capable, la Sunna lui recommande d’utiliser son propre argent pour faire un sacrifice en son nom et au nom des membres de sa famille, quand le chef de famille refuse de procéder à ce rite.
Dans al-Mouhalla (6/37), Ibn Hazem (Puisse Allah lui accorder Sa miséricorde) écrit : «Le voyageur est aussi concerné par le sacrifice que le résident. Il en est de même pour la femme compte tenu de laparole du Très-haut : Faites du bien. Procéder au sacrifice est un bon acte. Tous ceux que nous avons cités (voyageur, etc.) ont besoin de faire du bien car il leur est recommandé. Il en est ainsi comme nous l’avons mentionné. Car la parole du prophète (Bénédiction et salut soient sur lui) concernant le sacrifice ne spécifie ni bédouin, ni citadin ni voyageur ni résident ni mâle ni femelle. Dès lors il est faux de limiter le sacrifice (à une catégorie de personnes). »
On lit dans l’encyclopédie juridique (5/81) :Le fait d’être de sexe masculin ne constitue pas une condition d’exigence du sacrifice ni son statut de sunna. Car il est exigé aussi bien des mâles que des femelles puisque les arguments qui permettent de lui donner un caractère obligatoire ou en font une sunna s’appliquent à tous. Extrait succinct.
Cela étant, si le chef de famille s’abstient d’accomplir ce rituel, son épouse peut s’en charger directement ou donner procuration à quelqu’un pour l’acheter et l’égorger à sa place. Que son mari soit au courant ou pas. Qu’il donne son autorisation ou pas. Car le sacrifice est une sunna pour tous. Quand le chef de famille refuse de s’y pilier, son épouse peut s’en charger.
A ce propos, le Prophète (Bénédiction et salut soient sur lui) a dit : Ô hommes ! Les membres de chaque famille doivent chaque année procéder au sacrifice… (Rapporté par Ahmad, 17216 et par Abou Dawoud, 2788 et jugé bon par Al-Albani dans Sahih Abi Dawoud.
Alkhatib ach-charbini (Puisse Allah lui accorder Sa miséricorde) a rapporté d’après l’auteur d’al-oudda ces propos : Le sacrifice est une sunna pour l’ensemble des concernés. Si l’un des membres de la famille s’en occupe, cela suffit pour les autres. Si un seul est capable de l’assurer, il est tenu personnellement de le faire. Extrait de Moughni al-mouhtadj (6/123).
