Le jugement du raccourcissement de la prière au cours d'un voyage


السؤال
هل يجوز للمرء أن يصلي أحيانا كالمقيم ، فيصلي كما لو كان في بيته لا يجمع ولا يقصر وأحيانا يجمع ويقصر الصلاة أم عليه أن يلزم رأيًا واحد؟
نص الجواب
الحمد لله
أما قصر الصلاة للمسافر فهو سنة مؤكدة ، لا ينبغي له تركها ، فإن النبي صلى الله عليه وسلم قصر الصلاة في جميع أسفاره ، ولم يثبت عنه أنه أتم في السفر .
وقد سبق بيان ذلك في جواب السؤال :111894.
لكن .. صلاة الجماعة واجبة على المسافر كما هي واجبة على المقيم ، فليس له أن يترك الجماعة من أجل أن يصلي قصرًا ، بل يصلي مع الجماعة ، فإن كان الإمام مقيمًا يتم الصلاة أتم خلفه .
ثانيًا :
أما الجمع بين الصلاتين للمسافر ، فهو جائز ، والأفضل أن لا يجمع إلا إذا كان في فعل كل صلاة في وقتها مشقة .
وعلى هذا ؛ فليس حكم القصر والجمع للمسافر واحدًا ، فالقصر سنة مؤكدة لكل مسافر ، أما الجمع فهو جائز وليس سنة ، ويكون سنة مستحبة إذا كان في تركه مشقة .
ويدل لذلك من السنة : أن النبي صلى الله عليه وسلم قصر في جميع أسفاره ، مما يدل على أن السنة للمسافر القصر ، وأما الجمع ، فثبت عنه صلى الله عليه وسلم الجمع في السفر ، وثبت عنه عدم الجمع أيضَا ، مما يدل على أن الجمع ليس سنة مستحبة لكل مسافر .
وخلاصة الجواب :
أن المسافر ليس مخيرًا في القصر وعدمه ، بل يتأكد له قصر الصلاة ، إلا إذا صلى خلف إمام يتم الصلاة فإنه يتم خلفه.
وأما الجمع ، فالمسافر مخير فيه ، إما أن يجمع ، وإما أن لا يجمع ، أو يجمع أحيانًا ولا يجمع أحيانًا ، وهو جائزٌ غير مستحب ، ويكون الجمع في حق المسافر مستحبًا إذا احتاج إليه.

Ruling on shortening prayers whilst travelling



Question

Is it permissible for a person to pray sometimes as resident, i.e. as if he is at home, not shortening or joining of prayers; and to shorten and join prayers together at other times? Or should he be obliged with one opinion only?.
Answer







Praise be to Allaah. Firstly:
With regard to shortening prayers when travelling, this is a confirmed Sunnah (Sunnah mu’akkadah) which should not be forsaken. The Prophet (peace and blessings of Allaah be upon him) shortened prayers during all his journeys, and it is not proven that he offered the prayers in full whilst travelling.
This has been discussed in the answer to question no. 111894.
But praying in congregation is obligatory for the traveller just as it is obligatory for the non-traveller, and he should not forsake the jamaa’ah (congregation) in order to shorten his prayer, rather he should pray with the congregation, and if the imam offers the prayer in full, then he should offer the prayer in full behind him.
Secondly:
With regard to the traveller joining two prayers, this is permissible, but it is better not to join them unless there is some difficulty in offering each prayer at its own time.
Based on that, the ruling on shortening and joining prayers for the traveller is not one and the same. Shortening the prayers is a confirmed Sunnah for all travellers, whereas joining the prayers is permissible but is not Sunnah, but it may be Sunnah and mustahabb if there is some difficulty involved in not doing it.
In the Sunnah, this is indicated by the fact that the Prophet (peace and blessings of Allaah be upon him) shortened his prayers on all his journeys, which indicates that the Sunnah for the traveller is to shorten his prayers. As for joining prayers, it is proven that he (peace and blessings of Allaah be upon him) joined prayers when travelling, and it is also proven that he did not join prayers, which indicates that joining prayers is not a recommended Sunnah for all travellers.
To sum up:
The traveller does not have the choice between shortening or not shortening his prayers; rather it is confirmed that he should shorten his prayers, unless he is praying behind an imam who is offering the prayer in full, in which case he should offer the prayer in full behind him.
As for joining prayers, the traveller has the choice: he may join them or not join them, or he may join them sometimes and not at other times. It is permissible but is not mustahabb, but joining prayers is mustahabb for the traveller if he needs to do that.

Est il permis (au voyageur) de prier parfois comme un résident, d'accomplir tantôt la prière normalement tantôt de façon raccourcie comme si l'on était chez soi? Ou faut il s'imposer un choix?

Premièrement, le raccourcissement de la prière par un voyager est une sunna fortement recommandée. Il ne convient pas de s'en passer car le Prophète (Bénédiction et salut soient sur lui) le pratiquait systématiquement au cours de tous ses voyages. On n'a jamais rapportéqu'il ait accompli la prière complètement. Cela a été traité dans le cadre de la réponse donnée à la question n° 111894.
Cependant la prière en commun est une obligation pour le voyageur comme il l'est pour le résident. Il ne doit pas s'absenter de la prière en commun afin de pouvoir y substituer une prière individuelle raccourcie. Il faut qu'il aille prier avec le public. Si l'imam qui lui dirige la prière est un résident, il complète la prière comme lui.
Deuxièmement, le rassemblement de deux prière est permis au voyageur. Il est toutefois préférable de s'en abstenir, à moins qu'il soit difficile d'effectuer chaque prière à son heure. Cela dit, la disposition applicable auraccourcissement et au rassemblement de la prière n'est pas la même. Le raccourcissement est une sunna fortement recommandée pour tout voyageur. Le rassemblement des prière est permis mais pas une sunna. Il peut devenir une sunna désirable quand son abandon entraîne une difficulté. L'argument tiré de la Sunna pour attester cette assertion est qu'il a été rapporté de façon sûre que le Prophète (Bénédiction et salut soient sur lui) a pratiqué le raccourcissement des prières au cours de tous ses voyages, ce qui prouve que la Sunna veut que le voyageur pratique le raccourcissement. Quant au rassemblement des prières, il a été rapporté de façon sûre que le Prophète (Bénédiction et salut soient sur lui) le pratiquait tantôt et s'en abstenait tantôt, ce qui signifie que le rassemblement des prières n'est pas une sunna désirable pour tout voyageur.
La réponse se résume ainsi: le voyageur n'a pas le choix entre raccourcir ou ne pas raccourcir, car il est tenu de le faire, sauf s'il doit parier derrière un imam qui complète la prière. Dans ce cas, il complète la prière. Quant au rassemblement des prières, le voyageur a le choix entre sa pratique et son abandon, comme il peutle faire tantôt et de s'en abstenir tantôt, la pratique étant permise mais non recommandée. Elle n'est recommandée que quand le voyager en a réellement besoin.
