Ruling on one who breaks the fast in Ramadan with no excuse

Le statut de la personne majeure et capable qui n’observe pas le jeûne

السؤال:ما حكم الرجل البالغ القادر الذي لا يصوم ؟ وما عقوبته في الدنيا ؟
نص الجواب





الحمد لله
صوم رمضان ركن من أركان الإسلام ، ولا يجوز للمسلم البالغ العاقل المكلف أن يفطر في رمضان إلا لعذر ، من سفر أو مرض أو غير ذلك ، ومن أفطر - ولو يومًا واحدًا - من غير عذر ، فقد أتى كبيرة من كبائر الذنوب ، وعرض نفسه لسخط الله وعقابه ، ويلزمه التوبة الصادقة النصوح ، ويلزمه قضاء ما أفطره ، في قول عامة أهل العلم ، وحكى بعضهم الإجماع عليه .

أما من أفطر متعمدا في رمضان ، وهو مستحل لذلك : فقد كفر ، فيستتاب ، فإن تاب وإلا قتل .
ومن جهر بالفطر عزّره الإمام ، وعاقبه العقوبة التي تردعه وأمثاله عن هذا الفعل العظيم .
وهذه جملة من أقوال أهل العلم في ذلك :
قال شيخ الإسلام ابن تيمية رحمه الله :
" إذَا أَفْطَرَ فِي رَمَضَانَ مُسْتَحِلًّا لِذَلِكَ ، وَهُوَ عَالِمٌ بِتَحْرِيمِهِ ، اسْتِحْلَالًا لَهُ : وَجَبَ قَتْلُهُ .
وَإِنْ كَانَ فَاسِقًا : عُوقِبَ عَنْ فِطْرِهِ فِي رَمَضَانَ ، بِحَسَبِ مَا يَرَاهُ الْإِمَامُ .
وَإِنْ كَانَ جَاهِلًا : عُرِّفَ بِذَلِكَ " انتهى من "الفتاوى الكبرى" 2/ 473 .
وقال ابن حجر الهيتمي رحمه الله :
" الْكَبِيرَةُ الْأَرْبَعُونَ وَالْحَادِيَةُ وَالْأَرْبَعُونَ بَعْدَ الْمِائَةِ : تَرْكُ صَوْمِ يَوْمٍ مِنْ أَيَّامِ رَمَضَانَ، وَالْإِفْطَارُ فِيهِ بِجِمَاعٍ أَوْ غَيْرِهِ ، بِغَيْرِ عُذْرٍ مِنْ نَحْوِ مَرَضٍ أَوْ سَفَرٍ " .
انتهى من "الزواجر" 1/ 323.
وقال علماء اللجنة الدائمة للإفتاء :
" فطر المكلف في نهار رمضان من كبائر الذنوب ، إذا كان بغير عذر شرعي " انتهى من "فتاوى اللجنة الدائمة" 10/ 357 .
وقال الشيخ ابن باز :
" من أفطر يومًا من رمضان بغير عذر شرعي فقد أتى منكراً عظيماً ، ومن تاب تاب الله عليه ، فعليه التوبة إلى الله بصدق ، بأن يندم على ما مضى ، ويعزم ألا يعود، ويستغفر ربه كثيرًا , ويبادر بقضاء اليوم الذي أفطره " انتهى .

وسُئِلَ الشيخُ ابن عثيمين رحمه الله عن حكم الفطر في نهار رمضان بدون عذر؟
فأجاب :
" الفطر في نهار رمضان بدون عذر : من أكبر الكبائر، ويكون به الإنسان فاسقًا، ويجب عليه أن يتوب إلى الله ، وأن يقضي ذلك اليوم الذي أفطره " .
انتهى من "مجموع فتاوى ورسائل العثيمين" 19/ 89 .

وقد روى النسائي في "الكبرى" 3273. عن أبي أُمَامَةَ قَالَ : سَمِعْتُ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ" بَيْنَا أَنَا نَائِمٌ إِذْ أَتَانِي رَجُلَانِ فَأَخَذَا بِضَبْعَيَّ " وَسَاقَ الْحَدِيثَ، وَفِيهِ قَالَ" ثُمَّ انْطَلَقَا بِي فَإِذَا قَوْمٌ مُعَلَّقُونَ بِعَرَاقِيبِهِمْ ، مُشَقَّقَةٌ أَشْدَاقُهُمْ تَسِيلُ أَشْدَاقُهُمْ دَمًا، قُلْتُ: مَنْ هَؤُلَاءِ؟ قَالَ: هَؤُلَاءِ الَّذِينَ يُفْطِرُونَ قَبْلَ تَحِلَّةِ صَوْمِهِمْ " .
وصححه الألباني في "الصحيحة" 3951 . ثم قال بعده :
" هذه عقوبة من صام ثم أفطر عمدًا قبل حلول وقت الإفطار، فكيف يكون حال من لا يصوم أصلا ؟! نسأل الله السلامة والعافية في الدنيا والآخرة " انتهى .

Question

What is the ruling on an able-bodied adult man who does not fast? What is his punishment in this world?


Answer



Praise be to Allah
Fasting Ramadan is one of the pillars of Islam, and it is not permissible for an adult Muslim of sound mind who is accountable to break the fast in Ramadan except with an excuse, such as travelling, sickness and the like. Whoever breaks the fast – even for one day – with no excuse has committed a major sin and has exposed himself to the wrath and punishment of Allah. He must repent sincerely and make up the days that he did not fast, according to the majority of scholars; some of them narrated that there was consensus on this point.

As for the one who deliberately does not fast in Ramadan, thinking it permissible to do so, he has become a disbeliever. He should be asked to repent, and if he repents, all well and good, otherwise he is to be executed.
Whoever openly breaks the fast should be given a disciplinary punishment by the ruler, a punishment that will deter him and others like him from doing this grave act.
There follow a number of comments by the scholars concerning that.
Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said:
If a person breaks the fast in Ramadan, believing that to be permissible although he is aware of the prohibition on doing so, but he thinks that it is permissible for him, he must be executed.
If he is an evildoer, he should be punished for breaking the fast of Ramadan, as the ruler sees fit.
If he is ignorant, he is to be taught the ruling.
End quote from al-Fataawa al-Kubra (2/473)
Ibn Hajar al-Haytami (may Allah have mercy on him) said:
Major sins no. 140 and 141: Not fasting one of the days of Ramadan, and breaking the fast by having intercourse or otherwise, with no excuse such as sickness or travelling.
End quote from az-Zawaajir (1/323).
The scholars of the Standing Committee for Issuing Fatwas said:
Breaking the fast during the day in Ramadan on the part of one who is accountable is a major sin, if it is done without a legitimate excuse.
End quote from Fataawa al-Lajnah ad-Daa’imah (10/357).
Shaykh Ibn Baaz said:
Whoever breaks the fast on any day in Ramadan, with no legitimate excuse, has committed a grave evil. Whoever repents, Allah will accept his repentance, so he must repent to Allah sincerely, by regretting what he has done in the past and resolving not to repeat it, and he should ask his Lord for forgiveness a great deal, and hasten to make up the day that he did not fast.
End quote.
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) was asked about the ruling on breaking the fast during the day in Ramadan with no excuse.
He replied:
Breaking the fast during the day in Ramadan with no excuse is a major sin, and the individual becomes an evildoer thereby. He must repent to Allah and make up the day that he did not fast.
End quote from Majmoo‘ Fataawa wa Rasaa’il al’Uthaymeen (19/89).
An-Nasaa’i narrated in al-Kubra (3273) that Abu Umaamah said: I heard the Messenger of Allah (blessings and peace of Allah be upon him) say: Whilst I was sleeping, two men came to me and took hold of my arms… And he quoted the hadith, in which he said: Then they set off with me, and I saw some people hung up by their Achilles tendon, with the corners of their mouths torn and dripping with blood. I said: Who are these? He said: These are the people who used to break the fast before it was permissible to do so.
Al-Albaani classed it as saheeh in as-Saheehah (3951), after which he said:
This is the punishment of those who fasted then broke the fast before the time for breaking the fast came. So how about those who did not fast at all?! We ask Allah to keep us safe and sound in this world and the hereafter. End quote.

Quel est le statut de la personne majeure et capable qui n’observe pas le jeûne? Quelle est la sanction qui doit lui être infligée ici-bas?

Louanges à Allah
Le jeûne du Ramadan est l’un des piliers de l’islam auquel aucun musulman majeur et jouissant de ses facultés mentales ne pourrait se soustraire en l’absence d’une excuse comme le voyage, la maladie etc. Celui qui refuse de jeûner, ne serait-ce qu’un jour, sans excuse, aura commis un péché majeur et se sera exposé à la colère et au châtiment d’Allah. Il sera tenu de procéder à un repentir sincère et au rattrapage du jeûne raté , selon l’avis de l’ensemble des ulémas. Certains prétendent même que la question est l’objet d’un consensus. Voir la réponse donnée à la question n°234125.
Quant à celui qui refuse délibérément d’observer le jeûne du Ramadan tout en jugeant son attitude licite, il renie sa foi et devra être invité à renouer avec elle. S’il ne l’accepte pas, on l’exécute. Celui qui affiche sa non observance du jeûne doit être corrigé par l’imam (autorité religieuse compétente). Il doit lui infligé une sanction de nature à le dissuader et servir d’exemple à tous ceux qui adoptent ce comportement odieux.
Voici des propos émis par les ulémas sur la question:
Cheikh al-islam, Ibn Taymiyah, (Puisse Allah lui accorder Sa miséricorde) a dit: Celui qui refuse délibérément et en connaissance de cause d’observer le jeûne du Ramadan et juge son comportement licite doit être tué. S’il le fait par perversion, on doit le punir selon l’appréciation de l’imam. S’il agit par ignorance, on doit l’instruire. Extrait d’al-fatawa al-koubra, 2/473.
Ibn Hadjar al-Haytami (Puisse Allah lui accorder Sa miséricorde) a dit: Le péché majeur n°141 consiste dans l’abandon du jeûne d’un jour du Ramadan; son inobservance marquée par un acte sexuel ou un autre acte incompatible avec le jeûne commis en l’absence d’une excuse comme la maladie ou le voyage. Extrait d’az-zawaadjr (1/323).
Les ulémas de la Commission permanente pour la Consultance ont dit: Le fait pour une personne majeure et responsable de ne pas observer le jeûne du Ramadan en l’absence d’une excuse légale constitue un péché majeur. Extrait des fatwas de la Commission permanente (10/357).
Cheikh Ibn Baz a dit:Celui qui refuse sans une excuse légale d’observer le jeûne d’un jour du Ramadan aura commis un acte très condamnable. Il doit se repentir sincèrement, regretter son comportement du passé et se résoudre à ne plus recommencer, solliciter fréquemment le pardon de son Maître et s’empresser à rattraper le jeûne. S’il agit ainsi , Allah agréa son repentir.
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde ) a été interrogé à propos de l’inobservance du jeûne du Ramadan en l’absence d’une excuse. Voie sa réponse: Refuser d’observer le jeûne du Ramadan sans excuse relève des péchés majeurs qui révèlent le caractère pervers de leurs auteur. Celui-ci doit se repentir devant Allah et rattraper le jeûne du jour qu’il a raté. Extrait des fatwas wa rassail d’al-Outhaymine (19/89).
An-Nassai a rapporté dans al-Koubaa (3273) qu’Abou Oumamah a déclaré avoir entendu le Messager d’Allah (Bénédiction et salut soient sur lui) dire:« Je dormais quand deux hommes me saisirent …. jusqu’à la fin du hadith dans lequel il dit : Puis ils repartirent avec moi jusqu’au moment où nous découvrîmes à ma grande surprise des hommes suspendus par leurs chevilles, leurs mâchoires déchirées et dégageant du sang…Je leur ai dit: qui sont ces gens-là?- Ce sont des gens qui mettaient fin à leur jeûne avant l’heure. (Hadith jugé authentique par al-Albani dans as-Sahihah (3951) Plus loin, il dit: Voilà le châtiment de celui qui commence le jeûne puis l’interrompt avant l’heure de la rupture du jeûne. Que dire alors de celui qui ne l’observe pas du tout? Nous demandons à Allah le salut et le bien-être ici-bas et dans l’au-delà.
