السؤال

لدي خالة أرملة لا يوجد لديها مصدر دخل ، تعيش لوحدها تتلقى بعض المساعدات النقدية من أخوين لها . ولي خال موظف يتقاضى راتبا لا يكفيه ، ولديه أربعة أبناء ، اثنان منهم يدرسون في الجامعة . سؤالي : هل يجوز إخراج كفارة تأخير قضاء الصيام -18 يوم - لهم ؟ وما هي قيمتها وصفة إخراجها لهم ؟
نص الجواب
الحمد لله
أولًا :
من أخر قضاء رمضان ، فلا يخلو تأخيره من حالين :
الحال الأولى : أن يكون تأخيره لعذر ، فهذا لا يلزمه إلا القضاء فقط .
والحال الثانية : أن يؤخر القضاء بدون عذر ، ففي هذه الحال : يلزمه قضاء الصيام ، ومع القضاء تلزمه الكفارة ، وهذا مذهب جمهور أهل العلم رحمهم الله .

وذهب بعض أهل العلم رحمهم الله - وهو القول الثاني في المسألة : أن الواجب هو قضاء الصوم مع التوبة من تأخير القضاء بدون عذر ، وأما الكفارة فليست واجبة . وقد سبق بيان ذلك في الفتوى رقم : 122319 ، 26865.
ثانيًا :
الكفارة في تأخير قضاء الصيام - عند القائلين بها – ليست نقودًا بل هي طعام يخرجه الشخص ، ومقدارها : إطعام مسكين عن كل يوم .

قال الشيخ ابن باز رحمه الله " عليك التوبة إلى الله سبحانه من هذا التأخير الكثير ، وكان الواجب عليك أن تصوم الأيام التي أفطرتها قبل مجيء رمضان الذي بعد السنة التي أفطرت فيها ، وعليك مع التوبة إطعام مسكين عن كل يوم نصف صاع من قوت البلد من تمر أو أرز أو غيرهما ، ومقداره كيلو ونصف تقريبًا ، يدفع الجميع إلى بعض الفقراء ، ولو إلى فقير واحد " انتهى من " مجموع فتاوى ابن باز " 15/341 .
فلا حرج عليك من دفع الكفارة إلى خالك أو خالتك ما داموا محتاجين ، بل ذلك أفضل من دفعها إلى شخص ليس من أقاربك ، ومقدارها عن جميع الأيام 27 كيلو من الأرز .

Ruling on giving the expiation for delay in making up missed fasts to relatives

Question

I have a maternal aunt who is a widow and has no income; she lives on her own and receives some financial help from two of her brothers. I also have a maternal uncle who works but his salary is not sufficient for his needs; he has four sons, two of whom are studying in university. My question is: is it permissible to give them the expiation for delay in making up missed fasts (eighteen days)? How much is that expiation, and how is it to be given to them?

Firstly:
If a person delays making up missed Ramadan fasts, one of the following must be the case:
1.His delay was for a valid reason, in which case he only has to make up the missed fast;
2.There was no reason for the delay. In this case he must make up the fast and, in addition to making it up, he must also offer expiation. This is the view of the majority of scholars (may Allah have mercy on them).
Some of the scholars (may Allah have mercy on them) were of the view, which is the second view concerning this issue – that what is required is to make up the missed fast and also to repent for the delay in making it up without an excuse. As for the expiation, it is not obligatory. This has been discussed previously in fatwas no. 122319 and 26865.
Secondly:
Expiation for delay in making up missed fasts – according to those scholars who say that it is required – is not offered in the form of cash; rather it is to be offered in the form of food which a person gives. What is required is to feed one poor person for each day.
Shaykh Ibn Baaz (may Allah have mercy on him) said:
You have to repent to Allah, may He be glorified, for this great delay. What you should have done was fast the days that you missed before the next Ramadan came following the year in which you did not fast. In addition to repenting, you must also feed one poor person for each day, giving half a saa‘ of the local staple food, whether it is dates, rice or something else. This is equivalent to approximately one and a half kilograms. It should all be given to some poor people, or even to one poor person.
End quote from Majmoo‘ Fataawa Ibn Baaz (15/341)
There is nothing wrong with you giving this expiation to your maternal uncle or your maternal aunt, so long as they are in need. In fact that is better than giving it to someone who is not one of your relatives. The amount in your case, for all the days in question, is 27 kg of rice.

J'ai une tante maternelle qui est une veuve sans source de revenu. Elle vit seule grâce à quelques aides financières qu'elle reçoit de deux de ses frères. J'ai aussi un oncle maternel qui un fonctionnaire qui perçoit un salaire qui ne suffit pas car il nourrit quatre enfants dont deux étudient à l'université. Ma question est la suivante:« Est-il permis de leur remettre les recettes de l'acte expiatoire du retardement du jeûne (18 jours à rattraper) Quelle en sont les valeur et modalité de paiement?

Louanges à Allah
Premièrement, celui qui retarde le rattrapage du jeûne du Ramadan ne peut pas ne pas se retrouver dans l'un des deux cas. Le premier est dû à la présence d'une excuse. Celui qui se trouve dans ce cas n'est pas tenu de procéder à un rattrapage. Le second concerne celui qui retarde le rattrapage sans excuse. Celui qui se trouve dans ce cas doit rattraper le jeûne. En plus du rattrapage, il doit effectuer un acte expiatoire. Voilà l'avis de la majorité des ulémas (Puisse Allah leur accorder Sa miséricorde).
Certains ulémas (Puisse Allah leur accorder Sa miséricorde) soutiennent le deuxième avis émis sur la question selon lequel on doit rattraper le jeûne et se repentir d'avoir retardé le rattrapage sans excuse. Quant à l'acte expiatoire, il ne s'impose pas. Ceci est déjà expliqué dans la fatwa n°123319 et la fatwa n° 26865.
Deuxièmement, l'acte expiatoire fait pour le retardement du rattrapage du jeûne, d'après ceux qui soutiennent cet avis, ne consiste pas à donner de l'argent mais plutôtà donner de la nourriture à raison d'un pauvre par jour.
Cheikh Ibn Baz (Puisse Allah lui accorder Sa miséricorde) dit: Vous devez vous repentir devant Allah le Transcendant pour avoir commis ce grave retardement. Car vous auriez dû jeûner les jours ratés avant l'arrivée du Ramadan de l'an suivant. Vous devez en plus du repentir nourrir un pauvre chaque jour en lui donnant un demi saa de la nourriture courante comme la datte, le riz ou d'autres. Ce qui peut être évalué à 1,5 kg. On doit tout remettre à nombre de pauvres ou à un seul pauvre. Extrait de Madjmou fatwas d'Ibn Baz (15/341).
Il n' y a aucun inconvénient à ce que vous remettiez les recettes de l'acte expiatoire à votre oncle maternel ou à votre tante maternelle s'ils sont dans le besoin. Mieux, il est préférable de lesleur donner au lieu de les donner à une personne étrangère. Ce qu'il faut donnerpour l'ensemble des jours (ratés) est estimé à27 kg de riz.
