من هم الناس الذين يجوز للمسلمة أن تخلع حجابها أمامهم ؟
نص الجواب





الحمد لله
.يجوز للمرأة أن تخلع حجابها أمام محارمها .
والمحرم للمرأة هو من لا يجوز له مناكحتها على التأبيد بقرابة "كالأب وإن علا والابن وإن نزل والأعمام والأخوال والأخ وابن الأخ وابن الأخت "أو رضاع " كأخي المرأة من الرضاعة وزوج المرضعة " أو صهرية " كزوج الأم وأبي الزوج وإن علا وولد الزوج وإن نزل " . وإليك أيتها السائلة تفصيلا للموضوع :
المحارم من النسب :
وهؤلاء هم المذكورون في سورة النور في قوله تعالى"
وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ أَوِ الطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَىٰ عَوْرَاتِ النِّسَاءِ...." النور : 31 . وقد قال المفسرون : إن محارم المرأة من الرجال بسبب النسب على ما صرحت به هذه الآية الكريمة أو دلت عليه هم من يأتي :
أولاً : الآباء ، أي آباء النساء وإن علوا من جهة الذكور والإناث كآباء الآباء وآباء الأمهات ، أما آباء بعولتهن فهم من المحارم بالمصاهرة كما سنبينه .
ثانيًا : الأبناء : أي أبناء النساء ، فيدخل فيهم أولاد الأولاد وإن نزلوا من الذكور والإناث مثل بني البنين ، وبني البنات ، أما " أبناء بعولتهن " في الآية الكريمة فهم أبناء أزواجهن من غيرهن ، وهؤلاء محارم بسبب المصاهرة لا بسبب النسب كما سنبينه لاحقاً .
ثالثًا : إخوانهن سواء كانوا اخوة لأم وأب ، أو لأب فقط أو لأم فقط .
رابعًا : بنو إخوانهن وإن نزلوا من ذكران وإناث كبني بنات الأخوات .
خامساً : العم والخال وهما من المحارم من النسب ولم يذكروا في الآية الكريمة لأنهما يجريان مجرى الوالدين ، وهما عند الناس بمنزلة الوالدين ، والعم قد يسمى أبا قال تعالى "
أَمْ كُنتُمْ شُهَدَاءَ إِذْ حَضَرَ يَعْقُوبَ الْمَوْتُ إِذْ قَالَ لِبَنِيهِ مَا تَعْبُدُونَ مِن بَعْدِي قَالُوا نَعْبُدُ إِلَٰهَكَ وَإِلَهَ آبَائِكَ إِبْرَاهِيمَ وَإِسْمَاعِيلَ وَإِسْحَاقَ إِلَهًا وَاحِدًا وَنَحْنُ لَهُ مُسْلِمُونَ " البقرة /133 . وإسماعيل كان العم لبني يعقوب . تفسير الرازي 23/206 ، وتفسير القرطبي 12/232و233 ، وتفسير الآلوسي 18/143، وفتح البيان في مقاصد القرآن لصديق حين خان 6/352 .
المحارم بسبب الرضاع
ومحارم المرأة قد يكونون بسبب الرضاع ، جاء في تفسير الآلوسي "ثم إن المحرمية المبيحة لإبداء الزينة للمحارم كما تكون من جهة النسب تكون من جهة الرضاع ، فيجوز أن يبدين زينتهن لآبائهن أو أبنائهن من الرضاع" تفسير الآلوسي 18/143 .لأن المحرمية بسبب الرضاع كالمحرمية بسبب النسب تمنع النكاح على التأبيد بالنسبة لأطراف المحرمية ، وهذا ما أشار إليه الإمام الجصاص وهو يفسر هذه الآية فقال - رحمه الله - " لما ذكر الله تعالى مع الآباء ذوي المحارم الذين يحرم عليهم نكاحهن تحريمًا مؤبدًا ، دل ذلك على أن من كان في التحريم بمثابتهم فحكمه حكمهم مثل أم المرأة والمحرمات من الرضاع ونحوهم " أحكام القرآن للجصاص 3/317 .
يحرم من الرضاع ما يحرم من النسب :
وقد جاء في السنة النبوية الشريفة : " يحرم من الرضاع ما يحرم من النسب " ، ومعنى ذلك أن المحارم للمرأة كما يكونون بسبب النسب يكونون أيضاً بسبب الرضاع ، فقد جاء في صحيح البخاري عن عائشة أم المؤمنين رضي الله عنها قالت" إن أفلح أخا أبي قٌعيس جاء يستأذن عليها وهو عمها من الرضاعة بعد أن نزل الحجاب ، فأبيت أن آذن له ، فلما جاء رسول الله صلى الله عليه وسلم أخبرته بالذي صنعت فأمر أن آذان له "صحيح البخاري بشرح العسقلاني 9/150 وقد روى هذا الحديث الإمام مسلم ولفظه"عن عروة عن عائشة أنها أخبرته أن عمها من الرضاعة يسمى أفلح استأذن عليها فحجبته ، فأخبرت الرسول صلى الله عليه وسلم فقال لها : لا تحتجبي منه ، فإنه يحرم من الرضاعة ما يحرم من النسب " صحيح مسلم بشرح النووي 10/22 .
محارم المرأة من الرضاع مثل محارمها من النسب :
وقد صرح الفقهاء متبعين ما دل عليه القرآن والسنة ، بأن محارم المرأة بسبب الرضاع مثل محارمها من النسب ، فيجوز لها أن تبدي زينتها لمحارمها من الرضاع كما تبدي زينتها لمحارمها من النسب ، ويحل لهم النظر من بدنها ما يحل لمحارمها من النسب من النظر إلى بدنها .
المحارم بسبب المصاهرة :
محارم المرأة بسبب المصاهرة هم الذين يحرم عليهم نكاحها على وجه التأبيد ، مثل زوجة الأب ، وزوجة الابن ، وأم الزوجة. شرح المنتهى 3/7 .
فالمحرم بالمصاهرة بالنسبة لزوجة الأب هو ابنه من غيرها ، وبالنسبة لزوجة الابن هو أبوه ، وبالنسبة لأم الزوجة هو الزوج ، وقد ذكر الله تعالى في آية سورة النور"
وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَىٰ جُيُوبِهِنَّ وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ أَوِ الطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَىٰ عَوْرَاتِ النِّسَاءِ...." النور : 31.وآباء بعولتهن وأبناء بعولتهن من محارم المرأة بالمصاهرة ، وقد ذكرهم الله تعالى مع آبائهن وأبنائهن وساواهم جميعاً في حق إبداء الزينة لهم . المغني 6/555

Who are the mahrams in front of whom a woman can uncover?

Question

what people can a muslimah take her hijab off from?



Answer




Praise be to Allaah.
It is permissible for a woman to take off her hijaab in front of her mahrams.
A woman’s mahram is a person whom she is never permitted to marry because of their close blood relationship (such as her father, grandfather, great-grandfather, etc., and her son, grandson, great-grandson, etc., her paternal and maternal uncles, her brother, brother’s son and sister’s son), or because because of radaa’ah or breastfeeding (such as the brother and husband of the woman who breastfed her), or because they are related by marriage (such as the mother’s husband, the husband’s father, grandfather, etc., and the husband’s son, grandson, etc.). More details on this subject are given below:
Mahrams by ties of blood
These are the ones mentioned in Soorat al-Noor, where Allaah says (interpretation of the meaning):
“… and not to reveal their adornment except to their husbands, or their fathers, or their husband’s fathers, or their sons, or their husband’s sons, or their brothers or their brother’s sons, or their sister’s sons…” [al-Noor 24:31].
The mufassireen said: the woman’s male mahrams by ties of blood, as stated clearly in this aayah or inferred by it are as follows:
1- the woman’s forefathers, no matter how far back the line of ascent goes through her father and her mother, such as her father’s forefathers and her mother’s forefathers. As for her husband’s forefathers, they are her mahrams by marriage, as we shall see below.
2- her sons, which includes her children’s children, no matter how the line of descent goes and whether they are descended from males or females, such as her sons’ sons and her daughters’ sons. As for her “husband’s sons” mentioned in the aayah, these are the husband’s sons from other wives, and these are her mahrams by marriage, not by blood, as we shall see below.
3- her brothers, whether they are her brothers through both the mother and father, or through the father only or the mother only.
4- the children of her siblings, whether they are descended through the males or females, such as the sons of her sister’s daughters.
5- paternal uncles and maternal uncles. They are mahrams by blood even though they are not mentioned in the aayah, because they are like parents and are regarded by people as having the same status as parents, and a paternal uncle may be called a father. Allaah says (interpretation of the meaning):
“Or were you witnesses when death approached Ya‘qoob (Jacob)? When he said unto his sons, “What will you worship after me?” They said, “We shall worship your Ilaah (God — Allaah) the Ilaah (God) of your fathers, Ibraaheem (Abraham), Ismaa’eel (Ishmael), Ishaaq (Isaac)…” [al-Baqarah 2:133]. Ismaa’eel was the paternal uncle of the sons of Ya’qoob.

Mahrams by radaa’ah (breastfeeding)
A woman may have mahrams through radaa’ah. It says in Tafseer al-Aloosi:
“The relationship of mahram which permits a woman to show her adornments may be through radaa’ah as well as through blood ties, so it is permissible for a woman to show her adornments to those who are her fathers or sons through radaa’ah.”
(Tafseer al-Aaloosi. 18/143) The relationship of mahram by radaa’ah is like the relationship of mahram by blood – it means that marriage is forever forbidden by virtue of that relationship of mahram. This was the view stated by Imaam al-Jassaas when he commented on this aayah. He said (may Allaah have mercy on him): “When Allaah mentioned the fathers and that their marriage to these women is forbidden forever, this indicates that the same prohibition applies in other relationships of mahram, such as the mother of the woman and those who are mahrams by radaa’ah, etc.” (Ahkaam al-Qur’aan by al-Jassaas, 3/317). The same things are made haraam by radaa’ah as by ties of blood.
It also says in the Sunnah: “The same things are made haraam by radaa’ah as by ties of blood.” This means that the people who are mahram to a woman because of blood ties are also mahram because of radaa’ah. It was reported in Saheeh Muslim that ‘Aa’ishah Umm al-Mu’mineen (may Allaah be pleased with her) said that Aflah the brother of Abu Qu’ays came and asked permission to see her. He was her uncle through radaa’ah. This was after hijaab had been revealed, so she refused to give him permission. When the Messenger of Allaah (peace and blessings of Allaah be upon him) came, she told him about what she had done and he told her to give him permission.
(Saheeh al-Bukhaari bi Sharh al-‘Asqallaani, 9/150). This hadeeth was also narrated by Imaam Muslim, where the wording is: from ‘Urwah from ‘Aa’ishah, who told him that her uncle by radaa’ah, who was called Aflah, asked permission to see her and she did not let him. She told the Messenger (peace and blessings of Allaah be upon him) and he said to her, “Do not observe hijaab in front of him, because the same relationships of mahram are created by radaa’ah as by blood ties.” (Saheeh Muslim bi Sharh al-Nawawi, 10/22) A woman’s mahrams through radaa’ah are the same as her mahrams through blood ties
In accordance with the Qur’aan and Sunnah, the fuqahaa’ have stated that a woman’s mahrams through radaa’ah are the same as her mahrams through blood ties. It is permissible for her to display her adornments before her mahrams by radaa’ah just as it is permissible for her to display her adornments before her mahrams by blood ties. It is permissible for her mahrams by radaa’ah to see whatever of her body it is permissible for her mahrams by blood ties to see.
Mahrams by marriage
A woman’s mahrams by marriage are those whom it is forever forbidden to marry, such as the father’s wife, the son’s wife or the wife’s mother.
(Sharh al-Muntahaa, 3/7). The mahram by marriage of the father’s wife is his son from another wife, for the wife of the son it is his father, and for the mother of the wife it is the husband. Allaah says in Soorat al-Noor (interpretation of the meaning):
“… and not to reveal their adornment except to their husbands, or their fathers, or their husband’s fathers, or their sons, or their husband’s sons…” [al-Noor 24:31]. Their husband’s fathers and their husband’s sons are mahrams of the woman by marriage. Allaah mentioned them along with their (the women’s own) fathers and sons, and made them all the same in the sense that women may display their adornments in front of them.

Louange à Allah
Il est permis à la femme musulmane de retirer son voile devant ses mahram. Celui-ci est toute personne qu’une femme ne pourra jamais épouser, soit pour la parente (le père , le grand père , le fils , le fils du fils, etc. Les oncles paternels, les oncles maternels, le neveu et la nièce) soit pour l’allaitement comme le frère par l’allaitement et le père par l’allaitement (l’époux de la nourrice), soit par alliance (le mari de la mère, le père du mari, son grand père, etc. le fils du mari, le fils de son fils, etc.
Voici de plus amples détails :
Les mahram pour parenté
Ce sont les personnes mentionnées dans la sourate de la lumière notamment les propos du Très Haut : et qu' elles ne montrent leurs atours qu' à leurs maris, ou à leurs pères, ou aux pères de leurs maris, ou à leurs fils, ou aux fils de leurs maris, ou à leurs frères, ou aux fils de leurs frères, ou aux fils de leurs sœurs. (Coran,24 : 31). Les exégètes disent que la lettre et l’esprit de ce verset permettent d’établir la liste des mahram comme suit :
Premièrement, les ascendants, ceux des épouses quel que soit leur degré , mâles et femelles confondus, comme les grands pères paternels et maternels. Quant aux beaux pères, ils sont des mahram par alliance comme nous l’expliquerons.
Deuxièmement, les descendants. C’est-à-dire ceux des épouses qui englobent les fils des fils quelque soit leur degré, mâles et femelles, confondus, comme les fils des fils et les fils des filles. Quant aux fils de leur mari cités dans le saint verset, ils sont ceux issus d’un autre mariage. Ceux-là sont des mahram par alliance et pas par parenté comme nous l’expliquerons plus bas.
Troisièmement, les frères (des femmes) germains, consanguins ou utérins.
Quatrièmement , les neveux et les nièces , quel que soit leur degré, comme les fils des filles des frères.
Cinquièmement, les oncles paternels et maternels sont des mahram assimilables et effectivement assimilés par les gens aux père et mère. L’oncle paternel est parfois appelé ‘père ’. A ce propos le Très Haut : Etiez- vous témoins quand la mort se présenta à Jacob et qu' il dit à ses fils: "Qu' adorerez- vous après moi?" - Ils répondirent: "Nous adorerons ta divinité et la divinité de tes pères, Abraham, Ismaël et Isaac. (Coran, 2 : 133). Or Ismaïl était comme un oncle paternel pour les fils de Jacob. Voir le Tafsir de Razi, 23/206 ; Le Tafsir de Qurtubi, 12/232 et 233 ; le Tafsir d’al-Alousi, 18/143 ; Fateh al-Bayaan fi maqassid al-Qur’an de Siddiq Khan, 6/352.
Les mahram par allaitement
L’on peut devenir mahram pour une femme à cause de l’allaitement. A ce propos, on lit dans le Tafsir d’al-Aloussi : L’état de mahram autorisant l’exhibition des parures peut être créé aussi bien par la parenté que par l’allaitement. Aussi est-il permis aux femmes d’exhiber leurs parures devant leur père et leurs fils par allaitement (Tafsir d’al-Aloussi, 18/143) parce que l’état de mahram créé par l’allaitement est comme celui créé par la parenté, dans la mesure où les deux entraînent une prohibition matrimoniale perpétuelle entre les parties concernées. Voilà à quoi l’imam al-Djassass (Puisse Allah lui accorder sa miséricorde) fait allusion quand il dit dans le cadre de son commentaire du présent verset : Quand Allah le Très Haut a mentionné à côté des pères les mahram qu’il est perpétuellement interdit aux femmes d’épouser, cela signifie que ceux qui leur sont assimilables dans l’interdiction partagent avec eux le même statut. C’est le cas de la mère de la femme et des femmes prohibées pour l’allaitement et des personnes semblables (Ahkam al-Qur’an de Djassass, 3/317).
Ce qui est prohibé pour une parenté l’est pour l’allaitement. La Sunna prophétique dit : Ce qui est prohibé pour une parenté l’est pour l’allaitement . Cela veut dire qu’on peut être mahram pour une femme à cause de l’allaitement, comme on l’est à cause de la parenté.
Aïcha, la mère des croyants (P.A.a) a dit qu’Aflah, le frère d’Abou Quays avait demandé l’autorisation de lui rendre visite après l’instauration du voile. Bien qu’il fût son oncle paternel par allaitement , elle la lui avait refusée. Mais quand elle en a informé le Prophète (bénédiction et salut soient sur lui) il lui a donné l’ordre d’autoriser la visite » Voir Sahih al-Boukhari commenté par al-Asqalani, 9/150.
Le même hadith est rapporté par Mouslim en ces termes ! « Urwa a rapporté d’après Aïcha que son oncle paternel par allaitement, du nom d’Aflah, lui avait demandé l’autorisation de lui rendre visite. Quand elle a informé le Prophète (bénédiction et salut soient sur lui) de son refus, celui-ci lui dit : Ne te voiles pas devant lui, car la prohibition (matrimoniale) créé par la parenté découle aussi de l’allaitement Sahih de Mouslim commenté par An-Nawawi, 10/22.
Les mahram de la femme pour raison d’allaitement sont comme ses mahram pour raison de parenté.
Les jurisconsultes se sont strictement appuyés sur la Charia et la Sunna pour déclarer nettement que ceux qui sont devenus mahram pour une femme à cause de l’allaitement sont comme ceux qui le sont pour la parenté. C’est pourquoi, il est permis à la femme d’exhiber ses parures devant ses mahram par allaitement, comme elle le fait devant ses mahram par parenté.
De même il est permis aux premiers de regarder les parties du corps de la femme qu’il est permis aux derniers de regarder
Les mahram par alliance
Les mahram d’une femme pour raison d’alliance sont les personnes qu’il lui est perpétuellement interdit d’épouser comme le mari de mère, l’époux de sa fille, le beau père). Voir Sharh al-Mountaha, 3/7.
Est considéré comme mahram par alliance pour l’épouse du père le fils de celui-ci issu d’un autre mariage. Pour la belle fille, c’est le beau père. Pour la mère de l’épouse, c’est le mari de celle-ci. Allah le Très Haut a dit dans la sourate de la Lumière : Et dis aux croyantes de baisser leurs regards, de garder leur chasteté, et de ne montrer de leurs atours que ce qui en paraît et qu' elles rabattent leur voile sur leurs poitrines; et qu' elles ne montrent leurs atours qu' à leurs maris, ou à leurs pères, ou aux pères de leurs maris, ou à leurs fils, ou aux fils de leurs maris, ou à leurs frères, ou aux fils de leurs frères, ou aux fils de leurs sœurs, ou aux femmes musulmanes, ou aux esclaves qu' elles possèdent, ou aux domestiques mâles impuissants, ou aux garçons impubères qui ignorent tout des parties cachées des femmes. Et qu' elles ne frappent pas avec leurs pieds de façon que l' on sache ce qu' elles cachent de leurs parures. Et repentez- vous tous devant Allah,ôcroyants, afin que vous récoltiez le succès. (Coran, 24 : 31).
Les pères des maris et leurs fils sont les mahram d’une femme par alliance. Allah le Très Haut les a mentionnés avec leurs pères et fils pour les placer sur un même pied d’égalité en ce qui concerne l’exhibition des parures devant eux. Al-Moughni, 6/555.
