السؤال

ما حكم الذي لا يصوم في أول رؤية هلال رمضان إذا رؤي حتى يرى بنفسه ويستدل بالحديث القائل " صوموا لرؤيته وأفطروا لرؤيته " وهل صحيح استدلالهم بهذا الحديث ؟
نص الجواب




الحمد لله
الحمد لله ، الواجب الصيام إذا ثبتت رؤية الهلال ولو بواحد عدل من المسلمين ، كما أمر النبي صلى الله عليه وسلم بالصيام عندما شهد الأعرابي برؤيته للهلال وأما الاستدلال بحديث " صوموا لرؤيته وأفطروا لرؤيته " على أن كل فرد لا يصوم إلا برؤيته بنفسه فغير صحيح ، لأن الحديث خطاب عام بالصيام عند تحقق الرؤية ولو من واحد عدل من المسلمين . فتاوى اللجنة الدائمة 10/94 ، ومن الأدلّة الدالة أيضا على أنّ رؤية الواحد العدل الثقة من المسلمين للهلال كافية لوجوب الصيام على جميع المسلمين حديث ابن عُمَرَ رضي الله عنه قال : تَرَاءَى النَّاسُ الْهِلالَ فَأَخْبَرْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنِّي رَأَيْتُهُ فَصَامَهُ وَأَمَرَ النَّاسَ بِصِيَامِهِ . رواه أبو داود في سننه : كتاب الصوم : باب في شهادة الواحد على رؤية هلال رمضان . وبعض أهل البدع يتأخّرون عن سائر المسلمين بالصّوم لأجل اعتقادهم الضّال بأنه لا صيام على الإنسان حتى يراه بنفسه والأحاديث تردّ عليهم ثم نسألهم ماذا يفعل الأعمى وضعيف البصر إذن ؟ والأمر كما قال الله تعالى " فَإِنَّهَا لا تَعْمَى الأَبْصَارُ وَلَكِنْ تَعْمَى الْقُلُوبُ الَّتِي فِي الصُّدُورِ"46: سورة الحج ، والله الهادي إلى سواء السبيل .

Question

What is the ruling on a person who does not fast according to the first sighting of the new moon of Ramadaan, but waits until he sees it for himself? Is their interpretation of hadeeth, “Fast when you see it [the new moon] and stop fasting when you see it” correct??

Praise be to Allaah.
What is obligatory is to fast when the sighting of the moon is confirmed, even if it is seen by only one trustworthy Muslim, as the Prophet (peace and blessings of Allaah be upon him) issued orders to fast when a Bedouin testified that he had seen the new moon. Interpreting the hadeeth “Fast when you see it and stop fasting when you see it” as meaning that no individual should fast until he sees the new moon for himself is incorrect, because the hadeeth is telling everyone to fast when the sighting is confirmed, even if only one trustworthy Muslim sees the new moon.
(Fataawa al-Lajnah al-Daa’imah, 10/94). Further evidence that the sighting of the new moon by one trustworthy, reliable Muslim is sufficient for fasting to be obligatory on all the people is the hadeeth of Ibn ‘Umar (may Allaah be pleased with him, who said: “The people went out to sight the new moon and I told the Messenger of Allaah (peace and blessings of Allaah be upon him) that I had seen it, so he fasted and told the people to fast.”
(Reported by Abu Dawood in his Sunan, Kitaab al-Sawm, Baab fi Shahaadat al-Waahid ‘ala ru’yat hilaali Ramadaan. Some of those who follow bid’ah delay fasting until after all the other Muslims have started to fast, because of their misguided belief that fasting is not obligatory on a person until he sees the new moon for himself. The ahaadeeth refute this, and we would ask them moreover: what are those who are blind or who have poor eyesight supposed to do? It is as Allaah says interpretation of the meaning “…Verily, it is not the eyes that grow blind, but it is the hearts which are in the breasts that grow blind.” [al-Hajj 22:46].
And Allaah is the One Who guides to the Straight Path.

Question : Comment juger celui qui n’entre en jeûne que quand il aperçoit lui-même le croissant lunaire et ne veut pas se contenter de la vision du croissant par les autres et croit pouvoir tirer un argument des propos : Jeûnez quand vous le verrez et mettez fin à votre jeûne quand vous le reverrez. Peut-il valablement tirer un argument de ce hadith ?

Louange à Allah
Le jeûne devient obligatoire dès que le croissant est aperçu fût ce par un seul musulman intègre. C’est ce qu’indique l’ordre donné au musulman par le Prophète (bénédiction et salut soient sur lui) après qu’un bédouin eût attesté avoir vu le croissant lunaire. Quant au fait de vouloir tirer un argument du hadith : Jeûnez quand vous le verrez et mettez fin à votre jeûne quand vous le reverrez. pour soutenir l’idée selon laquelle chaque individu doit le voir personnellement avant d’entrer en jeûne, c’est inexact. En effet, le hadith exprime l’ordre général de jeûner après la vision du croissant, fût ce par un seul musulman sûr.

Parmi les arguments utilisés pour soutenir que la vision du croissant par un seul musulman sûr suffit pour que le jeûne s’impose à tous les musulmans, le hadith d’Ibn Omar dans lequel il dit : Les gens scrutaient le ciel pour apercevoir la lune et j’ai informé le Messager d’Allah (bénédiction et salut soient sur lui) que je l'avais vue. Dès lors, il s’est mis à jeûner et en a donné l’ordre aux gens. (rapporté par Abou Dawoud dans ses Sunan : livre sur le jeûne : chapitre : le témoignage d’une seule personne portant sur la vision du croissant lunaire annonçant le début du Ramadan).
Certains hérétiques n’entrent en jeûne qu’après tous les autres musulmans du fait de leur croyance erronée que l’on ne doit jeûner qu’après une vision personnelle du croissant lunaire. Les hadith réfutent leur opinion. En plus, il faudrait leur demander ce que feraient l’aveugle et celui qui voit faiblement. Il est vrai, comme le dit Allah le Très Haut : ce ne sont pas les yeux qui s'aveuglent, mais, ce sont les cœurs dans les poitrines qui s'aveuglent. Coran, 22:46). Allah est le seul qui guide sur le droit chemin.
