السؤال

أفْطَرتُ أيامًا من رمضان بسبب الحيض ، وهذا من عدة سنوات . ولم أصم هذه الأيام حتى الآن . فماذا عليّ أن أفعل ؟.

نص الجواب
الحمد لله
اتفق الأئمة على أنه يجب على من أفطر أياماً من رمضان أن يقضي تلك الأيام قبل مجيء رمضان التالي .
واستدلوا على ذلك بما رواه البخاري :1950- ومسلم :1146: عن عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قالت " كَانَ يَكُونُ عَلَيَّ الصَّوْمُ مِنْ رَمَضَانَ ، فَمَا أَسْتَطِيعُ أَنْ أَقْضِيَهُ إِلا فِي شَعْبَانَ ، وَذَلِكَ لِمَكَانِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ".
قال الحافظ :
وَيُؤْخَذ مِنْ حِرْصهَا عَلَى ذَلِكَ فِي شَعْبَان أَنَّهُ لا يَجُوز تَأْخِير الْقَضَاء حَتَّى يَدْخُلَ رَمَضَان آخَرُ اهـ
فإن أخر القضاء حتى دخل رمضان التالي فلا يخلو من حالين :
الأولى :
أن يكون التأخير بعذر ، كما لو كان مريضاً واستمرَّ به المرض حتى دخل رمضان التالي ، فهذا لا إثم عليه في التأخير لأنه معذور . وليس عليه إلا القضاء فقط . فيقضي عدد الأيام التي أفطرها .
الحال الثانية :
أن يكون تأخير القضاء بدون عذر ، كما لو تمكن من القضاء ولكنه لم يقض حتى دخل رمضان التالي.
فهذا آثم بتأخير القضاء بدون عذر ، واتفق الأئمة على أن عليه القضاء ، ولكن اختلفوا هل يجب مع القضاء أن يطعم عن كل يوم مسكينًا أو لا ؟
فذهب الأئمة مالك والشافعي وأحمد أن عليه الإطعام . واستدلوا بأن ذلك قد ورد عن بعض الصحابة كأبي هريرة وابن عباس رضي الله عنهم .
وذهب الإمام أبو حنيفة رحمه الله إلى أنه لا يجب مع القضاء إطعام .
واستدل بأن الله تعالى لم يأمر مَنْ أفطر من رمضان إلا بالقضاء فقط ولم يذكر الإطعام ، قال الله تعالى " وَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ " البقرة/185.

وهذا القول الثاني اختاره الإمام البخاري رحمه الله ، قال في صحيحه :
قَالَ إِبْرَاهِيمُ -يعني : النخعي- : إِذَا فَرَّطَ حَتَّى جَاءَ رَمَضَانُ آخَرُ يَصُومُهُمَا وَلَمْ يَرَ عَلَيْهِ طَعَامًا ، وَيُذْكَرُ عَنْ أَبِي هُرَيْرَةَ مُرْسَلا وَابْنِ عَبَّاسٍ أَنَّهُ يُطْعِمُ . ثم قال البخاري : وَلَمْ يَذْكُرِ اللَّهُ الإِطْعَامَ ، إِنَّمَا قَالَ " فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ " اهـ
وقال الشيخ ابن عثيمين رحمه الله وهو يقرر عدم وجوب الإطعام :
وأما أقوال الصحابة فإن في حجتها نظراً إذا خالفت ظاهر القرآن ، وهنا إيجاب الإطعام مخالف لظاهر القرآن ، لأن الله تعالى لم يوجب إلا عدة من أيام أخر ، ولم يوجب أكثر من ذلك ، وعليه فلا نلزم عباد الله بما لم يلزمهم الله به إلا بدليل تبرأ به الذمة ، على أن ما روي عن ابن عباس وأبي هريرة رضي الله عنهم يمكن أن يحمل على سبيل الاستحباب لا على سبيل الوجوب ، فالصحيح في هذه المسألة أنه لا يلزمه أكثر من الصيام إلا أنه يأثم بالتأخير . اهـ

وعلى هذا فالواجب هو القضاء فقط ، وإذا احتاط الإنسان وأطعم عن كل يوم مسكينًا كان ذلك حسنًا .
وعلى السائلة - إذا كان تأخيرها القضاء من غير عذر- أن تتوب إلى الله تعالى وتعزم على عدم العودة لمثل ذلك في المستقبل .
والله تعالى المسؤول أن يوفقنا لما يحب ويرضى .

Delaying making up Ramadaan fasts until the next Ramadaan begins

Question

I did not fast some days in Ramadaan because of my period. This happened a few years ago, and I have not fasted these days until now. What do I have to do?.

Praise be to Allaah.
The imams are agreed that whoever does not fast some days of Ramadaan has to make up those days before the next Ramadaan comes.
They quoted as evidence for that the hadeeth narrated by al-Bukhaari (1950) and Muslim (1146) from ‘Aa’ishah (may Allaah be pleased with her) who said: “I used to have fasts that I still owed from Ramadaan, and I could not make them up until Sha’baan, and that was because of the position of the Messenger of Allaah (peace and blessings of Allaah be upon him) [as a husband].”
Al-Haafiz said:
It may be understood from her keenness to fast them in Sha’baan that it is not permissible to delay making up fasts until the next Ramadaan begins.
If a person delays making up fasts until Ramadaan begins, one of the following two scenarios must apply.
1 – The delay is for a reason, such as being sick and the sickness lasting until the following Ramadaan begins. There is no sin on a person for delaying in this case, because he has an excuse, and he only has to make up the days missed. So he should make up the number of days that he did not fast.
2 – There is no reason for the delay, such as when a person was able to make up the fasts but he did not do so before the following Ramadaan began.
This person is sinning by failing to make up the fasts with no excuse. The imams are agreed that he must make up the fasts, but they differed as to whether along with making up the fasts he must also feed one poor person for each day or not.
Maalik, al-Shaafa’i and Ahmad said that he must feed a poor person, and they quoted as evidence for that the reports narrated from some of the Sahaabah such as Abu Hurayrah and Ibn ‘Abbaas (may Allaah be pleased with them).
Imam Abu Haneefah (may Allaah have mercy on him) was of the view that he does not have to feed a poor person as well as making up the fasts.
He quoted as evidence the fact that Allaah commands the one who does not fast in Ramadaan only to make up the missed fasts, and He did not mention feeding a poor person. Allaah says (interpretation of the meaning):
“and whoever is ill or on a journey, the same number [of days which one did not observe Sawm (fasts) must be made up] from other days”
[al-Baqarah 2:185]

This second view was also favoured by Imam al-Bukhaari (may Allaah have mercy on him). He said in his Saheeh:
Ibraaheem (i.e., al-Nakha’i) said: If a person neglects (to make up missed fasts) until the next Ramadaan comes, he should fast the missed days of both months. But he did not think that he has to feed a poor person. There was also a mursal report from Abu Hurayrah and Ibn ‘Abbaas which says that he should also feed a poor person. Then al-Bukhaari said: But Allaah does not mention feeding a poor person, rather He says (interpretation of the meaning):
“…the same number [of days which one did not observe Sawm (fasts) must be made up] from other days”
[al-Baqarah 2:185]
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said, when noting that it is not obligatory to feed a poor person:
With regard to the words of the Sahaabah, their use as evidence is subject to further discussion if it goes against the apparent meaning of the Qur’aan. In this case, saying that it is obligatory to feed a poor person goes against the apparent meaning of the Qur’aan, because Allaah only enjoined making up the same number from other days, and He did not mention more than that. Based on this, we should not oblige the slaves of Allaah to do any more than they need to fulfil their duty. But what was narrated from Ibn ‘Abbaas and Abu Hurayrah may be interpreted as referring to what is mustahabb, not what is obligatory. The correct view with regard to this issue is that a person does not have to do anything more than making up the missed fasts, but he is sinning if he delays doing so.

Based on this, then what is obligatory is to make up the fasts only, but if a person wants to be on the safe side and feed one poor person for each day missed, then that is good.
The woman who asked this question – if she delayed making up the fasts with no excuse, has to repent to Allaah and resolve not to repeat this mistake in the future.
And Allaah is the One Whom we ask to help us to do that which He loves and which pleases Him.

Retarder le rattrapage du jeûne du Ramadan jusqu'à l'arrivée du Ramadan suivant

J'ai raté le jeûne de jours du Ramadan en raison de mon cycle menstruel. Cela s'est répété pendant plusieurs années. Je n'ai pas rattrapé ces jours jusqu'à maintenant.. Que dois-je faire ?

Tous les imams sont d'avis que celui qui rate le jeûne de jours du Ramadan doit les rattraper avant l'avènement du Ramadan suivant. Ils fondent leur avis sur ce hadith rapporté par al-Boukhari (1950) et par Mouslim (1146) d'après Aicha (P.A.a)selon lequel elle a dit: je ratais des jours du Ramadan que je ne pouvais rattraper qu'au mois de Chabaane, pour tenir compte (des besoins) du Messager d'Allah (Bénédiction et salut soient sur lui). Son souci d'agir ainsi permet de comprendre qu'il n'est pas permis de retarder le rattrapage jusqu'à l'arrivée du Ramadan suivant. Si on le fait , deux cas peuvent se présenter. Le premier est la présence d'une excuse; comme une maladie qui continue jusqu'à l'arrivée du Ramadan suivant. Dans ce cas, l'excuse exclut le péché. L'intéressé ne fera que rattraper les joursratés. Le second cas concerne l'absence d'excuse comme si on a eu la possibilité de rattraper le jeûne sans le faire jusqu'à l'arrivée du Ramadan suivant. Le fidèle concerné tombe dans ce cas dans le péché pour avoir retardé le rattrapage du jeûne sans excuse.
Tous les imams sont d'avis qu'il est tenu de rattraper le jeûne. Mais il y a divergence de vues à propos de la question de savoir s'il doit en plus nourrir un pauvre pour chaque jour ou pas. Pour les imams Malick, Chafii et Ahmad, il doit le faire. Ils arguent qu'il a été rapporté que des Compagnons comme Abou Hourayrah et Ibn Abbas (P.A.a) avaient agi ainsi. Pour l'imam Abou Hanifa (Puisse Allah lui accorder Sa miséricorde) le fidèle n'a pas à nourrir un pauvre en plus du rattrapage du jeûne. Il tire son argument du fait qu'Allah Très Haut ne lui a donné que l'ordre de rattraper le jeûne sans mentionner l'offre de nourriture dans Ses propos : qu'il jeûne un nombre égal d'autres jours (Coran,2:185). Voir al-Madjmou' (6/366) et al-Moughni (4/400). Ce deuxième avis a été choisi parl'imam al-Boukhari (Puisse Allah lui accorder Sa miséricorde) car il dit dans son Sahih: « Ibrahim, c'est –à-dire an-Nakhai, dit: si, par négligence onn'a pas rattrapé le jeûne raté du Ramadan jusqu'à l'arrivée du Ramadan suivant, on rattrape le jeûne raté sans y ajouter l'offre de nourriture. Ibrahim cite un hadith rapporté de façon interrompue d'après Abou Hourayrah et Ibn Abbas selon lequel l'intéressé doit en plus nourrir (un pauvre). Ensuite , al-Boukhari dit: Allah n'a pas mentionné l'offre de nourriture. Il a plutôt dit: un nombre d'autres jours.
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa récompense) dit pour confirmer que la nourriture n'est pas nécessaire : Quand les propos des Compagnons contredisent le sens apparent du texte coranique, leur utilisation en tant qu'argument devient discutable. Dans le cas présent, le fait d'imposer l'offre de nourriture est contraire au sens apparent du Coran car Allah Très Haut n'a imposé au fidèle que de jeûner des jours égales en nombre aux jours ratés. Il n'a imposé rien de plus. Par conséquent, nous n'avons pas à imposer aux fidèles serviteurs d'Allah ce qu'Allah , lui-même, ne leur demande pas, à moins de disposer d'un argumentqui procure acquis de conscience. S'y ajoute que ce qui a été rapporté d'Abou Hourayrah et d'Ibn Abbas (P.A.a) peut signifier non une obligation mais plutôt une recommandation. Ce qui est juste dans cette question est que le fidèle concerné n'est tenu de faire rien de plus que le rattrapage du jeûne, même s'il commet un péché en le retardant. Charh al-Moumti' (6/451).
Cela étant, ce qui est obligatoire, c'est le seul rattrapage. Toutefois, si, par précaution, le fidèle nourrit un pauvre pour chaque jour, c'est bien.
Si l'auteur de la question avait retardé le rattrapage du jeûne sans excuse, elle doit se repentir devant Allah Très Haut et se résoudre à ne pas récidiver dans le futur. C'est à Allah Très Haut qu'il est demandé de nous assister à faire ce qu'Il aime et agrée.»
