Ruling on eating after the adhaan for Fajr because of uncertainty as to whether the timing of the adhaan is correct


Le fait de manger après le premier appel à la prière du matin sur la base d’un doute portant sur l’exactitude du moment de l’appel.



السؤال

يوجد خلاف على تحديد موعد صلاة الفجر فى مصر أمس أمى شعرت بعطش شديد مع سماع أذان الفجر فسألت أخى فقال لها اشربى - تقليدا لشيخ سلفى كبير فى مصر يقول بأن موعد الصلاة به خطأ وكان يأكل هو وتلامذته بعد الاذان لمدة 10 دقائق اخى كرر ذلك كثيرا ولا يذكر عدد الأيام ماذا على أمى وأخي ؟


الحمد لله
الواجب في الصوم الإمساك عن المفطرت من طلوع الفجر إلى غروب الشمس؛ لقوله تعالى"وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ " البقرة/187 .
فالعبرة بطلوع الفجر، فمن لم يتيقن طلوع الفجر، فله أن يأكل حتى يتيقن.
وكذا لو علم أن المؤذن يؤذن قبل الوقت، أو شك أنه يؤذن في الوقت أو قبله، فله أن يأكل حتى يتيقن، والأولى له أن يُمسك بمجرد سماع الأذان احتياطا.
سئل الشيخ عبد العزيز بن باز رحمه الله ما نصه : ما الحكم الشرعي في صيام من سمع أذان الفجر واستمر في الأكل والشرب ؟
فأجاب " الواجب على المؤمن أن يمسك عن المفطرات من الأكل والشرب وغيرهما إذا تبين له طلوع الفجر ، وكان الصوم فريضة كرمضان وكصوم النذر والكفارات ؛ لقول الله عز وجل " وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ " البقرة/187 .
فإذا سمع الأذان ، وعلم أنه يؤذن على الفجر : وجب عليه الإمساك .
فإن كان المؤذن يؤذن قبل طلوع الفجر : لم يجب عليه الإمساك ، وجاز له الأكل والشرب حتى يتبين له الفجر .
فإن كان لا يعلم حال المؤذن ، هل أذن قبل الفجر أو بعد الفجر : فإن الأولى والأحوط له أن يمسك إذا سمع الأذان ، ولا يضره لو شرب أو أكل شيئا حين الأذان لأنه لم يعلم بطلوع الفجر .
ومعلوم أن من كان داخل المدن التي فيها الأنوار الكهربائية لا يستطيع أن يعلم طلوع الفجر بعينه وقت طلوع الفجر ، ولكن عليه أن يحتاط بالعمل بالأذان والتقويمات التي تحدد طلوع الفجر بالساعة والدقيقة ، عملا بقول النبي صلى الله عليه وسلم " دَعْ مَا يَرِيبُكَ إِلَى مَا لا يَرِيبُكَ " وقوله صلى الله عليه وسلم " مَنْ اتَّقَى الشُّبُهَاتِ اسْتَبْرَأَ لِدِينِهِ وَعِرْضِهِ " والله ولي التوفيق " انتهى نقلا عن "فتاوى رمضان" جمع أشرف عبد المقصود :ص 201 .
وعليه : فإذا قلدت أمك وأخوك من يثقون به ، ممن يقول إن الأذان متقدم على الفجر الصادق، فأكلا بناء على ذلك، فلا حرج عليها فيما مضى، وصومها صحيح .
وينبغي مستقبلا أن يمسكا مع الأذان، فإن مسألة الخطأ في التقويم يعتريها كلام كثير، لا سيما في تحديد قدر الخطأ، فالأحوط للصوم أن يكون الإمساك مع الأذان، والأحوط للصلاة تأخيرها عشرين دقيقة أو فوقها.

Question

There is a difference of opinion about the timing of Fajr prayer in Egypt. Yesterday my mother felt extremely thirsty when hearing the adhaan for Fajr, so she asked my brother and he told her to drink – following the view of a senior Salafi shaykh in Egypt who says that the official timing of the prayer is wrong, and he and his students used to eat for ten minutes after the adhaan. My brother did this repeatedly, but he does not remember how many days he did this on. What should my mother and my brother do?



Praise be to Allah.
What is required with regard to fasting is to refrain from doing anything that breaks the fast from the break of dawn until the sun sets, because Allah, may He be exalted, says (interpretation of the meaning):
“And eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]”
[al-Baqarah 2:187].
What matters is the break of dawn; if someone is not certain that dawn has broken, then he may eat until he is certain.
Similarly, if he knows that the mu’adhdhin gives the call to prayer ahead of time, or he is not sure whether he is giving the call to prayer on time or ahead of time, then he may eat until he is certain. However, it is more appropriate for him to stop (eating and drinking) as soon as he hears the adhaan, so as to be on the safe side.
Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allah have mercy on him) was asked: What is the shar‘i ruling on the fast of someone who hears the adhaan of Fajr but continues to eat and drink?
He replied: What is required of the believer is to refrain from things that break the fast, such as eating, drinking and so on, when it becomes clear to him that dawn has broken, if the fast is obligatory, such as the fast of Ramadan, or fasting in fulfilment of a vow or as an act of expiation, because Allah, may He be glorified and exalted, says (interpretation of the meaning):
“And eat and drink until the white thread of dawn becomes distinct to you from the black thread [of night]. Then complete the fast until the sunset”
[al-Baqarah 2:187].
So if he hears the adhaan and knows that this is the call for Fajr, then he must stop (eating etc.)
If the mu’adhdhin gives the call to prayer before dawn breaks, then it is not obligatory to stop eating etc., and it is permissible to eat and drink until he is certain that dawn has broken.
If he does not know whether the mu’adhdhin gives the call to prayer before dawn has broken or after, then it is better and more prudent to stop eating etc. when he hears the adhaan, but it does not matter if he eats or drinks something whilst hearing the adhaan, because he does not know (for sure) whether dawn has broken.
It is well-known that people who live in cities where there is electric lighting cannot know whether dawn has broken by looking at the sky at the time of dawn; but he should err on the side of caution by paying attention to the adhaan and the timetables which state the time of dawn, mentioning hour and minute, acting in accordance with the words of the Prophet (blessings and peace of Allah be upon him): “Leave that which makes you doubt for that which does not make you doubt”; and “Whoever is cautious with regard to ambiguous matters will protect his religious commitment from shortcomings and will protect his honour from slander” and Allah is the source of strength.

Based on that, if your mother and your brother were following someone whom they trust, who says that the adhaan is given ahead of the time of the true dawn, so they ate based on that, then there is no blame on them for what they did in the past, and their fast is valid.
But in the future, they should stop eating when the adhaan begins, because the issue of errors in timetables is very controversial, especially with regard to the degree of error. So the most prudent approach with regard to fasting is to stop eating when the adhaan begins, and the most prudent approach with regard to the prayer is to delay it for twenty minutes or more.

Il y a une divergence à propos de la fixation de l’heure de la prière de l’aube.Hier, ma mère a éprouvé une intense soif lors du lancement de l’appel à ladite prière.J’ai interrogé mon frère et il m’a dit qu’elle peut boire en suivant l’avis d’un grand cheikh salafiste d’Egypte selon lequel l’heure retenue pour cette prière (là-bas) n’est pas exacte. Le cheikh et ses adeptes continuaient de manger pendant dix minutes après le lancement de l’appel à la prière. Mon frère a souvent répété (cet avis) mais il ne se souvient pas du nombre de jours (au cours des quels il l’a appliqué)..Que doivent faire mes frère et mère?


Louanges à Allah
Le jeûne consiste essentiellement à s’abstenir de tout ce qui lui est incompatible du début de l’aube jusqu’au coucher du soleil selon la parole du Très-haut: mangez et buvez jusqu’à ce que se distingue, pour vous, le fil blanc de l’aube du fil noir de la nuit. Puis accomplissez le jeûne jusqu’à la nuit. (Coran,2:187)
Ce qui compte c’est l’entrée de l’aube.Celui qui ne l’a pas constatée avec certitude peut continuer à manger.Il en est de même si on sait que le muezzin lance son appel à la prière avant l’heure juste ou si on en doute .Dans ce cas, on peut continuer de manger jusqu’au moment où l’on est sûr de l’arrivée de l’heure.Par précaution ,il vaut mieux s’abstenir de manger dès qu’on entend l’appel à la prière.
Cheikh Abdoul Aziz ibn Baz (Puisse Allah lui accorder Sa miséricorde) fut interrogé en ces termes: Comment la loi religieuse juge celui qui mange et boit après avoir entendu l’appel à la prière du matin?
Voici sa réponse: « Le devoir du croyant est de s’abstenir de tout ce qui rompt le jeûne , donc de cesser de manger de boire et de commettre d’autres actes (incompatibles avec le jeûne) dès qu’il constate l’entrée de l’aube, s’il s’engage dans un jeûne obligatoire comme celui de Ramadan ou un jeûne répondant à un voeu ou entrepris à titre expiatoire, conformément à la parole d’Allah le Puissant et Majestueux : mangez et buvez jusqu’à ce que se distingue, pour vous, le fil blanc de l’aube du fil noir de la nuit.Puis accomplissez le jeûne jusqu’à la nuit. (Coran 2:187).
Quand on entend l’appel à la prière et sait qu’il s’agit de celui qui annonce la prière du matin, on doit s’abstenir (de tout ce qui est incompatible avec le jeûne). Si le muezzin a l’habitude de faire son appel avant l’aube, on n’est pas tenu de commencer l’abstinence car il est permis de manger et de boire jusqu’à l’aube.
Si on ne connait pas l’état du muezzin et ne sait pas s’il a lancé son appel avant ou après l’entrée de l’aube, il vaut mieux s’abstenir dès l’entente de l’appel, par précaution.Il n’y aucun mal à manger ou à boire pendant le déroulement de l’appel si on ne sait pas que l’aube est entrée.
Il est bien connu que celui qui vit dans une ville bien éclairée ne peut pas connaitre l’entrée de l’aube par constat visuel.Mais il doit prendre une précaution et se servir d’un calendrier qui fixent les heures exactes de l’entrée de l’aube, en application de la parole du Prophète (Bénédiction et salut soient sur lui): Délaisse ce qui t’inspire le doute pour ce qui ne te l’inspire pas. et sa parole: Celui qui évite les choses suspectes sauve sa foi et son honneur. Cela étant, si votre mère et votre frère suivent l’avis d’une personne de confiance qui affirme que l’apple en question précède l’aube authentique et s’ils mangent en se fondant sur un tel avis, ils n’encourent rien pour leur pratique du passé, et leur jeûne est valide.Pour le future, ils doivent s’abstenir dès l’entente de l’appel car l’erreur dans la confection des calendriers est l’objet d’un débat interminable, notamment quant il s’agit d’en fixer la marge.Il est plus prudent pour le jeûneur de commencer son abstinence dès qu’il entend l’appel à la prière et il est plus prudent encore de situer celle-ci à un peu plus de 20 minutes plus tard.
