Le jugement de la prononciation de la tasmiyah (au nom d’Allah …) dans les ablutions



الحمد لله
اختلف العلماء في حكم التسمية في الوضوء .
فذهب الإمام أحمد إلى وجوبها ، واستدل بما رُوي عن النبي صلى الله عليه وسلم أنه قال " لا وُضُوءَ لِمَنْ لَمْ يَذْكُرْ اسْمَ اللَّهِ عَلَيْهِ " رواه الترمذي :25، وحسنه الألباني في صحيح الترمذي . انظر : المغني: 1/145.
وذهب جمهور العلماء منهم الأئمة أبو حنيفة ومالك والشافعي ورواية عن الإمام أحمد إلى أن التسمية سنة من سنن الوضوء وليست واجبة .
واستدلوا على عدم وجوبها بأدلة :
1- منها : أن النبي صلى الله عليه وسلم عَلَّمَ رجلاً الوضوءَ فقال له " تَوَضَّأْ كَمَا أَمَرَكَ اللَّهُ " رواه الترمذي :302، وصححه الألباني في صحيح الترمذي :247 . وهذا إشارة إلى قول الله تعالى " يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا قُمْتُمْ إِلَى الصَّلاةِ فَاغْسِلُوا وُجُوهَكُمْ وَأَيْدِيَكُمْ إِلَى الْمَرَافِقِ وَامْسَحُوا بِرُءُوسِكُمْ وَأَرْجُلَكُمْ إِلَى الْكَعْبَيْنِ " المائدة/6 . وليس فيما أمر الله التسمية . انظر : المجموع للنووي :1/346 .
وقد روى أبو داود :856، هذا الحديث بلفظ أكمل من هذا ، وأوضح في الدلالة على عدم وجوب التسمية في الوضوء .
فعَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : إِنَّهَا لا تَتِمُّ صَلاةُ أَحَدِكُمْ حَتَّى يُسْبِغَ الْوُضُوءَ كَمَا أَمَرَهُ اللَّهُ عَزَّ وَجَلَّ فَيَغْسِلَ وَجْهَهُ وَيَدَيْهِ إِلَى الْمِرْفَقَيْنِ وَيَمْسَحَ بِرَأْسِهِ وَرِجْلَيْهِ إِلَى الْكَعْبَيْنِ . . . الحديث .
فلم يذكر النبي صلى الله عليه وسلم التسمية ، مما يدل على عدم وجوبها . انظر : السنن الكبرى للبيهقي:1/44 .
2- ومنها : أن كثيرًا من الذين وصفوا وضوء النبي صلى الله عليه وسلم لم يذكروا فيه التسمية ، ولو كانت واجبة لذُكرت .

وهذا القول اختاره كثير من الحنابلة كالخرقي وابن قدامة .

واختاره من المعاصرين الشيخان محمد بن إبراهيم ، ومحمد بن عثيمين رحمهما الله .

وأجاب هؤلاء عن الحديث الذي استدل به من قال بوجوب التسمية بجوابين :
الأول : أن الحديث ضعيف .
ضعفه جماعة من العلماء منهم الإمام أحمد والبيهقي والنووي والبزار .
سُئِلَ الإمام أحمد عن التسمية في الوضوء ، فقال : ليس يثبت في هذا حديث ، ولا أعلم فيها حديثًا له إسناد جيد اهـ المغني :1/145 .

الجواب الثاني : أن الحديث إن صح فمعناه : لا وضوء كامل . وليس معناه لا وضوء صحيح .

وعلى هذا ؛ فالحديث –إن صح- فإنه يدل على استحباب التسمية لا وجوبها . والله أعلم .
وعلى هذا لو توضأ المسلم ولم يسم فوضوؤه صحيح ، غير أنه فَوَّت على نفسه ثواب الإتيان بهذه السنة ، والأحوط للمسلم ألا يترك التسمية على الوضوء .

Ruling on saying Bismillaah in wudoo’



Praise be to Allaah.
The scholars differed concerning the ruling on saying Bismillaah in wudoo’.
Imam Ahmad was of the view that it is obligatory, and he quoted as evidence the hadeeth narrated from the Prophet (peace and blessings of Allaah be upon him), according to which he said: “There is no wudoo’ for the one who does not mention the name of Allaah.” (Narrated by al-Tirmidhi, 25; classed as hasan by al-Albaani in Saheeh al-Tirmidhi. See al-Mughni, 1/145)
The majority of scholars – including Imam Abu Haneefah, Imam Maalik and Imaam al-Shaafa’i – and according to one view narrated from Imam Ahmad, are of the view that saying Bismillaah is one of the Sunnahs of wudoo’, and that it is not obligatory.
They quoted evidence for its not being obligatory, such as:
1 – The Prophet (peace and blessings of Allaah be upon him) taught a man how to do wudoo’, and said to him: “Do wudoo’ as Allaah has commanded you.” (Narrated by al-Tirmidhi, 302; classed as saheeh by al-Albaani in Saheeh al-Tirmidhi, 247). This is referring to the words of Allaah (interpretation of the meaning):
“O you who believe! When you intend to offer As-Salaah (the prayer), wash your faces and your hands (forearms) up to the elbows, rub (by passing wet hands over) your heads, and (wash) your feet up to the ankles”
[al-Maa'idah 5:6]
And there is no mention of saying Bismillaah in what Allaah commands here. See al-Majmoo’ by al-Nawawi, 1/346
Abu Dawood (856) narrated a more complete version of this hadeeth, which more clearly demonstrates that it is not obligatory to say Bismillaah when doing wudoo’.
It was narrated from Abu Hurayrah that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: The prayer of any one of you is not complete unless he does wudoo’ properly as enjoined by Allaah. So he should wash his face and his hands up to the elbows, and wipe his head, and wash his feet up to the ankles…”
The Prophet (peace and blessings of Allaah be upon him) did not mention saying Bismillaah, which indicates that it is not obligatory. See al-Sunan al-Kubra by al-Bayhaqi, 1/44
2 – Many of those who described the wudoo’ of the Prophet (peace and blessings of Allaah be upon him) did not mention that he said Bismillaah; if it was obligatory it would have been mentioned.

This is the view favoured by many of the Hanbalis such as al-Khuraqi and Ibn Qudaamah.

Among contemporary scholars, this view is favoured by Shaykh Muhammad ibn Ibraaheem and Muhammad ibn ‘Uthaymeen (may Allaah have mercy on them both).

They responded in two ways to the hadeeth which is quoted by those who say that saying Bismillaah is obligatory:
1 – That the hadeeth is da’eef (weak).
It was classed as da’eef by a number of scholars including Imam Ahmad, al-Bayhaqi, al-Nawawi and al-Bazzaar.
Imam Ahmad was asked about saying Bismillaah when doing wudoo’, and he said: There is no sound hadeeth concerning that, and I do not know of any hadeeth that has a jayyid (good) isnaad to support that. Al-Mughni, 1/145

2 – If the hadeeth is saheeh, then what it means is “no perfect wudoo’” and not “no valid wudoo’”. See al-Majmoo’, 1/347; al-Mughni, 1/146
Based on this, then the hadeeth – if it is saheeh – indicates that it is mustahabb to say Bismillaah, but it is not obligatory. And Allaah knows best.
Based on this, if a Muslim does wudoo’ and does not say Bismillaah, then his wudoo’ is valid, but he is missing out on the reward for doing this Sunnah. To be on the safe side, the Muslim should not omit to say Bismillaah when doing wudoo’.

Quel est le statut de la prononciation de la tasmiyah (au nom d’Allah …) dans les ablutions?


Louanges à Allah
Une divergence de vues oppose les ulémas à propos du statut de la prononciation de la tasmiyah dans les ablutions. L’imam Ahmad en soutient le caractère obligatoire et tire son argument du hadith rapporté du Prophète (Bénédictin et salut soient sur lui) en ces termes Pas d’ablutions pour celui qui n’y aura pas mentionné le nom d’Allah. (Rapporté par at-Tirmidhi,25) et jugé bon par al-Abani dans Sahih at-Tirmidhi. Voir al-Moughni (1/145).
Quant à la majorité des ulémas, notamment les imams Abou Hanifah, Malik et Chafii et Ahmad selon une version estiment que la tasmiyah est l’une des sunna des ablutions et qu’elle ne revêt aucun caractère obligatoire. Ils tirent leurs arguments des textes suivants:
  1. En apprenant à un homme la manière de faire ses ablutions, le Prophète (Bénédiction et salut soient sur lui) lui dit: Fais tes ablutions conformément à l’ordre qu’Allah t’a donné. (Rapporté par at-Tirmidhi,302) et jugé authentique par al-Abani dans Sahih at-Tirmidhi,247). Il y a là une référence à la parole d’Allah Très-haut: أ” les croyants! Lorsque vous vous levez pour la prière, lavez vos visages et vos mains jusqu’aux coudes; passez les mains mouillées sur vos têtes; et lavez-vous les pieds jusqu’aux chevilles (Coran,5:6) L’ordre émis par Allah le Transcendant ne comprend pas la tasmiyah. Voir al-Madjmou par an-Nawawi (1/346).
Abou Dawoud (856) a rapporté le présent hadith en des termes plus complets et plus explicites dans leur indication de l’absence d’un caractère obligatoire de la tasmiyah dans les ablutions.D’après Abou Hourayrah, le Messager d’Allah (Bénédiction e salut soient sur lui) a dit: En vérité, la prière de l’un d’entre vous ne se déroule parfaitement s’il ne fait pas ses ablutions complètement, donc conformément à l’ordre d’Allah le Puissant et Majestueux. Aussi doit on laver son vissage et ses mains jusqu’aux coudes et masser sa tête et ses pieds jusqu’aux chevilles…. Le Prophète (Bénédiction et salut soient sur lui) n’a pas mentionné la tasmiyah. Ce qui indique qu’elle n’est pas obligatoire. Voir as-Sunan al-koubraa par al-Bayhaqui (1/44).
2.Figure encore parmi les arguments le fait qu’un bon nombre de ceux qui ont décrit la manière dont le Prophète (Bénédictin et salut soient sur lui) faisait ses ablutions n’ont pas mentionné la tasmiyah. Si elle était obligatoire , on l’aurait mentionnée. Voir ach-charh al-moumt’i (1/130). Cet avis a été choisi par un grand nombre des Hanbalites, notamment al-Kharqui et Ibn Qoudamah. Voir al-Moughni (1/145) et al-Insaaf (1/128). Parmi les contemporains qui l’ont choisi, citons les deux cheikhs Muhammad ibn Ibrahim et Muhammad ibn Outhaymine (Puisse Allah leur accorder Sa miséricorde). Voir les fatwa de Cheikh Muhammad ibn Ibrahim (2/39) et ach-charh al-moumt’i (1/130,300)
Les partisans de cet avis ont donné deux réponses au hadith qui a servi d’argument à ceux qui soutiennent le caractère obligatoire de la mention de la tasmiyah dans les ablutions. La première est que le hadith est faible. Car un groupe d’ulémas dont l’imam Ahmad, al-Bayhaqui, an-Nawawi et al-Bazzar l’a déclaré faible. Interrogé sur la mention de la tasmiyah dans les ablutions, Ahmad dit: Aucun hadith sûr ne le prouve à ma connaissance. Voir al-Moughni (1/145). Voir as-Sunan al-koubra par al-Bayhaqui (1/43); al-Madjmou (1/343) et Talkhis al-habiir (1/72).
La deuxième réponse est qu’à supposer que le hadith soit authentique , il signifie que les ablutions ne seraient parfaites (sans la mention de la tasmiyah). ce qui ne signifie pas que les ablutions ne seraient pas valides. Voir al-Madjmou (1/347) et al-Moughi (1/146). Cela dit, si le hadith était authentique, il n’indiquerait que la recommandation de la tasmiyah mais il ne la rendrait pas obligatoire. Allah le sait mieux. Autrement dit, si un musulman fait ses ablutions sans y mentionner la tasmiyah, ses ablutions restent valides mais il se serait privé de la récompense que génère l’observance de cette sunna.
Aussi vaut-il mieux que le musulman n’abandonne pas la tasmiyah dans ses ablutions.
