السؤال

هل إذا فاتتني صلاة الضحى بعد الساعة الثانية عشرة ظهرًا أقضيها حتى ولو بعد صلاة الظهر ؟.

نص الجواب




الحمد لله
أولًا :
وقت الصلاة الضحى من ارتفاع الشمس قدر رمح ، وذلك بمضي ربع ساعة أو ثلث ساعة بعد طلوعها ، إلى قبيل الزوال " والزوال هو دخول وقت صلاة الظهر " ، وقبيل الزوال ما بين عشر دقائق إلى خمس دقائق فقط ، أي قبل دخول وقت النهي " مجموع فتاوى الشيخ ابن عثيمين رحمه الله" 14/306.
قال ابن مفلح رحمه الله : " ووقتها من خروج وقت النهي إلى الزوال , والمراد والله أعلم قبيل الزوال ؛ للنهي " انتهى من "الفروع" 1/567.
ثانيا :
اختلف أهل العلم في قضاء صلاة الضحى إذا فات وقتها ، فذهب بعضهم إلى أنها تقضى ، وهو الصحيح عند الشافعية ، وقال به بعض الحنابلة ، وذهب آخرون إلى عدم قضائها ، وهو قول الشافعي القديم ، ومذهب الحنفية والمالكية .
قال النووي رحمه الله في "المجموع" 3/532 " قال أصحابنا : النوافل قسمان - أحدهما - غير مؤقت وإنما يفعل لعارض كالكسوف والاستسقاء وتحية المسجد , فهذا إذا فات لا يقضى ( الثاني ) مؤقت كالعيد والضحى والرواتب مع الفرائض كسنة الظهر وغيرها ، فهذه فيها ثلاثة أقوال : الصحيح منها أنها يستحب قضاؤها , قال القاضي أبو الطيب وغيره : هذا القول هو المنصوص في الجديد .
والثاني : لا تقضى وهو نصه في القديم ، وبه قال أبو حنيفة .
والثالث : ما استقلّ كالعيد والضحى قُضي ، وما لا يستقل كالرواتب مع الفرائض فلا يقضى , وإذا -كانت - تقضى فالصحيح أنها تقضى أبدا . وحكى بعض أصحابنا قولاً ضعيفا أنه يقضي فائت النهار ما لم تغرب شمسه , وفائت الليل ما لم يطلع فجره , وعلى هذا تقضى سنة الفجر ما دام النهار باقيا ... وهذا الخلاف كله ضعيف والصحيح استحباب قضاء الجميع أبدا , ودليله قول الرسول صلى الله عليه وسلم " من نام عن صلاة أو نسيها فليصلها إذا ذكرها " وحديث أبي قتادة رضي الله عنه " أن النبي صلى الله عليه وسلم فاته الصبح في السفر حتى طلعت الشمس فتوضأ ثم صلى سجدتين ثم أقيمت الصلاة فصلى الغداة"رواه مسلم ، والمراد بالسجدتين صلاة السنة الراتبة التي قبل الفجر . وحديث أم سلمة رضي الله عنها أن النبي صلى الله عليه وسلم صلى ركعتين بعد العصر فسألته عن ذلك فقال " إنه أتاني ناس من عبد القيس بالإسلام من قومهم فشغلوني عن الركعتين اللتين بعد الظهر فهما هاتان الركعتان بعد العصر " رواه البخاري ومسلم ، وحديث أبي هريرة رضي الله عنه أن النبي صلى الله عليه وسلم قال " من لم يصل ركعتي الفجر حتى تطلع الشمس فليصلهما "رواه البيهقي بإسناد جيد , وعن أبى سعيد رضي الله عنه أن النبي صلى الله عليه وسلم قال " من نام عن وتره أو نسيه فليصل إذا ذكره " رواه أبو داود بإسناد حسن ... وعن عائشة رضي الله عنها أن النبي صلى الله عليه وسلم " كان إذا فاتته الصلاة من الليل من وجع أو غيره صلى من النهار ثنتي عشرة ركعة " رواه مسلم ... وفي المسألة أحاديث كثيرة غير ما ذكرتها وفي هذا أبلغ كفاية , وبالله التوفيق " انتهى باختصار وتصرف يسير .
وقال المرداوي في "الإنصاف" 2/191 " وقال الشيخ عبد القادر : له فعلها بعد الزوال , وإن أخرها حتى صلى الظهر قضاها ندبا – يعني استحبابًا - " انتهى .
وصرح الحنفية بأن السنن إذا فاتت لا يقضى منها إلا سنة الفجر إذا فاتت مع الفرض ، فإنها تقضى إلى الزوال . "الفتاوى الهندية" 1/112.
وإلى هذا ذهبت المالكية أيضا ، فلا يقضى عندهم نفل سوى ركعتي الفجر ، تقضى إلى الزوال ، سواء كان معها الصبح أم لا . "بلغة السالك" 1/408.

واختار الشيخ ابن عثيمين رحمه الله القول بأن صلاة الضحى لا تقضى إذا فات وقتها ، فقد سئل رحمه الله : إذا فاتت سنة الضحى هل تقضى أم لا ؟
فأجاب : " الضحى إذا فات محلها فاتت ؛ لأن سنة الضحى مقيدة بهذا ، لكن الرواتب لما كانت تابعة للمكتوبات صارت تقضى وكذلك الوتر لما ثبت في السنة " أن النبي صلى الله عليه وآله وسلم ، إذا غلبه النوم ، أو المرض في الليل صلى من النهار ثنتي عشرة ركعة " . فالوتر يقضى أيضا " انتهى من "مجموع فتاوى الشيخ ابن عثيمين" 14/305.
والأمر في ذلك واسع ، والحمد لله .

Should Duha prayer be made up if the time for it has ended?

Question

If I miss Duha prayer after twelve noon, should I make it up even if that it after Zuhr prayer?.



Answer




Praise be to Allaah. Firstly:
The time for Duha prayer is from when the sun has risen to the height of a spear, which is fifteen or twenty minutes after sunrise, until just before the sun passes its zenith (and the zenith is when the time for Zuhr prayer begins). What is meant by just before the sun passes its zenith is ten to fifteen minutes before it reaches the zenith, i.e. before the time when it is forbidden to pray begins. End quote. Majmoo’ Fataawa al-Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him), (14/306).
Ibn Muflih (may Allaah have mercy on him) said: The time for (Duha) is from when the time when it is forbidden to prays ends, until the sun reaches its zenith. What is meant – and Allaah knows best – is just before the sun passes its zenith, because it is forbidden to pray at that time. End quote from al-Furoo’ (1/5670.
Secondly:
The scholars differed with regard to making up Duha prayer if the time has ended. Some of them were of the view that it should be made up, and this is the correct view according to the Shaafa’is and some of the Hanbalis. Others were of the view that it should not be made up. This is the old view of al-Shaafa’i and of the Hanbalis and Maalikis.
Al-Nawawi (may Allaah have mercy on him) said in al-Majmoo’ (3/532): Our companions said: Naafil prayers are of two types, one that is not connected to a specific time and is only done for a reason such as eclipses, praying for rain and greeting the mosque. If it is missed, it cannot be made up. The second type is connected to a specific time, such as Eid prayer, Duha and regular Sunnah prayers that are offered with obligatory prayers, such as the Sunnah of Zuhr etc. There are three views concerning these, the correct view is that it is mustahabb to make them up. Al-Qaadi Abu’l-Tayyib and others said that this is the view that is stated in the new view (of al-Shaafa’i).
The second view is that they should not be made up. This was stated in the old view (of al-Shafaa’i), and it is the view of Abu Haneefah.
The third view is that independent prayers such as Eid and Duha should be made up, whereas prayers that are not independent such as the regular Sunnah prayers that are offered with obligatory prayers should not be made up. If they are made up then the correct view is that they should always be made up. Some of our companions narrated a weak view which is that missed prayers of the day may be made up so long as the sun has not set and missed prayers of the night may be made up so long as the sun has not risen. Based on this, the Sunnah of Fajr may be made up so long as it is still day… This is all weak (da’eef) and the correct view is that it is mustahabb to make up all prayers at all times. The evidence for that is the words of the Prophet (peace and blessings of Allaah be upon him): “Whoever sleeps and misses a prayer or forgets it, let him pray it when he remembers it.” And Abu Qataadah (may Allaah be pleased with him) narrated that the Prophet (peace and blessings of Allaah be upon him) missed Fajr prayer whilst travelling, until the sun had risen. So he did wudoo’ then he prayed two rak’ahs, then the iqaamah was given and he prayed Fajr prayer. What is meant by two rak’ahs here is the regular Sunnah prayer that comes before Fajr. And Umm Salamah (may Allaah be pleased with her) narrated that the Prophet (peace and blessings of Allaah be upon him) prayed two rak’ahs after ‘Asr and she asked him about that. He said: “Some people from ‘Abd al-Qays came to me with the news that their people had become Muslim and they distracted me from the two rak’ahs that come after Zuhr, so I did these two rak’ahs after ‘Asr.” Narrated by al-Bukhaari and Muslim. And Abu Hurayrah (may Allaah be pleased with him) narrated that the Prophet (peace and blessings of Allaah be upon him) said: “Whoever did not pray two rak’ahs of Fajr until the sun rose, let him pray them (now).” Narrated by al-Bayhaqi with a jayyid isnaad. And it was narrated from Abu Sa’eed (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “Whoever slept and missed Witr, or forgot it, let him pray it when he remembers.” Narrated by Abu Dawood with a hasan isnaad. And it was narrated from ‘Aa’ishah (may Allaah be pleased with her) that if the Prophet (peace and blessings of Allaah be upon him) missed praying at night because of pain or anything else, he would pray twelve rak’ahs during the day. Narrated by Muslim. There are many other ahaadeeth about this matter, apart from those which we have mentioned, but this is sufficient. And Allaah is the Source of strength. End quote.
Al-Mardaawi said in al-Insaaf (2/191): Shaykh ‘Abd al-Qaadir said: He may do it after the sun has passed its zenith, but if he delays it until he has prayed Zuhr, he may make it up. End quote.
The Hanafis stated that if the Sunnah prayers are missed, none of them should be made up except the Sunnah of Fajr, which should be made up if it is missed along with the obligatory prayer, and it may be made up until the sun reaches its zenith. Al-Fataawa al-Hindiyyah (1/112).
This is also the view of the Maalikis. In their view no naafil prayer should be made up except the two rak’ahs of Fajr, which may be made up until the sun reaches the zenith, whether the obligatory Fajr prayer was offered alongside it or not. Balghat al-Saalik (1/408).

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) favoured the view that Duha prayer should not be made up if the time for it has ended. He was asked: If the Sunnah prayer of Duha is missed, should it be made up or not?
He replied: If the time for Duha prayer is missed, then the prayer has been missed, because it is limited to that time. But with regard to the regular Sunnah prayers, because they are connected to the obligatory prayers, they may be made up alongside them. The same also applies to Witr, because it is proven in the Sunnah that if the Prophet (peace and blessings of Allaah be upon him) slept or was ill at night he would pray twelve rak’ahs during the day. And Witr may also be made up. End quote from Majmoo’ Fataawa al-Shaykh Ibn ‘Uthaymeen (14/305).
The matter is broad in scope, praise be to Allaah.

Si je n’ai pu accomplir la prière de milieu de matinée avant midi, dois-je la rattraper même après avoir effectué celle de Zuhr ?

Premièrement, le temps d’accomplissement de la prière de milieu de matinée commence dès que le soleil se lève l’espace d’une lance, c’est-à-dire un quart ou un tiers d’heure après son lever, et s’étend jusqu’à peu de temps avant l’inclinaison. C’est-à-dire l’entrée du temps d’accomplissement de la prière du zuhr. Peu de temps signifie entre 5 et 10 minutes ou avant le début du temps d’interdiction de la prière ».
Madjmou’fatawaCheikh Ibn 0uthaymine (Puisse Allah lui accorder Sa miséricorde).
Ibn Mouflouh (Puisse Allah lui accorder Sa miséricorde) dit : Le temps de cette prière s’étend de la fin du temps d’interdiction de la prière à l’inclinaison (zénith). L’on entend par là – Allah le sait mieux – peu avant le zénith, compte tenu de l’interdiction (de prier à ce moment) . Extrait d’al-Fourou’, 1/567.
Deuxièmement, il y a une divergence de vues au sein des ulémas au sujet de la question de savoir si on doit rattraper la prière de milieu de matinée après l’écoulement de son temps. Certains soutiennent la nécessité du rattrapage. C’est l’avis juste défendu par les Chafiites et une partie des Hanbalites. D’autres disent qu’elle ne doit pas être rattrapée. C’est le premier avis de Chafii et celui adopté par les Malikites et les Hanafites.
An-Nawawi (Puisse Allah lui accorder Sa miséricorde) dit dans al-Madjmou (3/532) : « nos condisciples disent : les prières surérogatoires sont de deux sortes. L’une n’a pas un temps déterminé, mais on la fait pour un événement. C’est le cas de l’éclipse (solaire/lunaire), la demande de pluie, le salut à la mosquée. Ces prières ne sont pas à rattraper après l’écoulement de leur temps. L’autre sorte de prière a un temps déterminé. C’est le cas de la prière des fêtes, la prière de milieu de matinée, les prières qui accompagnent régulièrement les prières prescrites comme celles faites avec le zuhr et d’autres. Cette sorte de prières fait l’objet de trois avis : l’avis juste est qu’il est recommandé de les rattraper. Al-Qadi Abou Tayyib et d’autres disent : c’est l’avis précisé dans le Nouveau (les derniers choix de Chaffi). Le deuxième avis est qu’on ne les rattrape pas. C’est l’avis exprimé dans l’Ancien (les anciens choix de Chaffi). C’est aussi l’avis d’Abou Hanifa. Le troisième avis est que les prières indépendantes, telles celles faites lors des Fêtes (religieuses) et de l’aurore, doivent être rattrapées. Quant à celles qui ne sont pas indépendantes comme les prières surérogatoires qui ne se séparent pas des prières obligatoires, on ne les rattrape pas. Les prières devant être rattrapées devront toujours être rattrapées.
Certains parmi nos condisciples ont rapporté un avis faible selon lequel ce qui est raté dans la journée doit être rattrapé tant que le soleil ne se sera pas couché. Et ce qui est raté dans la nuit doit être rattrapé tant que l’aube ne se sera pas annoncée. Sur la base de cet avis on doit rattraper les deux rak’a qui précède la prière du matin tant que le jour durera. Cette divergence de vues est faible, ce qui est juste étant donné la nécessité de tout rattraper. Cela s’atteste dans cette parole du Messager (bénédiction et salut soient sur lui) : Si quelqu’un dort à l’arrivée d’une prière ou l’oublie, qu’il l’accomplisse quand il s’en souviendra . Cela s’atteste encore dans le hadith d’Abou Qatada (P.A.a) selon lequel le Prophète (bénédiction et salut soient sur lui) avait raté la prière du matin au cours d’un voyage jusqu’au lever du soleil. Et il fit ses ablutions et effectua deux rak’as. Puis on annonça la prière du matin et il l’effectua ». (Rapporté par Mouslim).
Par deux rak’a on entend la prière régulière qui précède celle du matin. Cela s’atteste encore dans le hadith rapporté par Oum Salamata (P.A.a) selon lequel le Prophète (bénédiction et salut soient sur lui) effectua deux rakaa après la prière d’asr. Et quand elle l’interrogea à ce propos il dit : Une délégation des Abd al-Qays est venue me rapporter la conversion de leurs contribules. Ce qui m’a distrait de deux rak’aa à faire après le zuhr. Et je les ai faites après asr (rapporté par al-Boukhari et par Mouslim) . Cela s’atteste en plus dans le hadith d’Abou Hourayra (P.A.a) selon lequel le Prophète (bénédiction et salut soient sur lui) a dit : Si quelqu’un n’a pas accompli les deux raka’a de l’aube jusqu’au lever du soleil, qu’il les fasse (rapporté par al-Bayhaqui grâce à une bonne chaîne de rapporteurs).
D’après Abou Said (P.A.a) le Prophète (bénédiction et salut soient sur lui) a dit : Si quelqu’un dort de sorte à ne pouvoir accomplir ses prières surérogatoires nocturnes ou les oublie, qu’il les fasse quand il s’en souvient (rapporté par Abou Dawoud grâce à une bonne chaîne) . D’après Aïcha (P.A.a) quand le Prophète (bénédiction et salut soient sur lui) ne pouvait pas accomplir les prières nocturnes en raison d’une souffrance ou pour une autre cause, il effectuait 12 rak’a pendant le jour (rapporté par Mouslim). La question fait l’objet de nombreux hadith autres que ceux cités. Mais ce qui précède suffit. Allah est le garant de l’assistance ». Citation légèrement remaniée.
Dans al-Insaf (2/191) al-Mawardi dit : « Cheikh Abd al-Qadir dit : Il peut faire la prière à rattraper après le zénith. S’il en retarde le rattrapage après la prière du zuhr, il lui est recommandé de le faire à titre facultatif .
Les hanafites déclarent nettement que quand le temps d’accomplissement des prières surérogatoires est passé, elles ne doivent pas être rattrapées à l’exception de la prière qui précède celle du matin. Car si on la rate avec celle qu’elle précède, on doit la rattraper avant le zénith ». Al-Fatawa al-Hadiyya, 1/112).
C’est aussi l’avis des Malikites pour lesquels seule la prière qui précède celle du matin est à rattraper avant le zénith ; qu’elle soit ratée avec celle du matin ou seule ».Boulghat as-salik, 1/408.

Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) a choisi de dire que la prière de milieu de matinée n’est pas à rattraper après l’écoulement de son heure. Interrogé sur la question, il a répondu en ces termes : Si le temps d’accomplissement de la prière de milieu de matinée est fini ; elle ne peut plus être rattrapée parce que cette prière est liée à cette circonstance. Quant aux prières qui accompagnent régulièrement les prières prescrites, on les rattrape comme on le fait de la prière nocturne dite witr parce qu’il est rapporté de façon sûre dans la Sunna que quand le sommeil ou la maladie gagnaient le Prophète (bénédiction et salut soient sur lui) dans la nuit, il effectuait pendant le jour une prière de 12 rak'a.
