If a person does not fast six days in Shawwaal, can he fast them in Dhu’l-Qa’dah?

Celui qui 'a pas pu jeûner six jours de Shawwal, peut il jeûner six jours de Dhoul Qu'ada?

السؤال

امرأة صامت أربعة من الأيام الست في شوال ثم جاءها الحيض في نهاية شوال ولم تكمل الست ، ولم يبق لها سوى يومين ، هل تستطيع أن تكمل الست من شوال بعد شوال أم لا ؟

نص الجواب





الحمد لله
روى مسلم في صحيحه (1164) عَنْ أَبِي أَيُّوبَ الْأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : ( مَنْ صَامَ رَمَضَانَ ثُمَّ أَتْبَعَهُ سِتًّا مِنْ شَوَّالٍ كَانَ كَصِيَامِ الدَّهْرِ ).
وظاهر الحديث أن تحصيل هذا الأجر إنما يكون لمن صام الست في شوال .
واختلف أهل العلم فيمن صام الست في غير شوال ، لعذر أو غيره ، هل يحصل له فضيلة صومها في شوال ، على أقوال :
القول الأول :
ذهب جماعة من المالكية وبعض الحنابلة إلى أن الفضيلة تحصل لمن صام ستة أيام في شوال أو بعده ، وأن الحديث إنما ذكر شوال من باب التيسير على المكلف ، لأن صومها بعد رمضان أسهل من صومها بعد ذلك .
قال العدوي في حاشيته على شرح الخرشي : 2/243 " وإنما قال الشارع " من شوال" للتخفيف باعتبار الصوم ، لا تخصيص حكمها بذلك الوقت ، فلا جرم أن فعلها في عشر ذي الحجة مع ما روي في فضل الصيام فيه أحسن ؛ لحصول المقصود مع حيازة فضل الأيام المذكورة , بل فعلها في ذي القعدة حسن أيضا , والحاصل : أن كل ما بعد زمنه كثر ثوابه لشدة المشقة " انتهى .
ونقل في "تهذيب فروق القرافي" لمحمد بن علي بن حسين مفتي المالكية بمكة ، المطبوع مع الفروق:2/191: عن ابن العربي المالكي أن قوله صلى الله عليه وسلم "من شوال""على جهة التمثيل ، والمراد : أن صيام رمضان بعشرة أشهر ، وصيام ستة أيام بشهرين ، وذلك المذهب -يعني مذهب الإمام مالك- فلو كانت من غير شوال لكان الحكم فيها كذلك ، قال : وهذا من بديع النظر فاعلموه" انتهى .
وقال ابن مفلح رحمه الله في "الفروع" 3/108" ويتوجه احتمال : تحصل الفضيلة بصومها في غير شوال , وفاقا لبعض العلماء , ذكره القرطبي , لأن فضيلتها كون الحسنة بعشر أمثالها , كما في خبر ثوبان , ويكون تقييده بشوال لسهولة الصوم لاعتياده رخصة , والرخصة أولى" انتهى .
ونقله صاحب الإنصاف وتعقبه بقوله : " قلت : وهذا ضعيف مخالف للحديث , وإنما ألحق بفضيلة رمضان لكونه حريمه , لا لكون الحسنة بعشر أمثالها ; ولأن الصوم فيه يساوي رمضان في فضيلة الواجب " انتهى من "الإنصاف" 3/344.
القول الثاني :
ذهب جماعة من الشافعية إلى أن من فاته صيام ست من شوال قضاها في ذي القعدة .
لكن ثوابها يكون دون ثواب من صامها في شوال ، فمن صام رمضان وأتبعه بست من شوال كان له ثواب صيام سنةٍ فرضا ، بخلاف من صام رمضان وستة من غير شوال ، فهذا له ثواب رمضان وثواب ستة أيام نفلا .
قال ابن حجر المكي في "تحفة المحتاج" 3/456 " من صامها مع رمضان كل سنة تكون كصيام الدهر فرضا بلا مضاعفة ، ومن صام ستةً غيرها كذلك تكون كصيامه نفلا بلا مضاعفة" انتهى .
القول الثالث :
أنه لا تحصل فضيلتها إلا بصومها في شوال ، وهو مذهب الحنابلة .
قال في "كشاف القناع" 2/338 " ولا تحصل الفضيلة بصيامها أي : الستة أيام في غير شوال ، لظاهر الأخبار" انتهى .
لكن يرجى لمن صام بعضها ولم يكملها لعذر أن ينال أجرها وفضيلتها .
قال الشيخ ابن باز رحمه الله " ولا يشرع قضاؤها بعد انسلاخ شوال ؛ لأنها سنة فات محلها ، سواء تركت لعذر أو لغير عذر " .
وقال فيمن صامت أربعة أيام من شوال ولم تكمل الست لبعض الظروف : " صيام الأيام الستة من شوال عبادة مستحبة غير واجبة ، فلك أجر ما صمت منها ، ويرجى لك أجرها كاملة إذا كان المانع لك من إكمالها عذراً شرعياً ؛ لقول النبي صلى الله عليه وسلم " إذا مرض العبد أو سافر كتب الله له ما كان يعمل مقيماً صحيحًا " رواه البخاري في صحيحه . وليس عليك قضاء لما تركت منها . والله الموفق " انتهى من "مجموع فتاوى الشيخ ابن باز" 15/389 ، 395.
والحاصل :
أن صيام الست من غير شوال ، من أهل العلم من رآه كصيامها في شوال ، ومنهم من أثبت لها فضلا لكن دون فضل الست في شوال . ومنهم من رجي الثواب لمن لم يكملها لعذر ، وفضل الله واسع ، وعطاؤه لا منتهى له ، فلو أن هذه الأخت صامت يومين من ذي القعدة عِوضًا عما فاتها من شوال ، كان ذلك حسنًا ، ويُرجَى لها الثواب والأجر إن شاء الله .

Question

A woman fasted four of the six days of Shawwaal, then her period came at the end of Shawwaal and she did not complete the six days. She only has two days left. Can she complete the six days of Shawwaal after Shawwaal or not?.

Praise be to Allaah. Muslim narrated in his Saheeh (1164) from Abu Ayyoob al-Ansaari (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Whoever fasts Ramadaan then follows it with six days of Shawwaal, it is as if he fasted a lifetime.”
The apparent meaning of the hadeeth is that this reward can be attained only by the one who fasts six days in Shawwaal.
The scholars differed concerning one who fasts the six days at a time other than Shawwaal, whether that is due to an excuse or not. Does he attain the virtue of fasting them in Shawwaal or not? There are two views.
(i)
A number of Maalikis, and some Hanbalis are of the view that this virtue may be attained by the one who fasts six days in Shawwaal and afterwards, and that the hadeeth only mentioned Shawwaal in order to make things easier, because fasting them after Ramadaan is easier than doing it later on.
Al-‘Adawi said in his commentary on Sharh al-Khurashi (2/243): The Lawgiver only mentioned Shawwaal in order to make it easier with regard to fasting, not to restrict the ruling to that time only. No doubt doing it in the first ten days of Dhu’l-Hijjah along with what was narrated concerning the virtue of fasting at that time is better, because the purpose is achieved in addition to the extra reward for fasting on virtuous days. Doing it in Dhu’l-Qa’dah is also good. To sum up: The later you fast them, the greater the reward because it is more difficult. End quote.
It was narrated in Tahdheeb Furooq al-Quraafi by Muhammad ibn ‘Ali ibn Husayn, the mufti of the Maalikis in Makkah, and printed with al-Furooq (2/191), from Ibn al-‘Arabi al-Maaliki, that the words of the Prophet (peace and blessings of Allaah be upon him) “in Shawwaal” are mentioned by way of example, and that what is meant is that fasting Ramadaan counts as ten months, and fasting six days of Shawwaal counts as two months, and that is the view of the madhhab of Imam Maalik. If that is at a time other than Shawwaal then the ruling is the same. He said: This is very smart so learn it. End quote.
Ibn Muflih said in al-Furoo’ (3/108): It is possible that the reward may be attained even when fasting them at a time other than Shawwaal, according to some scholars. This was mentioned by al-Qurtubi, because the virtue of that is based on the fact that one good deed (hasanah) will be rewarded tenfold, as it says in the report of Thawbaan. And the recommendation of fasting in Shawwaal is because it is easier to fast as one is already used to fasting, and this is a kind of dispensation, and it is more appropriate to avail oneself of the dispensation.
It was also quoted by the author of al-Insaaf, who commented on it by saying: I say: This view is weak and is contrary to the hadeeth. Rather it is connected to the virtue of Ramadaan because it comes immediately after it and not because the good deed is rewarded tenfold, and because fasting them is equal to the obligatory fast of Ramadaan in virtue. End quote from al-Insaaf (3/344).
(ii)
A number of the Shaafa’is were of the view that a person who does not fast six days in Shawwaal can make it up in Dhu’l-Qa’dah, but the reward will be less than that of the one who fasts them in Shawwaal. The person who fasts Ramadaan and follows it with six days of Shawwaal will have the reward of fasting a whole year of obligatory fasts, unlike the one who fasts Ramadaan and six days other than in Shawwaal. He will have the reward of Ramadaan and the reward of six naafil days.
Ibn Hajar al-Makki said in Tuhfat al-Muhtaaj (3/456): If a person fasts them along with Ramadaan every year, it will be like observing obligatory fasts for a lifetime, without multiplying the reward. If he fasts six other days, it will be like observing naafil fasts, without multiplying the reward. End quote.
(iii)
He can only attain this virtue by fasting them in Shawwaal. This is the view of the Hanbalis.
It says in Kashshaaf al-Qinaa’ (2/338): The virtue of fasting them – i.e., the six days of Shawwaal – cannot be attained at any time other than Shawwaal, because of the apparent meaning of the reports. End quote.
But there is the hope that the person who fasted some of them and could not complete them because of an excuse will attain the reward and virtue thereof.
Shaykh Ibn Baaz (may Allaah have mercy on him) said: It is not prescribed to make them up after the end of Shawwaal, because they are Sunnah and the time for them has passed, whether one missed them for an excuse or otherwise.
He said concerning one who fasted four days in Shawwaal and did not complete six because of circumstances: Fasting the six days of Shawwaal is a mustahabb act of worship but is not obligatory; but you will have the reward of whatever you fast of them, and there is the hope of a complete reward if there was a legitimate shar’i excuse for not completing them, because the Prophet (peace and blessings of Allaah be upon him) said: “If a person falls sick or travels, Allaah will decree for him (the reward of) what he used to do when he was not travelling and was healthy.” Narrated by al-Bukhaari in his Saheeh. So you do not have to make up what you did not do. And Allaah is the Source of strength. End quote from Majmoo’ Fataawa al-Shaykh Ibn Baaz (15/389, 395).
To sum up:
Fasting six days at a time other than Shawwaal: some scholars regarded that as being like fasting them in Shawwaal, and some stated that there is virtue therein but it is less than the virtue of fasting six days in Shawwaal. And some scholars hope for the reward for the one who is not able to complete six days because of an excuse. The bounty of Allaah is great and His generosity knows no end. If this sister fasted two days in Dhu’l-Qa’dah to make up for what she missed of Shawwaal, that is good, and there is the hope that she will be rewarded in sha Allaah.

Question

Voici une femme qui, après avoir jeûné quatre jours de Shawwal, a vu ses règles à la fin dudit mois et n'a pu terminer le jeûne des six jours. Peut elle terminer le jeûne après Shawwal?

Mouslim a rapporté dans son Sahih (1164) d'après Abou Ayyou al-Ansari (P.A.a) que le Messager d'Allah (bénédiction et salut soient sur lui) a dit: Quiconque jeûne le Ramadan et y ajoute six jours de Shawwal est comme quelqu'un qui a jeûné tout le temps. Ce hadith signifie apparemment que la récompense n'est accorde qu'à celui qui a effectué le jeûne en Shawwal.D'où une divergence de vues au sein des ulémas à propos de celui qui fait le jeûne dans un autre mois, avec ou sans excuse. Il s'agit de savoir si un tel jeûne a la même valeur que celui effectué en Shawwal.Il y a plusieurs opinions sur la question.
La première est celle d'un groupe de Malékites et certains hanbalites selon lesquels le mérite est accordé aussi bien à celui qui effectue le jeûne en Shawwal qu'à celui qui le fait après ce mois car le hadith n'a spécifié Shawwal que pour faciliter le jeûne aux concernés. Car il est bien plus facile de l'effectuer immédiatement après le Ramadan que plus tard.
Dans ses notes sur le commentaire d'al-Kharashi (2/243),al-Adwi dit : «» Le législateur a dit : Shawwal pour atténuer le jeûne. Mais il n'entend nullement limiter le jeûne à ce mois. Cependant, effectuer le jeûne au cours des dix premiers jours de Dhoul Hidjdja (12e mois lunaire) dont le jeûne est déclaré particulièrementméritoire, est mieux. Car jeûner en ce temps permet d'atteindre un double objectif. Mieux, effectuer le jeûne dans Dhoul Quaada est aussi bon. En somme, plus le jeûne est éloigné de celui duRamadan, plus méritoire il est».
Dans Tahdhib al-Fourouq d'al-Qarafi, Muhammad ibn Ali ibn al-Houssayn, le mufti malékite de La Mecque, ditdans son commentaire de Fourouq al-Qarafi (vol.2/ 191) imprimé en marge de cet ouvrage, en citant Ibn al-Arabi al-Makki que la parole du Prophète (bénédiction et salut soient sur lui) : De Shawwal a valeur d'exemple. Car il sous-entend que la récompense du jeûne du Ramadan est multipliée par 10 comme celle des six jours. Voilà ce qu'enseigne l'école malékite. Si le jeûne était effectué en dehors de Shawwal, il garderait le même statut… Il dit encore: C'est une magnifique déduction à méditer».
Dans al-Fourou' (3/108) Ibn al-Mouflih dit : Il est fort probable que le mérite du jeûne des six jours s'obtient en dehors de Shawwal selon l'avis de certains ulémas cité par al-Qurtubi.Ce mérite consiste dans la multiplication par dix de la récompense, comme le confirme le hadith rapporté par Thawban.Le lien entre le jeûne et le mois de Shawwal n'imliquequ'une dispense qui s'explique par la facilité de l'acte en ce moment à cause de l'habitude acquise. L'utilisation de cette dispense est plus indiquée. Après avoir cité cet avis, l'auteur de l'Insaf le critique en ces termes: « C'est faible et contraire au hadith. L'assimilation de ce jeûne à celui du Ramadan est dûe au fait qu'il en constitue le prolongement et pas au fait qu'une bonne action est multipliée par dix à la récompense. Le fait de jeûner en Shawwal a la même valeur que le jeûne obligatoire«». Extrait de l'Insaf (3/344)
Le deuxième avis est celui d'un groupe de chafiites selon lequel si quelqu'un n'a pas pu jeûner en Shawwal, il peut le rattraper en Dhoul Qa'ada.Mais alors, la récompense est inférieure à celle du jeûne effectué en Shawwal. Quiconque jeûne le Ramadan et y ajoute six jours de Shawwal obtient la récompense d'un jeûne obligatoire d'un an.Celui qui jeûne le Ramadan et y ajoute six jours en dehors de Shawwal aura la récompense d'un jeûne obligatoire pour le Ramadan et celle d'un jeûne surérogatoire pour les six jours.
Dans Touhfat al-Mouhtadj (3/456) Ibn Hadjar al-Makki dit : « Celui qui jeûne les six jours après le Ramadan chaque année est comme quelqu'un qui a observé un jeûne obligatoire tout le temps sans une récompense décuplée. Celui qui jeûne les six jours en dehors de Shawwal sera considéré comme quelqu'un qui a effectué un jeûne surérogatoire dont la récompense ne fait pas l'objet d'une multiplication.
Le troisième avis est que le mérite lié au jeûne ne s'obtient que si on le fait en Shawwal. C'est l'avis des hanbalites. L'auteur de Kashf al-Qinaa (2/338) dit : Le mérite du jeûne n'est accordé qu'à celui qui l'observe en Shawwal , compte tenu du sens apparent des hadith.
Cependant, l'on espère que celui en jeûne une partie et ne les complète pas à cause d'une excuse en sera récompensé».
Cheikh Ibn Baz (Puisse Allah lui accorder Sa miséricorde) dit : On ne les rattrape pas après l'écoulement de Shawwal car leur jeûne est une sunna dont le temps est alors dépassé. Qu'on les néglige pour ou sans excuse.
Ibn Baz dit à une femme ayant jeûné quatre jours de Shawwal sans pouvoir les porter à six en raison de certaines circonstances «jeûner six jours de Shawwal est une pratique cultuelle recommandée non obligatoire. Vous serez récompensée pour le jeûne effectué. On espère que vous le serez pour le reste parfaitement, si ce qui vous a empêché de continuer constitue une excuse légale .En effet,le Prophète (bénédiction et salut soient sur lui) a dit : Quand un fidèle est malade ou en voyage, on lui inscrit (en termes de récompense) ce qu'il faisait quand il était sain et fixe. (Rapporté par al-Boukhari dans son Sahih) Vous n'avez à effectuer aucun rattrapage pour ce que vous avez abandonné. Allah est le garant de l'assistance. En somme, certains ulémas estiment que jeûner les six jours en dehors de Shawwal a la même valeur que leur jeûne dans ce mois. D'autres reconnaissent un mérite au jeune effectué en dehorsde ce mois, mais le considèrent comme inférieur. D'autres enfin espèrent une récompense pour celui qui a commencé le jeûne en Shawwal et n'a pas pu le compléter en raison d'une excuse. La grâce divine reste immense et les dons d'Allah inépuisables.
Si la sœur en question jeûnait deux jours de Dhoul Qaada en remplacement des jours manqués en Shawwal, elle ferait bien. On espèrerait qu'elle obtiendra une généreuse récompense, s'il plait à Allah.
Allah le sait mieux.
