السؤال

إنسان عزم على السفر فنوى الفطر من الغد ، ثم بعد طلوع الفجر ألغى السفر قبل أن يأتي بأي مفطر ، ما حكم ذلك ؟.
نص الجواب




الحمد لله
دلت الأدلة من الكتاب والسنة والإجماع على أن للمسافر أن يفطر في رمضان ، ثم يقضي عدد الأيام التي أفطرها ، قال الله تعالى " وَمَنْ كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ " البقرة/185 .
ومن كان في بلده ، ثم عزم على السفر ، فلا يسمى مسافرا حتى يفارق عمران بلده . فلا يحل له أن يأخذ برخص السفر كالفطر والقصر بمجرد نية السفر ، لأن الله تعالى إنما أباح الفطر للمسافر ، ولا يكون مسافرا حتى يفارق بلده .
قال ابن قدامة في "المغني" 4/347. بعد أن ذكر أن من سافر أثناء اليوم فله الفطر ، قال :
" إذا ثبت هذا ؛ فإنه لا يباح له الفطر حتى يُخَلِّف البيوتَ وراء ظهره , يعني أنه يجاوزها ويخرج من بين بنيانها . وقال الحسن : يفطر في بيته , إن شاء , يوم يريد أن يخرج . وروي نحوه عن عطاء . قال ابن عبد البر : قول الحسن قول شاذ , وليس الفطرُ لأحدٍ في الحضرِ في نظرٍ ولا أثر . وقد روي عن الحسن خلافه " .
ثم قال ابن قدامة " لقول الله تعالى " فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ " البقرة/185 . وهذا شاهد- أي حاضر لم يسافر- , ولا يوصف بكونه مسافرًا حتى يخرج من البلد , ومهما كان في البلد فله أحكام الحاضرين , ولذلك لا يقصر الصلاة " انتهى
وسئل الشيخ ابن عثيمين : عن رجل نوى السفر فأفطر في بيته لجهله ، ثم انطلق ، هل عليه الكفارة ؟
فأجاب : " حرام عليه أن يفطر وهو في بيته ، ولكن لو أفطر قبل مغادرته بيته فعليه القضاء فقط " انتهى . "فتاوى الصيام" ص 133 .
وقال في "الشرح الممتع" 6/218 :
" جاءت السنة والآثار عن الصحابة رضي الله عنهم أنه إذا سافر في أثناء اليوم فله الفطر ، ولكن هل يشترط أن يفارق قريته ؟ أو إذا عزم على السفر وارتحل فله أن يفطر ؟
الجواب : في هذا قولان عن السلف .
ذهب بعض أهل العلم إلى جواز الفطر إذا تأهب للسفر ولم يبق عليه إلا أن يركب ، وذكروا ذلك عن أنس رضي الله عنه أنه كان يفعله ، وإذا تأملت الآية وجدت أنه لا يصح هذا ؛ لأنه إلى الآن لم يكن على سفر فهو الآن مقيم وحاضر ، وعليه ؛ فلا يجوز له أن يفطر إلا إذا غادر بيوت القرية . . .
فالصحيح أنه لا يفطر حتى يفارق القرية ، ولذلك لا يجوز أن يقصر الصلاة حتى يخرج من البلد ، فكذلك لا يجوز أن يفطر حتى يخرج من البلد " انتهى باختصار تصرف يسير .
وبناء على ذلك ، فمن عزم على السفر ليلا ، فلا يجوز له أن يصبح مفطرا ، بل يلزمه أن ينوي الصوم ، فإن أصبح وسافر ، جاز له الفطر بعد مفارقة بلده .
والحاصل : أن من نوى الفطر من الليل بحجة أنه سيسافر غدا ، فقد أخطأ . ويلزمه قضاء يوم مكان ذلك اليوم ، حتى لو فرض أنه لم يسافر ؛ لأنه لم ينو الصيام من الليل ، وقد قال النبي صلى الله عليه وسلم " مَنْ لَمْ يُجْمِعْ الصِّيَامَ قَبْلَ الْفَجْرِ فَلَا صِيَامَ لَهُ "رواه أبو داود :2454. والترمذي :730. وصححه الألباني في صحيح أبي داود . ويلزمه في حالة عدم السفر أن يمسك عن المفطرات بقية اليوم ، احتراما للشهر ، لأنه أفطر من غير عذر شرعي .

فعلى السائل أن يستغفر الله ويتوب إليه مما فعل ، ويقضي ذلك اليوم .

Question

A man decided to travel and he intended not to fast the following day, then after dawn came, he changed his mind and decided not to travel, before he did anything that breaks the fast. What is the ruling in this case?.
Answer




Praise be to Allaah. The evidence from the Qur’aan and Sunnah and scholarly consensus indicates that the traveller is allowed not to fast during Ramadaan, then he should make up the number of days that he missed. Allaah says (interpretation of the meaning):
“and whoever is ill or on a journey, the same number [of days which one did not observe Sawm (fasts) must be made up] from other days”
[al-Baqarah 2:185]
If a person is in his hometown, then he decides to travel, he is not regarded as being a “traveller” until he has left the built-up area of his town. So it is not permissible for him to avail himself of the concessions granted to travellers, such as not fasting and shortening the prayer, when he has merely formed the intention of travelling. Rather Allaah has permitted the one who is travelling to break the fast, and he is not travelling until he has left his town.
Ibn Qudaamah said in al-Mughni (4/347), after stating that one who travels during the day may break the fast:
Once this is established, it is not permissible for him to break the fast until he has left the houses behind, i.e., he has gone past them and has left the buildings behind. Al-Hasan said: He may break the fast in his house, if he wishes, on the day that he intends to leave. Something similar was narrated from ‘Ata’. Ibn ‘Abd al-Barr said: The view of al-Hasan is odd; no one is allowed to break the fast when not travelling, and there is no evidence for that, either rationally or in the reports. A different opinion was also narrated from al-Hasan.
Then Ibn Qudaamah said: Because Allaah says (interpretation of the meaning):
“So whoever of you sights (the crescent on the first night of) the month (of Ramadan i.e. is present at his home), he must observe Sawm (fasts) that month”
[al-Baqarah 2:185]
The one who is present and sights the moon is not regarded as being a traveller until he has left the town. So long as he is still in the town, the rulings on those who are there and not travelling still apply to him. Hence he should not shorten his prayer. End quote.
Shaykh Ibn ‘Uthaymeen was asked about a man who intended to travel and broke his fast in his house, because he was unaware of the ruling, then he set out. Does he have to offer any expiation?
He replied: It is haraam for him to break the fast when he is in his house, but if he broke the fast before leaving his house, then he only has to make up the day. End quote, from Fataawa al-Siyaam, p. 133.
He said in al-Sharh al-Mumti’ (6/218):
The Sunnah and reports from the Sahaabah (may Allaah be pleased with them) indicate that if a person travels during the day, he may break the fast, but is it essential that he leave his town first? Or once he decides to travel and gets into his means of transportation is he allowed to break the fast?
The answer is that two views have been narrated from the salaf.
Some of the scholars are of the view that it is permissible to break the fast once he is ready to travel and there is nothing left to do but get into the means of transportation. They narrated that this is what Anas (may Allaah be pleased with him) used to do. But if you study the verse you will see that this is not correct, because up till now he has not started to travel and he is still a resident and non-traveller. Based on this, it is not permissible for a person to break the fast until he has left the houses of the town behind.
The correct view is that he should not break the fast until he has left the village. Hence it is not permissible to shorten the prayer until one has left the town, and it is not permissible to break the fast until one has left the town. End quote.
Based on that, if a person decides at night that he is going to travel, it is not permissible for him to start the day not fasting, rather he must form the intention to fast, then if he travels in the morning, he may break the fast after leaving his town.
Conclusion: if a person decides at night that he is not going to fast on the basis that he is going to travel the next day, he has made a mistake, and he has to make up that day, even if we assume that he did not travel, because he did not have the intention to fast from the night before, and the Prophet (peace and blessings of Allaah be upon him) said: “Whoever does not intend to fast from before dawn, there is no fast for him (i.e., his fast does not count).” Narrated by Abu Dawood, 2454’ al-Tirmidhi, 730; classed as saheeh by al-Albaani in Saheeh Abi Dawood.
In the event that he does not travel, he must refrain from everything that breaks the fast for the rest of the day, out of respect for the month, because he has broken the fast without a legitimate shar’i excuse.

The questioner has to seek Allaah’s forgiveness and repent to Him from what he has done, and he has to make up that day.

Question

Voici une personne qui a nourri l’intention de ne pas jeûner le lendemain pour un voyage qu’il avait décidé d’entreprendre…Mais il a annulé le voyage après l’entrée de l’aube et avant qu’il ne puisse commettre un acte de nature à rompre le jeûne. Comment juger son cas ?

Louanges à Allah
Des arguments tirés du livre saint, de la sunna et du consensus indiquent qu’il est donné au voyageur la possibilité de ne pas jeûner les jours de Ramadan et de procéder plus tard à un jeûne de rattrapage pour remplacer les jours non jeûnés. A ce propos Allah Très Haut dit : (Ces jours sont) le mois de Ramadân au cours duquel le Coran a été descendu comme guide pour les gens, et preuves claires de la bonne direction et du discernement. Donc, quiconque d' entre vous est présent en ce mois, qu' il jeûne! Et quiconque est malade ou en voyage, alors qu' il jeûne un nombre égal d' autres jours. - Allah veut pour vous la facilité, Il ne veut pas la difficulté pour vous, afin que vous en complétiez le nombre et que vous proclamiez la grandeur d' Allah pour vous avoir guidés, et afin que vous soyez reconnaissants! (Coran, 2 :185)
Celui qui prend la décision de voyager tout en restant chez lui ne peut être considérer comme un voyageur que quand il quitte sa localité. Avant cela, il ne peut pas bénéficier des dispenses liées au voyage tels le raccourcissement des prières à quatre rakaa et la rupture du jeûne pour la seule existence chez lui de l’intention de voyager. Car Allah Très Haut n’a donné l’autorisation de ne pas observer le jeûne qu’au voyageur qui est réellement en voyage pour avoir quitté son lieu de résidence dans ce but. Apres avoir mentionné que celui qui a effectué un voyage pendant un jour a le droit de ne pas jeûner, Ibn al Qudama dit dans al-Moughni, 4/347 : Cela étant, le voyageur n’est autorisé à abandonner le jeûne que quand il dépasse les habitations de son lieu de résidence. C'est-à-dire qu’il faut quitté complètement la localité.
Selon Al-Hassan, le voyageur, décidé à partir incessamment, peut rompre le jeûne, même chez lui. Un avis similaire est rapporté d’Ata. Ibn Abd al-Barr a dit :L'avis de Hassan est rare.Car aucun argument rationnel ou d’autorité ne permet à un résident de ne pas jeûner.Le contraire de l’avis (incriminé) a été rapporté du même Hassan. Ibn Qudama ajoute : c’est en raison de la parole du Très Haut : Et quiconque est malade ou en voyage… (Coran, 2 :185).Or celui qui est encore chez lui n’a pas voyagé. Et on ne pourra le qualifier de voyageur que quand il aura quitté sa ville. C’est pourquoi on ne lui permet pas de raccourcir la prière.
Cheikh Ibn Outtaymine a été interrogé à propos du cas d’un homme qui, ayant nourri l’intention de voyager, s’est abstenu, tout en restant chez lui, d’observer le jeûne. Et puis, il est parti.. Doit il procéder à l’expiation ?
Voici sa réponse : Il lui est interdit de s’abstenir de jeûner tout en étant chez lui. Mais s’il rompt le jeûne au moment de quitter sa maison, il n’aura qu’à effectuer un jeûne de rattrapage….Fatawa as-siyam, p.133.
L’auteur du charh al-mumti, (6/218) dit :« la Sunna et des traditions rapportées des compagnons (P.A.a) indiquent que celui qui entreprend un voyage au cours d’un jour de jeûne est autorisé à ne pas l’observer…Mais faut il qu’il se mette effectivement en mouvement de sorte à quitter son village ? Ou suffit-il qu’il se décide à voyager et s’y apprête pour avoir le droit de ne pas jeûner ?
La réponse est que deux avis sont rapportés des ancêtres pieux sur la question. Certains ulémas soutiennent que le voyageur est autorisé à ne pas jeûner dés qu’il s’apprête à partir et va s’installer sur sa monture. Ces ulémas ont rapporté qu’Anas (P.A.a) agissait ainsi. Mais si on réfléchit bien sur le verset susmentionné, on s’aperçoit qu’il est incontestable qu'on peut l’interpréter dans ce sens. Car la personne en question n’est pas encore en voyage ; elle est toujours résidente. De ce fait, elle ne sera autorisée à ne pas jeûner que quand elle aura quitté les habitations du village. Ce qui est juste c’est qu’il ne s’abstient du jeûne que quand elle aura quitté le village. Voila pourquoi, il ne lui est permis de raccourcir la prière que quand il aura quitté la localité…De la même manière, il ne lui est permis de s’abstenir de jeûner que quand elle aura quitté la localité »
Cela étant, celui qui prend au cours de la nuit la décision de voyager n’est pas autorisé à entrer dans la matinée sans jeûner. Car il faut qu’il nourrisse l’intention de jeûner. S’il voyage au matin, il peut ne plus observer le jeûne dés qu’il quitte sa localité.
En somme, celui qui nourrit au cours de la nuit l’intention de ne pas jeûner le lendemain pour cause de voyage commet une erreur. Et il doit jeûner un jour de rattrapage à la place de ce jour là, même s’il ne voyageait plus. Car il n’a pas nourri l’intension de jeûner depuis la veille. Or le prophète (bénédiction et salut soient sur lui) a dit : Celui qui na pas nourri l’intention de jeûner avant l’aube ne peut pas jeûner le lendemain valablement (rapporté par Abou Dawoud, 2454 et par at-Tirmidhi, 730 et déclaré authentique par al Albani dans Sahihi Abou Dawoud.
L’intéressé devrait, au cas où il ne voyageait pas, s’abstenir de tout ce qui rompt le jeûne pour le reste de la journée par respect pour le mois et parce qu’il a invalidé son jeûne sans excuse légale. Voir ach-charh al-mumti, 6/209
L’auteur de la question doit demander pardon à Allah, se repentir pour l’acte qu’il a commis et rattraper le jeûne du jour en question. Allah le sait mieux.
