السؤال
لماذا لا يتوحد المسلمون في الصيام مع أن هلال رمضان واحد ؟ وقديمًا يعذرون لعدم وجود وسائل الإعلام .

الحمد لله
أولًا : السبب الغالب في اختلاف بدء الصيام من بلد لآخر ، هو اختلاف مطالع الأهلة . واختلاف المطالع أمر معلوم بالضرورة حسًّا وعقلًا .
وعليه فلا يمكن إلزام المسلمين بالصوم في وقت واحد ، لأن هذا يعني إلزام جماعة منهم بالصوم قبل رؤية الهلال ، بل قبل طلوعه .

وقد سُئل الشيخ ابن عثيمين رحمه الله عمن ينادي بتوحيد الأمة في الصيام ، وربط المطالع كلها بمطالع مكة ، فقال :

" هذا من الناحية الفلكية مستحيل ؛ لأن مطالع الهلال كما قال شيخ الإسلام ابن تيمية رحمه الله تختلف باتفاق أهل المعرفة بهذا العلم ، وإذا كانت تختلف فإن مقتضى الدليل الأثري- أي الشرعي- والنظري أن يجعل لكل بلد حُكْمه .

أما الدليل الأثري- أي الشرعي- قال الله تعالى " فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ " البقرة/185. فإذا قُدِّرَ أن أُناسًا في أقصى الأرض ما شهدوا الشهر -أي : الهلال - وأهل مكة شهدوا الهلال ، فكيف يتوجه الخطاب في هذه الآية إلى من لم يشهدوا الشهر ؟! وقال النبي صلى الله عليه وسلم " صُومُوا لِرُؤْيَتِهِ ، وَأَفْطِرُوا لِرُؤْيَتِهِ " متفق عليه ، فإذا رآه أهل مكة مثلًا فكيف نُلزم أهلَ باكستان ومن وراءهم من الشرقيين بأن يصوموا ، مع أننا نعلم أن الهلال لم يطلع في أفقهم ، والنبي صلى الله عليه وسلم علق ذلك بالرؤية .

أما الدليل النظري فهو القياس الصحيح الذي لا تُمْكن معارضته ، فنحن نعلم أن الفجر يطلع في الجهة الشرقية من الأرض قبل الجهة الغربية ، فإذا طلع الفجر على الجهة الشرقية ، فهل يلزمنا أن نمسك ونحن في ليل ؟ الجواب : لا . وإذا غربت الشمس في الجهة الشرقية ، ولكننا نحن في النهار فهل يجوز لنا أن نفطر ؟ الجواب : لا . إذًا الهلال كالشمس تمامًا ، فالهلال توقيته توقيت شهري ، والشمس توقيتها توقيت يومي ، والذي قال " وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ " البقرة/187 . هو الذي قال"فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ"البقرة/185.فمقتضى الدليل الأثري والنظري أن نجعل لكل مكانٍ حكمًا خاصًّا به فيما يتعلق بالصوم والفطر ، ويُرْبَط ذلك بالعلامة الحِسِّية التي جعلها الله في كتابه ، وجعلها نبيه محمد صلى الله عليه وسلم في سنته ألا وهي شهود القمر ، وشهود الشمس ، أو الفجر " انتهى من فتاوى أركان الإسلام ص 451.

وقال رحمه الله موضحًا هذا القياس ، ومؤيدًا به حُجة الذين اعتبروا اختلاف المطالع :
" قالوا : والتوقيت الشهري كالتوقيت اليومي ، فكما أن البلاد تختلف في الإمساك والإفطار اليومي ، فكذلك يجب أن تختلف في الإمساك والإفطار الشهري ، ومن المعلوم أن الاختلاف اليومي له أثره باتفاق المسلمين ، فمن كانوا في الشرق فإنهم يمسكون قبل من كانوا في الغرب ، ويفطرون قبلهم أيضًا .

فإذا حكمنا باختلاف المطالع في التوقيت اليومي ، فإن مثله تمامًا في التوقيت الشهري .
ولا يمكن أن يقول قائل : إن قولَهُ تعالى" وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ " وقوله صلى الله عليه وسلم " إِذَا أَقْبَلَ اللَّيْلُ مِنْ هَا هُنَا ، وَأَدْبَرَ النَّهَارُ مِنْ هَا هُنَا ، وَغَرَبَتْ الشَّمْسُ فَقَدْ أَفْطَرَ الصَّائِمُ "صحيح البخاري. لا يمكن لأحد أن يقول : إن هذا عام لجميع المسلمين في كل الأقطار .
وكذلك نقول في عموم قوله تعالى " فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ " وقوله صلى الله عليه وسلم "إذَا رَأَيْتُمُوهُ فَصُومُوا، وإذَا رَأَيْتُمُوهُ فأفْطِرُوا، فإنْ غُمَّ علَيْكُم فَاقْدُرُوا له " صحيح البخاري.

فإنْ غُمَّ عليكم؛ أي: تَعذَّرتْ رُؤيةُ الهِلالِ بسبَبِ الغَيْمِ، فإنَّه يُقدَّرُ للشَّهرِ ثَلاثونَ يومًا؛ لأنَّ الشَّهرَ لا يَزيدُ على ذلك، فيَتحقَّقُ اليَقينُ بدُخولِه أو بخُروجِه. الدرر -
وهذا القول كما ترى له قوته بمقتضى اللفظ ، والنظر الصحيح ، والقياس الصحيح أيضًا ، قياس التوقيت الشهري على التوقيت اليومي " انتهى . نقلا عن "فتاوى رمضان" جمع أشرف عبد المقصود ص 104

وصدر عن هيئة كبار العلماء ، بيان مهم بهذا الخصوص ، وهذا نصه :
"أولًا : اختلاف مطالع الأهلة من الأمور التي علمت بالضرورة حسًّا وعقلًا ، ولم يختلف فيها أحد من العلماء ، وإنما وقع الاختلاف بين علماء المسلمين في : اعتبار خلاف المطالع ، وعدم اعتباره .

ثانيًا : مسألة اعتبار اختلاف المطالع وعدم اعتباره من المسائل النظرية التي للاجتهاد فيها مجال ، والاختلاف فيها واقع ممن لهم الشأن في العلم والدين ، وهو من الخلاف السائغ الذي يؤجر فيه المصيب أجرين : أجر الاجتهاد ، وأجر الإصابة ، ويؤجر فيه المخطئ أجر الاجتهاد .

وقد اختلف أهل العلم في هذه المسألة على قولين : فمنهم من رأى اعتبار اختلاف المطالع ، ومنهم من لم ير اعتباره . واستدل كل فريق منهما بأدلة من الكتاب والسنة ، وربما استدل الفريقان بالنص الواحد كاشتراكهما في الاستدلال بقوله تعالى " يَسْأَلونَكَ عَنِ الأَهِلَّةِ قُلْ هِيَ مَوَاقِيتُ لِلنَّاسِ وَالْحَجِّ " البقرة/189 . وبقوله صلى الله عليه وسلم"صُومُوا لِرُؤْيَتِهِ ، وَأَفْطِرُوا لِرُؤْيَتِهِ" الحديث . وذلك لاختلاف الفهم في النص ، وسلوك كل منهما طريقًا في الاستدلال به .

ونظرًا لاعتبارات رأتها الهيئة وقدرتها ، ونظرًا إلى أن الاختلاف في هذه المسألة ليست له آثار تخشى عواقبها ، فقد مضى على ظهور هذا الدين أربعة عشر قرنًا ، لا نعلم فيها فترة جرى فيها توحيد الأمة الإسلامية على رؤية واحدة . فإن أعضاء مجلس هيئة كبار العلماء يرون بقاء الأمر على ما كان عليه . وعدم إثارة هذا الموضوع ، وأن يكون لكل دولة إسلامية حق اختيار ما تراه بواسطة علمائها من الرأيين المشار إليهما في المسألة ، إذ لكل منهما أدلته ومستنداته .

ثالثًا : نظر مجلس الهيئة في مسألة ثبوت الأهلة بالحساب ، وما ورد في الكتاب والسنة ، واطلعوا على كلام أهل العلم في ذلك ، فقرروا بإجماعٍ عدمَ اعتبار حساب النجوم في ثبوت الأهلة في المسائل الشرعية ؛ لقوله صلى الله عليه وسلم " صُومُوا لِرُؤْيَتِهِ ، وَأَفْطِرُوا لِرُؤْيَتِهِ " الحديث . وقوله صلى الله عليه وسلم " لا تَصُومُوا حَتَّى تَرَوْهُ ، وَلا تُفْطِرُوا حَتَّى تَرَوْهُ " الحديث /صحيح مسلم . وما في معنى ذلك من الأدلة " انتهى نقلا عن "فتاوى اللجنة الدائمة"10/102 .

Question

Why are the Muslims not united in their fasting even though there is only one new moon for Ramadaan? In the past there was the excuse of there being no media or means of communication.
Answer




Praise be to Allaah. Firstly:
The most likely reason for the differences in the start of the fast from one country to another is the difference in sighting the new moon. Such differences are well known and it makes sense that there are such differences.
Based on this, it is not possible to expect all the Muslims to start fasting at the same time, because this would mean that some of them were starting to fast before the new moon had been sighted and even before it had appeared.
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked about those who call for the ummah to be united in fasting and for the moon sighting to be based on its sighting in Makkah. He said:
This is impossible from an astronomical point of view, because the sighting of the new moon, as Shaykh al-Islam Ibn Taymiyah said, differs, according to the scientists who are well-versed in this field. Because it differs, then each country should have its own ruling, according to the reports and according to science.
The evidence from reports is the verse in which Allaah says (interpretation of the meaning):
“So whoever of you sights (the crescent on the first night of) the month (of Ramadan i.e. is present at his home), he must observe Sawm (fasts) that month”
[al-Baqarah 2:185]
If it so happens that people in a remote region of the world do not see the new moon whereas the people of Makkah do see it, then how can the words of this verse apply to those who have not seen the new moon? The Prophet (peace and blessings of Allaah be upon him) said: “Fast when you see it and stop fasting when you see it.” (Agreed upon). So if the people of Makkah, for example, see it, then how can we expect the people of Pakistan and countries further east to start fasting, when we know that that the new moon has not yet appeared in their region, and the Prophet (peace and blessings of Allaah be upon him) connected the start of fasting to the sighting of the moon?
The scientific evidence is the correct analogy which we cannot contradict. We know that dawn appears in eastern regions of the earth before it appears in western regions, so if dawn has appeared in eastern regions, do we have to stop eating even though it is still night where we are? The answer is no. If the sun has set in eastern regions but it is still day where we are, is it permissible for us to break our fast? The answer is no. And the new moon is exactly like the sun, except that the timing of the new moon is monthly and the timing of the sun is daily. The One Who said (interpretation of the meaning):
“and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night), then complete your Sawm (fast) till the nightfall”
[al-Baqarah 2:187] is also the One Who said (interpretation of the meaning):
“So whoever of you sights (the crescent on the first night of) the month (of Ramadan i.e. is present at his home), he must observe Sawm (fasts) that month”
[al-Baqarah 2:185]
So the evidence of both the texts and science indicates that we should establish a separate ruling for each place when it comes to starting and ending the fast, and this should be connected to the physical sign which Allaah has described in His Book and which His Prophet Muhammad (peace and blessings of Allaah be upon him) established in his Sunnah, namely the sighting of the moon and the sighting of the sun or dawn.

And he said, explaining this analogy and supporting the argument of those who say that there should be different moon sightings:
They say that the monthly timings should be like the daily sightings. Just as different countries vary in the start and end of the fast each day, so too they must differ in the start and end of the month-long fast. The difference in daily timings is well known according to Muslim consensus; those who are in the east start fasting before those who are in the west, and they also break the fast first.
If we accept the differences in sighting with regard to daily timings, then we should also accept it with regard to the month.
No one can say that the verse “and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night), then complete your Sawm (fast) till the nightfall” and the words of the Prophet (peace and blessings of Allaah be upon him) “When the night has come from here and the day has departed from here and the sun has set, then the faster may break his fast” are general in meaning and apply to all the Muslims in every region.
The same applies to the verse “So whoever of you sights (the crescent on the first night of) the month (of Ramadan i.e. is present at his home), he must observe Sawm (fasts) that month” and the words of the Prophet (peace and blessings of Allaah be upon him) “When you see it fast and when you see it stop fasting.”
As you see, this opinion is very strong, and the analogy is sound, the analogy between the monthly timing and the daily timing.

The Council of Senior Scholars issued an important statement on this topic, the text of which is as follows:
Firstly: The difference in moon sighting is something which is well known, and there is no difference among the scholars concerning this. Rather the difference of scholarly opinion has to do with whether the difference in moon sighting matters or not.
Secondly: The issue of whether the difference in moon sighting matters or not is a theoretical matter in which there is room for ijtihaad. Even people of great knowledge and piety differed concerning this matter. This is a type of difference which is acceptable, where the one who makes ijtihaad and gets it right will have two rewards, one for his ijtihaad and the other for getting it right, and the one who gets it wrong will be rewarded for his ijtihaad.
The scholars differed concerning this matter and there are two points of view. One is that the difference in moon sighting matters and the other is that it does not matter. Each group quotes evidence from the Qur’aan and Sunnah, and sometimes they quote the same text, such as when they both quote the verse (interpretation of the meaning):
“They ask you (O Muhammad) about the new moons. Say: These are signs to mark fixed periods of time for mankind and for the pilgrimage”
[al-Baqarah 2:189]
and the words of the Prophet (peace and blessings of Allaah be upon him), “Fast when you see it and stop fasting when you see it.”
That is because of different understandings of the texts, and different ways in which each group derives evidence from them.
Based on the considerations that the Council has seen and examined, and based on the fact that the difference of opinion on this matter does not have any effect that may lead to undesirable consequences, since this religion appeared fourteen centuries ago and we do not know of any period during which the ummah was united in moon sighting, the members of the Council of Senior Scholars think that matters should be left as they are and that this subject should not be stirred up. Each Islamic state should have the right to choose whichever opinion it wishes, based on the suggestions of its own scholars, because each view has its evidence and proofs.
Thirdly: The Council has studied the issue of proving the new moon by means of calculation, and what has been narrated in the Qur’aan and Sunnah, and they have studied the comments of the scholars on this matter. They have decided unanimously that astronomical calculations carry no weight in determining the new moon with regard to Islamic matters, because the Prophet (peace and blessings of Allaah be upon him) said, “Fast when you see it and stop fasting when you see it.” And he (peace and blessings of Allaah be upon him) said: “Do not fast until you see it, and do not stop fasting until you see it.” And because of other evidence to that effect.

Pourquoi les musulmans ne jeûnent ils pas à l'unisson alors que le croissant lunaire du Ramadan est un? Jadis , ils étaient excusés en raison de l'absence de moyens d'information.

Premièrement, la cause dominante de la différence de la date du début du jeûne d'un pays à l'autre réside dans la différence des points de naissance du croissant. Cette différence est nécessairement connue par la raison et par les sens. Cela étant, il n'est pas possible d'imposer aux musulmans de jeûner en même temps car cela reviendrait à amener un groupe d'entre eux à jeûner avant de voir le croissant lunaire, voire avant sa naissance.
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) a été interrogé à propos de l'appel à unifier l'entrée en jeûne pour la Umma et relier les points de naissance du croissant lunaire àceux de La Mecque. Il a répondu en ces termes: «C'est impossible du point de vue astronomique car les points de naissance du croissant , comme le dit Cheikh al-Islam, Ibn Taymiya (Puisse Allah lui accorder Sa miséricorde) diffèrent selon l'avis unanime des connaisseurs. Si tel est le cas, les évidences physique et théorique veulent que le cas de chaque pays soit traité à part. S'agissant de l'évidence physique, Allah Très haut en dit ceci: (Ces jours sont) le mois de Ramadan au cours duquel le Coran a été descendu comme guide pour les gens, et preuves claires de la bonne direction et du discernement. Donc quiconque d'entre vous est présent en ce mois, qu'il jeûne!.(Coran,2:185). A supposer que des gens qui se trouvent à l'extrémité de la terre n'ont pas constaté l'apparition du croissant lunaire alors que les Mecquois l'ont constatée, comment le discours véhiculé par le verset précédent s'adresserait il à ceux qui n'ont pas constaté l'apparition du croissant lunaire? Le Prophète (Bénédiction et salut soient sur lui) a dit: Jeûnez quand vous l'aurez vu et mettez fin à votre jeûne quand vous l'aurez vu. (cité dans les Deux collections authentiques ) Si les Mecquois le voient , par exemple, comment imposer aux Pakistanais et les autres orientaux qui résident au-delà de jeûner alors que nous savons que le croissant n'est pas apparu dans leur horizon et que le Prophète (Bénédiction et salut soient sur lui)a fait dépendre le début du jeûne de la vision du croissant?
Quant à l'évidence théorique , elle repose sur le raisonnement par analogie qui ne peut pas être contesté. Nous savons que l'aube apparait du côté est de la terre avant d'arriver au côté ouest. Quant l'aube pointe à l'Est, sommes nous tenus d'entrer en jeûne alors que nous sommes en pleine nuit? La réponseest : non. Quand le soleil se couche dans la partie Est de la terre alors que nous sommes en plein jour, sommes nous tenu de rompre notre jeûne? Aussi le soleil est il parfaitement comme le croissant lunaire. La datation fondée sur le mouvement de la lune est mensuelle alors que celle fondée sur le mouvement du soleil est quotidienne. Celui qui a dit: mangez et buvez jusqu'à ce que se distingue, pour vous, le fil blanc de l'aube du fil noir de la nuit (Coran,2:187) est celui-là même qui a dit: (Ces jours sont) le mois de Ramadan au cours duquel le Coran a été descendu comme guide pour les gens, et preuves claires de la bonne direction et du discernement. Donc quiconque d'entre vous est présent en ce mois, qu'il jeûne! (Coran,2:185). Les évidences physique et théorique impliquent que chaque endroit soit traité de manière spécifique en ce qui concerne le début et la fin du jeûne. Ce qui est lié au signe perceptible indiqué par Allah dans Son livre et signalé par Son Prophète Muhammad (Bénédiction et salut soient sur lui) dans sa Sunna, à savoir l'apparition de la lune et l'apparition du soleil ou de l'aube.» Extrait de fatawa arkane al-Islam,p.351.
Il poursuit (Puisse Allah lui accorder Sa miséricorde) pour expliciter ce raisonnement analogique et pour en faire un argument en faveur de ceux qui soutiennent qu'il faut tenir compte de la différence des stations de naissance de la lune.Ils disent que l'horaire lunaire est comme l'horaire solaire. De même que les pays diffèrent par rapport aux heures du début et de la fin du jeûne de chaque jour, de même ils diffèrent par rapport au début et à la fin du mois du jeûne. Or il est bien connu que les effets liés à la différence affectant le début du jour est unanimement reconnu par les musulmans car ceux qui se trouvent à l'Est entrent en jeûne avant ceux qui se trouvent à l'Ouest et les premiers mettent fin à leur jeûne avant les derniers. Si nous tenons compte de la différence des apparaitrions en ce qui concerne les jours, il doit en être de même pour les mois. Personne ne pourrait arguer que la parole du Très haut: mangez et buvez jusqu'à ce que se distingue, pour vous, le fil blanc de l'aube du fil noir de la nuit (Coran,2:187) et la parole du Prophète (Bénédiction et salut soient sur lui): quand la nuit monte par là et le jours disparait par ci et que le soleil se retire, le jeûner peut mettre fin à son jeûne., personne ne peut dire que ceci concerne tous les musulmans dans toutes les régions. C'est exactement ce que nous disons sur la portée générale de la parole du Très haut : (Ces jours sont) le mois de Ramadan au cours duquel le Coran a été descendu comme guide pour les gens, et preuves claires de la bonne direction et du discernement. Donc quiconque d'entre vous est présent en ce mois, qu'il jeûne!. (Coran,2:185) et de la parole du Prophète (Bénédiction et salut soient sur lui): Jeûnez quand vous l'aurez vu et mettez fin à votre jeûne quand vous l'aurez vu. C'est avis , comme vous le constatez , est solide compte tenu à la fois de sa formulation , mais aussi de son fondement théorique et du raisonnementexact qui le sou tend, raisonnement qui assimile l'horaire lunaire à l'horaire solaire.» Extrait de fatawa Ramadan recueillis par Ashraf Adoul Maqsoud, p.104.
Le collège des Grands ulémas a publié une déclaration à ce propos. En voici le texte:
«Premièrement, la différence des stations de naissance du croissant lunaire est nécessairement connu grâce à la raison et les sens. Aucun uléma ne le conteste. La divergence de vues des ulémas porte sur la question de savoir s'il faut en tenir compte ou pas.
Deuxièmement, le fait d'en tenir compte ou de ne pas en tenir compte fait partie des questions théoriques qui constituent le domaine de la réflexion personnelle (idjtihad). La divergence de vues dans ce domaine est une réalité au sein des gens compétents en religion et en science. C'est le genre de divergence de vues acceptable puisque celui qui a raison est doublement récompensé pour avoir réfléchi et l'avoir fait justement, tandis quecelui qui a tort estrécompensé simplement pour avoir réfléchi.
Une divergence de vues oppose les ulémas sur cette question. Les uns pensent qu'il faut tenir compte de la différence des stations de la naissance du croissant lunaire tandis que les autres pensent le contraire. Chaque groupe tire ses arguments du livre et de la Sunna; Parfois ils utilisent le même texte. C'est le cas de la parole du Très haut: «Ils t'interrogent sur les nouvelles lunes - Dis : Elles servent aux gens pour compter le temps, et aussi pour le Hajj [pèlerinage]. Mais ils lesinterprètent et les comprennent différemment.
Vu des considérations retenues par le Collège et compte tenu du fait que la divergence sur cette question n'a pas de conséquences à redouter puisqu'elle persiste depuis 14 siècles, période pendant laquelle nous ne sachions qu'on ai pu unifierla vision du croissant pour la Umma Islamique, les membres du Collège des Grand Ulémas pensent qu'il faut maintenir le statut quo et s'abstenir de polémiquer sur la question et laisser chaque pays musulman choisir en fonction celui des deux avis que ses ulémas préfèrent car chaque avis repose sur des arguments.
Troisièmement, le conseil du Collège a examiné la question de la possibilité d'utiliser le calcul astronomique pour prouver la naissance du croissant lunaire et ce qui en est dit dans le livre et la Sunna et passé en revue les propos des ulémas sur la question et décidé unanimement de ne pas tenir compte du calcul astronomique pour affirmer la naissance du croissant lunaire devant avoir des effets légaux car le Prophète ( Bénédiction etsalut soient sur lui) a dit : Jeûnez quand vous l'aurez vu et mettez fin à votre jeûne quand vous l'aurez vu. Et dit: ne jeûnez que quand vous aurez vu le croissant lunaire et ne mettez fin à votre jeûne que quand vous aurez vu le croissant lunaire et d'autres arguments allant dans le même sens.»
