السؤال

أحب أن أستفسر عن حكم البيت بوكس " Beat box " ، وهي أصوات تشبه الموسيقي يصدرها الشخص بواسطة فمه بدون تدخل آلات موسيقية أيًا كانت ، فما حكم سماعها أو تعلُمُها ؟

نص الجواب
الحمد لله
أولًا :
" البيت بوكس " هو فن يعتمد على إخراج صوت الطبول والإيقاع والأصوات الموسيقية باستخدام الفم وممر الأنف والحنجرة ، وفي بعض الأحيان يستخدم هؤلاء الفنانون أيديهم أو أي أجزاء أخرى من أجسادهم لتوسيع نطاق المؤثرات الصوتية والإيقاع .
وقد انتشر في الغرب منذ عشرات السنين ؛ وبدأت في الدخول للبلاد العربية ، والانتشار بها ، في السنوات الأخيرة .

ثانيًا :
هذه الأصوات البشرية التي يتم إخراجها بطريقة تشبه أصوات الآلات الموسيقية : أصوات محرمة ، يحرم إخراجها بهذه الطريقة كما يحرم سماعها .

ويدل على ذلك جملة من الأمور :
الأول : أن المعازف التي وردت النصوص بتحريمها ، ليست محصورة في آلات معينة ، بل التحريم شامل لكل ما يندرج تحت هذا اللفظ العام .
وأهل اللغة لم يحصروها في نوع معين ، بل أدخلوا فيها كل ما كان من " الملاهي " ، فالمَعازف " اسم يجمع العُود والطنبور ، وما أشبههما " كما في " جمهرة اللغة - لابن دُرَيد " 1/452.

وإذا كان تحريم المعازف لا يختص بآلة دون آلة ؛ فتحريم الآلة ليس لعينها ، بل لما ينتج عنها من اللهو المحرم ؛ فمتى صدر هذا اللهو المحرم من شيء آخر ، كان له حكم هذه الآلة ، ومتى فقدت الآلة هذه الخاصية ، لم يتعلق بها تحريم من هذا الوجه .
قال ابن عابدين رحمه الله " آلَةَ اللَّهْوِ لَيْسَتْ مُحَرَّمَةً لِعَيْنِهَا ، بَلْ لِقَصْدِ اللَّهْوِ مِنْهَا ، إمَّا مِنْ سَامِعِهَا أَوْ مِنْ الْمُشْتَغِلِ بِهَا.. " انتهى من " حاشية ابن عابدين " 6/350 .
الثاني : أن الشرع لا يفرِّق بين المتماثلات ، فلا يليق أن يُنسبَ إلى الشرع الحكيم أنه يُحرِّم صوتاً ، ثم يبيح صوتاً آخر مماثلاً له .
وكما قال ابن القيم رحمه الله تعالى : " فالشريعة لا تفرِّق بين متماثلين البتَّة ، ولا تسوِّي بين مختلفين ، ولا تحرِّم شيئاً لمفسدة ، وتبيح ما مفسدته مساوية لما حرَّمته ، ولا تبيح شيئاً لمصلحة ، وتحرِّم ما مصلحته مساوية لما أباحته البتة ، ولا يوجد فيما جاء به الرسول صلى الله عليه وسلم شيء من ذلك البتة " انتهى من " بدائع الفوائد " 3/663 .
وهذه الأصوات مماثلة لصوت الموسيقى ، حتى إن مهندسي الصوت أنفسهم ، ربما يجدون صعوبة ، في بعض الأحيان ، في التمييز بين هذه الأصوات والموسيقى .

الثالث : أن العبرة بمآلات الأمور ، وصوت الآدمي إذا غُيِّر فآل إلى الصوت الموسيقي ، فالعبرة بما آل إليه ، لا بأصله ، كما لو غيِّر صوت رجل إلى صوت فتاة مراهقة أو بالغة .
فهذه الأصوات ، وإن كان أصلها مباحًا ، إلا أنها بعد التعديل تأخذ حكمًا آخر ، ولو كان بناء الأحكام على ماضيِّها وأصولها ؛ لقلنا بحل الخمر ؛ لأنها في ماضيها وأصلها مأخوذة من العنب أو الزبيب المعلوم الحِلّ .
وقد ألمح ابن القيم رحمه الله إلى تلبيس الشيطان على الناس بمثل هذه الأمور فقال " ولما يئس الصياد - يقصد الشيطان - من المتعبدين أن يَسمع أحدهم شيئًا من الأصوات المحرَّمة كالعود والطنبور والشبَّابة ، نظر إلى المعنى الحاصل بهذه الآلات فأدرجه في ضمن الغناء وأخرجه في قالبه ، وحسنه لمن قلَّ فقهه ورقَّ علمه ، وإنما مراده التدريج من شيء إلى شيء .
والعارفُ من نظر في الأسباب إلى غايتها ونتائجها ، وتأمل مقاصدها وما تؤول إليه " .
انتهى من " الكلام على مسألة السماع " ص/167 ، ومعناه في " تلبيس إبليس - لابن الجوزي " ص /274 .

الرابع : أن الطَّرب الحاصل بهذه الأصوات ، يماثل الطرب الحاصل بآلات الموسيقى ، فوجب إلحاقها بها .
وقد نص العلماء على تحريم بعض الأشياء لوجود الطرب فيها ، فذكر ابن حجر الهيتمي رحمه الله أنه : " يمكن أن يستدل لتحريم الشبَّابة ، بالقياس على الآلات المحرمة ، لاشتراكه في كونه مُطرِبا " انتهى من " كف الرعاع " ص/160 .

وقد سئل الشيخ عبد الله بن جبرين رحمه الله : ما حكم إخراج أصوات من الفم ، تشبه أصوات المعازف ؟
فقال " نرى أنه يحرم ، لأنه يقوم مقام آلات اللهو ، وهي آلات محرمة تصد عن ذكر الله ؛ وما قام مقامها فهو محرم " ، وقد سبق نقل هذا عنه في جواب السؤال : 1867 .

ثالثًا :
وأما الأصوات البشرية التي لا تشبه صوت الآلات الموسيقية : فهي مباحة ، كما يباح صوت خرير الماء ، أو صوت الرياح ، أو أصوات الحيوانات ، كصهيل الفرس وصوت العصافير، أو صوت الآدمي ، من بكاء أو ضحك ، أو أصوات المدافع والقذائف ، أو أصوات السيارات ، وسقوط الأشياء ، وكسر الزجاج ... الخ .

What is the ruling on “beatboxing”?

Question

I would like to find out the ruling on “beatboxing”, which is sounds resembling music that a person makes with his mouth, without the use of any musical instruments of any kind. What is the ruling on listening to it or learning it?
Answer

Praise be to Allah.
Firstly:
Beatboxing is an art which involves producing the sounds of drums, percussion and other musical sounds by using the mouth, nasal passages and throat; sometimes these artists also use their hands or other parts of their bodies to expand their repertoire of vocal effects and percussion.
This has been widespread in the West for decades and has begun to appear and become widespread in Arab countries in recent years.
Secondly:
These human sounds that are produced in a way that resembles the sounds of musical instruments are haraam sounds. It is haraam to produce them in this manner and it is also haraam to listen to them.
This is indicated in a number of ways:
1.Musical instruments, as mentioned in the texts which forbid them, are not limited to specific instruments; rather the prohibition applies to everything that may come under this general heading.
The linguists did not limit it to any particular type; rather they included under this heading everything that may be called entertainment. The word ma‘aazif (musical instruments) is a name that covers flutes, drums, and the like, as it says in Jamharat al-Lughah by Ibn Durayd (1/425).
As the prohibition of musical instruments is not limited only to one type and not another, the prohibition is not because of what it is, rather it is because of what it produces of haraam types of entertainment. If this haraam type of entertainment was produced by something else, it would also come under the same ruling as these instruments. If it did not have these features, then this prohibition would not apply to it.
Ibn ‘Aabideen (may Allah have mercy on him) said: The musical instrument is not haram because of what it is; rather it is because it is intended for (haraam) entertainment, either for the one who listens to it or for the one who plays it.
End quote from Haashiyat Ibn ‘Aabideen (6/350).
2.Islam does not differentiate between things of a similar nature, so it is not appropriate to suggest that the wise Lawgiver would prohibit one sound then permit another, similar sound.
As Ibn al-Qayyim (may Allah have mercy on him) said: Islam does not differentiate between things that are similar at all, and it does not regard as equal things that are different. It does not forbid one thing because of its harmful effects then permit another thing that is equally harmful, or permit one thing because it serves a useful purpose and forbid another thing that could serve an equal purpose. There is no suggestion that the Messenger (blessings and peace of Allah be upon him) did any such thing at all.
End quote from Baada’i‘ al-Fawaa’id (3/663).
These sounds are so similar to musical sounds that even sound engineers themselves may sometimes find it difficult to distinguish between these sounds and actual music.
3.What matters is the consequences or results of things. If the human voice is changed and turns into a musical sound, then what matters is what it turns into, not what it was originally, such as if a man’s voice is turned into the voice of a teenage girl or adult woman.
Although these sounds are basically permissible, after this change they come under a different ruling. If rulings were to be based on what things originally were in the past, then we would say that alcohol is permissible, because it originally comes from grapes or raisins which are known to be permissible.
Ibn al-Qayyim (may Allah have mercy on him) noted how the Shaytaan misleads people with regard to matters of this nature, as he said:
When the Shaytaan despaired of devoted worshippers ever listening to haram sounds such as flutes and drums, he looked at what results from these instruments, then he tried to make singing (without musical accompaniment) produce the same effect, and he made it attractive to those who lack understanding and have little knowledge. His aim is to mislead people step-by-step. But the one who has knowledge would look at what things may lead to and their likely results; he would look at the ultimate purpose behind things.
End quote from Kalaam ‘ala Mas’alat as-Samaa‘ (p. 167). There is a similar discussion in Talbees Iblees by Ibn al-Jawzi (p. 274).
4.The kind of pleasure that comes from these sounds is similar to that which comes from musical instruments, so they should be included under the same heading.
The scholars have stated that some things are haraam because of the kind of pleasure they lead to. Ibn Hajar al-Haytami (may Allah have mercy on him) said that it is possible to determine that reed flutes are haraam by analogy with other haraam musical instruments, because they produce the same kind of pleasure.

Shaykh ‘Abdullah ibn Jibreen (may Allah have mercy on him) was asked: What is the ruling on producing sounds from the mouth that are similar to the sounds of musical instruments?
He said: In our opinion it is haraam because it sounds like, and could be taking the place of, musical instruments, which are forbidden and which distract people from remembering Allah. So whatever takes their place is also haraam. We quoted this from him previously in the answer to question no. 1867.
Thirdly:
With regard to human sounds that do not resemble the sound of musical instruments, they are permissible, just as the sound of flowing water or the sound of the wind or the sounds of animals – such as horse’s neighing or birds’ tweeting – or the human voice – whether it is crying or laughing – or the sounds of guns and shells, or the sounds of cars, falling objects and breaking glass etc. are also permissible.

Comment juger le Beat box?

Question

Je voudrais demander l'explication du jugement à porter sur le beat box. Ce sont des voix émises par une personne à travers sa bouche pour imiter la musique sans en utiliser les instruments. Comment juger son écoute et son apprentissage?

Premièrement, le beat box est un art qui consiste à imiter les sons des tambours et les mélodies et les aires en manipulant la bouche , la gorge et le nez. Parfois, les artistes utilisent leurs mains ou d'autres organes de leurs corps pour amplifier les incidences sonores. Cet art s'est répandu en Occident depuis des dizaines d'années. Il a commencé à envahir les pays arabes au cours des dernières années.
Deuxièmement, ces sons humains émis d'une manière qui ressembleà ceux produits par des instruments de musique sont interdits. Il est prohibé de les produire comme indiqué. La prohibition s'étendencore à leur écoute. Ceci s'atteste dans plusieurs choses:
La première est que les instruments de musique dont les textes interdisent l'usagene sont pas limités en des instruments déterminés car l'interdiction s'applique à tout ce qui est appelé ainsi. Les linguistes ne les ont pas limités à une catégorie déterminée car ils y ont intégré tout instrument de divertissement. Le terme m'aazif désigne le guitare arabe, le tambour et consort, comme cela est indiqué dans Djamharatou lougha d'Ibn Dourayd (1/452).
Si l'interdiction de l'usage des instruments de musique ne fait pas de distinction entre les différents instruments, cela signifie que l'interdiction ne vise pas l'instrument en tant que tel mais ce qui résulte de son usage en fait divertissement interdit. Si un tel divertissement provenait d'une autre source, celle-ci serait assimilable à un instrument de musique. Tout instrument non apte à produit cet effet n'est pas concerné par l'interdiction en question.
Ibn Abidine (Puisse Allah lui accorder Sa miséricorde) dit: L'instrument de divertissement n'est pas interdit en tant que tel mais c'est l'intention qui anime celui qui le joue ou l'écoute jouer. Extrait de hachiyatou Ibn Abidine (6/350).
La deuxième est que la loi religieuse ne fait aucune distinction entre des choses identiques. Il ne convient pas d'attribuer à la sage loi religieuse l'interdiction d'un son et l'autorisation d'un autre identique. A ce propos Ibn al-Qayyim (Puisse Allah lui accorder Sa miséricorde) dit: La charia ne fait aucune distinction entre deux choses identiques et elle ne juge pas égales deux choses différentes et n'interdit pas une chose à cause d'un inconvénient puis autorise une chose identique à ce qu'elle a interdite. Elle n'autorise pas une chose pour un intérêt pour interdire une autre chose identique à celle qu'elle a interdite. Une telle approche n'existe absolument pas dans ce qui a été reçu du Messager d'Allah (Bénédiction et salut soient sur lui). Extrait de Badai al-fawaid (3/663).
Les sons en question sont identiques à la musique au point que même les ingénieurs du son ont parfois du mal àdistinguer les deux.
La deuxième est qu'on doit tenir compte de l'issue des choses. Si un son humain devient comme une musique, on tient compte non pas de l'origine mais de l'aboutissement. C'est comme si on modifiait la voix d'un homme de sorte qu'elle devienne comme celle d'une fille adolescente ou majeure.
Il est vrai que les sons émis sont en principe permis. Les manipulations qu'elles subissent leur confèrent un autre statut. Si les dispositions tenaient compte de l'origine des choses, nous dirions que le vin est licite car il est extrait du raisin frais ou desséché bien connu. Ibn al-Qayyim (Puisse Allah lui accorder Sa miséricorde) a fait allusion à la brouille à laquelle Satan expose les gens à travers ces choses. A ce propos, il a dit: Quand le chasseur (Satan) désespère de pousser les dévots à écouter l'un des sons interdits comme ceux produis par la guitare, le tambour et la flute, il cherche (par une voie détournée) le résultat de l'usage de ces instruments, lui donne la forme d'un chant pour l'inclure (dans l'interdit). Il réussit ainsi à embellir la chose aux yeux de celui qui a du mal à comprendre et dispose de peu de savoir. Satan ne veut que passer d'une chose à une autre. Le vrai connaisseur est celui qui examine les fins et les résultats et en médite les tenants et les aboutissements. La quatrième est que le plaisir que procurent ces sons est comme celui qui résulte de l'usage des instruments de musique, ce qui justifie qu'on les leur assimile. Les ulémas ont précisé l'interdiction de certaines sources du plaisir (sonore). C'est dans ce sens qu'Ibn Hadjar al-Haytami dit :On peut tirer un argument permettant d'interdire l'usage de la flute de l'assimilation de celle-ci aux instruments interdits compte tenu de leur aptitude commune à procurer du plaisir. Extrait de kaff ar-Ri'aa, p. 160.
Cheikh Abdoullah ibn Djabrine (Puisse Allah lui accorder Sa miséricorde) a été interrogé en ces termes: Comment juger la production par la bouche de sons identiques à ceux produits par les instruments de musique? Voici sa réponse: « Nous pensons que c'est interdit car ces sons tiennent lieu de ceux émis par les instruments de divertissement interdits en raison de leur capacité de détourner les gens de la mention du nom d'Allah. Ce qui peut se substituer à l'interdit est interdit. Ces propos du cheikh ont déjà été cités dans le cadre de la réponse donnée à la question n° 1867.
Troisièmement, quant aux sons humains qui ne ressemblent pas à celui produit par les instruments de musique , ils sont permis. Il en est de même du bruit de l'écoulement de l'eau, du bruit du vent, des cris des animaux comme le cheval , du chant des oiseaux, des pleurs, des rires, du retentissement des canons et des projectiles, des klaxons, du fracas résultant de la chute d'objets, notamment des verres brisés, etc.
Allah le sait mieux.
