Le jugement d'un massage rituel effectué sur le mouchoir de tête de la femme


الحمد لله.
اختلف العلماء في حكم مسح المرأة على خمار رأسها إلى أقوال ثلاثة :
1. ذهب الجمهور – وهو رواية عن أحمد - إلى عدم جواز المسح عليه وحده ، وحكموا على الوضوء إن هي فعلت بالبطلان ، إلا أن يكون الخمار رقيقاً ينفذ الماء من خلاله .
ففي " المدونة " 1 / 124 :
قال مالك في المرأة تمسح على خمارها : أنها تعيد الصلاة والوضوء .انتهى.
وننبه هنا إلى أن الشافعي رحمه الله قد علَّق جواز المسح على العمامة بصحة الخبر فيه ، وقد صحَّت أخبار في ذلك – كحديث بِلاَلٍ في " صحيح مسلم " 275 : أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم " مَسَحَ عَلَى الْخُفَّيْنِ وَالْخِمَارِ " أي : العمامة ؛ لأنها تخمر الرأس أي : تغطيه - فوجب أن يُضم الشافعي رحمه الله إلى المجيزين للمسح على عمائم الرجال وخمُر النساء .
2. وذهب الحنابلة في الرواية الأخرى عن إمامهم إلى جواز المسح وصحة الوضوء ، وهو قول ابن حزم ، حيث قال :
وكل ما لُبس على الرأس من عمامة أو خمار أو قلنسوة أو بيضة أو مغفر أو غير ذلك : أجزأ المسح عليها ، المرأة والرجل سواء في ذلك ، لعلة أو غير علة .

3. وذهب فريق ثالث إلى التفريق بين ما يشق نزعه وما يسهل فأجازوا المسح على الأول دون الآخر ، وهو قول ابن تيمية ، ومن المعاصرين : الشيخ العثيمين .
قال شيخ الإسلام ابن تيمية – رحمه الله - :
وفي مسح المرأة على مقنعتها وهي خمارها المدار تحت حلقهما روايتان :
إحداهما : لايجوز ؛ لأن نصوص الرخص إنما تناولت الرجل بيقين ، والمرأة مشكوك فيها ، ولأنها ملبوس على رأس المرأة فهو كالوقاية .
والثانية : يجوز ، وهي أظهر لعموم قوله " امسحوا على الخفين والخمار " – رواه أحمد : 39 / 325 : وقال المحققون : حديث صحيح من فعله صلى الله عليه وسلم لا من قوله - ، والنساء يدخلن في الخطاب المذكور تبعاً للرجال كما دخلن في المسح على الخفين ... .
ولأن الرأس يجوز للرجل المسح على لباسه فجاز للمرأة كالرجل ، ولأنه لباس يباح على الرأس يشق نزعه غالباً فأشبه عمامة الرجل وأولى ؛ لأن خمارها يستر أكثر من عمامة الرجل ، ويشق خلعه أكثر ، وحاجتها إليه أشد من الخفين ." شرح العمدة " 1 / 265 ، 266 .
وقال الشيخ العثيمين – رحمه الله :
وعلى كُلِّ حالٍ : إِذا كان هناك مشقَّة إِما لبرودة الجوِّ ، أو لمشقَّة النَّزع واللَّفّ مرَّة أخرى : فالتَّسامح في مثل هذا لا بأس به ، وإلا فالأوْلى ألاَّ تمسح ، ولم ترد نصوصٌ صحيحة في هذا الباب .
" الشرح الممتع على زاد المستقنع " 1 / 239 .
والقول الثالث هو الأرجح ، وقد ثبت عن النبي صلى الله عليه وسلم أنه مسح على عمامته ، ولا فرق بين عمامة الرجل وخمار المرأة ، بل المرأة أولى بالجواز ؛ لما ذكره شيخ الإسلام من أسباب .
وعليه : فليس كل غطاء للرأس يُمسح عليه ، بل ما كان الرأس مستوراً به وثمة حرج في نزعه ، كامرأة تخشى رؤية شعرها ، أو كانت تغطي رأسها المخضَّب بحناء ، أو كان ثمة برد تخشى على نفسها منه ، ومثل هذا من الأعذار .

Ruling on wiping over the head cover for women

Question

Is it permissible for a woman to wipe over her head cover?
Answer
Praise be to Allah.
The scholars differed concerning the ruling on a woman wiping over her head cover; there are three views:
~1~
The majority – which was also narrated from Ahmad – are of the view that it is not permissible for her to wipe over it only, and they ruled that if she does that, her wudoo’ is invalid, unless the head cover is thin and the water can penetrate it.
In al-Mudawwanah (1/124) it says:
Maalik said concerning a woman wiping over her head cover: She had to repeat her wudoo’ and her prayer. End quote.
We should point out here that ash-Shaafa‘i (may Allah have mercy on him) said that the permissibility of wiping over the head cover depends on whether the report that mentions it is saheeh. There are some saheeh reports concerning that, such as the hadeeth of Bilaal in Saheeh Muslim (275), according to which the Messenger of Allah (blessings and peace of Allah be upon him) wiped over his khuffayn (leather socks) and head cover. So ash-Shaafa‘i (may Allah have mercy on him) should be included among those who allow wiping over the head covers of both men and women.

The Hanbalis, according to the other report from their imam, are of the view that it is permissible to wipe (over the head cover) and the wudoo’ is valid. This is also the view of Ibn Hazm, who said:
Anything that is worn on the head, such as a head cover, cap, helmet and chain-mail, and so on, it is permissible to wipe over it, and women and men are the same in that regard, whether there is a reason to do so or not.

A third group are of the view that a distinction should be made between that which is difficult to remove and that which is easy. In the first case they regard it as permissible to wipe over it, but not in the second case. This is the view of Ibn Taymiyah and, among contemporary scholars, Shaykh al-‘Uthaymeen.
Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said:
With regard to a woman wiping over her head cover, there are two reports:
According to the first report it is not permissible, because the texts that speak of the concession only refer to men for sure, whereas there is some doubt as to whether they refer to women.
According to the second report, it is permissible, and this is the apparent meaning of the general words “wipe over the khuffayn and the head cover.” – Narrated by Ahmad (39/325). The commentators said: The hadeeth that says that the Prophet (blessings and peace of Allah be upon him) did that is saheeh, but the hadeeth that says he allowed it is not saheeh, and women are also included in that, along with men, just as they are included with regard to wiping over the khuffayn…
And because it is permissible for men to wipe over the head cover, so that is permissible for women too, like men. And because it is clothing that it is permissible to wear on the head and it is usually difficult to take it off, so it is likened to a man’s head cover, and more so, because the woman’s head cover covers more than the man’s head cover, and it is more difficult to take it off, so the woman's need for (this concession) is greater than in the case of the khuffayn.
Sharh al-‘Umdah, 1/265, 266
Shaykh al-‘Uthaymeen (may Allah have mercy on him) said:
Whatever the case, if there is some difficulty, either because it is cold or because it is difficult to take it off and put it on again, then there is nothing wrong with being lenient in matters such as this, otherwise it is better not to wipe over it, as there is no saheeh text concerning this matter.
Ash-Sharh al-Mumti‘ ‘ala Zaad al-Mustaqni‘, 1/239
The third view is the one that is most likely to be correct. It is proven from the Prophet (blessings and peace of Allah be upon him) that he wiped over his head cover, and there is no difference between the head cover of a man and that of a woman; in fact it is more appropriate that this should be permissible in the case of women, because of the reasons mentioned by Shaykh al-Islam.
Based on that, not every head covering may be wiped over; rather if the head is covered with something that might be problematic to take off, as in the case of a woman who fears that her hair may be seen, or she has covered her head to which she has applied henna, or it is very cold and she fears some harm (if she takes off her head cover), and other similar excuses.

Le jugement d'un massage rituel effectué sur le mouchoir de tête de la femme

Est-il permis à la femme de procéder audit massage?

Louange à Allah.
Louanges à Allah Il y a une divergence au sein des ulémas à propos du jugement du message rituel effectué par la femme sur son mouchoir de tête. Elle a donné lieu à trois avis:
1. La majorité soutient qu'il n'est pas permis de se contenter d'un tel massage. Si on le fait, les ablutions qui l'accompagnent sont caduques, à moins qu'il ne s'agisse d'un léger couvre-tête qui laisse passer l'eau. C'est aussi l'avis d'Ahmad.
On lit dans al-Moudawwanah (1/124): Malick a dit à propos de la femme qui se contente de masser sur son mouchoir de tête qu'elle doit refaire aussi bien les ablutions que la prière.
Nous attirons l'attention de tous sur le fait que Chaafii (Puisse Allah lui accorder Sa miséricorde) a fait dépendre la permission du massage sur un turban de la vérification de l'information allant dans ce sens. Or des informations vérifiées l'attestent. En fait partie le hadith de Bilal rapporté dans le Sahih de Mouslim (275) selon lequel le Messager d'Allah (Bénédiction et salut soient sur lui) fit ledit massage sur des bottes et sur un turban car celui-ci couvre la tête. Aussi faut il ajouter Chaafi (Puisse Allah lui accorder Sa miséricorde) à ceux qui permettent le massage sur les turbans et les mouchoirs de tête.
2. Les hanbalites, selon une autre version reçue de leur imam, permettent le massage et valident les ablutions qui l'accompagnent. C'est aussi un avis d'Ibn Hazem puisqu'il dit: Tout ce qui couvre la tête comme un turban, un mouchoir de tête, un bonnet, un casque ou un bouclier peut faire l'objet dudit massage. Peu importe que le porteur soit un homme ou une femme; qu'on les porte pour une cause (particulière) ou pas. al-Mouhallah (1/303).
3. Un troisième groupe établit une distinction entre ce qu'il est pénible de retirer et ce qu'il est facile d'enlever, et permettent le massage dans le premier cas et s'y opposent dans le second. C'est l'avis d'Ibn Taymiyyah et de notre contemporain, Cheikh al-Outhaymine.
Cheikh al-islam Ibn Taymiyyah (Puisse Allah lui accorder Sa miséricorde) dit: «deux versions existent à propos du massage que la femme peut effectuer sur son voile. La premier dit que cela n'est pas permis car les textes qui vont dans le sens de l'autorisation concernent certainement l'homme. Leur applicabilité à la femme fait l'objet d'un doute.. Il s'y ajoute que le voile couvre la tête de la femme comme un moyen de protection. La seconde version dit que cela est permis. C'est plus évident, compte tenu de la portée générale de la parole du Prophète (Bénédiction et salut soient sur lui) :Massez sur les bottes et les gants. (Rapporté par Ahmad,39/325).
Les vérificateurs ont dit que l'authenticité du hadith s'atteste dans la pratique du Prophète (Bénédiction et salut soient sur lui) non dans ses propos. Les femmes sont comprises dans le discours qui s'adresse en premier lieu aux hommes comme elles sont concernées par le massage sur les bottes. Le massage sur ce que l'homme porte sur sa tête étant permis, il doit en être de même pour la femme. C'est encore parce qu'il s'agit d'un vêtement porté sur la tête qu'il peut être difficile de retirer. Ce qui l'assimile au turban. D'autant plus que le voile couvre un espace plus que grand que celui couvert par le turban et qu'il est plus difficile de le retirer. Et la femme en a un besoin plus important que son besoin d'une gant.» Charha l-oumdah (1/265,266).
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) dit :«En tout état de cause, en présence d'une difficulté due au froid ou à la complexité du voile composé de plusieurs couches, il y a aucun inconvénient à tolérer cette situation. Autrement, il vaut mieux qu'elle s'abstienne du massage. Il n' y a pas de textes authentiques sur ce chapitre. Ach-Charah al-moumt'h alaa zad al-moustaqnaa (1/239).
Le troisième avis jugé le mieux argumenté réside dans le fait qu'il a été rapporté de façon sûre que le Prophète (Bénédiction et salut soient sur lui) effectua un massage sur son turban. Or il n' y a aucune différence entre le turban de l'homme et le voile de la femme. Mieux, celle-ci mérite mieux qu'on lui autorise le massage pour les raisons mentionnées par Cheikh al-Islam.
Cela dit, on n'effectue pas le massage en question sur tout ce qui couvre la tête. Mais il concerne ce qui couvre la tête et dont le retrait peut entraîner la gêne comme c'est le cas d'une femme qui craint qu'on voie ses cheveux ou une femme qui couvre sa tête après l'avoir tentée de la henné ou qui souffre d'un froid dangereux pour elle ou qui jouit d'une autre excuse.
