السؤال

أذهب إلى شخص ما معه مال ؛ ليقوم بشراء غرفة نوم لي للزواج ، فيذهب معي إلى التاجر ويقوم بشراء الغرفة لي بمبلغ معين ، ثم يقوم بتقسيطها لي بمبلغ أعلى من المبلغ الذي تم شراؤها به ، وهذا التعامل يحدث مع أشخاص كثر ، كل شخص حسب السلعة الذي يريد شراءها ، فيقوم بشرائها له ، ويقوم بتقسيطها له ، مع العلم أن هذا الشخص غير متخصص في تجارة معينة ، فهل هذا ربا ؟
نص الجواب






الحمد لله
هذه المعاملة تعرف ببيع المرابحة للآمر بالشراء ، قال الدكتور محمد عبد الحليم عمر في بحثه "التفاصيل العملية لعقد المرابحة" المنشور في "العدد الخامس" من :مجلة مجمع الفقه الإسلامي : يمكن أن تتم المرابحة بإحدى صورتين عرفهما الفقه قديمًا وهما :
1- الصورة الأولى : ويمكن أن يطلق عليها الصورة العامة أو الأصلية ، وهي أن يشتري شخص ما سلعة بثمن معين ، ثم يبيعها لآخر بالثمن الأول وزيادة ربح ، فهو هنا يشتري لنفسه دون طلب مسبق ، ثم يعرضها للمبيع مرابحة .
2- الصورة الثانية : وهي ما يطلق عليها حديثًا اصطلاح " بيع المرابحة للآمر بالشراء " وكيفيتها : أن يتقدم شخص إلى آخر ويقول له : اشتر سلعة معينة موجودة ـ أو يحدد أوصافها ـ وسوف أشتريها منك بالثمن الذي تشتريها به ، وأزيدك مبلغًا معينًا أو نسبة من الثمن الأول كربح ، وهذه الصورة وإن كانت تسميتها بالبيع مرابحة للآمر بالشراء ، من إطلاق الفقهاء المعاصرين إلا أن كيفيتها وردت لدى الفقهاء القدامى ، كما جاء في كتاب الأم للشافعي ما نصه " وإذا أرى الرجل الرجل السلعة فقال : اشتر هذه وأربحك فيها كذا ، فاشتراها الرجل فالشراء جائز ... " ثم يقول " وهكذا إن قال : اشتر لي متاعًا - ووصفه - أو متاعًا أي متاع شئت وأنا أربحك فيه ، فكل هذا سواء يجوز البيع " " انتهى.
وبيع المرابحة للآمر بالشراء ، جائز بشرط أن يقوم المأمور بشراء السلعة لنفسه وقبضها حقيقةً ، قبل بيعها على الآمر .
جاء في " فتاوى اللجنة الدائمة " 13/153 " إذا طلب إنسان من آخر أن يشتري سيارة معينة أو موصوفة بوصف يضبطها ، ووعده أن يشتريها منه ، فاشتراها مَن طلبت منه وقبضها ، جاز لمن طلبها أن يشتريها منه بعد ذلك نقدا أو أقساطا مؤجلة بربح معلوم ، وليس هذا من بيع الإنسان ما ليس عنده ؛ لأن من طُلبت منه السلعة إنما باعها على طالبها بعد أن اشتراها وقبضها ، وليس له أن يبيعها على صديقه مثلا قبل أن يشتريها أو بعد شرائه إياها وقبل قبضها ؛ لنهي النبي صلى الله عليه وسلم عن بيع السلع حيث تبتاع حتى يحوزها التجار إلى رحالهم " انتهى.
وبهذا يعلم أن صاحب المال إذا ذهب مع السائل إلى التاجر ودفع قيمة غرفة النوم مثلا ، ثم أخذها السائل من محل التاجر مباشرة ، دون أن يحوزها صاحب المال ويقبضها وتدخل في ضمانه ، فهذا لا يجوز .
قال الشيخ ابن عثيمين في "فتاوى نور على الدرب : " ما يفعله كثير من الناس الآن ، يأتي الدائن والمدين إلى شخص آخر عنده سلعة ، فيشتريها الدائن ثم يبيعها على المدين وهي في مكانها لم تنقل ، ثم يبيعها المدين على صاحب المحل أو على غيره قبل أن ينقلها ، نعلم أن هذه المعاملة محرمة وليست بجائزة بلا شك ؛ لأنها من بيع السلع في مكانها وقد نهى النبي صلى الله عليه وسلم عن بيع السلعة حيث تبتاع حتى يحوزها التجار إلى رحالهم " انتهى.
ومما يبين المنع أيضا ، أن صاحب المال في هذه الصورة قد ربح ما لم يضمن ، وقد قال رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ "لَا يَحِلُّ رِبْحُ مَا لَمْ يُضْمَنْ " رواه الترمذي :1234. وقال : وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ. وأبو داود :3504- والنسائي :4629- وابن ماجه :2188- وأحمد :6591: وصححه الألباني في " الصحيحة" 1212.

Selling by instalments to the one who issued instructions to buy

Question


I went to someone who has no money to buy a bedroom set for my marriage, then he went with me to the merchant and bought the bedroom set for me for a certain amount. Then he sold it to me by instalments for a higher price than the price for which he bought it. This kind of transaction happens with many people; each person identifies the item he wants to buy, then he buys it for him and sells it to him by instalments. Please note that this person is not specialised in any particular trade. Is this riba?.

Praise be to Allah.
Praise be to Allaah. This transaction is known as a muraabahah transaction for the one who gives instructions for the purchase. Dr. Muhammad ‘Abd al-Haleem ‘Umar said in his paper at-Tafaaseel al-‘Amaliyyah li ‘Aqd al-Muraabahah, which was published in the fifth edition of Majallat Majma‘ al-Fiqh al-Islami:
Muraabahah may be done in one of two ways that were defined in classical fiqh. They are:
-1-
This may be called the general or original form. This is when someone buys an item for a certain price, then he sells it to another person for the original price plus an extra amount of profit. In this case he is buying it for himself without any prior request from anyone else, then he offers it for sale on the basis of muraabahah.
-2-
This has recently been called “muraabahah transaction for one who issued instructions to buy.” How this is done is as follows: one person goes to another and says to him: Buy a particular item which is present (in the market) – or he gives a description of it – and I will buy it from you for the price you bought it for, and I will add a certain amount or percentage of the first price as profit. Although this kind has been called “muraabahah transaction for one who issued instructions to buy” by contemporary fuqaha’, the way it is done has been described by the earlier fuqaha’, as is mentioned in al-Umm by ash-Shaafa‘i, in which it says: If one man shows an item to another man and says: Buy this and I will give you such and such profit for it, and the man buys it, this purchase is permissible. Then he said: The same applies if he says: Buy something for me – and he describes it – or buy any item you want and I will give you a profit for it, all of that is the same and the transaction is permissible. End quote.
“muraabahah transaction for one who issued instructions to buy” is permissible on condition that the one who is instructed to make the purchase buys the item for himself and takes possession of it in a real sense before he sells it to the one who gave those instructions.
It says in Fataawa al-Lajnah ad-Daa’imah (13/153): If someone asks another person to buy a specific car or a car that meets the description he gives, and he promises to buy it from him, and the one who was asked to do so buys it and takes possession of it, it is permissible for the one who asked him to do that to buy it from him after that, whether for cash or by instalments, for a stated amount of profit. This does not come under the heading of selling what one does not possess, because the one who was asked for the product is only selling it to him after buying it and taking possession of it. But he does not have the right to sell it to his friend, for example, before he has bought it or after he has bought it and before he has taken possession of it, because the Prophet (blessings and peace of Allah be upon him) forbade selling an item in the place where it was bought, until after the merchants have taken it to their own places. End quote.
Thus it is known that if the person with the money goes with the questioner to the merchant and pays for the bedroom set, for example, then the questioner takes it directly from the merchant’s store, without the person with the money moving it and taking possession of it and becoming responsible for it, this is not permissible.
Shaykh Ibn ‘Uthaymeen said in Fataawa Noor ‘ala ad-Darb: What many people do nowadays, whereby the lender and borrower go to another person who has an item, and the lender buys it then sells it to the borrower when it is still in place and has not been moved, then the borrower sells it to the store owner or someone else before moving it – we know that this transaction is haraam and is not permissible, beyond any doubt, because it comes under the heading of selling an item in its place, but the Prophet (blessings and peace of Allah be upon him) forbade selling an item in the place where it was bought until the merchants have moved it to their own places. End quote.
What also highlights the fact that it is not allowed is that in this case the owner of the money has made a profit on an item for which he was never liable. But the Messenger of Allah (blessings and peace of Allah be upon him) said: “No profit is allowed on an item unless it has become one’s responsibility (for which one is liable)”. Narrated by at-Tirmidhi, 1234 – he said: This is a hasan saheeh hadeeth. Also narrated by Abu Dawood, 3504; an-Nasaa’i, 4629; Ibn Maajah, 2188; Ahmad, 6591. Classed as saheeh by al-Albaani in as-Saheehah, 1212.

La vente à terme au profit de l'auteur d'une commande

Question

Je me rends auprès d'une personne aisée qui va acheter pour moi une chambre à coucher pour mon mariage. La personne m'accompagne chez le commerçant et achète la chambre à coucher à une somme déterminée. Ensuite, elle me demande de rembourser par tranches une somme supérieure au prix d'achat. Cette opération est engagée par d'autres personnes , chacune selon la marchandise qu'elle veut acquérir. La personne aisée la leur achète puis la leur revend grâce à un paiement échelonné. L'auteur de ces opérations ne se limite pas à un commerce déterminé. Y a-t-il là de l'usure?

Louanges à Allah Cette opération est connue sous l'appellation de vente avec partage des bénéfices au profit de l'auteur de la commande.
Dr Muhammad Abdoul Halim Omar dit dans sa recherche intitulée : les détails pratiques du contrat portant sur la vente avec bénéfices publié dans le numéro 5 de la revue de l'académiejuridique islamique : « la dite vente peut se présenter sous deux formes anciennement connues dans le droit musulman. La première forme qu'on peut appeler la forme générale ou originelle consiste à ce qu'une personne achète une marchandise à un prix déterminé puis la revend à un autre au prix d'achat plus un bénéfice. Sous cette forme, le premier acquéreur achète la marchandisepour lui-même sans que personne ne la lui demande puis il la met en vente pour réaliser un bénéfice. La deuxième forme est celle qui a reçu récemment l'appellation citée en objet. Elle consiste à ce qu'une personne se présente auprès d'une autre et lui dit: procure toi une marchandise déterminée et disponible répondant à telle ou telle caractéristique..Je te l'achèterai après au prix d'achat et t'ajouterai une somme déterminée ou un pourcentage du prix d'achat à titre de bénéfices. L'appellation vente avec partage des bénéfices au profit de l'auteur de la commande donnéerécemment à cette forme de vente provient de juristes contemporains. Pourtant elle était connues des juristes musulmans anciens. En effet, on trouve précisément dans l'ouvrage al-Umm d' l'imam Chaffii ceci: si un homme montre une marchandise à un autre homme et luidit: achète la, je vais la racheter de toi avec une marge bénéficiaire. Si le premier l'achète à cette condition, la transaction est licite. Plus loin, il poursuit: il en serait de même si on disait: achète moi un bagage en le décrivant ou achète moi un bagage quelconque, je te le rachèterait avec une marge bénéficiaire; tout cela serait permis.
La vente avec partage des bénéfices au profit de l'auteur de la commande est permise à condition que celui à qui on demande d'acheter la marchandise l'achète effectivement et la réceptionne avant de la revendre à l'autre.
La fatwa n° 13/153 de la Commission Permanente stipule: «si une personne demande à une autre d'acheter une voiture déterminée ou décrite de manière exacte et promet de le lui acheter (cela est permis). Quand la première personne aura acheté et réceptionné la voiture, il est permis à celle qui en avait demandé l'achat de la lui acheter alors en payant cash ou par des tranches assorties d'un bénéfice connu. Ceci n'est pas assimilable à la vente par une personne d'un bien qu'elle ne possède pas puisque celui à qui la marchandisea été demandée ne l'aura vendue qu'après l'avoir acheté et réceptionnée. Il ne pourrait pas la revendre à son ami avant de l'avoir achetée et réceptionnée ou après le simple achat et avant la réception. En effet, le Prophète(bénédiction et salut soient sur lui) a interdit la vente d'une marchandisenon encore achetée et réceptionnée par le commerçant.
Ceci permet de savoir que si le nanti se rend en compagnie de celui qui lui demande d'acheterune marchandise auprès d'un commerçant et paie le prix de la chambre à coucher et si celle-ciest directement livrée à celui qui en a demandé l'achat avant d'être livrée à l'acheteur effectif, la transaction ne serait pas permise.
Cheikh Ibn Outhaymine dit dans : fatawa nouroune ala ad-darb: ce que beaucoup de gens font maintenant, c'est que un débiteur et son créancier se rendent ensemble auprès d'une personne qui possède une marchandise. Le créancier l'achète puis la revend au débiteur sur place sans déplacer la marchandise. Puis le débiteur la revend au propriétaire du magasin ou à un autre avant de la réceptionner.. Nous savons que cette transaction est interdite; elle n'est indubitablement pas permise car il s'agit de revendre une marchandise sur le lieu d'achat. Or le Prophète (bénédiction et salut soient sur lui) a interdit la revente d'une marchandise sur son lieu d'achat et avant son transfert au dépôt du commerçant acheteur.
Pour expliquer le fondement de l'interdiction, sachons que le propriétaire de l'argent (le premier acheteur) a réalisé un bénéfice sans fournir une garantie. Or le Messager d'Allah (bénédiction et salut soient sur lui) a dit : il n'est pas permis de réaliser un gain sur une transaction sans garantie. (rapporté par at.-Tirmidhi,1234) et qualifié par lui de hadith bon et authentique et rapporté par an-Nassai,4629 et par Ahmad,6591 et jugé authentique par al-Albani dans as-Sahihah,1212).
