Ruling on taking birth control pills before the farewell tawaaf

La prise de comprimés pour bloquer les règles avant la circumambulation d'adieu

السؤال:
أنا بحج بإذن الله ، والدورة ستأتي يوم 10 ، وسوف آخذ حبوب منع الدورة حتى أستطيع أن أطوف طواف الإفاضة

فسؤالي :
هل يجوز أن امتنع عن تناول الحبوب بعد الطواف خشية ضررها لأني فتاة ؟ أم لا بد من تناولها إلى طواف الوداع ؟

الجواب :
الحمد لله
أولًا :
طواف الإفاضة ركن من أركان الحج لا يسقط عن المرأة الحائض ولا عن غيرها ، لكن المرأة الحائض ليس لها أن تطوف بالبيت حتى تطهر ؛ لقوله عليه الصلاة والسلام – لعائشة رضي الله عنها لما حاضت –" افْعَلِي كَمَا يَفْعَلُ الْحَاجُّ غَيْرَ أَنْ لَا تَطُوفِي بِالْبَيْتِ حَتَّى تَطْهُرِي " رواه البخاري :1650 .
جاء في " الموسوعة الفقهية "18/320 " لا خلاف بين الفقهاء في أن الحيض لا يمنع شيئًا من أعمال الحج إلا الطواف ؛ لقول النبي صلى الله عليه وسلم لعائشة حين حاضت " افعلي ما يفعل الحاج غير أن لا تطوفي بالبيت " " انتهى .

ولا حرج على المرأة أن تتناول شيئًا من العقاقير الطبية ، لمنع نزول الدورة ، أو تقليل مدتها ، لتتمكن من الطواف بالبيت .
سئل الشيخ عبد العزيز بن باز رحمه الله :
ما حكم استعمال المرأة لحبوب منع العادة الشهرية في أيام الحج ؟
فأجاب رحمه الله " لا حرج في ذلك ؛ لأن فيها فائدة ومصلحة ؛ حتى تطوف مع الناس وحتى لا تعطل رفقتها " انتهى من " فتاوى إسلامية " 2/185 .

ثانيًا :
أما طواف الوداع ، فقد جاء التخفيف عن المرأة الحائض فيه ، فقد روى البخاري :1755- ومسلم :1328- عن ابن عباس رضي الله عنهما قال " أُمِرَ النَّاسُ أَنْ يَكُونَ آخِرُ عَهْدِهِمْ بِالْبَيْتِ ، إِلَّا أَنَّهُ خُفِّفَ عَنْ الْحَائِضِ " .
وروى أحمد :3495- أن ابن عباس رضي الله عنهما كان يذكر أن النبي صلى الله عليه وسلم رَخَّصَ لِلْحَائِضِ أَنْ تَصْدُرَ قَبْلَ أَنْ تَطُوفَ ، إِذَا كَانَتْ قَدْ طَافَتْ فِي الْإِفَاضَةِ .

وجاء في " الموسوعة الفقهية "18/320 " واتفق الفقهاء على أن للحائض أن تنفر بلا طواف وداع ، تخفيفًا عليها ؛ لحديث عائشة رضي الله عنها " أن صفية رضي الله عنها حاضت ، فأمرها النبي صلى الله عليه وسلم أن تنصرف بلا وداع " ، وعن طاوس قال " كنت مع ابن عباس إذ قال زيد بن ثابت : تفتي أن تصدر الحائض قبل أن يكون آخر عهدها بالبيت ، فقال له ابن عباس : إما لا ، فسل فلانة الأنصارية ، هل أمرها بذلك رسول الله صلى الله عليه وسلم ؟ قال : فرجع زيد بن ثابت إلى ابن عباس يضحك ، وهو يقول : ما أراك إلا قد صدقت " انتهى .
وحينئذ ، فإذا لم يكن عليك ضرر في الاستمرار في تناول تلك الحبوب ، حتى تنتهي من المناسك كاملة ، وتطوفي بالبيت للوداع ، فهو حسن ، لا سيما مع قرب الفترة التي تكون بين الطوافين ، عادة .
وإن خشيت من ذلك ضررًا ، فلا حرج عليك في تركه ، فإن بقيت على طهرك ، فبها ونعمت ؛ وإلا فترخصي برخصة رسول الله صلى الله عليه وسلم للحائض : أن تنفر من غير وادع .

Ruling on taking birth control pills before the farewell tawaaf


I am going for Hajj, by Allah’s leave, and my monthly period will come on the 10th (of Dhu’l-Hijjah). I am going to take birth control pills so that I will be able to do tawaaf al-ifaadah.
My question is:
Is it permissible to stop taking the pills after tawaaf for fear of them causing harm, because I am unmarried, or do I have to keep taking them until the farewell tawaaf?



Praise be to Allah.
Firstly:
Tawaaf al-ifaadah is one of the pillars or essential parts of the Hajj, which is not waived in the case of a menstruating woman or anyone else, but the menstruating woman cannot circumambulate the Ka‘bah until she becomes pure (i.e., her period ends and she does ghusl), because the Prophet (blessings and peace of Allah be upon him) said to ‘Aa’ishah when she menstruated: “Do what the pilgrims do, except do not circumambulate the Ka‘bah until you become pure.” Narrated by al-Bukhaari (1650)
It says in al-Mawsoo‘ah al-Fiqhiyyah (18/320): There is no difference of opinion among the fuqaha’ that menses does not prevent the woman from doing any of the actions of Hajj apart from tawaaf, because the Prophet (blessings and peace of Allah be upon him) said to ‘Aa’ishah when she menstruated: “Do what the pilgrims do, except do not circumambulate the Ka‘bah. End quote.
There is nothing wrong with a woman taking some medicine to prevent menstruation or shorten its duration, so that she will be able to circumambulate the Ka‘bah (tawaaf).
Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allah have mercy on him) was asked:
What is the ruling on a woman using pills to prevent her monthly period during the days of Hajj?
He (may Allah have mercy on him) replied: There is nothing wrong with that, because it serves a purpose, so that she will be able to do tawaaf with the people and so that she will not hold her travelling companions back.

Secondly:
With regard to the farewell tawaaf, an exception was made for menstruating women. al-Bukhaari (1755) and Muslim (1328) narrated that Ibn ‘Abbaas (may Allah be pleased with him) said: The people were commanded that the last thing they should do is to circumambulate the House, but an exception was made for menstruating women.
Ahmad (3495) narrated that Ibn ‘Abbaas (may Allah be pleased with him) used to say that the Prophet (blessings and peace of Allah be upon him) granted a concession allowing the menstruating woman to leave before doing tawaaf, if she had already done tawaaf al-ifaadah.
It says in al-Mawsoo‘ah al-Fiqhiyyah (18/320): The fuqaha’ are unanimously agreed that the menstruating woman may leave (Makkah) without doing the farewell tawaaf, so as to make things easier for her, because of the hadeeth of ‘Aa’ishah (may Allah be pleased with her), according to which Safiyyah (may Allah be pleased with her) got her menses, so the Prophet (blessings and peace of Allah be upon him) instructed her to leave without doing the farewell tawaaf. And it was narrated that Tawoos said: I was with Ibn ‘Abbaas when Zayd ibn Thaabit said: You issue fatwas stating that the menstruating woman may leave without the last thing she does being to circumambulate the Ka‘bah. Ibn ‘Abbaas said to him: Why not? Ask So and So the Ansaari woman whether the Messenger of Allah (blessings and peace of Allah be upon him) instructed her to do that. Then Zayd ibn Thaabit came back to Ibn ‘Abbaas smiling and saying: I see that you are right. End quote.
As that is the case, so long as there will be no harm done by your continuing to take those pills until you have completed all the rituals of Hajj and done the farewell tawaaf around the Ka‘bah, that is good, especially when the time between the two tawaafs is usually short.
But if you fear that this may cause you harm, then there is nothing wrong with you refraining from it. If you remain pure (i.e., do not get your period), then that is fine, otherwise you may avail yourself of the concession granted by the Messenger of Allah (blessings and peace of Allah be upon him) to the menstruating woman, by leaving without doing the farewell tawaaf.

Je vais faire le pèlerinage-avec la permission d'Allah- et mon cycle menstruel commence le 10. Je vais donc prendre des comprimés pour pouvoir faire la circumambulation principale. Ma question est la suivante: m'est-il permis de ne plus prendre des comprimés après cette circumambulation pour éviter leurs effets négatifs? Ou faut -il que je continue à les prendre jusqu'à la circumambulation d'adieu?



Louanges à Allah
Premièrement, la circumambulation principale est l'une des pratiques fondamentales du pèlerinage. On n'en dispense aucune femme, qu'elle voie ses règles ou pas. La femme qui voit ses règles ne fait pas la circumambulation avant de recouvrer sa propreté rituelle en vertu de la parole du Prophète (Bénédiction et salut soient sur lui ) adressée à Aicha (P.A.a) (qui se trouvait dans cette situation):« Fais tout ce que les autres pèlerins font. Mais ne procède à la circumambulation que lors que tu auras recouvré ta propriété rituelle.» (Rapporté par al-Bokhari, 1650).
On lit dans l'encyclopédie juridique (18/320):« Aucune divergence n'existe au sein des ulémas à propos du fait qu'aucun rite du pèlerinage n'est interdit à la femme qui voit ses règles hormis la circumambulation. Car le Prophète (Bénédiction et salut soient sur lui) a dit à Aicha (P.A.a): « Fais tout ce que les autres pèlerins font mais ne fais la circumambulation que lors que tu auras recouvré ta propriété rituelle.»
Il n' y a aucun inconvénient à ce qu'une femme prenne un médicament pour bloquer ses règles ou les reporter pour pouvoir faire la circumambulation.
Cheikh Abdoul Aziz ibn Baz (Puisse Allah lui accorder Sa miséricorde) a été interrogé en ces termes:« Qu'en est-il de l'usage par la femme de comprimés pour bloquer ses règles pendant le pèlerinage?» Voici sa réponse (Puisse Allah lui accorder Sa miséricorde):« Il n' y a aucun inconvénient à le faire car l'acte lui apporte un avantage dans la mesure où il lui permet de faire la circumambulation en même temps que les autres et donc ne pas retarder leur départ.» Extrait de fatwas islamiques (2/185). A toutes fins utiles, voir la réponse donnée à la question n° 112271 et à la question n° 36600.
Deuxièmement, s'agissant de la circumambulation d'adieu, elle fait l'objet d'un allègement au profit de la femme qui voit ses règles. En effet, al-Bokhari (1755) et Mouslim (1328) ont rapporté qu'Ibn Abbas (P.A.a): «Ordre fut donné aux gens de faire de leur ultime contact avec la Maison le dernier rite de leur pèlerinage. Cependant la femme qui voit ses règles est dispensée de se conformer à cet ordre.»
Ahmad rapporte (3495) qu'Ibn Abbas disait que le Prophète (Bénédiction et salut sur lui) autorisait la femme qui voyait ses règles de partir sans faire la circumambulation d'adieu si elle avait fait celle principale (ifadha).
On lit dans l'encyclopédie juridique (18/320): «Les jurisconsultes sont tous d'avis que la femme qui voit ses règles peut s'en aller sans avoir fait la circumambulation d'adieu. C'est une dispense qui lui est faite compte tenu du hadith d'Aicha (P.A.a) selon lequel «Safiyya (P.A.a) vit ses règles et reçut du Prophète (Bénédiction et salut soient sur lui) l'ordre de s'en aller sans avoir fait la circumambulation d'adieu.» Tawous dit : je me trouvait en compagnie d'Ibn Abbas quand Zayd ibn Thabit lui disait:
-«Tu penses que la femme qui voit ses règle puisse s'en aller sans avoir eu un ultime contact avec la Maison?»
-«Si tu penses le contraire, interroge une Telle, l'Ansari, pour savoir si le Messager d'Allah (Bénédiction et salut soient sur lui) ne lui avait pas donné un ordre dans ce sens.»
Zayd ibn Thabit revint plus tard auprès d'Ibn Abbas en riant et dit:
-«Je penses que tu as raison.»
Cela dit, si la poursuite de la prise des comprimés jusqu'à la fin de tous les rites du pèlerinage, y compris la circumambulation d'adieu ne vous porte pas préjudice, étant donné le court délai qui sépare les deux circumambulations, c'est bon. Si vous craignez un préjudice, il n' y a aucun mal à s'en abstenir. Si vous restez rituellement propre, tant mieux. Autrement, profitez de la dispense établie par le Messager d'Allah (Bénédiction et salut soient sur lui) au profit de la femme qui voit ses règles, qui lui permet de partir sans avoir fait la circumambulation d'adieux.
Allah le sait mieux.
