السؤال

بالنسبة لغير الحاج من المسلمين , ما الذي يجب فعله في الأيام العشرة الأوائل من شهر ذي الحجة ؟ يعني : هل قص الأظافر والشعر لا يجوز ووضع الحناء ولبس الملابس الجديدة لا يجوز إلا بعد ذبح الأضحية ؟.

نص الجواب




الحمد لله
إذا ثبت دخول شهر ذي الحجة وأراد أحدٌ أن يضحي فإنه يحرم عليه أخذ شيء من شعر جسمه أو قص أظفاره أو شيء من جلده ، ولا يُمنع من لبس الجديد ووضع الحناء والطيب ، ولا مباشرة زوجته أو جماعها .
وهذا الحكم هو للمضحي وحده دون باقي أهله ، ودون من وكَّله بذبح الأضحية ، فلا يحرم شيء من ذلك على زوجته وأولاده ، ولا على الوكيل .
ولا فرق بين الرجل والمرأة في هذا الحكم ، فلو أرادت امرأة أن تضحي عن نفسها ، سواء كانت متزوجة أم لم تكن فإنها تمتنع عن أخذ شيء من شعر بدنها وقص أظفارها ، لعموم النصوص الواردة في المنع من ذلك .
ولا يسمَّى هذا إحرامًا ؛ لأنه لا إحرام إلا لنسك الحج والعمرة ، والمحرم يلبس لباس الإحرام ويمتنع عن الطيب والجماع والصيد وهذا كله جائز لمن أراد أن يضحي بعد دخول شهر ذي الحجة ، ولا يُمنع إلا من أخذ الشعر والأظفار والجلد .
عن أم سلمة رضي الله عنها أن النبي صلى الله عليه وسلم قال " إِذَا رَأَيْتُمْ هِلَالَ ذِي الْحِجَّةِ وَأَرَادَ أَحَدُكُمْ أَنْ يُضَحِّيَ ، فَلْيُمْسِكْ عَنْ شَعْرِهِ وَأَظْفَارِهِ "رواه مسلم: 1977 . وفي رواية " فَلا يَمَسَّ مِنْ شَعَرِهِ وَبَشَرِهِ شَيْئًا " . والبشرة : ظاهر الجلد الإنسان .
وقال علماء اللجنة الدائمة :
" يشرع في حق من أراد أن يضحي إذا أهل هلال ذي الحجة ألا يأخذ من شعره ولا من أظافره ولا بشرته شيئًا حتى يضحي ؛ لما روى الجماعة إلا البخاري رحمهم الله ، عن أم سلمة رضي الله عنها أن رسول الله صلى الله عليه وسلم قال " إذا رأيتم هلال ذي الحجة وأراد أحدكم أن يضحي فليمسك عن شعره وأظفاره " ولفظ أبي داود ومسلم والنسائي "من كان له ذِبح يذبحه فإذا أهل هلال ذي الحجة فلا يأخذنَّ من شعره ومن أظفاره شيئًا حتى يضحي " سواء تولى ذبحها بنفسه أو أوكل ذبحها إلى غيره ، أما من يضحِّي عنه فلا يشرع ذلك في حقه ؛ لعدم ورود شيء بذلك ، ولا يسمى ذلك إحرامًا ، وإنما المحرم هو الذي يحرم بالحج أو العمرة أو بهما " انتهى .

وسئل علماء اللجنة الدائمة :
الحديث " من أراد أن يضحي أو يُضحَّى عنه فمن أول شهر ذي الحجة فلا يأخذ من شعره ولا بشرته ولا أظفاره شيئًا حتى يضحي " هل هذا النهي يعم أهل البيت كلهم ، كبيرهم وصغيرهم أو الكبير دون الصغير ؟
فأجابوا :
" لا نعلم أن لفظ الحديث كما ذكره السائل ، واللفظ الذي نعلم أنه ثابت عن النبي صلى الله عليه وسلم هو ما رواه الجماعة إلا البخاري عن أم سلمة رضي الله عنها أن رسول الله صلى الله عليه وسلم قال " إذا رأيتم هلال ذي الحجة وأراد أحدكم أن يضحي فليمسك عن شعره وأظفاره " ، ولفظ أبي داود - وهو لمسلم والنسائي أيضاً - : ( من كان له ذبح يذبحه فإذا أهل هلال ذي الحجة فلا يأخذ من شعره وأظفاره حتى يضحي ) فهذا الحديث دال على المنع من أخذ الشعر والأظفار بعد دخول عشر ذي الحجة لمن أراد أن يضحي ، فالرواية الأولى فيها الأمر والترك ، وأصله أنه يقتضي الوجوب ، ولا نعلم له صارفاً عن هذا الأصل ، والرواية الثانية فيها النهي عن الأخذ ، وأصله أنه يقتضي التحريم ، أي : تحريم الأخذ ، ولا نعلم صارفاً يصرفه عن ذلك ، فتبين بهذا : أن هذا الحديث خاص بمن أراد أن يضحي فقط ، أما المضحى عنه فسواء كان كبيراً أو صغيراً فلا مانع من أن يأخذ من شعره أو بشرته أو أظفاره بناء على الأصل وهو الجواز ، ولا نعلم دليلاً يدل على خلاف الأصل " انتهى .

ثانيًا :
لا يحرم شيء من هذا على من لم يرد التضحية لعدم قدرته ، ومن أخذ شيئاً من شعره أو أظفاره وكان أراد التضحية فلا يلزمه فدية ، والواجب عليه التوبة والاستغفار .
قال ابن حزم رحمه الله :
من أراد أن يضحي ففرض عليه إذا أهل هلال ذي الحجة أن لا يأخذ من شعره ولا من أظفاره شيئا حتى يضحي , لا بحلق , ولا بقص ولا بغير ذلك , ومن لم يرد أن يضحي لم يلزمه ذلك .
" المحلى " 6 / 3 .
وقال ابن قدامة رحمه الله :
إذا ثبت هذا , فإنه يترك قطع الشعر وتقليم الأظفار , فإن فعل استغفر الله تعالى ، ولا فدية فيه إجماعا , سواء فعله عمداً أو نسياناً .
" المغني " 9 / 346) .
فائدة :
قال الشوكاني :
والحكمة في النهي أن يبقى كامل الأجزاء للعتق من النار ، وقيل : للتشبه بالمحرم , حكى هذين الوجهين النووي وحكي عن أصحاب الشافعي أن الوجه الثاني غلط ; لأنه لا يعتزل النساء ولا يترك الطيب واللباس وغير ذلك مما يتركه المحرم .

What should the one who wants to offer a sacrifice refrain from doing?

Question

With regard to a Muslim who is not performing Hajj, what should he do during the first ten days of Dhu’l-Hijjah? Is cutting the nails and hair not permissible? Is putting on henna or wearing new clothes not permitted until after the sacrifice has been slaughtered?.

Answer




Praise be to Allaah.
If the onset of Dhu’l-Hijjah has been proven and a person wants to offer a sacrifice, it is haraam for him to remove anything from the hair on his body or to cut his nails or any part of his skin. It is not forbidden for him to wear new clothes or to put on henna or perfume, or to be intimate with his wife or have intercourse with her.
This ruling applies only to the one who is going to offer the sacrifice, and not to the rest of his family, and not to the one whom he appoints to slaughter the sacrifice on his behalf. None of these things are forbidden for his wife or children, or for his deputy.
No differentiation is made between men and women with regard to this ruling. If a woman wants to offer a sacrifice on her own behalf, whether she is married or not, then she should refrain from removing any hair from her body or cutting her nails, because of the general meaning of the texts which state that that is not allowed.
This is not called ihraam, because there is no ihraam except during the rituals of Hajj and ‘Umrah, and the one who is in ihraam wears the ihraam garments and refrains from wearing perfume, having intercourse, and hunting, but all of these things are permissible for the one who wants to offer a sacrifice after the month of Dhu’l-Hijjah begins. He is not forbidden to do anything except cut his hair, trim his nails or remove anything from his skin.
It was narrated from Umm Salamah (may Allaah be pleased with her) that the Prophet (peace and blessings of Allaah be upon him) said: “When you see the new moon of Dhu’l-Hijjah, and one of you wants to offer a sacrifice, let him refrain from (removing anything) from his hair or nails.” Narrated by Muslim, 1977. According to another version: “Let him not remove anything of his hair or skin.”
The scholars of the Standing Committee said:
It is prescribed for the one who wants to offer a sacrifice, when the month of Dhu’l-Hijjah begins, that he should not remove anything from his hair, nails or skin until he has offered the sacrifice, because of the report narrated by the group apart from al-Bukhaari (may Allaah have mercy on them), from Umm Salamah (may Allaah be pleased with her), that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “When you see the new moon of Dhu’l-Hijjah, and one of you wants to offer a sacrifice, let him refrain from (removing anything) from his hair or nails.” According to a version narrated by Abu Dawood, Muslim and al-Nasaa’i: “Whoever has a sacrifice to offer, when the new moon of Dhu’l-Hijjah begins, let him not remove anything from his hair or nails until he has offered the sacrifice” – whether he is going to slaughter the sacrifice himself or has asked someone else to slaughter it on his behalf. As for the one on whose behalf the sacrifice is being offered, that is not prescribed in his case, because there is no report to that effect. That is not called ihraam, rather ihraam refers to the one who enters ihraam for Hajj or ‘Umrah or both. End quote.

The scholars of the Standing Committee were asked:
In the hadeeth it says, “Whoever wants to offer a sacrifice or appoint some else to slaughter the sacrifice for him, from the beginning of the month of Dhu’l-Hijjah, let him not remove anything from his hair, skin or nails, until he has offered the sacrifice.” Does this prohibition apply to all the members of a household, old and young, or does it apply to the adults only and not the children?
They replied:
We do not know of a version of the hadeeth which appears as mentioned in the question. The version which we know is narrated from the Prophet (peace and blessings of Allaah be upon him), as reported by the group apart from al-Bukhaari from Umm Salamah (may Allaah be pleased with her), according to which the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “When you see the new moon of Dhu’l-Hijjah, and one of you wants to offer a sacrifice, let him refrain from (removing anything) from his hair or nails.” According to a version narrated by Abu Dawood – which was also narrated by Muslim and al-Nasaa’i – “Whoever has a sacrifice to offer, when the new moon of Dhu’l-Hijjah begins, let him not remove anything from his hair or nails until he has offered the sacrifice.” This hadeeth indicates that it is not allowed to remove anything from the hair or nails after the first ten days of Dhu’l-Hijjah begin, for the one who wants to offer a sacrifice. The first report includes a command to refrain, which basically implies that refraining is obligatory, and we do not know of any reason to interpret it otherwise. The second report includes the prohibition on removing anything, which basically implies that it is haraam, and we do not know of any reason to interpret it otherwise. Thus it is clear that this hadeeth applies only to the one who wants to offer the sacrifice. As for the one on whose behalf the sacrifice is being offered, whether he is old or young he is not forbidden to remove anything from his hair, skin or nails, based on the basic principle, which is that these actions are permitted. We do not know of any evidence to the contrary. End quote.
Fataawa al-Lajnah al-‘Daa’imah, 11/426, 427
Secondly:
None of these things are haraam for the one who does not intend to offer a sacrifice because he is unable to. Whoever removes anything from his hair or nails although he plans to offer a sacrifice does not have to offer any fidyah (ransom), but he has to repent and seek forgiveness.
Ibn Hazm (may Allaah have mercy on him) said:
Whoever wants to offer a sacrifice, it is obligatory for him, once the month of Dhu’l-Hijjah begins, not to remove anything from his hair or nails until he has offered the sacrifice, whether that is by shaving, trimming or any other means. Whoever does not plan to offer a sacrifice is not obliged to adhere to that.
Al-Muhallah, 6/3
Ibn Qudaamah (may Allaah have mercy on him) said:
Once this is established, then he should forego cutting his hair or clipping his nails. If he does that, he should ask Allaah for forgiveness, but he does not have to offer any fidyah, according to scholarly consensus, whether he did that deliberately or out of forgetfulness.

Al-Shawkaani said:
The reason behind this prohibition is so that all parts will remain to be ransomed from the Fire, or it was said that it is so that he will resemble the one who is in ihraam. Both views were narrated by al-Nawawi, but he narrated from the companions of al-Shaafa’i that the second view is a mistake, because (the person who wants to offer a sacrifice) does not keep away from women or stop putting on perfume or wearing regular clothes, and other things which the person in ihraam refrains from.

De quoi doit s'abstenir celui qui veut procéder au sacrifice animal?

Que doit faire le musulman non pèlerin au cours des dix premiers jours de Dhoul-Hidjdjah? En d'autres termes, n'est il permis de se tailler les ongles, de se couper les cheveux, de se teindre du henné et de porter de nouveaux vêtements qu'après avoir égorgé l'animal à sacrifier (au 10e jour du mois)?

Si l'entrée du mois Dhoul Hidjdjah se confirme et si le fidèle croyant veut procéder à un sacrifice, on lui interdit d'enlever des cheveux de son corps, de tailler ses ongles ou de prélever un morceau de sa peau. Mais on ne lui interdit ni de porter de nouveaux vêtements, ni de se teindre du henné, ni de se parfumer ni d'avoir un rapport intime avec son épouse.
Cette disposition ne concerne que celui qui veut procéder à un sacrifice. Sa famille et celui qu'il mandate à égorger le sacrifice ne sont nullement concernés. La disposition ne fait aucune différence entre l'homme et la femme puisque si une femme, mariée ou célibataire, voulait procéder à un sacrifice, elle devrait s'abstenir d'enlever une partie quelconque des poils et cheveux de son corps, compte tenu de la portée générale des textes relatifs à ce sujet.
La situation qui en résulte ne revient pas mettrel'intéresséen un état de sacralisation car on entre dans cet état que pour faire un pèlerinage mineur et majeur. Le pèlerin porte la tenue de sacralisation et s'abstient du parfum, des rapports intimes et de la chasse. Choses qui sont permises au non pèlerin qui veut procéder à un sacrifice après l'entrée du mois susmentionné. Tout ce qui lui est interdit est de se couper des cheveux, de se tailler des ongles et de prélever un morceau de sa peau.
Oum Salamah (P.A.a) a rapporté que le Prophète (Bénédiction et salut soient sur lui) a dit: Quand vous apercevez le croissant lunaire annonçant l'entrée de Dhoul-Hidjdjah et si l'un d'entre vous veut procéder à un sacrifice, qu'il s'abstienne de se couper les cheveux et de se tailler les ongles. (Rapporté par Mouslim,1977) Une autre version précise: Qu'il ne touche pas à ses cheveux et poils.
Les ulémas de la Commission Permanente ont dit: Il est institué pour celui qui veut procéder à un sacrifice de s'abstenir, dès l'apparition du croissant lunaire marquant le début de Dhoul Hidjdjah, decouper une partie quelconque de ses poils et cheveux jusqu'au moment où il aura égorgé son sacrifice. La version citée par Mouslim et par Abou Dawoud se présente comme suit: Que celui qui veut procéder à un sacrifice s'abstienne de se couper les cheveux et de se tailler les ongles à partir de l'apparition du croissant lunaire marquant le début de Dhoul-Hidjdja. Qu'il égorge le sacrifice lui-même ou le confie à un mandaté. Ce dernier n'est toutefois pas concerné (par les interdictions) car aucun texte n'est reçu à ce propos. Ces restrictions ne mettent pas le concerné dans un état de sacralisation. Seul doit se mettre en cet état celui qui accomplit un pèlerinage mineur ou majeur ou les deux à la fois.» Fatwa de la Commission Permanente (11/397,398).
Les ulémas membres de cette Commission ont été interrogés à propos de ce hadith: Que celui qui veut faire un sacrifice ou le faire faire s'abstienne, dès le début du mois de Dhoul Hidjdja, de couper ses cheveux et poils et de se tailler les ongles, jusqu'au moment du sacrifice. pour savoir si cette interdiction s'applique à tous les membres de la famille, petits et grands ou ces derniers à l'exclusion de ceux-là?
Voici leur réponse: «Nous ne connaissons pas le hadith dans les termes employés par l'auteur de la question. La version que nous avons sûrement reçue du Prophète (Bénédiction et salut soient sur lui) est celle rapportée par le Groupe (des principaux auteurs de collections de hadith vérifiés) à l'exception d'al-Bokhari d'après Oum Salamah (P.A.a) selon laquelle le Messager d'Allah (Bénédiction et salut soient sur lui) a dit: Si vous apercevez le croissant lunaire et si l'un d'entre vous veut procéder à un sacrifice, qu'il s'abstienne de se couper les cheveux et de se tailler les ongles.La version d'Abou Dawoud reprise par Mouslim et an-Nassai se présente comme suit: Que celui qui a un sacrifice à égorger s'abstienne de se couper les cheveux et les ongles dès l'apparition du croissant lunaire. Ce hadith indique qu'il est interdit de s'occuper les cheveux et de se tailler les ongles après le début des dix premiers jours. L'interdiction concerne celui qui veut procéder un sacrifice. La première version véhicule un ordre et une interdiction. En principe, l'ordre implique une obligation et nous ne savons rien qui le détourne de ce sens. La seconde version indique l'interdiction de couper (ses cheveux et de se tailler des ongles). En principe, l'expression traduit une interdiction; l'interdiction de prélever des cheveux ou des ongles et nous ne sachions rien qui le détourne de ce sens. De tout cela se dégage que le hadith concerne exclusivement celui qui veut procéder à un sacrifice.
Quant à celui qui profite du sacrifice, qu'il soit petit ou grand, rein ne l'empêche de se couper les cheveux et poils ou de se tailler les ongles, compte tenu de la permission de principe. D'autant plus que nous ne savons rien qui prouve le contraire.» Extrait de la Commission Permanente (11/426-427).
Deuxièmement, rien des interdiction sus indiquées ne concerne celui qui ne veut pas procéder à un sacrifice parce qu'incapable de le faire. Celui qui les viole tout en étant concerné n'est pas tenu d'accomplir un acte expiatoire. Mais il doit se repentir et demander pardon.
Ibn Hazem (Puisse Allah lui accorder Sa miséricorde) dit: Celui qui veut procéder à un sacrifice est tenu, dès l'apparition du croissant lunaire, de ne plus se couper des cheveux ou se tailler des ongles jusqu'au moment de l'immolation du sacrifice. On doit s'abstenir aussi bien de la coupe des cheveux que de leur rasage ou d'autres moyens de les enlever. Celui qui ne veut pas faire un sacrifice n'est pas concerné par cela (les restrictions). Al-Mouhalla (6/3).
Ibn Qoudamah (Puisse Allah lui accorder Sa miséricorde) dit: Cela étant, on s'abstient de se couper les cheveux et de se tailler les ongles. Si toutefois on viole ces interdits, on sollicite le pardon d'Allah Très-haut sans avoir à accomplir un quelconque acte expiatoire à l'avis unanime de tous; qu'on ai violé l'interdiction par oubli ou sciemment. Al-Moughni (9/346).
Observation utile:
Chawkani dit: La sagesse qui sou tend ces interdictions est de faire en sorte que toutes les parties du corps puissent bénéficier de l'affranchissement de l'enfer. On dit encore que c'est pour assimiler les concernés aux pèlerins. Ces deux explications sont rapportées par an-Nawawi. On a rapporté d'après lescompagnons de Chaffi que la deuxième explications est erronées puisque les concernés n'ont pas l'obligation de s'éloigner des femmes ou d'éviter le parfum ou le port de vêtements (ordinaires) ou d'autres choses interdites aux pèlerins.
