السؤال

صمت ستًا من شوال واليوم الخامس كان يوم الجمعة وعند صلاة الفجر استفرغت ما أكلته دون قصد فأكملت صيامي وصمت يوم السبت أيضًا فهل كان صيامي صحيحا أم خطأ؟

نص الجواب

الحمد لله
صيامك صحيح ، ولا يضرك ما حصل فيه من الاستفراغ ، لأن من قاء بغير قصد وتعمد ، فصومه صحيح ، وأما من استقاء عمدا فقد أفطر ، وذلك لما روى الترمذي: 720. عَنْ أَبِي هُرَيْرَةَ رضي الله عنه أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ "مَنْ ذَرَعَهُ الْقَيْءُ – أي : غلبه- فَلَيْسَ عَلَيْهِ قَضَاءٌ ، وَمَنْ اسْتَقَاءَ عَمْدًا فَلْيَقْضِ" صححه الألباني في صحيح الترمذي .
قال ابن قدامة رحمه الله في "المغني" 3/23 "ومن استقاء فعليه القضاء , ومن ذرعه القيء فلا شيء عليه .
معنى استقاء : تقيأ مستدعيا للقيء . وذرعه : خرج من غير اختيار منه , فمن استقاء فعليه القضاء ; لأن صومه يفسد به . ومن ذرعه فلا شيء عليه ; وهذا قول عامة أهل العلم . قال الخطابي : لا أعلم بين أهل العلم فيه اختلافا " انتهى .
وسئل الشيخ ابن عثيمين رحمه الله عن القيء في رمضان هل يفطر ؟
فأجاب " إذا قاء الإنسان متعمدًا فإنه يفطر ، وإن قاء بغير عمد فإنه لا يفطر ، والدليل على ذلك حديث أبي هريرة رضي الله عنه ....وذكر الحديث المتقدم .
فإن غلبك القيء فإنك لا تفطر ، فلو أحس الإنسان بأن معدته تموج وأنها سيخرج ما فيها ، فهل نقول : يجب عليك أن تمنعه ؟ لا . أو تجذبه ؟ لا . لكن نقول : قف موقفا حياديا ، لا تستقئ ولا تمنع ، لأنك إن استقيت أفطرت ، وإن منعت تضررت . فدعه إذا خرج بغير فعل منك ، فإنه لا يضرك ولا تفطر بذلك " انتهى من "فتاوى الصيام" ص (231).

Question

I fasted six days of Shawwaal and the fifth day was a Friday. At the time of Fajr prayer I unintentionally vomited what I had eaten, but I completed my fast and fasted the Saturday too. Is my fast valid or invalid?.

Answer




Praise be to Allaah.
Your fast is valid, and the fact that you vomited does not matter, because if a person vomits unintentionally and without meaning to do so, his fast is still valid. But the one who vomits intentionally has broken his fast, because of the report narrated by al-Tirmidhi (720) from Abu Hurayrah (may Allaah be pleased with him), that the Prophet (peace and blessings of Allaah be upon him) said: “The one who cannot help vomiting does not have to make up the fast, but the one who vomits deliberately has to make it up.” Classed as saheeh by al-Albaani in Saheeh al-Tirmidhi.
Ibn Qudaamah (may Allaah have mercy on him) said in al-Mughni (3/23): The one who makes himself vomit has to make up (the fast), but the one who cannot help vomiting does not have to do anything.
What is meant by making oneself vomit is vomiting deliberately, and what is meant by “cannot help vomiting” is when it happens involuntarily. The one who makes himself vomit has to make up the fast because his fast has been spoiled, but the one who cannot help it does not have to do anything. This is the view of the majority of scholars. Al-Khattaabi said: I do not know of any difference of opinion among the scholars. End quote.
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked about vomiting in Ramadaan – does it break the fast?
He replied: If a person vomits deliberately then it breaks the fast, but if he vomits unintentionally then it does not break the fast. The evidence for that is the hadeeth of Abu Hurayrah (may Allaah be pleased with him) … and he quoted the hadeeth that we have quoted above.
If you could not help vomiting, then you did not break the fast. If a person feels that his stomach is queasy and that its contents will be expelled, do we say that you have to try to stop it? No. Or that you have to make it happen? No. Rather we say: Take a middle approach – do not make yourself vomit and do not try to stop it, because if you make yourself vomit you will break the fast, but if you try to stop it, that will harm you. So leave it, and if it comes out without any action on your part, then it will not matter and that will not break your fast. End quote from Fataawa al-Siyaam, p. 231.

J’ai jeûné six jours de Shawwal. Le cinquième a coïncidé avec un vendredi. Lors de la prière de l’aube, j’ai vomis involontairement tout ce que j’avais mangé. Ce qui ne m’a pas empêché de jeûner le samedi.Mon jeûne est-il valide ou pas?

Votre jeûne est valide, le vomissement involontaire n’ayant aucune incidence sur son déroulement. Seul le jeûne qui provoque le vomissement est invalide; Ceci s’atteste dans ce qui a été rapporté par at-Tirmidhi (720) d’après Abou Hourayrah (P.A.a) selon lequel le Prophète (Bénédiction et salut soient sur lui) a dit: « Le jeûneur qui se trouve sous l’emprise du vomissement n’aura pas à rattraper son jeûne, contrairement à celui qui le provoque. » (hadith tué authentique par al-Abani dans Sahih at-Tirmidhi)
Ibn Qoudalah (Puisse Allah lui accorder Sa miséricorde ) écrit dans al-Moughni: « Le jeûneur qui vomit volontairement devra rattraper son jeûne, contrairement à celui qui le subit. » En d’autres termes , dans le premier cas, le jeûne devient invalide alors que dans le second il reste intacte. C’est l’avis de l’ensemble des ulémas. Al-Khattabi dit: « Je ne connais aucune divergence entre eux sur cet avis. »
Cheikh Ibn Ourhaymine (Puisse Allah lui accorder Sa miséricorde) fut interrogé sur le vomissement qui survient pendant l’observance du jeûne du Ramadan pour savoir s’il entraine la rupture du jeûne ou pas. Voici sa réponse: « Le vomissement provoqué entraîne la rupture du jeûne, contrairement à celui qu’on subit. Ceci s’atteste dans un hadith rapporté par Abou Hourayrah. » Ensuite , il a cité le hadith susmentionné avant de poursuivre: « Celui qui vomit involontairement ne perd pas son jeûne. Si l’on sentait des ballonnements dans le ventre risquant d’entraîner un vomissement, devrait on les inhiber ou les laisser passer? Non, nous pensons qu’il ne faut rien faire; ni favoriser le vomissement ni l’inhiber car dans le preneur cas , le jeûne est rompu et dans le second on se porte préjudice. Abstenez vous d’agir. Si les ballonnements aboutissent au vomissent involontaire, cela ne vous porte aucun préjudice et n’invalide pas votre jeûne. » Extrait de Fataawaa siyam,p. 231.
