أمر النبي صلى الله عليه وسلم هل يفيد الوجوب ؟

Does the command of the Prophet (peace and blessings of Allaah be upon him) mean that something is obligatory?


L’ordre donné par le Prophète (bénédiction et salut soient sur lui) exprime-t-il une obligation

السؤال

هل كل ما يأمرنا به رسول الله صلى الله عليه وسلم فرض ؟ إن كان نعم ، فكيف نوفق بين ذلك وبين الحديث الذي معناه : (ما نهيتكم عنه فانتهوا ، وما أمرتكم به فأتوا منه ما استطعتم) ؟ وإن كان لا ، فلماذا مثلا إطلاق اللحية فرض وليس سنة ؟ .

الحمد لله
أولاً :
الأوامر الواردة في الشرع على ثلاثة أنواع :
الأول : أن يقترن بالأمر قرائن تدل على أن المراد به الوجوب والفرضية , كقوله تعالى : ) وَأَقِيمُوا الصَّلاةَ َ) البقرة/43 فقد دلت الأدلة القطعية من الكتاب والسنة وإجماع المسلمين على أن الأمر بإقامة الصلوات الخمس للوجوب .
الثاني : أن يقترن بالأمر ما يدل على أنه ليس للوجوب , كقول الرسول صلى الله عليه وسلم في صحيح البخاري ( 1183) : ( صَلُّوا قَبْلَ صَلاةِ الْمَغْرِبِ , قَالَ فِي الثَّالِثَةِ : لِمَنْ شَاءَ كَرَاهِيَةَ أَنْ يَتَّخِذَهَا النَّاسُ سُنَّةً ) .
فقوله : ( لمن شاء ) دليل على أن الأمر في قوله : ( صلوا قبل المغرب ) ليس للوجوب .
الثالث : أن يرد الأمر مجرداً عن القرائن , وهو ما يسميه العلماء بالأمر المطلق , فلم يقترن به ما يدل على أنه للوجوب أو غيره , وحكم هذا الأمر أنه يكون للوجوب .
ولذلك يقول العلماء : " الأمر المجرد عن القرائن يفيد الوجوب " .
وإلى هذا ذهب جمهور العلماء من المذاهب الأربعة .

واستدلوا على ذلك بأدلة كثيرة ، من الكتاب والسنة .
أما أدلة القرآن فمنها :
1. قول الله تعالى : ( وَمَا كَانَ لِمُؤْمِنٍ وَلا مُؤْمِنَةٍ إِذَا قَضَى اللَّهُ وَرَسُولُهُ أَمْرًا أَنْ يَكُونَ لَهُمْ الْخِيَرَةُ مِنْ أَمْرِهِمْ وَمَنْ يَعْصِ اللَّهَ وَرَسُولَهُ فَقَدْ ضَلَّ ضَلالا مُبِينًا ) الأحزاب/36 .
فجعل الله جل وعلا أمرَه وأمرَ رسوله مانعاً من الاختيار ، وذلك دليل الوجوب اهـ "المذكرة" للشنقيطي (ص 191) .
2. وقوله عز وجل : ( فَلْيَحْذَرْ الَّذِينَ يُخَالِفُونَ عَنْ أَمْرِهِ أَنْ تُصِيبَهُمْ فِتْنَةٌ أَوْ يُصِيبَهُمْ عَذَابٌ أَلِيمٌ ) النور/63 .
فتوعد الله تعالى المخالفين لأمر الرسول صلى الله عليه وسلم بالفتنة وهي الزيغ ، أو بالعذاب الأليم ، ولا يتوعد بذلك إلا على ترك واجب ، فدل على أن أمر الرسول صلى الله عليه وسلم المطلق يقتضي الوجوب اهـ "شرح الورقات" للفوزان (ص 59) . وقال القرطبي (12/322) : بهذه الآية استدل الفقهاء على أن الأمر للوجوب اهـ .
3. ومن الأدلة على ذلك أيضا : قول الله سبحانه وتعالى منكراً على إبليس عدم سجوده بعد أمره بالسجود لآدم : ( مَا مَنَعَكَ أَلا تَسْجُدَ إِذْ أَمَرْتُكَ ) الأعراف/12 . فَقَرَّعَ إبليسَ ووَبَّخَهُ على مخالفة الأمر اهـ "الشنقيطي" (ص 192) بمعناه .
4. وقوله سبحانه : ( أَفَعَصَيْتَ أَمْرِي ) طه/93 . وقال عن الملائكة : ( لا يَعْصُونَ اللَّهَ مَا أَمَرَهُمْ ) التحريم/6 . فهو دليل على أن مخالفة الأمر معصية اهـ "الشنقيطي" (ص 192) .
5. وقوله تعالى : ( وَإِذَا قِيلَ لَهُمْ ارْكَعُوا لا يَرْكَعُونَ ) المرسلات /48 . وهذا ذمٌّ لهم على ترك امتثال الأمر بالركوع ، وهو دليل الوجوب اهـ "الشنقيطي" (ص 191) .
وأما أدلة السنة على أن الأمر المطلق للوجوب ، فكثيرة :
منها :
1. قصة بريرة لما عتقت واختارت فسخ النكاح من زوجها وكان عبدا ، وكان زوجها يحبها ، وكان يمشي خلفها في طرق المدينة ودموعه تسيل على خده يترضاها لترجع إليه فلم تفعل ، فشفع له النبي صلى الله عليه وسلم حتى قال لها : كما رواه أبو داود (2231) يَا بَرِيرَةُ ، اتَّقِي اللَّهَ ، فَإِنَّهُ زَوْجُكِ ، وَأَبُو وَلَدِكِ . فَقَالَتْ : يَا رَسُولَ اللَّهِ ، أَتَأْمُرُنِي بِذَلِكَ ؟ قَالَ : لا ، إِنَّمَا أَنَا شَافِعٌ . قَالَتْ : لا حَاجَةَ لِي فِيهِ . صححه الألباني في صحيح أبي داود (1952) . ورواه البخاري (5283) بلفظ آخر .
قال شيخ الإسلام ابن تيمية رحمه الله : وإنما قالت : (أتأمرني ؟) لما استقر عند المسلمين أن طاعة أمره واجبة اهـ الفتاوى (1/317) .
2. ومن أدلة السنة أيضاً : قول النبي صلى الله عليه وسلم : ( لَوْلا أَنْ أَشُقَّ عَلَى أُمَّتِي أَوْ عَلَى النَّاسِ لأَمَرْتُهُمْ بِالسِّوَاكِ مَعَ كُلِّ صَلاةٍ ) رواه البخاري (887) ومسلم (252) .
قال الحافظ في الفتح : فِيهِ دَلِيل عَلَى أَنَّ الأَمْر لِلْوُجُوبِ مِنْ وَجْهَيْنِ :
أَحَدهمَا : أَنَّهُ نَفَى الأَمْر مَعَ ثُبُوت النَّدْبِيَّة , وَلَوْ كَانَ لِلنَّدْبِ لَمَا جَازَ النَّفْي .
ثَانِيهمَا : أَنَّهُ جَعَلَ الأَمْر مَشَقَّة عَلَيْهِمْ ، وَذَلِكَ إِنَّمَا يَتَحَقَّق إِذَا كَانَ الأَمْر لِلْوُجُوبِ , إِذْ النَّدْب لا مَشَقَّة فِيهِ ، لأَنَّهُ جَائِز التَّرْك اهـ .
وقال شيخ الإسلام رحمه الله : وأمر الله ورسوله إذا أطلق كان مقتضاه الوجوب اهـ . الفتاوى (22/29) .
ثانياً :
لا تعارض بين هذه القاعدة : ( الأصل في الأمر أنه للوجوب ) وبين قوله صلى الله عليه وسلم : ( إِذَا نَهَيْتُكُمْ عَنْ شَيْءٍ فَاجْتَنِبُوهُ ، وَإِذَا أَمَرْتُكُمْ بِأَمْرٍ فَأْتُوا مِنْهُ مَا اسْتَطَعْتُمْ ) رواه البخاري (7288) ومسلم (1337) إذ غاية ما فيه أنه قيد امتثال الأمر بالاستطاعة ، وهذا من رحمة الشريعة وكمالها ، وليس هذا خاصا بأمر الرسول صلى الله عليه وسلم ، بل أمر الله تعالى مقيد بالاستطاعة كذلك ، كما قال سبحانه : ( فَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ ) التغابن/16 ، وقال : ( لا يُكَلِّفُ اللَّهُ نَفْسًا إِلا وُسْعَهَا ) البقرة/286 .
قال النووي رحمه الله في شرح مسلم : " قوله صلى الله عليه وسلم : ( فإذا أمرتكم بشيء فأتوا منه ما استطعتم ) : هذا من قواعد الإسلام المهمة ومن جوامع الكلم التي أعطيها صلى الله عليه وسلم ، ويدخل فيها ما لا يحصى من الأحكام ، كالصلاة بأنواعها ، فإذا عجز عن بعض أركانها أو بعض شروطها ، أتى بالباقي ، وإذا عجز عن بعض أعضاء الوضوء أو الغسل ، غسل الممكن ، وإذا وجد بعض ما يكفيه من الماء لطهارته أو لغسل النجاسة ، فعل الممكن ، وإذا وجد ما يستر بعض عورته ، أو حفظ بعض الفاتحة ، أتى بالممكن ، وأشباه هذا غير منحصرة ، وهي مشهورة في كتب الفقه ، والمقصود التنبيه على أصل ذلك " انتهى باختصار .
وقد قال الله تعالى في الحج الذي هو ركن من أركان الإسلام ، ومن أعظم فرائضه : ( وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلاً ) آل عمران/97 .
وبناء على ما سبق فإن أمر النبي صلى الله عليه وسلم بإعفاء اللحية وتوفيرها ، يدل على الوجوب والفرضية ، لأن الأصل في الأمر أنه يفيد الوجوب ، ولم توجد قرينة تصرفه عن ذلك ، وانظر تفصيل الكلام على مسألة إعفاء اللحية ، في جواب الأسئلة (1189) ، (8196) ، (48960) .

Does the command of the Prophet (peace and blessings of Allaah be upon him) mean that something is obligatory?


Question

Is everything that the Messenger of Allaah (peace and blessings of Allaah be upon him) enjoined upon us obligatory? If the answer is yes, then how can we reconcile between that and the hadeeth which says, “Whatever I forbid to you, avoid it, and whatever I enjoin upon you, do as much of it as you can”? If the answer is no, then why, for example, is growing the beard obligatory and not Sunnah?.



Praise be to Allaah. Firstly:
The commands that are narrated in Islam are of three types:
1 – A command which is accompanied by evidence which indicates that what is meant is that it is obligatory, such as the verse in which Allaah says (interpretation of the meaning):
“And perform As-Salaah (Iqaamat-as-Salaah)”
[al-Baqarah 2:43]
The definitive evidence from the Qur’aan and Sunnah, and the consensus of the Muslims, indicates that the command to establish the five daily prayers means that it is obligatory.
2 – A command which is accompanied by evidence that it is not obligatory, such as the hadeeth in Saheeh al-Bukhaari (1183) in which the Messenger (peace and blessings of Allaah be upon him) said: “Pray before Maghrib,” and the third time he said: “for whoever wants to,” not wanting the people to take it as a Sunnah.
The words “for whoever wants to” indicate that the command in the words “Pray before Maghrib” does not mean that it is obligatory.
3 – A command which does not come with any indication as to whether it is obligatory or not. This is what the scholars call al-amr al-mutlaq (general commands). It is not accompanied by anything to suggest whether it is obligatory or otherwise. The ruling on such commands is that they are obligatory.
Hence the scholars said: A command that is not accompanied by any indication is obligatory.
This is the view of the majority of scholars from the four madhhabs.

They quoted a great deal of evidence from the Qur’aan and Sunnah to support this view.
The evidence from the Qur’aan includes the following:
1-
“It is not for a believer, man or woman, when Allaah and His Messenger have decreed a matter that they should have any option in their decision. And whoever disobeys Allaah and His Messenger, he has indeed strayed into a plain error”
[al-Ahzaab 33:36]
So Allaah has decreed that His command and the command of His Messenger (peace and blessings of Allaah be upon him) rule out any other option, which proves that it is obligatory.
End quote from al-Mudhkirah by al-Shanqeeti, p. 191
2-
“And let those who oppose the Messenger’s (Muhammad’s) commandment (i.e. his Sunnah legal ways, orders, acts of worship, statements) (among the sects) beware, lest some Fitnah (disbelief, trials, afflictions, earthquakes, killing, overpowered by a tyrant) should befall them or a painful torment be inflicted on them”
[al-Noor 24:63]
Here, Allaah warns those who go against the command of the Messenger (peace and blessings of Allaah be upon him) of fitnah (trial or tribulation), namely deviation, or of a painful torment; such a warning is only issued to one who fails to do something that is obligatory. This indicates that the general command of the Messenger (peace and blessings of Allaah be upon him) is obligatory.

Al-Qurtubi said: This verse is quoted as evidence by the fuqaha’ to show that the command means that a thing is obligatory.
3-
Another example of the evidence quoted is the verse in which Allaah denounces Iblees for not prostrating to Adam when he was commanded to do so (interpretation of the meaning):
“ ‘What prevented you (O Iblees) that you did not prostrate yourself, when I commanded you?’”
[al-A’raaf 7:12]
So He rebuked Iblees for going against the command.
Al-Shanqeeti, p. 192
4-
“ ‘Have you then disobeyed my order?’”
[Ta-Ha 20:93]
And He says of the angels (interpretation of the meaning):
“ [they] disobey not, (from executing) the Commands they receive from Allaah, but do that which they are commanded”
[al-Tahreem 66:6]
This indicates that going against the command is disobedience or sin.
Al-Shanqeeti, p. 192
5-
“And when it is said to them: ‘Bow down yourself (in prayer)!’ They bow not down (offer not their prayers)”
[al-Mursalaat 77:48]
This is a criticism of them for not obeying the command to bow. This indicates that it is obligatory.

As for the evidence from the Sunnah that the general command means that a thing is obligatory, there is a great deal of such evidence, including the following:
1 – The story of Bareerah, when she was set free and she chose to annul her marriage to her husband, who was a slave. Her husband loved her, and he was walking behind her on the streets of Madeenah with tears flowing down his cheeks, pleading with her to come back to him, and she refused; the Prophet (peace and blessings of Allaah be upon him) interceded for him and said to her – as is narrated by Abu Dawood (2231) – “O Bareerah, fear Allaah, for he is your husband and the father of your child.” She said: “O Messenger of Allaah, are you commanding me to do that?” He said, “No, I am just interceding.” She said: “I have no need of him.”
Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 1952.
It was also narrated by al-Bukhaari, with different wording.
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said: She said: “Are you commanding me?” because it is established among the Muslims that his command means that a thing is obligatory.
Al-Fataawa, 1/317
2-
The Prophet (peace and blessings of Allaah be upon him) said: “Were it not that it would be too difficult for my ummah, or for the people, I would have commanded them to use the siwaak at the time of every prayer.”
Narrated by al-Bukhaari, 887; Muslim, 252.
Al-Haafiz said in al-Fath: this indicates that a command implies that a thing is obligatory in two ways:
(i) It is shown not to be obligatory although it is recommended; if a command may be interpreted as a recommendation, the hadeeth would have not stated that this is not obligatory.
(ii) He described the command as being difficult for them, which would only be the case if a command was understood as meaning that it was obligatory, because there is no hardship in a thing that is encouraged but left as optional, because it is permissible not to do it.
End quote.
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said: If the command of Allaah and His Messenger is general in meaning, that implies that it is obligatory.
Secondly:
There is no contradiction between this principle, that a command means a thing is obligatory, and the words of the Prophet (peace and blessings of Allaah be upon him), “If I forbid you to do a thing, then avoid it, and if I command you to do a thing, then do as much of it as you can” (narrated by al-Bukhaari, 7288; Muslim, 1337), because all that we understand from this hadeeth is that following commands is dependent upon one's ability to carry them out. This is part of the mercy and perfection of Islam. This does not apply only to the commands of the Prophet (peace and blessings of Allaah be upon him), rather the commands of Allaah, may He be exalted, are also dependent upon one's ability to do them, as Allaah says (interpretation of the meaning):
“So keep your duty to Allaah and fear Him as much as you can”
[al-Taghaabun 64:16]
“Allaah burdens not a person beyond his scope”
[al-Baqarah 2:286]
Al-Nawawi (may Allaah have mercy on him) said in Sharh Muslim: The words of the Prophet (peace and blessings of Allaah be upon him), “If I command you to do a thing, then do as much of it as you can”, form one of the basic principles of Islam, and is an example of the conciseness of speech which was bestowed upon him (peace and blessings of Allaah be upon him). This includes innumerable rulings, such as prayers of all kinds. If a person is unable to do some of the essential parts of the prayer or fulfil some of its conditions, he may do the rest. If he is unable to wash some of the parts that should be washed in wudoo’ or ghusl, he should wash what he can. If he finds water that is only enough to wudoo’ or wash off some impurity partially, he should do whatever he can, and so on. If he finds something to cover only part of his ‘awrah, or he learns some of al-Faatihah and not all of it, he should do whatever he can, and so on. This is well known in the books of fiqh.

Allaah says concerning Hajj, which is one of the pillars of Islam, and one of the greatest duties (interpretation of the meaning):
“And Hajj (pilgrimage to Makkah) to the House (Ka‘bah) is a duty that mankind owes to Allaah, those who can afford the expenses (for one’s conveyance, provision and residence)”
[Aal ‘Imraan 3:97]
Based on the above, the command of the Prophet (peace and blessings of Allaah be upon him) to let the beard grow indicates that it is obligatory, because the basic principle concerning commands is that they are obligatory, and there is no evidence in this case to suggest otherwise.

Est-ce que tout ordre qui nous est donné par le Prophète (bénédiction et salut soient sur lui) traduit une obligation ? Comment concilier cela et le hadith qui dit : abstenez-vous de ce que je vous interdit et appliquez mes ordres dans la mesure du possible ? S’il n’en est pas ainsi, pourquoi considérer le fait de laisser pousser la barbe comme une obligation et non comme une sunna ?

Louanges à Allah
Premièrement, les ordres religieux sont de trois catégories :
La première est représentée par l’ordre accompagné d’indices qui indiquent qu’il exprime une obligation. C’est le cas dans la parole du Très Haut : ** (Coran, 2 : 43). Beaucoup d’arguments décisifs tirés du Coran, et de la Sunna et du consensus des musulmans montrent que la célébration des cinq prières est obligatoire.
La deuxième catégorie est représentée par l’ordre assortie d’un indice qui montre qu’il n’exprime pas une obligation. C’est le cas dans la parole du Messager (bénédiction et salut soient sur lui) rapportée dans Sahih d’al-Boukhari (1183) : « Faites une prière (surérogatoires) avant celle du Maghrib.. A la troisième répétition de la cette phrase, il ajoute : Pour celui qui veut pour éviter que les gens ne transforment cette prière en Sunna.
L’expression Pour celui qui veut signifie que l’ordre exprimé dans Faites une prière etc. n’implique pas une obligation.
La troisième catégorie est représentée par l’ordre non accompagné d’un indice qui en détermine le sens. C’est ce que les ulémas appelle l’ordre absolu qui n’est pas accompagné d'un élément qui montre qu’il exprime une obligation ou autre chose. Un tel ordre doit être interprété comme l’expression d’une obligation. C’est ce qui fait dire aux ulémas que l’ordre non accompagné d’un indice déterminant exprime une obligation. C’est l’avis de la majorité des ulémas des quatre écoles juridiques. Voir Charh al-kawkab al-munir, 3/39.Ils se sont appuyés sur de nombreux arguments tirés du Coran et de la Sunna pour soutenir cet avis.
Voici leurs arguments coraniques :
1/ La parole du Très Haut : Il n' appartient pas à un croyant ou à une croyante, une fois qu' Allah et Son messager ont décidé d' une chose d' avoir encore le choix dans leur façon d' agir. Et quiconque désobéit à Allah et à Son messager, s' est égaré certes, d' un égarement évident. (Coran, 33 : 36).
Allah a considéré que Son ordre et celui de Son Messager mettent fin à toute possibilité de choisir autrement. Ce qui prouve que ces ordres expriment une obligation. Voir al-mudhakhira de Chinquiti, p. 191.
2/ La parole du Puissant et Majestueux : Que ceux, donc, qui s' opposent à son commandement prennent garde qu' une épreuve ne les atteigne, ou que ne les atteigne un châtiment douloureux. (Coran, 24 : 63).
Allah menace ceux qui violent l’ordre du Messager (bénédiction et salut soient sur lui) d’encourir une épreuve, une déviation ou un châtiment douloureux. Or Allah ne profère une menace qu’à cause de l’abandon d’une obligation. Ce qui implique que l’ordre absolu exprimé par le Prophète (bénédiction et salut soient sur lui) véhicule une obligation. Charh al-waraqat par al-Fawzan, p. 59.
Al-Qurtubi (12/322) dit : c’est sur ce verset que les jurisconsultes s’appuient pour soutenir que l’ordre exprime une obligation.
3/ un autre argument allant dans le même sens réside dans la parole d’Allah Très Haut et Transcendant désapprouvant le refus d’Iblis de se prosterner après avoir reçu l’ordre de le faire en l’honneur d’Adam : (Allah) dit: "Qu' est- ce qui t' empêche de te prosterner quand Je te l' ai commandé?" Il répondit: "Je suis meilleur que lui: Tu m' as créé de feu, alors que Tu l' as créé d' argile". (Coran, 7 : 12). Il a ainsi réprimandé Iblis à cause de son refus d’exécuter Son ordre.

4/ La parole du Transcendant : Avez-vous désobéi mon ordre (Coran, 20 : 93). Il dit encore aux anges : Ils ne désobéissent pas à l’ordre d’Allah (Coran, 66 : 6). Ceci signifie que l’inexécution de l’ordre est une désobéissance. Voir Chinquiti, p. 192.
5/ la parole du Très Haut : Quand on leur dit de s’incliner, ils ne s’exécutent pas (Coran, 77: 48). Il entend ainsi les stigmatiser pour leur refus de s’incliner. Ce qui signifie que l’ordre exprime une obligation. Voir Chinquiti, p. 192.
Quant aux arguments tirés de la Sunna qui indiquent que l’ordre absolu exprime une obligation, ils sont très nombreux. Les voici :
1/ L’histoire de Barira, qui, affranchie, choisit de dissoudre le lien du mariage qui l’unissait à un esclave. Pourtant ce dernier l’aimait tendrement. Il la poursuivait dans les rues de Médine en pleurant de sorte que ses larmes coulaient sur ses joues. Il la suppliait de lui revenir en vain. Et puis le Prophète (bénédiction et salut soient sur lui) intervint en sa faveur et dit à Barira selon un hadith rapporté par Abou Dawoud (2231) : Barira ! Crains Allah. C’est quand même ton mari, père de tes enfants ! A quoi elle répondit :
ô Messager d’Allah ! Me donnes-tu l’ordre de le faire ?
Non, je ne fais qu’intercéder pour lui
Alors, je n’ai plus besoin de lui (déclaré authentique par al-Albani dans Sahihi Abi Dawoud (1952) et rapporté par al-Boukhari (5283) en d’autres termes.
2/ Parmi les arguments relevant de la Sunna figure encore la parole du Prophète (bénédiction et salut soient sur lui) : Si ce n’était pour éviter la peine aux gens (ou à ma communauté) je leur donnerai l’ordre d’utiliser le cure-dent avant chaque prière (rapporté par al-Boukhari, 887 et par Mouslim, 252).
Al-Hafiz dit dans al-Fateh : « ce hadith indique de deux manières que l’ordre exprime une obligation. La première consiste à nier avoir donné l’ordre tout en laissant comprendre que la pratique est recommandée. Or si l’ordre n’impliquait que celle-ci, la négation n’aurait pas de sens. La deuxième consiste à indiquer que l’ordre serait une source de peine. Ce qui n’est le cas que quand l’ordre exprime une obligation. Car celui qui exprime une recommandation n’est pas une source de peine puisqu’il est permis de ne pas l’observer.
Cheikh al-islam (Puisse Allah lui accorder Sa miséricorde) a dit : Dans l’absolu, les ordres d’Allah et de son Messager expriment une obligation Al-Fatawa, 22/29.
Deuxièmement, il n’existe aucune contradiction entre cette règle : En principe, l’ordre exprime l’obligation et la parole du Prophète (bénédiction et salut soient sur lui) : Quand je vous interdis une chose abstenez-vous en et quand je vous donne un ordre appliquez-le dans la mesure du possible (rapporté par al-Boukhari, 7288 et par Mouslim, 1337. Car cette parole n’implique rien de plus que le fait de soumettre l’application des ordres à la capacité. Or ceci est une manifestation de la clémence qui sous-tend la charia et une implication de sa perfection. Et rien de cela n’est une spécificité de l’ordre du Messager (bénédiction et salut soient sur lui) car l’ordre d’Allah est aussi conditionné de la capacité selon les propos du Transcendant : Craignez Allah dans la mesure du possible (Coran, 64 : 16) et : Allah n’impose à aucune âme ce qui dépasse ses capacités (Coran 2 : 286).
An-Nawawi (Puisse Allah lui accorder Sa miséricorde) a dit : « La parole du Prophète (bénédiction et salut soient sur lui) : quand je vous donne un ordre appliquez-le dans la mesure du possible fait partie des importantes règles de l’Islam, une des expressions riches et concises réservées au Prophète (bénédiction et salut soient sur lui). Elle englobe un nombre indéterminé de dispositions notamment celles qui régissent les différentes formes de prière. Car quand le fidèle se trouve incapable d’effectuer certaines de ses pratiques essentielles ou de remplir certaines de ses conditions, il passe aux autres. Quand il se trouve incapable de procéder au lavage de certains organes de son corps dans le cadre des ablutions ou du bain rituel, il se contente de laver ce qu’il peut laver.
S’il trouve une quantité d’eau suffisante pour lui permettre de faire ses ablutions ou pour laver une souillure, il fait ce qu’il peut. S’il ne trouve que de quoi cacher une partie de la région honteuse de son corps ou s’il ne maîtrise que quelques éléments de la Fatiha, il se contente de ce qu’il peut faire … Les cas qui relèvent de ce chapitre sont impossibles à recenser. Ceci est bien connu dans les livres de droit musulman, notre dessein n’étant que d’attirer l’attention (des gens) sur le principe ».
Allah Très Haut a dit à propos du pèlerinage qui constitue un des piliers de l’Islam, une de ses plus importantes prescriptions : Et c' est un devoir envers Allah pour les gens qui ont les moyens, d' aller faire le pèlerinage de la Maison. Et quiconque ne croit pas... Allah Se passe largement des mondes. (Coran, 3 : 97).
Cela étant, l’ordre donné par le Prophète (bénédiction et salut soient sur lui) de laisser pousser abondamment la barbe exprime une obligation, étant donné qu’en principe l’ordre exprime une obligation et qu’aucun élément n’est là pour le détourner de ce sens-là.
