على من تجب الأُضحية ؟ وهل الذُّكُورة من الشروط ؟
س :من يجب عليه الأضحية ؟ ربة المنزل التي لها معاش يجوز لها أن تضحي ؟ .
ج :الحمد لله
اختلف العلماء في حكم الأضحية : هل هي واجبة يأثم تاركها ؟ أم سنة مؤكدة يكره تركها ؟
والصحيح أنها سنة مؤكدة ، وسبق بيان ذلك في جواب السؤال :
36432 .
ويشترط لوجوب الأضحية أو سنيتها : غنى المضحي ، بأن يكون ثمن الأضحية فاضلاً عن كفايته وكفاية من ينفق عليهم ، فإذا كان للمسلم راتب يأتيه كل شهر أو (معاش) وهذا الراتب يكفيه ، ومعه ثمن الأضحية ، شرعت الأضحية في حقه .
ودل على اشتراط الغنى قول النبي صلى الله عليه وسلم "من كان له سَعة ولم يضح فلا يقربن مصلانا" رواه ابن ماجه : 3123 ، وحسنه الألباني في " صحيح ابن ماجه " ، والسعة هي الغنى .
والأضحية مشروعة لأهل البيت ، لقول النبي صلى الله عليه وسلم "إِنَّ عَلَى أَهْلِ كُلِّ بَيْتٍ فِي كُلِّ عَامٍ أَضْحَاةً" رواه أحمد :20207. وقال الحافظ ابن حجر في "فتح الباري" : إسناده قوي ، وحسنه الألباني في صحيح سنن أبي داود :2788 .
ولا فرق في هذا بين الرجل والمرأة ، فإذا كانت المرأة تعيش وحدها ، أو مع أولادها فعليهم الأضحية .
جاء في الموسوعة الفقهية :5/81 :
"وليست الذكورة من شروط الوجوب ولا السنية , فكما تجب على الذكور تجب على الإناث , لأن أدلة الوجوب أو السنية شاملة للجميع" انتهى باختصار

Who is obliged to offer the udhiyah (sacrifice)? Is it permissible for a housewife who has an income to offer the udhiyah?


Answer
Praise be to Allah.
The scholars differed concerning the ruling on offering the udhiyah: is it obligatory, such that the one who does not do it is sinning, or is it a confirmed Sunnah, such that it is makrooh (disliked) not to do it? The correct view is that it is a confirmed Sunnah (sunnah mu’akkadah). This has been discussed previously in the answer to question no. 36432
In order for it to be obligatory or Sunnah to offer the udhiyah, it is stipulated that the one who offers it should be independent of means, in that the price of the udhiyah is surplus to his needs and the needs of those on whom he spends. If a Muslim has a salary that comes to him every month, and this salary is sufficient for him and he has surplus money which which he can afford the price of the udhiyah, then in his case it is prescribed for him to offer the udhiyah.
The fact that it is stipulated that he should be independent of means is indicated by the words of the Prophet (blessings and peace of Allah be upon him): “Whoever can afford it but does not offer a sacrifice, let him not come near our prayer-place.” Narrated by Ibn Maajah, 3123; classed as hasan by al-Albaani in Saheeh Ibn Maajah. What is meant by being able to afford it is being independent of means.
The udhiyah is prescribed for the members of the household, because the Prophet (blessings and peace of Allah be upon him) said: “The people of each household should offer an udhiyah every year.” Narrated by Ahmad, 20207. Al-Haafiz Ibn Hajar said in Fath al-Baari: Its isnaad is qawiy. It was classed as hasan by al-Albaani in Saheeh Sunan Abi Dawood, 2788.
There is no difference between men and women in this regard. If a woman is living on her own or with her children, then they should offer the udhiyah.
It says in al-Mawsoo‘ah al-Fiqhiyyah (5/81):
Being male is not a condition of it being obligatory or sunnah to offer the udhiyah; as it is required of males it is also required of females, because the evidence for it being obligatory or Sunnah applies to everyone.

س :هل يجوز الاشتراك في الأضحية ؟ مع العلم أن بعض المشتركين لا ينوي الأضحية .
ج : الحمد لله سبق في جواب السؤال رقم :45757. أنه يجوز أن يشترك السبعة في البعير أو البقرة ، أما الشاة فلا يجوز الاشتراك فيها .
ويجوز الاشتراك في البقرة أو البعير ولو كان بعض المشتركين لا يريد الأضحية ، بل يريد اللحم ليأكله أو ليبيعه أو غير ذلك .
قال النووي في "المجموع" 8/372 :
" يجوز أن يشترك سبعة في بدنة أو بقرة للتضحية , سواء كانوا كلهم أهل بيت واحد أو متفرقين , أو بعضهم يريد اللحم ، فيجزئ عن المتقرب , وسواء أكان أضحية منذورة أم تطوعا , هذا مذهبنا وبه قال أحمد وجماهير العلماء " انتهى .
وقال ابن قدامة في "المغني" 13/363 :
" وتجزئ البدنة عن سبعة , وكذلك البقرة ، وهذا قول أكثر أهل العلم . . ثم ذكر بعض الأحاديث الدالة على هذا ثم قال :
إذا ثبت هذا , فسواء كان المشتركون من أهل بيت , أو لم يكونوا , مفترضين أو متطوعين ، أو كان بعضهم يريد القربة وبعضهم يريد اللحم ; لأن كل إنسان منهم إنما يجزئ عنه نصيبه , فلا تضره نية غيره " انتهى .

Is it permissible to share in a sacrifice even if it is known that some of the participants do not have the intention of offering a sacrifice?.

Answer

Praise be to Allah.
In the answer to question no. (45757), we have stated that it is permissible for seven people to share in a camel or a cow, but it is not permissible to share a sheep.
It is permissible to share in a cow or a camel even if some of the participants do not have the intention of offering a sacrifice, and simply want the meat to eat it, sell it or whatever.
Al-Nawawi said in al-Majmoo’, 8/372:
It is permissible to have a share of one-seventh of a camel or a cow for sacrifice, whether all the people are members of the same household or not, or whether some of them just want the meat; that is sufficient on the part of the one who is offering the sacrifice, whether the sacrifice is in fulfilment of a vow or is offered voluntarily. This is our view and it is the view of Ahmad and most of the scholars. End quote.
Ibn Qudaamah said in al-Mughni (13/363):
A camel is sufficient on behalf of seven people, as is a cow. This is the view of the majority of scholars… then he quoted some ahaadeeth which indicate that, then he said:
Having established that, it makes no difference whether the partners are members of one household or not, whether they are offering an obligatory or voluntary sacrifice, or whether some of them have the intention of offering a sacrifice whilst others simply want the meat, because the share of each of them is sufficient for him and the intention of the others does not matter. هل تُجْزِئ نية العقيقة عن الأضحية والعكس ؟
س : هل تجزئ نيتا العقيقة والأضحية معا في عيد الأضحى ؟ وهل تصح العقيقة أم لا ؟ ساعدني ببيان ترجيح أعمال أقرب من السنة ؟
ج : الحمد لله
اختلف الفقهاء في هذه المسألة على قولين :
القول الأول : تجزئ الأضحية عن العقيقة ، وبه قال الحسن البصري ومحمد بن سيرين وقتادة ، وهو قول الحنفية ، وهو إحدى الروايتين عن الإمام أحمد .
وقد جعلوا هذه المسألة مثل مسألة اجتماع الجمعة والعيد ، وأنه يجزئ القيام بإحدى الصلاتين عن الأخرى ، فقد اشتركا في العدد والخطبة والجهر فكان الفعل واحداً ، وكذا هنا فإن الذبح واحد .
وقالوا أيضًا : كما لو صلى المسلم ركعتين ينوي بهما تحية المسجد وسنة المكتوبة .
القول الثاني : أنه لا تجزئ الأضحية عن العقيقة ، وهو قول المالكية ، والشافعية ، والرواية الأخرى عن الإمام أحمد .
وقال هؤلاء : إن الأضحية والعقيقة ذبيحتان لسببين مختلفين ، فلا تجزئ إحداهما عن الأخرى ، كما لو اجتمع دم التمتع ودم الفدية فإنه لا يجزئ أحدهما عن الآخر .
وقالوا : أيضًا : إن المقصود في الأضحية والعقيقة إراقة الدم في كل منهما ؛ لأنهما شعيرتان يُقصد منهما إراقة الدماء ، فلا تجزئ إحداهما عن الأخرى .
وقد سئل ابن حجر المكي الشافعي رحمه الله : عن ذبح شاة أيام الأضحية بنيتها ونية العقيقة ، فهل يحصلان أو لا ؟
فأجاب :
"الذي دل عليه كلام الأصحاب وجرينا عليه منذ سنين : أنه لا تداخل في ذلك ؛ لأن كلاًّ من الأضحية والعقيقة سنَّةٌ مقصودةٌ لذاتها ، ولها سبب يخالف سبب الأخرى ، والمقصود منها غير المقصود من الأخرى ، إذ الأضحيةُ فداءٌ عن النفس ، والعقيقةُ فداءٌ عن الولد ، إذ بها نُمُّوهُ وصلاحهُ ، ورجاءُ بِرِّهِ وشفاعته ، وبالقول بالتداخل يبطل المقصود من كلٍ منهما ، فلم يمكن القول به ، نظير ما قالوه في سنة غسل الجمعة وغسل العيد ، وسنة الظهر وسنة العصر ، وأما تحية المسجد ونحوها فهي ليست مقصودة لذاتها بل لعدم هتك حرمة المسجد ، وذلك حاصلٌ بصلاة غيرها ، وكذا صوم نحو الاثنين ؛ لأن القصد منه إحياء هذا اليوم بعبادة الصوم المخصوصة ، وذلك حاصلٌ بأي صومٍ وقع فيه ، وأما الأضحية والعقيقة ، فليستا كذلك كما ظهر مما قررته وهو واضح ..." انتهى. والذي يظهر ـ والله أعلم ـ أنه تجزئ ذبيحة واحدة بنية العقيقة والأضحية ، وقد اختار هذا القول فضيلة الشيخ محمد بن إبراهيم رحمه الله ، وذكرنا قوله ونقولاً أخرى في جواز ذلك في جواب السؤال رقم:106630 .

Does the intention of offering ‘aqeeqah count for the udhiyah as well, and vice versa?



Question

Is it acceptable to have the intention of offering the ‘aqeeqah and udhiyah together on Eid al-Adha? Is the ‘aqeeqah valid or not? Please tell me which of these actions is closer to the Sunnah?.

Praise be to Allah.
The fuqaha’ differed concerning this issue and there are two views:
The first view is that the udhiyah may also count as ‘aqeeqah. This is the view of al-Hasan al-Basri, Muhammad ibn Sireen and Qataadah, and it is the view of the Hanafis, and one of two views narrated from Imam Ahmad.
They regarded this issue as being like when Jumu’ah and Eid fall on the same day, and offering one of the two prayers counts for the other one too, because they have in common the number of rak’ahs, the khutbah and the fact that Qur’aan is recited out loud in the prayer, so the actions are the same. The same applies here, the act of slaughtering the animal is the same.
They also said: It is like when the Muslim prays two rak’ahs intending them to be both greeting the mosque and the regular Sunnah.
The second view is that the udhiyah does not count as the ‘aqeeqah too. This is the view of the Maalikis and Shaafa’is, and it is the other view narrated from Imam Ahmad.
These scholars said that the udhiyah and ‘aqeeqah are two different sacrifices offered for different reasons, so one of them cannot count as the other one too, just as if the sacrifice offered by the pilgrim doing tamattu’ and the sacrifice offered as a fidyah are combined, the one cannot count as the other too.
And they also said that the point of offering udhiyah and ‘aqeeqah is to shed the blood of the animal in both cases, because they are two rituals with the aim of shedding the blood of the animal, therefore one cannot count as the other too.
Ibn Hajar al-Makki al-Shaafa’i was asked about slaughtering a sheep on the days of sacrifice with the intention of both offering a sacrifice and offering ‘aqeeqah: does it serve both purposes or not?
He replied:
What is indicated by the words of our companions and we have been holding this view for many years, is that they cannot be combined, because both the udhiyah and the aqeeqah are Sunnah and each is done for its own sake and is done for a reason that is different than the other. The purpose behind one is not the same as the purpose behind the other, because the udhiyah is a sacrifice offered on behalf of oneself and the ‘aqeeqah is a sacrifice offered on behalf of one's child, because by its blessing one hopes that the child will be righteous and kind to his parents and may intercede for them. Saying that they may be combined negates the purpose behind both of them, so we cannot say that. This is like what they say about the Sunnah of doing ghusl for Jumu’ah and doing ghusl for Eid, and the Sunnah prayers of Zuhr and ‘Asr. As for the prayer to greet the mosque and so on, they are not done for their own sake, rather that is done so as not to transgress against the sanctity of the mosque, and that may be achieved by offering any other prayer. The same applies to fasting Mondays, because the purpose is to fill this day with worship by observing this special fast, but it may be achieved by observing any other fast on that day. But this does not apply to udhiyah and ‘aqeeqah, so they are not like that, as is clear from what I have stated… End quote.
Al-Fataawa al-Fiqhiyyah (4/256).
What seems to be the case – and Allaah knows best – is that it is acceptable to offer one sacrifice with the intention of ‘aqeeqah and udhiyah. This view was favoured by Shaykh Muhammad ibn Ibraaheem (may Allaah have mercy on him). We have mentioned his view and those of others in the answer to question no. 106630.

هل الأضحية واجبة على الحاج ؟
س: هل الأضحية واجبة على الحاج ؟
ج :الحمد لله
اختلف العلماء في حكم الأضحية ، فذهب جمهور العلماء إلى أنها سنة مؤكدة ، وذهب آخرون إلى أنها واجبة على القادر ، وقد يبق بيان ذلك في جواب السؤال :36432.
وهذا الخلاف إنما هو في حق غير الحاج ، وأما الحاج فقد اختلف العلماء في حكم الأضحية له ، بين قائلٍ بالمشروعية – سواء الاستحباب أم الوجوب - ، ومنهم من قال بعدم المشروعية.
والذين قالوا بعدم مشروعية الأضحية للحاج اختلفوا في سبب ذلك على قولين :
الأول : أن الحاج ليس له صلاة عيد ، ونسكه هو هدي التمتع أو القِران .
والثاني : أن الحاج مسافر ، والأضحية مشروعة للمقيمين ، وهذا قول أبي حنيفة ، وعنده أن الحاج إن كان من أهل مكة : فهو غير مسافر ، وتجب عليه الأضحية .
وهذا تفصيل مذاهبهم وبعض أقوالهم :
1. أما الحنفية : فقد جاء في " المبسوط " 6 / 171 :
"وهي واجبة على المياسير والمقيمين عندنا" . انتهى.
وفي " الجوهرة النيرة " 5 / 285 ، 286 :
"ولَا تجب عَلى الحَاجِّ الْمُسافر ، فأَمَّا أَهلُ مكَّةَ فإِنَّهَا تَجِبُ عَلَيهِم وإِنْ حَجُّوا" انتهى .
2. وأما المالكية : فقد قالوا بأنه لا أضحية على الحاج لكونه حاجًّا لا لكونه مسافرًا .
ففي " المدونة " 4 / 101 :
"قَالَ لِي مَالِكٌ : لَيس عَلَى الحَاجِّ أُضحِيةٌ وَإِن كَان مِن سَاكني مِنًى بَعدَ أَن يَكُون حاجًّا ،
قُلتُ : فالناسُ كلهُم عَلَيهِم الأَضَاحِي فِي قَولِ مَالِكٍ إلَّا الحَاجَّ ؟ قَالَ : نَعَم" انتهى .
3. وقال الشافعية باستحباب الأضحية للحاج وغيره .
قال الإمام الشافعي رحمه الله :
"والحاج المكي والمنتوي - أي المنتقل المتحول من بلد إلى بلد] والمسافر والمقيم والذكر والأنثى ممن يجد ضحية : سواء كلهم ، لا فرق بينهم ، إن وجبت على كل واحد منهم : وجبت عليهم كلهم ، وإن سقطت عن واحد منهم : سقطت عنهم كلهم ، ولو كانت واجبة على بعضهم دون بعض : كان الحاج أولى أن تكون عليه واجبة ؛ لأنها نسك وعليه نسك ، وغيره لا نسك عليه ، ولكنه لا يجوز أن يوجب على الناس إلا بحجة ولا يفرق بينهم إلا بمثلها" انتهى ." الأم " 2 / 348 .
4. وقال ابن حزم رحمه الله :
"والأضحية للحاج مستحبة كما هي لغير الحاج .
وقال قوم : لا يضحي الحاج ... .
وقد حضَّ رسول الله عليه السلام على الأضحية فلا يجوز أن يمنع الحاج من الفضل والقربة إلى الله تعالى بغير نص في ذلك" انتهى باختصار .
" المحلى " 5 / 314 ، 315 .
5. وأما الحنابلة : فالأضحية عندهم جائزة للحاج .
قال ابن قدامة رحمه الله :
"فَإِن لَم يَكُن مَعَه هَديٌ ، وَعَلَيهِ هَديٌ ، وَاجِبٌ ، اشتَرَاهُ ، وَإِن لَم يَكُن عَلَيهِ وَاجِبٌ ، فَأَحَبَّ أَن يُضَحِّيَ ، اشتَرَى ما يُضَحِّي بِه" ." المغني " 7 / 180 .
وقد جاء في الحديث عن عَائِشَةَ رضي الله عنها (أَنَّ النَّبِيَّ صلى الله عليه وسلم ضَحَّى عَنْ نِسَائِهِ بِمِنًى فِي حَجَّةِ الْوَدَاعِ) رَوَاهُ الْبُخَارِيُّ : 5239 - وَمُسْلِمٌ : 1211 .
وقد ردَّ بعض أهل العلم – كابن القيم - الاستدلال بهذا الحديث ، وقالوا : إن المراد بالأضحية هنا : الهدي .
وانظر : " زاد المعاد " 2 / 262 – 267 .
واختار شيخ الإسلام وتلميذه ابن القيم أن الحاج لا يضحي ، وانظر " الإقناع " 1 / 409 . و " الإنصاف " 4 / 110 . ورجح هذا القول الشيخ ابن عثيمين رحمه الله ، فقد سئل رحمه الله : كيف يجمع الإنسان بين الأضحية والحج ، وهل هذا مشروع ؟
فأجاب "الحاج لا يضحي ، وإنما يهدي هدياً ، ولهذا لم يضحِ النبي صلى الله عليه وسلم في حجة الوداع وإنما أهدى ، ولكن لو فرض أن الحاج حج وحده وأهله في بلده فهنا يدع لأهله من الدراهم ما يشترون به أضحية ويضحون بها ، ويكون هو يهدي ، وهم يضحون ، لأن الأضاحي إنما تشرع في الأمصار ، أما في مكة فهو الهدي " انتهى من "اللقاء الشهري".

Is the udhiyah obligatory for the pilgrim doing Hajj?.

Answer
Praise be to Allah.
The scholars differed concerning the ruling on the udhiyah. The majority of scholars are of the view that it is Sunnah mu’akkadah (a confirmed Sunnah), and others are of the view that it is obligatory for the one who can afford it. This has been discussed in the answer to question no. 36432.
This difference of opinion has to do with people other than the one who is performing Hajj. As for the pilgrim, the scholars differed as to the ruling on offering an udhiyah in his case. Some say that it is prescribed – whether they regard it as mustahabb or obligatory, and others said that it is not prescribed.
Those who say that the udhiyah is not prescribed for the pilgrim differed as to the reason for that, and there are two opinions:
(i)because there is no Eid prayer for the pilgrim, and his sacrifice is the hadiy of tamattu’ or Qiraan
(ii)because the pilgrim is a traveller, and the udhiyah is prescribed for those who are not travelling. This is the view of Abu Haneefah, according to whom if the pilgrim is one of the people of Makkah, then he is not a traveller, so it is obligatory for him to offer the udhiyah.
There follow details of their views and some of their comments.
1.
The Hanafis. It says in al-Mabsoot (6/171):
It is obligatory for the one who can afford it and for non-travellers in our opinion. End quote.
In al-Jawharah al-Nayyarah (5/285, 286) it says:
It is not obligatory for the pilgrim who is a traveller. As for the people of Makkah, it is obligatory for them even if they do Hajj. End quote.

The Maalikis. They said that the pilgrim does not have to offer an udhiyah because he is a pilgrim not because he is a traveller.
In al-Mudawwanah (4/101) it says:
Maalik said to me: The pilgrim does not have to offer an udhiyah even if he is one of the inhabitants of Mina once he is performing Hajj. I said: Do all people have to offer the udhiyah according to Maalik’s view except the pilgrim? He said: Yes. End quote.

The Shaafa’is said it is mustahabb to offer the udhiyah for the pilgrim and for others.
Imam al-Shaafa’i (may Allaah have mercy on him) said:
The Makkan pilgrim, the one who is in transit from one country to another, the traveller, the non-traveller, and the male and female who can afford an udhiyah, are all the same and there is no difference between them. If it is obligatory for each one of them then it is obligatory for all of them and if it is waived for one of them then it is waived for all of them. If it is obligatory for some of them and not others, then the pilgrim is the one for whom it is most likely to be obligatory, because it is a sacrifice and he has to offer a sacrifice, whereas others do not have to offer a sacrifice. But it is not permissible to make something obligatory for the people without proof or to differentiate between them without the same. End quote.
Al-Umm (2/348)

Ibn Hazm (may Allaah have mercy on him) said:
The udhiyah for the pilgrim is mustahabb as it is for non-pilgrims.
Some people said: The pilgrim does not offer an udhiyah.
The Messenger of Allaah (peace and blessings of Allaah be upon him) encouraged offering the udhiyah, so it is not permissible to deny the pilgrim the virtue and possibility of drawing closer to Allaah without a text to that effect. End quote.
Al-Muhalla (5/314, 315)

According to the Hanbalis, it is permissible for the pilgrim to offer an udhiyah.
Ibn Qudaamah (may Allaah have mercy on him) said:
If he does not have a hadiy (sacrificial animal) with him, and he has to offer a hadiy because it is obligatory for him, then he should buy it. If it is not obligatory for him, but he wants to offer an udhiyah, then he may buy an animal that may be offered as such.
Al-Mughni (7/180)
In the hadeeth from ‘Aa’ishah (may Allaah be pleased with her) it says that the Prophet (peace and blessings of Allaah be upon him) offered an udhiyah on behalf of his wives in Mina during the Farewell Pilgrimage. Narrated by al-Bukhaari (5239) and Muslim (1211).
Some of the scholars – such as Ibn al-Qayyim – rejected this interpretation of the hadeeth and said that what was meant by udhiyah here was the hadiy.

Shaykh al-Islam Ibn Taymiyah and his student Ibn al-Qayyim favoured the view that the pilgrim should not offer an udhiyah. See al-Iqnaa’ (1/409) and al-Insaaf (4/110). This view was also regarded as more correct by Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him). He (may Allaah have mercy on him) was asked: How can a person combine udhiyah and Hajj, and is that prescribed?
He replied: The pilgrim does not offer an udhiyah, rather he offers a hadiy. Hence the Prophet (peace and blessings of Allaah be upon him) did not offer an udhiyah during the Farewell Hajj, rather he offered a hadiy. But if we assume that he is doing Hajj by himself and his family are in his homeland, then in that case he should leave his family enough money to buy an animal and offer it as an udhiyah, so he will be offering a hadiy and they will be offering an udhiyah, because the udhiyah is only prescribed in places other than Makkah, but in Makkah it should be a hadiy.
