السؤال

أهل البيت "الورثة" يحاولون طرد الأسرة المستأجرة بجميع الوسائل وبدون أي خوف من غضب الله عليهم, يشتمونهم ويقذفهم بالكبيرة علانية والناس تسمع, يضربوهم وتتدخل الشرطة في كل مرة ثم المحكمة - الأسرة المستأجرة متضررة و في أزمة من شدة الذل والفقر - الأسرة المتضررة لها مكان عبارة عن مخزن تحت عمارة حاليا غير صالح للسكن أبدا , يريدون تعديله والسكن فيه. سؤالي : هل يجوز لي قرض الأسرة بحيث تعدل هذا المخزن كسكن نظيف الذي سيكلف تقريبا 25 ألف ريال , ثم استرجع مالي من مال الزكاة أو الصدقات ؟ يعني أساعدهم ماليا وبِنيَّت أن أقضي الدين أنا لنفسي من مال الصدقات أو الزكاة من عند أهلي ومعارفي ؟
الجواب
الحمد لله.
يجوز لك إقراض هذه الأسرة ما تحتاج إليه من مال لإصلاح مسكنها ، ثم أخذ ذلك من الزكاة لكونك دائنة لهم ، ولكونهم غارمين ، ومعلوم أن الغارم من الأصناف المستحقة للزكاة ، ولا يشترط دفع الزكاة إليهم ، بل يجوز أن يدفع المال إلى الدائن مباشرة .
هذا إذا جرى بينك وبينهم إقراض صريح . وكذلك إذا أعطيتهم المال لأجل الإصلاح بيتهم وقطع الخصومة ونويت الرجوع على أهل الزكاة .
ورَجَّح الشيخ ابن عثيمين رحمه الله وجها ثالثًا ، وهو أنه يجوز دفع المال للمستحق – ولو لم توجد خصومة- بنية الزكاة عن شخص من الأغنياء ، فإن رضي الغني وأجازه ، حسب ذلك من زكاته .
فهذه ثلاثة أوجه جائزة في مسألتك : الإقراض الصريح ، وإعطاؤهم لإصلاح ذات البَين بنية الرجوع على أهل الزكاة ، وإعطاؤهم زكاة فلان من الناس ممن تعلمين أن لديه زكاة ، ثم إخباره واستجازته .
قال في "كشاف القناع" (2/283) "وإن دفع المالك زكاةً إلى الغريم -الدائن- عن دين الغارم بلا إذن الفقير الغارم صح وبرئ لأنه دفع الزكاة في قضاء دين المدين , أشبه ما لو دفعها إليه فقضى بها دينه " انتهى .
وقال الشيخ ابن عثيمين رحمه الله " إصلاح ذات البين أن يكون بين جماعة وأخرى عداوة وفتنة فيأتي آخر ويصلح بينهم، لكن قد لا يتمكن من الإصلاح إلا ببذل المال، فيقول: أنا ألتزم لكل واحدة منكم بعشرة آلاف ريال بشرط الصلح، ويوافقون على ذلك، فيُعطى هذا الرجل من الزكاة ما يدفعه في هذا الإصلاح، فيعطى عشرين ألفًا.
وإذا وَفَّى من ماله فإنه لا يُعطى؛ لأنه إذا وفَّى من ماله لا يكون غارماً، فليس عليه دَيْن الآن.
ولكن ينبغي التفصيل فيقال: يُعْطَى من الزكاة في حالين:
1 ـ إذا لم يوف من ماله؛ فهنا ذمته مشغولة، فلا بد أن نفكه.
2 ـ إذا وَفَّى من ماله بنية الرجوع على أهل الزكاة؛ لأجل ألا نسدَّ باب الإصلاح، وقد قال الله تعالى" لاَ خَيْرَ فِي كَثِيرٍ مِنْ نَجْوَاهُمْ إِلاَّ مَنْ أَمَرَ بِصَدَقَةٍ أَوْ مَعْرُوفٍ أَوْ إِصْلاَحٍ بَيْنَ النَّاسِ " النساء/114؛ ولأن الحال قد تقتضي الدفع فوراً " انتهى من "الشرح الممتع" 6/233.
وقال أيضا : " قال العلماء: وهكذا كل من أدى عن غيره دَيْناً واجباً، فإنه يرجع إن نوى الرجوع، ولو بغير إذنه، إلا إذا كان الدَّيْن مما تشترط فيه نية المدين، فإنه لا يرجع إلا بإذن، مثل الزكاة والكفارة؛ لأن الذي عليه الزكاة لم ينوِ ولم يوكل.
مثاله: جاء رجل وقال: أنا سأذهب إلى المجاهدين أعطوني دراهم من الزكاة، وكنت أعلم أن صاحبي عنده زكاة كثيرة، فأعطيت هذا الرجل ثلاثين ألفاً على أنها زكاة صاحبي فهل أرجع؟ لا؛ لأن الزكاة تجب فيها النية، وهنا الذي عليه الزكاة لم ينو، وأما الثلاثون ألفاً فلا تذهب، بل عند الله وفيها أجر وتكون صدقة للذي بذلها.
فلو أنني أخبرته، وقلت: إنني دفعت عنك زكاة، فقال: جزاك الله خيراً، وأنا مجيز لك هذا التصرف، فالمذهب لا يجزئ؛ لعدم وجود النية حين الدفع، والصحيح جواز ذلك ، والدليل على ذلك حديث أبي هريرة رضي الله عنه في قصة حفظه التمر، وهو وكيل للرسول صلّى الله عليه وسلّم على صدقة الفطر يحفظها، فجاءه الشيطان ليلة من الليالي وأخذ من التمر فأمسكه أبو هريرة، فقال الشيطان: إنه فقير وله عائلة، فَرَقَّ له أبو هريرة وتركه، وهكذا الليلة الثانية، والليلة الثالثة قال: لا بد أن تذهب إلى الرسول صلّى الله عليه وسلّم فخاف من الرسول صلّى الله عليه وسلّم وقال: أخبرك بآية تقرؤها، فإن قرأتها في ليلة لم يزل عليك من الله حافظ ولا يقربك شيطان حتى تصبح، فأعلمه بآية الكرسي، فلما أصبح قال له الرسول صلّى الله عليه وسلّم: ما فعل أسيرك البارحة؟ وقال: إنه صدقك وهو كذوب، فقال: أتدري من تخاطب منذ ثلاثة أيام؟ فقال: لا، فقال: ذلك شيطان .
فأبو هريرة رضي الله عنه حين دفع من الزكاة لم يدفع بإذن الرسول، لكن الرسول عليه الصلاة والسلام أجازه.
فالصحيح أن الإنسان لو دفع عن غيره زكاة وأجازه الغير، فإن الصحيح جواز ذلك " انتهى من "الشرح الممتع" 9/199.

Lending money to a poor person with the intention of getting it back from the people who pay zakaah


Question

The people who acquired the house by inheritance are trying to evict the family who are renting it by all means and with no fear of Allaah's wrath. They revile them and slander them in the nastiest of terms whilst people are listening, and they beat them. The police intervene all the time, and then the courts. The family are suffering and going through hardship of humiliation and poverty. This family that is suffering has a place, namely a store under a building but at the moment it is not fit to live in at all. They want to alter it and live in it.
My question is: is it permissible for me to lend money to the family so that they can fix up the store as a clean place to live in, which will cost approximately 25,000 riyals, then get my money back from zakaah or charity money? In other words, can I help them financially with the intention of recovering the debt myself from the money of charity or zakaah from my family and acquaintances? Please advise me concerning this issue, may Allaah bless you
.


Answer

Praise be to Allah.
It is permissible for you to lend this family what they need of money to renovate their home, then take that from zakaah because you are lending it to them and they will be in debt, and it is well known that the debtor is among the groups of people who are entitled to zakaah, and it is not essential that the zakaah be given to them, rather it is permissible to give the money to the lender directly.
This applies if it is clearly and unambiguously identified as a loan. The same applies if you give the money to them for the purpose of reconciliation and so as to stop the dispute, and you intend to get it back from those who give zakaah.
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) preferred a third way, which is that it is permissible to give the money to the one who is entitled to it -- even if there is no dispute -- with the intention of giving zakaah on behalf of a rich person. If the rich person agrees to that and allows it, then it will be counted as part of his zakaah.
These three ways are all permissible in your case: giving an unambiguous loan, giving it to them so as to reconcile between people with the intention of getting it back from those who give zakaah, and giving them the zakaah of so-and-so, someone who you know has money to give as zakaah, then telling him about it and asking his consent.
It says in Khashshaaf al-Qinaa’ (2/283): if a person who has zakaah gives it to the lender to pay the debt of the debtor without the permission of the poor person who is in debt, it is sound and valid, because he has given zakaah to pay off the debts of the debtor. This is similar to giving it to him to pay off his debts with it. End quote.
Shaykh Ibn ‘Uthaymeen (Allaah have mercy on him) said: Reconciling between people -- if there is enmity and trouble between one group and another, then another person comes and reconciles between them, but reconciliation may not be possible except by giving money, so he says: I make a commitment to give each one of you 10,000 riyals provided that you reconcile, and they agree to that. So this man may be given zakaah in the amount that he would have spent on reconciliation, so he may be given 20,000.
But if the poor person pays it off himself from his own money, then he should not be given zakaah, because if he pays it off from his own money then he is not a debtor and is not in debt now.
But this matter is subject to further discussion and it may be said that he can be given zakaah in two cases:
1.If he did not pay off the debt from his own money. In this case he is still in debt and it is essential to relieve him.
2.If he paid it off from his own money with the intention of getting it back from those who pay zakaah, so as not to close the door to reconciliation. Allaah says (interpretation of the meaning): “There is no good in most of their secret talks save (in) him who orders Sadaqah (charity in Allaah’s Cause), or Ma‘roof (Islamic Monotheism and all the good and righteous deeds which Allaah has ordained), or conciliation between mankind” [al-Nisa’ 4:114]. And because the situation may dictate that payment be made immediately. End quote from al-Sharh al-Mumti’ (6/233).
He also said: scholars said that this applies to everyone who pays an obligatory debt on behalf of someone else. He may collect it, even without the permission (of the debtor), unless the debt is of the type where the intention of the debtor is stipulated, in which case he can only do that with permission, as in the case of zakaah and expiation, because the one who has to pay the zakaah did not intend that and did not ask anyone to do it on his behalf.
An example of that is where a man comes and says: I am going to join the mujaahideen, give me some zakaah money, and I know that my friend has a lot of zakaah to be paid. So I gave this man 30,000 on the basis that it is my friend’s zakaah -- can I get it back? The answer is no, because the intention is essential in the case of zakaah, and in this case the one who owes zakaah did not have that intention. But the 30,000 is not wasted; rather there is great reward with Allaah for it and it will be charity on the part of the one who gave it.
If I tell him about that and say: I gave zakaah on your behalf, and he says: May Allaah reward you with good, I give my consent for that, then according to the madhhab this does not count as zakaah, because the intention was not there at the time when it was paid. But the correct view is that this is permissible, and the evidence for that is the hadeeth of Abu Hurayrah (may Allaah be pleased with him) and the story about his guarding the dates, when the Messenger (blessings and peace of Allaah be upon him) appointed him to guard the sadaqat al-fitr, and the Shaytaan came to him one night and took some of the dates. Abu Hurayrah grabbed him and the Shaytaan said that he was poor and had a family, so Abu Hurayrah felt sorry for him and let him go. This happened again on the second night, and on the third night he said: “You have to go to the Messenger (blessings and peace of Allaah be upon him.” He was afraid of the Messenger (blessings and peace of Allaah be upon him) and said: “I will tell you of a verse, that if you recite it at night you will have a guardian with you from Allaah and no devil will come near you until morning.” And he taught him Aayat al-Kurisy. The following morning, the Messenger (blessings and peace of Allaah be upon him) said to him: “What happened to your prisoner last night?” And he said: “He told you the truth even though he is a liar.” And he said: “Do you know who you have been talking to for the last three nights?” He said No.” He said: “That was a devil.”
Abu Hurayrah (may Allaah be pleased with him), when he gave some of that zakaah, did not give it with the permission of the Messenger, but the Messenger (blessings and peace of Allaah be upon him) allowed it.
So the correct view is that if a person gives zakaah on behalf of another person, and that person allows it, then the correct view is that it is valid and permissible. End quote from al-Sharh al-Mumti’ (9/199).

Question

Des héritiers d'un immeuble cherchent par tous les moyens et sans craindre de s'exposer à la colère divine à en expulser les locataires. Ils les insultent, les accusent publiquement de commettre l'adultère et les frappent. Il s'ensuit chaque fois l'intervention de la police puis celle du tribunal. Les locataires vivent dans la gêne due à une pauvreté avilissante. Ils ne possèdent qu'un abri souterrain situé dans un immeuble inhabitable. Ils veulent le réfectionner pour y habiter. Ma question est la suivante: m'est il permis de leur prêter les 25000 rials nécessaire pour rendre l'abri propre et habitable, quitte à me faire rembourser grâce aux recettes de la zakat et de l'aumône? En d'autres termes, je les aides financièrement avec l'intention de me faire rembourser grâce à des zakat et aumônes collectées auprès des membres de ma famille et de mes connaissances.

Louanges à Allah Il vous est permis de prêter à cette famille ce dont elle a besoin pour réfectionner son logement, et de vous faire rembourser votre dette grâce à la zakat, puisque vous êtes pour eux un créancier, et eux pour vous, des débiteurs. Or, il est bien connu que les débiteurs sont des destinataires de la zakat. Ce n'est pas une condition de validité de la zakat que de la leur remettre directement car on peut bien la remettre à leur créancier. Tel doit être le cas , si vous leur avez fait un prêt direct. Ce serait également le cas, si vous leur donniez de l'argent dans le cadre du règlement d'un différend les opposant à d'autres avec l'intention de vous faire rembourser grâce à la zakat.
Cheikh Ibn Outaymine (Puise Allah lui accorder Sa miséricorde) soutient une troisième opinion, à savoir qu'il est permis de donner de l'argent à un ayant droit, même en l'absence d'un différend, avec l'intention d'en faire une zakat au nom et à la place d'un riche. Si celui-ci agrée l'opération, on déduit le montant donné de sa zakat. Voilà trois possibilités concernant votre question: octroyer un prêt direct, donner de l'argent au titre de règlement d'un différend avec l'intention de se faire rembourser grâce à la zakat à acquitter, donner de la zakat au nom et la place de quelqu'un que vous savez redevable de la zakat, quitte à l'informer et demander son accord a posteriori.
L'auteur de kashf al-Quinaa (2/283) dit: Si ondonne de la zakat à un créancier à la place d'un débiteur, sans l'autorisation de ce dernier, l'opération est juste et le débiteur devient quitte puisque la zakat est acquitté pour régler une dette. C'est comme si on la remettait au débiteur pour qu'il paie lui-même sa dette.
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) a dit: «La réconciliation consiste à écarter des hostilités et risques de confrontation entre deux groupes en facilitant leur entente. Elle peut nécessiter l'usage de l'argent et pousser le réconciliateur à dire: je m'engage à remettre à chaque partie 10000 rials, à condition de l'acceptation des termes de la réconciliation. Puis onprélève des recettes de la zakat le même montant afin de lui rembourser son avance. Si celle-ci était prélevée de ses fonds personnels, on ne la lui rembourserait pas avec les recettes de la zakat, car il ne serait pas un débiteur. Cependant la question doit être examinée de façon détaillée. On utilise les recettes de la zakat pour rembourser le réconciliateur dans deux cas:
1.Si l'avance qu'il a faite n'est pas prélevée de ses propres fonds car il est alors un débiteur qu'il faut libérer.
2.S'il avance de ses propres fonds avec l'intention de se faire rembourser par des donateurs de zakat car il faut éviter de fermer la porte de la réconciliation à propos de laquelle le Très Haut: Il n'y a rien de bon dans la plus grande partie de leurs conversations secrètes, sauf si l'un d'eux ordonne une charité, une bonne action, ou une conciliation entre les gens. Et quiconque le fait, cherchant l'agrément d'Allah, à celui-là Nous donnerons bientôt une récompense énorme (Coran,4:114) et parce que la situation peut nécessiter un rapide remboursement.» Extrait de ach-charh al-moumti',6/233.
Il dit encore: «Les ulémas affirment que doit être traité de la même manière toute personne qui règle une dette à la place d'une autre; il faut lui permettre de se faire rembourser si telle était son intention, même sans l'autorisation du débiteur, à moins qu'il s'agisse d'une dette dont le règlement s'accompagne de l'intention du débiteur (comme la zakat et les dépenses expiatoires). Car, dans ce cas, celui qui règle la dette à la place de ce dernier ne peut pas se faire rembourser sans sa permission parce que celui qui est tenu d'acquitter personnellement la zakat n'en a pas formulé l'intention et n'a pas donné procuration à celui qui a payé la zakat. Voici un exemple: un homme se présente et dit: je vais rejoindre les combattants au nom d'Allah (Moudjahidine). Donnez moi des recettes de la zakat..Sachant que mon compagnon détient une importante somme de ces recettes, j'ai donné au solliciteur 30000 à titre de la zakat à prélever auprès de mon compagnon. M'est il permis de m'adresser à celui-ci pour me faire rembourser? Non, parce l'acquittement de la zakat doit s'accompagner de l'intention de celui qui est tenu de le faire, ce qui n'est pas le cas ici. Quant au 30000, il n'est pas perdu. Il est reçu par Allah qui en assurera la récompense. Il sera considéré comme une aumône de la part du donneur. Si je l'avais informé en lui disant: j'ai acquitté la zakat à ta place et qu'il dit: puisse Allah te récompenser par le bien. J'approuve ton geste, la procédure ne serait pas valide, selon notre doctrine juridique à cause de l'absence de l'intention de la part du principal intéressé au moment de l'accomplissement de l'acte. Ce qui est vrai, c'est que la procédure est juste. La preuve en réside dans un hadith d'Abou Hourayra (P.A.a) relatif au récit portant sur les dattes dont il était chargé de la garde en tant que mandant du Messager d'Allah ( Bénédiction et salut soient sur lui) pour la conservation des recettes de la zakat de rupture du jeûne. Un démon s'était présenté à lui nuitamment et se mit à puiser des dattes. Abou Hoyarara se saisit de lui. L'intrus lui dit qu'il était pauvre et avait en charge une famille. Abou Hourayra eut pitié de lui et le lâcha. Quand il récidiva une deuxième et une troisième fois, Abou Hourayra lui dit: il faut que nous nous en référions au Messager d'Allah (Bénédiction et salut soient sur lui). Le démon eut peur du Messager d'Allah (Bénédiction et salut soient sur lui) et dit: je t'apprends un verset du Coran que tu vas réciter chaque nuit car si tu le fais Allah t'affectera un gardien qui empêchera les démon de s'approcher de toi. Ensuite, il lui apprit le verset du Trône. Au matin, le Messager (Bénédiction et salut soient sur lui ) lui dit: qu'a fait ton prisonnier d'hier?..Il t'a parlé vrai ( cette fois-ci), bien que menteur..Sais-tu à qui tu avais affaire depuis trois jours?- Non.-C'était un démon.
Abou Hourayra (P.A.a) n'avait pas agi avec la permission du Messager quand il avait laissé puiser dans la zakat, mais le Messager (Bénédiction et salut soient sur lui ) approuva son geste. Ce qui est juste, c'est que si quelqu'un paye la zakat à la place d'un autre et que ce dernier approuve, l'acte est validé." Extrait d'ach-Charh al-Moumt',9/199.
