Résumé des cas et dispositions concernant la zakat du foncier


الحمد لله.
من المعلوم أن للعقار اليوم وضعًا مختلفًا عن السابق من حيث الرواج والإقبال ، وله أحوال يختلف حكم الزكاة باختلافها .
والعقار: يُراد به ما يملكه الإِنسان من الأراضي ، والمنشآت التي عليها من : البيوت، والقصور، والعمائر، والشقق، والدكاكين، ومحطات الوقود، والاستراحـات ، ونحوها.
ولتفصيل الكلام في زكاة العقار يقال:
1- القاعدة العامة في هذا الباب : أن العقار ليس من الأموال الزكوية ، ولذلك فالأصل عدم وجوب الزكاة فيه إلا إذا كان للتجارة .
2- العقار الذي يتخذه الإنسان للسكنى أو لأيِّ استعمالٍ شخصي كمستودع ونحوه : لا زكاة فيه باتفاق العلماء.
وذلك لأن العقار يعد في هذه الحال من أموال القنية ، والزكاة لا تجب فيها بالاتفاق .

وسواء أكانت نية القنية موجودة عند الشراء ، أو طرأت بعد ذلك ، فمجرد نية اقتناء العقار للاستعمال الشخصي تجعله مالاً غير زكوي ، حتى لو بقي سنوات عديدة ، ما دامت نية مالكه لم تتغير عن هذا القصد .

3- الأرض الزراعية لا زكاة فيها ، وإنما تجب الزكاة في الزروع والثمار فقط .
أما إذا اشترى أرضاً للتجارة ، وزرعها ريثما يبيعها ، فأثمر النخل ونبت الزرع ، فإنه يزكي الثمرة والحب : زكاة العشر، ويزكي الأرض : زكاة القيمة ؛ لأنهما حقان يختلف سبب وجوبهما ، فلا يسقط أحدهما بالآخر.
قال زكريا الأنصاري " فَإِنْ زَرَعَ زَرْعًا لِلْقِنْيَةِ فِي أَرْضٍ لِلتِّجَارَةِ : فَلِكُلٍّ مِنْهُمَا حُكْمُهُ ، فَتَجِبُ زَكَاةُ الْعَيْنِ فِي الزَّرْعِ ، وَزَكَاةُ التِّجَارَةِ فِي الْأَرْضِ "انتهى من "أسنى المطالب" (1/385).

4- العقار الذي يتملكه الإنسان بقصد الاستغلال ، أي لتأجيره والاستفادة من ريعه وغلته : لا زكاة في قيمته ، وإنما الزكاة في الأجرة المتحصلة منه إذا حال عليها الحول .
فالمساكن والمستودعات والشقق المفروشة والفنادق والعمائر: كل هذه العقارات إذا أعدت للتأجير : لا زكاة فيها عند عامة العلماء ، فلا يلزمه تقويم هذا العقار كل سنة وإخراج زكاته .

5- العقار الذي يتملكه الإنسان بنية التجارة : تجب فيه الزكاة عند عامة العلماء.
والمراد بنية التجارة : أن ينوي بتملك هذا العقار التكسب منه والتربح .
قال المرداوي " مَعْنَى " نِيَّةِ التِّجَارَةِ : أَنْ يَقْصِدَ التَّكَسُّبَ بِهِ بِالِاعْتِيَاضِ عَنْهُ ".
انتهى من "الإنصاف" (3/154).
أما مجرد إرادة البيع فلا تجعله بالضرورة من عروض التجارة ؛ لأن بيع السلع يكون لمقاصد كثيرة كالتخلص من السلعة ، أو عدم الرغبة فيها أحيانا ، أو وجود ضائقة مالية ، أو نحو ذلك ، أما التجارة : فهي البيع بقصد التكسب والتربح منها .
وقد ذكر الشيخ ابن عثيمين لو أن رجلا عنده أرض اشتراها يريد أن يبني عليها ثم عدل عن هذه النية ونوى أن يبيعها لاستغنائه عنها ، أو أن إنسانا عنده أراض فاحتاج , فنوى أن يبيع واحدة منها لدفع حاجته ، فقال : " فليس عليه زكاة لا في هذه ولا في التي قبلها , لأنه ما نوى البيع هنا للتجارة , لكن نواه في المسألة الأولى لاستغنائه عنها , وفي المسألة الثانية نواه لحاجته إلى قيمتها , بخلاف صاحب العروض فإنه ينتظر فيها الربح ، فهو من الأصل لا يريد إلا أن تكون للتجارة" انتهى من "فتح ذي الجلال" (6/173).

6- إذا تملك العقار ولم يجزم بقصد التجارة أو لم تكن له نية محددة : فلا زكاة فيه .
قال القرافي: " فَإِنِ اشْتَرَى وَلَا نِيَّةَ لَهُ فَهِيَ لِلْقِنْيَةِ ؛ لِأَنَّهُ الْأَصْلُ فِيهَا " .
انتهى من " الذخيرة "(3/18) .
وسئل الشيخ ابن عثيمين رحمه الله تعالى: رجل عنده أرض واختلفت نيته فيها، لا يدري هل هو يبيعها أو يعمرها أو يؤجرها أو يسكنها، فهل يزكي إذا حال الحول؟
فأجاب: " هذه الأرض ليس فيها زكاة أصلاً ما دام ليس عنده عزم أكيد على أنها تجارة ، فليس فيها زكاة لأنه متردد ، ومع التردد لو واحداً في المائة فلا زكاة عليه".

7- إذا تملك العقار للقنية والسكنى ، ثم نوى به التجارة بعد ذلك ، ففي وجوب الزكاة فيه خلاف
، وقد سبق ترجيح القول بوجوب الزكاة فيها .

8- إذا تملك العقار بنية التجارة ، ثم غير نيته ونوى فيه القنية والاستعمال أو التأجير: فلا زكاة فيه.
لأن شرط النية استصحابها حتى نهاية الحول ، فإذا غير نيته قبل نهاية الحول: سقطت الزكاة .
قال النووي: " لَوْ قَصَدَ الْقُنْيَةَ بِمَالِ التِّجَارَةِ الَّذِي عِنْدَهُ فَإِنَّهُ يَصِيرُ قُنْيَةً بِالِاتِّفَاقِ" .
انتهى من "المجموع " (6/ 49).

9- إذا تملك العقار للقنية مع التجارة ، أو للتجارة مع القنية : فالعبرة بأصل التملك .
فمن اقتنى شيئاً من السلع بنية الاستعمال ، ونوى تبعاً أنه إن وجد فيه ربحا باعه : فلا زكاة عليه .
ومن اقتنى شيئاً من السلع بنية التجارة ، واستعمله وانتفع به ريثما يتم بيعه : فتجب فيه الزكاة كل سنة حتى يتم بيعه .
وكذلك إذا قصد الاستعمال والانتفاع لمدة محددة قبل البيع : فتجب فيها زكاة العروض ؛ لأن نية الاستعمال أولاً لا تنافي كونها مرصدةً للتجارة .

10- إذا كان العقار لا يزال في مرحلة البناء والإنشاء – وهو للتجارة - فتجب فيه الزكاة سواء كان معروضاً للبيع أو لن يتم بيعه إلا بعد الانتهاء من بناءه ، ويزكيه بحسب قيمته على حالته الراهنة وقت وجوب الزكاة .

11- العقار الذي يتربص به صاحبه ارتفاع الأسعار: تجب الزكاة فيه كل سنة بحسب قيمته ، ولو بقي سنين .
فشراء العقار على نية التربح منه في المستقبل البعيد : لا يسقط الزكاة عنه .
ومنه شراء المخططات البعيدة عن البلد انتظاراً لوقت رغبة الناس فيها وارتفاع سعرها : فهذه النية المستقبلية في بيع الأرض موجبة لزكاتها، ولا تأثير لتأجيل نية البيع ، ما دامت الأرض مرصدة للتجارة ، والمقصود منها نماء المال.
وهذا يسميه أهل العلم "التاجر المتربص" وأصح الأقوال فيه هو ما ذهب إليه جمهور العلماء من وجوب الزكاة عليه في كل عام .

12- العقار الذي يشتريه صاحبه بنية حفظ المال : لا زكاة فيه إلا إن قصد الفرار من الزكاة.
وقد سبق بيان هذا في جواب السؤال : (231857) .

13- إذا اشترى عقاراً تجارياً ولم يقبضه حتى حال الحول على المال الذي اشتراه به : فتجب الزكاة فيه ؛ لأن العقار تنتقل ملكيته للمشتري بمجرد العقد ، والقبض مقدور عليه بالنسبة له.
سئل الشيخ ابن عثيمين - رحمه الله تعالى -: رجل اشترى أرضاً معدة للتجارة بمبلغ من المال، علماً بأن هذا الرجل لم يستلم الأرض حتى الآن، ولا حتى صكها، فهل عليها زكاة؟
فأجاب بقوله: " نعم عليه الزكاة في هذه الأرض، ولو لم يستلم الصك، مادام البيع قد ثبت ولزم، فيزكيها زكاة عروض تجارة، فيقومها حين وجوب الزكاة بما تساوي، ويخرج ربع عشر قيمتها". انتهى من "مجموع فتاوى ورسائل العثيمين" (18/ 234).

14- العقارات المرهونة : تجب فيها الزكاة إذا كانت معدة للتجارة .
قال الشيخ ابن باز : " فإن كنت أعددتها للتجارة وهي مرهونة فعليك زكاتها، وإن كانت مرهونة ولم تعد للتجارة ، ولكن مرهونة حتى توفيه حقه، وإذا أوفيته فهي للسكن أو للتأجير، فهذه ليس فيها زكاة ". انتهى من "فتاوى نور على الدرب" (15/43).

15- الشركاء في ملكية العقار يزكي كل واحد منهم نصيبه إذا كان قد بلغ النصاب عند الجمهور .
قال الشيخ بكر أبو زيد : "الشركاء في عقار يشترط في وجوب الزكاة على كل واحد منهم, أن تبلغ قيمة نصيبه من العقار نصاباً في نفسه, أو بضمه إلى مال لـه زكوي آخـر من نقد عُرُوْض تجارة" انتهى من " فتوى جامعة في زكاة العقار "صـ 12
وقد سبق في جواب السؤال : (147855) بيان أن مذهب الشافعية العبرة بالمجموع لا بنصاب كل فرد ، فإذا كانت قيمة العقار تبلغ النصاب يجب على كل واحد منهم الزكاة ولو كان نصيبه لا يبلغ النصاب .
وبه أخذ مجمع الفقه الإسلامي ، ومال له الشيخ ابن عثيمين .

16- العقار الموقوف على جهات البر العامة كالفقراء: لا زكاة فيه؛ لانتفاء الملك.

17- لا فرق في وجوب الزكاة بين العقار الرائج والكاسد ما دام له قيمة يباع بها .
وهذا مذهب جمهور العلماء ؛ لأنَّ الاعتبار الذي قام على أساسه إيجاب الزَّكاة في عروض التجارة أنَّها مال مرصَد للنماء ، مثل النقود ، سواء أنمت بالفعل أم لا، وسواء ربحت أم خسرت .
فلا أثر للكساد في باب الزكاة مادام أن للعروض قيمة سوقية حقيقية، ويمكن أن تباع وتشترى.
وفي "فتاوى اللجنة الدائمة " (8/102) : " الأرض المعروضة للبيع تجب فيها الزكاة كلما تم عليها الحول؛ لأنها من عروض التجارة، وتقدر قيمتها بما تساوي على رأس السنة، ويخرج منها ربع العشر، سواء كانت رائجة أو كاسدة؛ لعموم الأدلة في وجوب الزكاة فيما أعد للبيع والتجارة" [ ابن باز ، آل الشيخ ، الفوزان ، الغديان ] .
وقال الشيخ عبد الرحمن البراك : " ليس لكساد العقار أثر في سقوط الزكاة، بل في نقص مقدار الزكاة؛ فإن الأرض الكاسدة تقوَّم بالسعر الذي يمكن أن تشترى به مهما قلَّ" انتهى.
لكن إذا كسد العقار بحيث أصبح صاحبه يعرضه للبيع ولا يجد من يشتريه منه ، فمن العلماء من قال يزكيه إذا باعه لسنة واحدة .

18- المساهمات العقارية ، تزكى زكاة عروض التجارة ، لأن هذه الشركات العقارية تشتري الأرض بقصد التجارة فيها .
فيجب على المساهم في نهاية حوله أن يقوّم أسهمه في هذه الشركة بما تساويه ، ويخرج زكاتها ، ربع العشر .

19- العقارات المحجوزة والمساهمات العقارية المتعثرة : لا زكاة فيها ، وهي في حكم "مال الضِّمار".
" فالأرض التي تحجز في المخططات ، كمرافق ومدارس وغير ذلك ، ومالكها ممنوع من التصرف فيها ، إلا إذا قررت الجهة الرسمية عدم الرغبة فيها ، فلا زكاة فيها إلا بعد تمكين مالكها من التصرف فيها ، فيستقبل في زكاتها حولا من تاريخ التمكين من التصرف فيها " .

كذلك المساهمات العقارية المتعثرة : وقد يكون سبب التعثر راجعا إلى النصب والاحتيال من إدارة الشركة ، وقد يكون السبب عوائق في أنظمة الدولة، أو بسب وجود خصومات أو استحقاقات على ذلك العقار، وأيا كان الحال فإن المساهمة العقارية التي لا يستطيع صاحبها التصرف فيها : لا زكاة فيها .

20- يقوَّم العقار في نهاية الحول بقيمته في السوق وقت حلول الحول ، وقد ينقص أو يزيد عن سعر الشراء.

21- حساب الحول لا يبدأ من وقت شراء العقار ، بل يكون حوله حول المال الذي اشتراه به.

Question

What are the situations in which zakaah is due on real estate and land?

Answer
Praise be to Allah.
It is well-known that real estate nowadays is different from what it was previously, with regard to its popularity and people’s interest in it, and there are different situations in which the ruling on zakaah differs accordingly.
What is meant by real estate is that which a person may own of land and the structures that may be built on it such as houses, palaces, high-rise buildings, apartments, shops, gas stations, leisure facilities and so on.
To discuss the matter of zakaah on real estate in more detail, we may note the following:
1.
The general principle concerning this matter is that real estate is not wealth that is subject to zakaah; therefore the basic guideline is that zakaah is not due on it unless it is for trade.
2.
With regard to real estate that a person acquires for his accommodation or for any personal use, such as storage and the like, no zakaah is due on it, according to scholarly consensus.
That is because in this case real estate is regarded as personal property, and no zakaah is due on personal property, according to consensus. See the answer to question no. 224770.
Regardless of whether the intention of keeping it as personal property was present at the time of purchase, or it came about after that, merely having the intention to keep the real estate for personal use puts it under the heading of wealth that is not subject to zakaah, even if it is kept for many years, so long as the owner’s intention does not change.
3.
Agricultural land is not subject to zakaah; rather zakaah is to be paid on the crops and fruits only.
But if a person buys land in order to trade it, and he cultivates it until he sells it, so the palm trees bear fruit and crops grow and ripen, then he must pay zakaah on the fruit and grains, at a rate of one tenth, and he must pay zakaah on the value of the land, because they are two different types of dues, which differ in the reasons why they are obligatory; one of them does not cause the other to be waived.
Zakariyya al-Ansaari said: If he grows crops for personal use on land that is bought for the purpose of trade, then each of them is subject to its own ruling. Zakaah on specific crops must be given on the crops that he grows, and zakaah on trade goods must be given for the land.

4.
With regard to real estate that a person acquires for the purpose of making use of it – i.e., by renting it out and benefitting from the income generated thereby – there is no zakaah on its value; rather zakaah is due on the rent that is collected from it, when one full year has passed.
So with regard to dwellings, storage places, furnished apartments, hotels and high-rise buildings, if they are prepared to be rented out, no zakaah is due on these types of real estate according to the majority of scholars, so the owner does not have to work out the value of this real estate every year and pay zakaah on it.

5.
With regard to real estate that a person acquires with the intention of trading or selling it, zakaah is due on it according to the majority of scholars.
What is meant by having the intention of trading or selling it is that one intends, by taking possession of this real estate, to make money thereby and make a profit on it.
Al-Mirdaawi said: “The intention of trading or selling it” means that he aims to make money from it by selling it.

However simply wanting to sell does not necessarily make it trade goods, because items may be sold for many purposes or reasons, such as to get rid of the item, or because one no longer has any interest in it, or because of financial difficulty and so on. As for trading, this refers to selling with the aim of making money and making a profit from it.
Shaykh Ibn ‘Uthaymeen said: If a man has land that he bought intending to build on it, then he changes his mind and decides to sell it because he does not need it, or because he has several pieces of land, then he needs money so he decides to sell one of them in order to meet his needs, then he does not have to give zakaah for this or for the others, because his intention is not to sell it for trade in this case. Rather his intention in the first scenario is because he no longer needs it, and in the second scenario he decided to sell it because he needed its value. This is unlike the one who owns trade goods and expects to make a profit on them, so from the outset he only wanted the item to be for trade.

If he buys real estate but does not have any firm intention of wanting it for trade, or he has no specific intention, then it is not subject to zakaah.
Al-Qarraafi said: If he buys it with no particular intention, then it is regarded as being for personal use, because that is what is usually the case.
End quote from adh-Dhakheerah (3/18).
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) was asked: There is a man who has a piece of land and is not quite sure what to do with it (i.e., his intention is not clear). He does not know whether he is going to sell it, develop it, rent it out, or live on it. Should he pay zakaah when one year has passed?
He replied: This land is not subject to zakaah at all, so long as he has no firm resolve that he bought it for trade. So no zakaah is due on it, because he is hesitant, and when there is hesitation, even if it is only one percent, no zakaah is due.

If he takes possession of the real estate for his personal use and to live there, then he decides to trade it after that, then there is a difference of scholarly opinion as to whether zakaah is due in this case. We have previously noted that the view that zakaah is due on it is more likely to be correct.

8.
If he acquires the real estate with the intention of trading, then he changes his mind and decides to keep it for personal use or to rent it out, then no zakaah is due on it, because the condition of intention is that one should have that intention until one full year has passed. So if he changes his intention before the end of the year, zakaah is waived. An-Nawawi said: If he decides to keep for personal use trade goods that are in his possession, they become personal property (and therefore not subject to zakaah), according to scholarly consensus.

9.
If he acquires the real estate for personal use plus trading, or for trading plus personal use, then what matters is what his intention was when he bought that property. Whoever buys any item with the intention of using it himself, and also intends that if he could make a profit on it he will sell it, then no zakaah is due on it. But whoever buys an item with the intention of trading it, and uses it for personal benefit whilst he is waiting until he can sell it, then zakaah is due on it every year, until it is sold.
Similarly, if he decides to use it and benefit from it for a certain length of time before selling it, then it is subject to the zakaah on trade goods, because his initial intention to make use of it is not contrary to its being prepared for trade.

10.
If the real estate is still at the construction stage – and it is for trade – then zakaah is due on it whether it is offered for sale or will not be sold until after construction is complete. Zakaah must be paid on it according to its value in the current situation at the time when zakaah becomes due.

11.
In the case of real estate when the owner is waiting for prices to go up, zakaah must be paid on it every year according to its value, even if that continues for years.
Buying real estate with the intention of making money on it in the distant future does not mean that zakaah on it is waived.
That includes buying land far from the city, waiting for such time as people show interest in it and prices begin to rise. This intention of selling the land in the future makes zakaah obligatory, and the fact that the intention is to sell it at a later date has no impact, so long as the land is kept for trade and the aim is to increase one’s wealth thereby.
The scholars call such a person “the trader who is biding his time”. The most correct scholarly view concerning this case is that of the majority of scholars, which is that zakaah due every year.
12.
In the case of real estate that is bought with the intention of protecting one’s wealth, no zakaah is due on it, unless the owner is trying to evade zakaah. This has been discussed previously in the answer to question no. 231857.
13.
If a person buys real estate for the purpose of trade, but he does not take possession of it until one year has passed since his acquisition of the wealth with which he bought it, then zakaah is due on it, because ownership of real estate passes to the purchaser once the contract is done and he is able to take possession of it.
Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) was asked: A man bought some land that was prepared for trade; please note that this man has not taken possession of the land until now, and he has not even taken possession of the title deed. Does he have to pay zakaah on it?
He replied: Yes, he has to pay zakaah on this land, even if he has not taken possession of the title deed, so long as the sale has been concluded and become binding. So he must give the zakaah on trade goods for it, and he should work out its value at the time when zakaah becomes due, and give one quarter of one tenth (i.e., 2.5%) of its value.

14.
With regard to mortgaged property, zakaah must be paid on it if it is prepared for trade.
Shaykh Ibn Baaz said: If you have prepared it for trade, but it is mortgaged, then you must pay zakaah on it. But if it is mortgaged and not prepared for trade; rather it is mortgaged until you pay off what is due to the person with whom it is mortgaged, and once you pay them off you either live in it or rent it out, then it is not subject to zakaah.

15.
In the case of partners in ownership of real estate, each partner must pay his share of zakaah, if it reaches the minimum threshold (nisaab), according to the majority of scholars.
Shaykh Bakr Abu Zayd said: In order for zakaah to be obligatory upon each partner in ownership of real estate, the value of his share of the property must reach the minimum threshold by itself or when added to other wealth of his that is subject to zakaah, such as cash or trade goods.

In the answer to question no. 147855, we explained that the view of the Shaafa‘is is that what matters is the total value of the property, not the minimum threshold of each individual. So if the value of the real estate reaches the minimum threshold, each of them must give zakaah, even if his own share does not reach that threshold.
This was the view adopted by the Islamic Fiqh Council, and Shaykh Ibn ‘Uthaymeen was also inclined towards this view.
16.
With regard to real estate that is endowed for charitable causes (i.e., a waqf), such as to benefit the poor, there is no zakaah on it, because it is no longer the property of any individual.

17.
With regard to zakaah being obligatory, there is no differentiation between real estate that sells easily and that for which a buyer cannot be found, so long as it still has value for which it may be sold.
This is the view of the majority of scholars, because the basic reasoning on which the obligation of giving zakaah on trade goods is based is the fact that they constitute wealth that is expected to increase, like currency, regardless of whether it actually does increase or not, and regardless of whether a profit is made or a loss is incurred.
The fact that the trade goods are not selling makes no difference with regard to zakaah, so long as the items still have a real market value and can be bought and sold.
In Fataawa al-Lajnah ad-Daa’imah (8/102), it says: In the case of land that is offered for sale, zakaah is due on it every time one full year passes, because it comes under the heading of trade goods. Its value is to be worked out at the beginning of each new year, and one quarter of one tenth is to be given, regardless of whether it is selling easily or not selling, because of the general meaning of the evidence for zakaah being due on anything that has been prepared for sale or trade.
[Ibn Baaz, Aal ash-Shaykh, al-Fawzaan, al-Ghadyaan]
Shaykh ‘Abd ar-Rahmaan al-Barraak said:
The fact that real estate is not selling (because of a slump in the market) has no impact and does not mean that zakaah is waived; rather the amount of zakaah may be reduced, because land that is not selling should be evaluated based on the price that it could be sold for, no matter how little it may be. End quote.
But if the real estate is not selling, to the extent that the owner is offering it for sale but cannot find anyone to buy it from him, then some of the scholars said that he should pay zakaah on it for one year when he does sell it.

With regard to shares in real estate, zakaah should be paid on them at the same rate as zakaah on trade goods, because these real-estate companies buy land for the purpose of trading in it.
When one year has passed since the shareholder bought his shares, he must work out the value of his shares in this company, and pay zakaah on them at a rate of one quarter of one tenth.

With regard to property on which there is a lien, or real-estate companies that are in turmoil, in which one has shares, no zakaah is due on them; they come under the ruling on wealth that is beyond one’s control.
With regard to land that is designated for public facilities, schools and so on, where the owner is prevented from disposing of it unless the authorities decide that they no longer need it, no zakaah is due on it until after the owner becomes able to dispose of it, in which case he should wait to pay zakaah on it until one year has passed since he became able to dispose of it.

The same applies to shares in real-estate companies that are in turmoil, where the reason for the may be because of corruption and cheating on the part of the management of the company, or the reason may be impediments in the rules and regulations laid down by the state, or disputes or liens against that property. Whatever the case, if there are shares in real estate that the owner cannot dispose of, no zakaah is due on them.

The value of the real estate should be worked out at the end of the year, based on the market value at year’s end, which may be lower or higher than the original purchase price.

Résumé des cas et dispositions concernant la zakat du foncier

Question

Quels sont les cas dans lesquels la zakat doit être prélevée sur le foncier notamment les terres ?

Louanges à Allah Le foncier a fini par avoir une situation différente de celle du passé par rapport à l’intérêt qu’il suscite et l’engouement dont il est l’objet. Il lui arrive des cas qui font varier les dispositions régissant sa zakat. Par foncier, on attend parler des propriétés foncières et les établissements qu’elles abritent, notamment les maisons, les palais, les immeubles, les appartements, les boutiques, les stations-service, les lieux de repos et consort.
Pour exposer la zakat du foncier exhaustivement, disons :
1.La règle générale en la matière est que le foncier ne fait pas parties des biens soumis au prélèvement de la zakat. C’est pourquoi il est, en principe, exempt de la zakat, à moins qu’il soit l’objet d’une exploitation commerciale.
2.Le terrain destiné à être habité ou à un usage personnel comme pour servir de dépôt n’est pas soumis à la zakat, à l’avis unanime des ulémas. Car, dans ce cas, le bien immeuble fait partie des biens utilisés couramment et qui ne sont pas à soumettre au prélèvement de la zakat, à l’avis de tous. Voir la réponse donnée à la question n° 224770. Que l’intention d’en faire un bien à usage personnel existe au moment de l’acquisition ou survienne plus tard. La seule existence de cette intention suffit pour le mettre à l’abri de la zakat, même s’il devait rester disponible pendant des années, à moins que l’intention du propriétaire ne change par rapport à la nature de l’usage.
3.Les terres de culture ne sont pas à soumettre au prélèvement de la zakat. Celle-ci ne frappe que les cultures et fruits. Si l’on achète une terre pour en faire une exploitation commerciale, et la cultive en attendant de trouver un acheteur, si les dattiers plantés sur la terre produisent et les cultures poussent, le propriétaire paye sur les fruits et les céréales une zakat évaluée à la dixième de la récolte. Zakaria al-assari a dit : Si on développe une culture destinée à la consommation sur une terre qui est l’objet d’une exploitation commerciale, la terre et le produit agricole sont régis chacun par des dispositions particulières. Les produits agricoles sont soumis à une zakat qui les concerne tandis que la zakat des recettes de l’exploitation commerciale de la terre frappe celle-ci. Extrait d’Asnaa al-Matalib (1/385).
4.La valeur du bien immeuble acquis pour être exploité ou mis en location pour profiter de ses revenus n’est pas soumise à la zakat. Celle-ci n’est prélevée que sur le revenu qu’il génère et qui reste immobilisé durant une année entière. Les logements, les dépôts, les appartements meublés, les hôtels destinés à être mis en location, ne sont pas soumis au prélèvement de la zakat, selon l’ensemble des ulémas. Ce patrimoine immobilier n’est pas à évaluer chaque année pour en prélever la zakat. Ceci est déjà expliqué dans le cadre de la réponse donnée à la question n° 223513et la réponse donnée à la question n°47760.
5.La propriété immobilière acquise à une fin commerciale doit être soumise au prélèvement de la zakat, d’après l’ensemble des ulémas. La fin commerciale renvoie à la recherche de bénéfices à travers l’acquisition de la propriété. Al-Mourdawi a dit : fin commerciale renvoie à la volonté d’utiliser un bien pour réaliser un gain. Le seul fait de vouloir vendre n’intègre pas un bien dans les effets du commerce car la vente des biens peut être dictée par de nombreux desseins y compris la volonté de se débarrasser du bien ou, parfois, le manque de désir du bien ou la présence d’une difficulté financière ou d’autres motifs. Quant au commerce à proprement parler il consiste à vendre dans le but de réaliser des bénéfices.
Cheikh Ibn Outhaymine a dit : si un homme possédait une terre achetée pour abriter une construction puis changeait d’intention et voulait la vendre parce qu’il en avait plus besoin… si un propriétaire terrien avait besoin de quelque chose et voulait vendre une de ses terres pour satisfaire son besoin, dans les deux cas les deux intéressés n’auraient pas à payer la zakat sur les terres concernées parce que dans le deuxième cas on ne vend pas pour un but purement commercial. Dans le premier cas, il a bien voulu vendre mais pour se débarrasser de l'objet vendu. Dans le deuxième, il a eu l’intention de vendre à cause de son besoin de disposer du prix, contrairement à ce que fait le propriétaire de marchandises qui vend dans l’espoir de réaliser des bénéfices. L’intention initiale de cet agent n’est rien d’autre que de faire du commerce. » Extrait de Fateh Dhoul Djalaal (6/173).
6.Quand on acquiert un bien foncier sans avoir la ferme intention d’en faire un fonds de commerce ou sans nourrir une quelque intention précise, on n’a pas à la soumettre au prélèvement de la zakat. A ce propos, al-Qarafi écrit : Si on achète une terre sans nourrir une intention particulière, on retient, en principe, qu’elle est destinée à un usage personnel. Extrait d’adh-dhakhiirah (3/18).
Cheikh Ibn Outhaymine (Puisse Allah Très-haut lui accorder Sa miséricorde) a été interrogé en ces termes : Voici un homme qui possède une terre sans nourrir une intention précise la concernant puisqu’il ne sait pas encore s’il doit la vendre ou la mettre en valeur ou la louer ou y construire un logement. Si ce patrimoine reste immobilisé pendant une année entière ?
Voici sa réponse : Une telle terre n’est pas à soumettre au prélèvement de la zakat aussi longtemps qu’il le propriétaire ne se sera pas déterminé à en faire un usage commercial. L’hésitation du propriétaire, quelle qu’en soit le degré, met la terre à l’abri de la zakat. Extrait de Madjmou fatwa al-Outhaymine (18/232).
7.Si on acquiert un bien immeuble pour un usage personnel comme un logement avant de nourrir plus tard l’intention d’en faire un usage commercial, le prélèvement de la zakat d’un tel bien est l’objet d’une divergence (au sein des ulémas). Il a déjà été indiqué que l’avis qui rend obligatoire le prélèvement de la zakat sur un tel bien est mieux argumenté. 8.Si on acquiert une terre avec l’intention d’en faire un usage commercial avant de changer d’intention pour en faire un usage personnel ou la mettre en location, on n’en prélève pas la zakat. Car la condition de l’efficacité de l’intention réside dans son inaltérabilité jusqu’à la fin de l’année. Si l’intention est altérée avant cette échéance, la zakat n’est plus exigible. A ce propos, an-Nawawi dit : Si on entend faire un usage personnel de biens initialement destinés au commerce, le premier usage détermine le statut des biens, à l’avis de tous. Extrait d’al-Madjmou (6/49).
9.Si on acquiert un bien immeuble dans la double intention d’en faire un usage personnel et un usage commercial, ce qui compte reste la motivation première. (exemple habiter une partie et louer une autre). Si on se procure un bien dans l’intention d’en faire un usage personnel avec la possibilité de le vendre si on pouvait réaliser un bénéfice important, la terre n’est pas à soumettre au prélèvement de la zakat. Si on acquiert un bien pour un but commercial et l’utilise pour en profiter en attendant de pouvoir le vendre, le bien est soumis à une zakat annuelle jusqu’à sa vente. Il en serait de même si le propriétaire entendait en profiter pour une durée déterminée avant de le vendre. On lui applique le type de zakat prélevée sur les effets du commerce. L’intention de faire un usage personnel d’un bien n’est pas incompatible avec son usage commercial. Voir la réponse donnée à la question n°228685.
10.Si la propriété foncière est l’objet d’une construction en cours dans une perspective commerciale, il sera soumis au prélèvement de la zakat ; qu’il soit déjà mis en vente ou que celle ne soit effective qu’une fois la construction terminée. Le propriétaire doit payer la zakat selon la valeur du moment quand le paiement devient obligatoire. Voir la réponse donnée à la question n°158440.
11.Le terrain gardé dans l’attente que les prix augmentent doit être soumis au prélèvement de la zakat chaque année selon sa valeur du moment, doit-il rester en l’état pendant des années. L’achat d’un terrain dans l’intention d’en tirer des bénéfices à long terme ne le met pas à l’abri de la zakat.
Relève du même chapitre l’achat de lotissements éloignés de la ville dans l’attente qu’ils soient plus convoités et que leur prix augmente. Cette intention portant sur la vente de la terre dans le futur justifie le prélèvement de la zakat. Le fait de retarder la vente n’altère pas l’intention aussi longtemps que les parcelles restent destinées au commerce pour l’accroissement du revenu du propriétaire.
Les ulémas appellent un tel opérateur ‘ commerçant en embuscade’. L’avis le plus juste le concernant est celui adopté par la majorité des ulémas selon lequel il doit payer la zakat de ses biens fonciers chaque année.
12.Le terrain acquis avec l’intention d’en faire le moyen de préserver son argent n’est pas soumis à la zakat, à moins que l’acheteur les achète pour échapper au paiement de la zakat. Ceci est déjà expliqué dans la réponse à la question n°231857.
13.Si on acquiert un bien foncier sans le réceptionner jusqu’à l’écoulement d’une année après le versement de l’argent ayant servi à l’achat, cet argent sera l’objet de prélèvement de la zakat car la propriété du bien foncier revient à l’acheteur dès la conclusion du contrat de vente et la possibilité de disposer de l’objet vendu.
Cheikh ibn Outhaymine (Puisse Allah Très-haut lui accorder Sa miséricorde) a été interrogé en ces termes : «Voici un homme qui a employé une somme d’argent pour acheter une terre destinée au commerce. L’homme n’a pas encore réceptionné cette terre jusqu’à maintenant et n’a pas remis le chèque de paiement…Doit-il payer la zakat de la terre ?
Voici sa réponse : Oui, le vendeur doit payer la zakat sur cette terre même avant la réception du chèque, étant donné que la vente est déjà définitivement conclue. La zakat à payer est comme celle qui frappe les effets du commerce. Il en estime justement la valeur au moment de payer la zakat et en prélève 2,5%. Extrait de Madjmou fatawa wa rassail al-Outhaymine (18/324).
14.Les terrains sous hypothèque sont à soumettre au prélèvement de la zakat s’ils sont destinés au commerce.
Cheikh Ibn Baz a dit : Si vous les destiniez à un usage commercial alors qu’ils sont toujours hypothéqués, vous en paierez la zakat malgré l’hypothèque et l’impossibilité d’en disposer étant donné que l’hypothèque ne sera levée que quand vous acquitterez le droit de l’autre. Une fois ce droit acquitté, les terrains vous reviennent. Vous pouvez soit les vendre, soit les mettre en location. Un terrain qui se trouve dans une telle situation n’est pas à soumettre au prélèvement de la zakat. Extrait de fatwa nouroune alaa ad-darb (15/43). Voir la réponse donnée à la question n°99311
15.Chacun des associés dans une propriété foncière paie la zakat sur sa part, si celle-ci atteint le montant requis selon la majorité des ulémas. A ce propos, le cheikh Bakre Zayd dit :Les associés dans une propriété foncière ne paye individuellement la zakat qu’à condition que la part de chacun d’eux atteigne le montant requis pour le paiement de la zakat ou que sa part ajoutée à d’autres fonds susceptibles à être soumis à zakat comme de l’argent liquides obtenu grâce au commerce atteignentle montant en question. Extrait de fatawa djaamia fii zakat al-aqaar,p. 12.
Il est déjà dit dans le cadre de la réponse donnée à la question n° 147855que selon la doctrine chafiite on tient compte de la totalité des parts non des parts individuelles. Si la valeur globale du bien foncier atteint le montant requis, chaque associé est tenu de payer la zakat, même si sa part personnelle n’atteignait pas le minimum à soumettre au prélèvement de la zakat. C’est cet avis qui a été retenu par l’Académie islamique de Jurisprudence. Cheikh Ibn Outhaymine penche pour cet avis.
16.Les biens immeubles déclarés waqf (d’utilité publique) dont les revenus sont réservés à des actions caritatives au profit du public, notamment les pauvres, ne sont pas à être soumis à la zakat parce qu’ils ne sont la propriété de personne. 17.Par rapport à la nécessité du prélèvement de la zakat, aucune distinction n’existe entre un terrain convoité et un terrain peu désirable, si tous les deux possèdent une valeur intéressante. Voilà l’avis de la majorité des ulémas car la considération qui fonde l’obligation de payer la zakat sur les effets du commerce est qu’il s’agit d’un bien qu’on garde pour voir augmenter sa valeur comme les monnaies. Que la hausse attendue se réalise effectivement ou pas. Que l’on obtienne des gains ou qu’on subisse des pertes. La perte de valeur subie par un bien n’a aucun effet par rapport au paiement de la zakat aussi longtemps que les effets du commerce gardent une valeur réelle sur le marché et peuvent être l’objet d’achat et de vente.
On lit dans les fatwas de la Commission permanente (8/102) :La terre mise en vente doit être l’objet du prélèvement de la zakat chaque année car elle fait partie des effets de commerce. On en estime la valeur au début de chaque année et paie 2,5% de la valeur. Que la terre soit convoitée ou pas, compte tenu de la portée générale des arguments fondant l’obligation de payer la zakat sur les biens destinés à la vente donc au commerce. Signé : Ibn Baz, Aal Cheikh, al-Fazwaan, et al-Ghoudayyan.
Cheikh Abdourrahman al-Baraak écrit : La baisse de la valeur d’un bien foncier n’a aucun effet sur son exemption de la zakat mais sur la diminution du montant à payer. Car une telle terre doit être l’objet d’une évaluation tentant compte du prix pouvant être obtenu, si minime qu’il soit. Si la baisse de la valeur du bien foncier est telle que son propriétaire ne trouve personne voulant le lui acheter, des ulémas disent qu’il ne payera que la zakat d’une seule année, une fois qu’il aura vendu le bien. 18.Les terrains appartenant à des sociétés immobilières anonymes sont soumis à la zakat comme on le fait des effets du commerce car ces sociétés acquièrent les terrains à une fin commerciale. Chacun des actionnaires doit au terme de chaque année évaluer ses actions et prélever 2,5% du montant. Voir la réponse donnée à la question n° 74989et la réponse donnée à la question n° 97124.
19.Les biens fonciers hypothéqués ou en contentieux ne sont pas soumis au prélèvement de la zakat. Ils ont le même statut que les fondsen litige.
Les espaces dans les lotissements destinées à abriter des infrastructures, telles des écoles et autres, dont le propriétaire originel ne peut plus gérer, sauf si l’autorité officielle décidait de s’en passer, ces espaces, disons-nous, ne sont soumis à la zakat qu’une fois restituées à leur propriétaires d’origine. C’est alors qu’il paie la zakat un an après la date de la restitution rendant possible leur gestion par le propriétaire. » Extrait de al-massail al-moustandjidah dii az-zakat, p. 87.
Il en est de même des biens fonciers communs en litige. Celui-ci peut résulter d’un détournement, de la tricherie de la part de la direction de la société immobilière. Le caractère litigieux peut être dû à des goulots d’étranglement dans la réglementation étatique ou à des disputes et querelles ou des revendications contradictoires sur le bien foncier. Quoi qu’il en soit, une telle propriété foncière, dont la gestion échappe au propriétaire d’origine, ne peut être l’objet du paiement de la zakat.Voir la réponse donnée à la question n° 143816
20.La propriété foncière doit être évaluée à la fin de l’année en tenant compte de sa valeur du moment. Cette valeur peut être supérieure ou inférieure au prix d’achat. Voir la réponse donnée à la question n°65515.
21.L’année retenue ne commence pas à la date de l’achat de la propriété foncière, mais à la date de l’obtention de l’argent utilisé dans l’achat de la propriété. Voir la réponse donnée à la question n°161816.
