السؤال

فضيلة الشيخ ، أحسن الله إليك ونفع بعلمك إذا وضع الرجل أو المرأة الحناء على الرأس ووضع فوق الحناء ملاصق من قرطاس أو نايلون ، فهل يصح المسح على الرأس من فوق ذلك الملاصق الذي فوق الحناء؟ وهل يجزيء المسح على بعضه فقط أم لا بد من المسح على جميع ذلك الملاصق؟ وهل يقاس على المسح على العمامة لمشقة النزع؟ ومن صلى بعد أن مسح على ذلك الملاصق ، هل صلاته صحيحة أم باطلة, وهل يلزمه إعادتها؟ بينوا لنا ذلك بيانا شافيا ، وبارك الله فيكم وجعله في ميزان حسناتكم.
الجواب





الحمد لله.
إذا احتاج الرجل أو المرأة لوضع الحناء على الرأس ، وحانت الصلاة ، وأرادا الصلاة دون إزالة الحناء ، جاز المسح على الحناء في الوضوء دون الغسل ، لأن مسح الرأس مبني على التخفيف ، وقد مسح النبي صلى الله عليه وسلم على العمامة ، وعلى رأسه وقد لبّده بصمغ أو عسل.
وكذلك لو كان قد وضعا على الحناء لاصقا من قرطاس ونحوه ، فيمسحان عليه . ويكفي المسح على أكثر اللاصق ، ولا يجب استيعاب الرأس .
ولا ينبغي أن يتعمدا وضع اللاصق لأجل المسح .
قال الشيخ محمد بن صالح العثيمين رحمه الله " واختلف العلماء في جواز مسح المرأة على خمارها :
فقال بعضهم : إِنه لا يجزئ لأن الله تعالى أمر بمسح الرَّأس في قوله "وَامْسَحُوا بِرُؤُوسِكُمْ" المائدة/6 ، وإِذا مَسَحَتْ على الخمار : فإِنها لم تمسح على الرَّأس ؛ بل مسحت على حائل وهو الخمار فلا يجوز .
وقال آخرون بالجواز ، وقاسوا الخِمَار على عِمَامة الرَّجُل ، فالخِمَار للمرأة بمنزلة العِمَامة للرَّجُل ، والمشقَّة موجودة في كليهما .
وعلى كُلِّ حالٍ إِذا كان هناك مشقَّة إِما لبرودة الجوِّ ، أو لمشقَّة النَّزع واللَّفّ مرَّة أخرى ، فالتَّسامح في مثل هذا لا بأس به ، وإلا فالأوْلى ألاَّ تمسح ، ولم ترد نصوصٌ صحيحة في هذا الباب .
ولو كان الرَّأس ملبَّداً بحنَّاء ، أو صمغ ، أو عسل ، أو نحو ذلك : فيجوز المسح ؛ لأنه ثبت أنَّ النبيَّ صلّى الله عليه وسلّم كان في إحرامه ملبِّدًا رأسَه ، فما وُضع على الرَّأس مِنَ التَّلبيد فهو تابع له .
وهذا يدلُّ على أن طهارة الرَّأس فيها شيء من التَّسهيل .
وعلى هذا ؛ فلو لبَّدت المرأة رأسها بالحِنَّاء جاز لها المسحُ عليه ، ولا حاجة إلى أن تنقض رأسَها ، وتَحُتُّ هذا الحنَّاء ، وكذا لو شدَّت على رأسها حُليًّا - وهو ما يُسمّى بالهامة - ، جاز لها المسحُ عليه ؛ لأننا إِذا جوَّزنا المسح على الخمار فهذا من باب أَوْلَى .
وقد يُقال : إن له أصلاً وهو الخاتم ، فالرَّسول صلى الله عليه وسلم كان يلبس الخاتم ، ومع ذلك فإِنَّه قد لا يدخل الماءُ بين الخاتم والجلد ، فمثل هذه الأشياء قد يُسامِحُ فيها الشَّرع ، ولا سيما أن الرَّأس من أصله لا يجب تطهيرُه بالغسل ، وإنما يطهرُ بالمسح ، فلذلك خُفِّفَتْ طهارتُه بالمسح ....
فالعِمامةُ ، والخُفُّ ، والخِمارُ ، إِنما تمسحُ في الحَدَث الأصغر دون الأكبر ، والدَّليل على ذلك : حديث صفوان بن عَسَّال قال "أمَرنا رسولُ الله صلّى الله عليه وسلّم إِذا كُنَّا سَفْراً ألاَّ ننزع خفافنا ثلاثة أيام ولياليهن إلا من جنابة ، ولكن من غائط ، وبول ، ونوم" .
فقوله "إلا من جنابة" يعني به : الحدَثَ الأكبر .
وقوله "ولكن من غائط وبول ونوم" ، هذا الحدث الأصغر ، فلو حصل على الإِنسان جنابة مدَّةَ المسح : فإنه لا يمسح ، بل يجب عليه الغُسلُ ؛ لأنَّ الحدث الأكبر ليس فيه شيء ممسوح ، لا أصلي ولا فرعي ، إلا الجبيرة" انتهى من "الشرح الممتع على زاد المستقنع"1/ 239 – 242. باختصار.

Wiping the head when there is henna on the hair or a bag over the henna

Question

If a man or woman put henna on their head and put a wrapper of paper or plastic over it, is it acceptable to wipe over that wrapper that has been placed over the henna? Is wiping over part of it acceptable or is it essential to wipe over all of that wrapper? Can that be compared with wiping over the head cover, because it is difficult to remove it? If a person prays after wiping over that wrapper, is his prayer valid or not, and does he have to repeat it?.

Praise be to Allah.
If a man or woman needs to apply henna to the head, then the time for prayer comes and he or she wants to pray without removing the henna, it is permissible to wipe over the henna in wudoo’ but not in ghusl, because wiping over the head is not a strict issue, and the Prophet (blessings and peace of Allah be upon him) wiped over his head cover and over his head when he had applied gum or honey to hold his hair together (mulabbad).
The same applies if they have put a wrapper of paper and the like over it; they may wipe over it and it is sufficient to wipe over most of the wrapper; it is not essential to wipe over the entire head.
But it is not appropriate to put the wrapper on so as to be able to wipe over it.
Shaykh Muhammad ibn Saalih al-‘Uthaymeen (may Allah have mercy on him) said: The scholars differed as to whether it is permissible for a woman to wipe over her head cover.
Some of them said that it is not acceptable because Allah, may He be exalted, enjoined wiping the head when He said (interpretation of the meaning): “rub (by passing wet hands over) your heads” [al-Maa’idah 5:6]. If the woman wipes over the head cover, then she has not wiped over her head; rather she has wiped over a barrier, namely the head cover, so it is not permissible.
Others said that it is permissible, and they drew an analogy between the (woman’s) head cover and the man’s head cover, so the woman’s head cover is like the man’s, and the difficulty (of removing it) is present in both cases.
Whatever the case, if there is any difficulty involved either because the weather is cold or because it is difficult to do it and wrap it again, then there is nothing wrong with taking a lenient approach in such matters, otherwise it is better not to wipe over the head, as there are no saheeh texts that speak of that.
If the hair is stuck together with henna, gum or honey, or the like, then it is permissible to wipe over it, because it is proven that when the Prophet (blessings and peace of Allah be upon him) was in ihram, he struck his head together with a sticky substance (an action called talbeed), and what is put on the head in the case of talbeed comes under the same rulings as the head.
This indicates that there is some lenience with regard to the matter of wiping the head.
Based on that, if a woman has applied henna to her head and stuck her hair together with it, it is permissible for her to wipe over it, and there is no need for her to undo her hair and wash off the henna. The same applies if she has fastened jewellery to her head. It is permissible for her to wipe over it, because if we say it is permissible to wipe over the head cover, this is more appropriate.
It may be said that there is a basis for that in the ring, because the Messenger (blessings and peace of Allah be upon him) used to wear a ring yet he did not make the water go between the ring and the skin, so in such matters there may be some shar‘i lenience, especially since the principle with regard to the head is not to purify it by washing but by wiping.
The man’s head cover, the khuff (leather slipper that covers the ankle) and the woman’s head cover can only be wiped over when purifying oneself from minor impurity (i.e., in wudoo’), not major impurity (i.e., ghusl). The evidence for that the hadeeth of Safwaan ibn ‘Assaal, who said: The Messenger of Allaah (peace and blessings of Allaah be upon him) used to command us, if we were travelling, not to take off our khufoof for three days and nights, except in the case of janaabah, but not in the case of stools, urine or sleep.
The words “except in the case of janaabah” refer to major impurity.
“but not in the case of stools, urine or sleep” refer to minor impurity. If a person becomes junub during the period in which it is permissible for him to wipe over the khufoof etc, he should not wipe over them; rather he has to do ghusl, because in the case of major impurity there is nothing that can be wiped overexcept a plaster cast.

Question

Quand un homme ou une femme s'enduisent la tête avec du henné et pose directement sur celle-ci une protection faite de papier ou de nylon, est il correct dans ce cas de se masser la tête avec les mains mouillées en les faisant passer sur la protection posée sur le henné? Est il permis faire le massage sur une partie de la tête ou faut il le faire sur toute la surface de la protection? Peut on assimiler le turban à cette protection de sorte à pouvoir le soumettre au même massage sans l'ôter en raison de la difficulté? Celui qui prie après avoir pratiqué ledit massage sur la protection aurait il prié justement ou pas? Doit il reprendre la prière?

Louange à Allah.
Quand un homme ou une femme ont besoin de s'enduire la tête avec du henné et quand arrive l'heure de la prière et que l'un ou l'autre veuille prier sans se débarrasser du henné, il lui est permis de masser sa tête avec ses mains mouillées en les passant sur le henné quand il fait ses ablutions mais pas dans le cadre d'un bain rituel. C'est parce que le massage de la tête est objet d'assouplissement. Le Prophète (bénédiction et salut soient sur lui) le fit en faisant passer ses mains sur son turban et sur sa tête alors que ses cheveux étaient rassemblés et collés à laide de la gomme ou du miel.
Il en serait de même si l'intéressé mettait sur le henné un autocollant en papier ou autre chose, il suffirait de pratiquer le massage sur l'autocollant et il ne serait pas nécessaired'étendre le massage à toutes les parties de la tête. Il ne convient pasque l'un ou l'autre mette l'autocollant dans le seul but de pouvoir masser dessus.
Cheikh Muhammad ibn Salih al-Outhaymine (puisse Allah lui accorder Sa miséricorde) dit: «Il y a une divergence au sein des ulémas à propos de la permission à la femme de passer ses mains mouillées sur son foulard. Les uns soutiennent que cela n'est pas permis car Allah Très haut a donné l'ordre de se masser la tête en ces termes: massez vous vos têtes (Coran,5:6). Si une femme pratique le massage sur son foulard, elle ne l'aurait pas fait sur sa tête mais sur un objet protégeant la tête, en l'occurrence : le foulard. Aussi cela ne lui est il pas permis. Selon d'autres, la pratique est permise. Ils l'assimilent au massage que l'homme fait sur son turban car le foulard pour la femme est comme le turban pour l'homme et il est difficile dans les deux cas de les ôter chaque fois.»
En tout état de cause, en cas de peine due au froid ou à la difficulté d'ôter et de remettrele foulard, il n y a aucun mal à pratiquer le massage. Dans le cas contraire , il vaut mieux éviter le massage. Ce sujet ne fait pas l'objet de textes authentiques. Si la tête est teint avec du henné, de la colle ou du miel ou d'autres substances pareilles, il est permis d'effectuer le massage dessus cat il a été rapporté de façon sûre que le Prophète (bénédiction et salut soient sur lui) avait gommé ses cheveux pendant son pèlerinage. Ce qui est utilisé pour coller les cheveux leur sont assimilé. Ce qui indique que la purification de la tête est matière d'assouplissement.
Cela étant, si une femme utilise du henné pour teindre ses cheveux, il lui est permis de masser dessus et elle n'a pas besoin de se défaire les cheveux et d'enlever le henné. De même, si elle fixe un bijou à ses cheveux- pratique appelée hamma-, elle peut effectuer le massage sur le bijou car il lui est permis de le faire avec le foulard.
On peut dire que le foulard peut être assimilé à la bague. Le Messager d'Allah (bénédiction et salut soient sur lui) portait une bague. Pourtant l'eau peut ne pas passer entre la bague et la peau. Ces choses peuvent faire l'objet d'une tolérance établie par la loi. D'autant plus qu'il n'est pas obligatoire de laver la tête. On n'en fait la masser avec les mains mouillées. Sa purification se réalise de cette manière.
Le turban, la botte et le foulard ne font l'objet du massage en question que dans le cas d'une souillure mineure. Cela s'atteste dans le hadith de Safwan ibn Assal qui dit: «Le Messager d'Allah (bénédiction et salut soient sur lui) nous a donné l'ordre quand nous sommes en voyage de chausser nos bottes durant trois journées et trois nuits même en cas défécation et d'urination et de sommeil mais pas en cas de souillure majeure. Les propos mais pas en cas de souillure majeure renvoient à la souillure consécutive au rapport intime. Les propos même en cas défécation et d'urination et de sommeil renvoient à la souillure mineure. Si on contractait une souillure majeure pendant la durée sus indiquée, on ne pratique pas le massage mais on doit prendre le bain rituel car rien qui puisse être porté ne peut faire l'objet d'un massage dans le cas d'une souillure majeure; rien ni un objet principal ni un objet secondaire, à l'exception d'un bandage.» Extrait résumé de charh al-moumti' ala zad al-moustaqna' (1/239-242).
