هل يجوز إخراج التمر والأقط في زكاة الفطر لقوم لا يعتبرونه قوتًا؟

Is it permissible to give dates and dried yoghurt for zakat al-fitr to people who do not regard them as staple foods?

Est-il permis de donner des dattes et du fromage comme petite zakat quand on est dans un milieu qui n’en fait sa nourriture de base ?


السؤال

هل يجوز إخراج زكاة الفطر من التمر والأقط مع أنه لا يعتبر قوتًا في كثير من البلاد ؟

الجواب
الحمد لله.
الذي يتعين إخراجه في زكاة الفطر هو ما كان من قوت البلد ، فإن كان قوتهم التمر أو الأقط أو الزبيب جاز إخراجه ، وما لا يعتبر قوتًا لا يجزئ إخراجه في زكاة الفطر ، ويدل على ذلك قول أبي سعيد الخدري رضي الله عنه "كُنَّا نُخْرِجُ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَ الْفِطْرِ صَاعًا مِنْ طَعَامٍ ، وَكَانَ طَعَامَنَا الشَّعِيرُ ، وَالزَّبِيبُ ، وَالْأَقِطُ ، وَالتَّمْرُ" رواه البخاري (1510) ومسلم (985).
فإخراج الصحابة رضي الله عنهم هذه الأصناف لأنها كانت طعامهم يومئذ .
قال النووي رحمه الله " الأصح عندنا وجوب الفطرة من غالب قوت البلد , وبه قال مالك . وقال أبو حنيفة : هو مخير , وعن أحمد رواية أنه لا يجزئ إلا الأجناس الخمسة المنصوص عليها : التمر والزبيب والبر والشعير والأقط " انتهى من "المجموع"(6/112) .
وقال الباجي في "شرح الموطأ" : " ومماذا يكون الصاع ؟ قال ابن القاسم عن مالك من غالب قوت البلد ، وبه قال أبو علي بن أبي هريرة من أصحاب الشافعي.." انتهى.
وفي "الموسوعة الفقهية" (23/343) ".... وذهب المالكية , إلى أنه يخرج من غالب قوت البلد كالعدس والأرز , والفول والقمح والشعير والسلت والتمر والأقط والدخن . وما عدا ذلك لا يجزئ , إلا إذا اقتاته الناس وتركوا الأنواع السابقة..." انتهى.
وقد اختار هذا القول شيخ الإسلام ابن تيمية رحمه الله كما في "الفتاوى الكبرى" (2/157) .
وقد سئل الشيخ ابن عثيمين رحمه الله : عن إخراج الشعير في زكاة الفطر فقد سمعنا عن فضيلتكم أنه غير مجزئ فيما يظهر، فنأمل من فضيلتكم التكرم بالإيضاح ؟
فأجاب "ذكرتم أنكم سمعتم منا أن إخراج الشعير في زكاة الفطر غير مجزئ فيما يظهر، ولقد كان قولنا هذا في قوم ليس الشعير قوتًا لهم ؛ لأن من حكمة إيجاب زكاة الفطر أنها طعمة للمساكين ، وهذه لا تتحقق إلا حين تكون قوتًا للناس ، وتعيين التمر والشعير في حديث عبد الله بن عمر رضي الله عنهما ليس لعلة فيهما، بل لكونهما غالب قوت الناس وقتئذ ، بدليل ما رواه البخاري في باب الصدقة قبل العيد، عن أبي سعيد الخدري رضي الله عنه قال" كنا نخرج في عهد رسول الله صلى الله عليه وسلم يوم الفطر صاعًا من طعام "، قال أبو سعيد"وكان طعامنا الشعير ، والزبيب ، والأقط ، والتمر" انتهى من "مجموع الفتاوى"(18/282) .
فالواجب على المسلم أن يخرج زكاة الفطر مما يعتبر قوتًا في بلده ، حتى تحصل الحكمة من الزكاة ، وهي إغناء الفقير عن السؤال يوم العيد .

Is it permissible to give zakat al-fitr in the form of dates and dried yoghurt even though these are not regarded as staple foods in many countries?
Answer





Praise be to Allah.
What should be given for zakat al-fitr is that which is the local staple food. If their staple food is dates or dried yoghurt or raisins, it is permissible to give it. Whatever is not regarded as a staple food is not acceptable as zakat al-fitr. This is indicated by the words of Abu Sa‘eed al-Khudri (may Allah be pleased with him): At the time of the Messenger of Allah (blessings and peace of Allah be upon him) on the day of (Eid) al-Fitr, we used to give (as zakat al-fitr) a saa‘ of foodstuff, and our food at that time was barley, raisins, dried yoghurt, and dates.
Narrated by al-Bukhaari (1510) and Muslim (985).
The Sahaabah (may Allah be pleased with them) gave these kinds of food because that was their staple food at that time.
An-Nawawi (may Allah have mercy on him) said:
The more correct view in our opinion is that zakat al-fitr must be given in the form of the usual staple food of the country. This is also the view of Maalik. Abu Haneefah said: One has the choice. One view was narrated from Ahmad that nothing is acceptable except the five kinds mentioned in the texts: dates, raisins, wheat, barley and dried yoghurt.
End quote from al-Majmoo‘ (6/112)
Al-Baaji said in Sharh al-Muwatta’: Of what should the saa‘ be? Ibn al-Qaasim said, narrating from Maalik, that it should be the usual staple food of the country. This was also the view of Abu ‘Ali ibn Abi Hurayrah among the companions of ash-Shaafa‘i. End quote.
In al-Mawsoo ‘ah al-Fiqhiyyah (23/343) it says: … The Maalikis are of the view that it should be given in the form of the usual local staple food, such as lentils (daal), rice, foul (fava beans), wheat, barley, dates, dried yogurt, and pearl millet. Anything other than that is not acceptable, unless the people use it as a staple food and do not use the kinds of food mentioned above. End quote.
This view was favoured by Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him), as stated in al-Fataawa al-Kubra (2/157). Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) was asked about giving barley for zakat al-fitr, as we have heard from you that it is not acceptable, as appears to be the case. We hope that you can explain?
He replied: You said that you heard from us that giving barley for zakat al-fitr is not acceptable, as appears to be the case, but we said that regarding people for whom barley is not a staple food. That is because the wisdom behind prescribing zakat al-fitr is that it should be food for the poor, and that can only be achieved if it is a staple food eaten by the people. Dates and barley are mentioned in the hadeeth of ‘Abdullah ibn ‘Umar (may Allah be pleased with him) not because there is a connection between them, rather it is because they were the usual staple foods eaten by people at that time. That is based on the report narrated by al-Bukhaari in his chapter on charity before Eid, from Abu Sa‘eed al-Khudri (may Allah be pleased with him) who said: At the time of the Messenger of Allah (blessings and peace of Allah be upon him) on the day of (Eid) al-Fitr, we used to give (as zakat al-fitr) a saa‘ of foodstuff. And Abu Sa‘eed said: And our food at that time was barley, raisins, dried yoghurt, and dates.
End quote from Majmoo‘ al-Fataawa (18/282)
What the Muslim must do is give zakat al-fitr in the form of whatever is regarded as staple food in his country, so as to fulfil the wisdom behind this zakaah, which is to make the poor independent of means so that they do not have to ask of people on the day of Eid.

Louange à Allah.
Louanges à Allah Ce dont il faut constituer sa petite zakat, c’est ce qui est couramment pris pour une nourriture base dans une localité. Si les habitants se nourrissent régulièrement de dattes, du fromage ou du raisin, ils peuvent prélever leur zakat de ces denrées. Ce qui n’est pas intégré dans la nourriture de base ne peut être donné comme une petite zakat. Ceci s’atteste dans cette parole d’Abou Said al-Khoudri (P.A.a) :Du temps du Messager d’Allah (Bénédiction et salut soient sur lui) nous offrions au jour de la Fête un saa (environ un kilogramme) de denrée alimentaire, notamment l’orge, le raisin, le fromage et la datte que nous consommions couramment. (Rapporté par al-Bokhari, 1510 et Mouslim, 985).
Les Compagnons (P.A.a) prélevaient leur zakat de ces denrées parce qu’elles constituaient leur nourriture de base. A ce propos, an-Nawawi (P.A.a) a dit : Ce qui est juste, selon nous, c’est qu’il est nécessaire que la petite zakat soir prélevée de la nourriture prédominante de la localité. C’est aussi l’avis de Malick. Pour Abou Hanfiah, le contribuable dispose d’un libre choix. Quant à Ahmad, il dit, dans une version, que seules les cinq espèces ainsi désignées suffisent, à savoir la datte, le raisin, le blé, l’orge et le fromage. Extrait d’al-Madjmou, 6/112.
Dans son commentaire sur al-Mouwatta, al-Badji écrit : De quoi le saa doit être prélevé ? Ibn al-Qassim a rapporté de Malick qu’il doit être prélevé de la nourriture locale prédominante. C’est aussi ce qu’a rapporté Abou Ali ibn Abi Hourayrah, l’un des compagnons de Chafii.
On lit dans l’encyclopédie juridique (23/343) : Les Malikites soutiennent que la petite zakat doit être prélevée de la nourriture locale prédominante telle les lentilles, le riz, les haricots, le blé, l’orge, la datte, le fromage et les céréales, aucune autre denrées ne pouvant suffire, à moins d’être choisie comme nourriture courante à l’exclusion de toutes les autres.
Cheikh al-islam, Ibn Taymiyah, (Puisse Allah lui accorder Sa miséricorde) a choisi cet avis dans ses al-fatwas al-koubra (2/157).
Cheikh Ibn Outhaymine (Puisse Allah lui accorder Sa miséricorde) a été interrogé à propos du choix du blé comme source de la petite zakat (en ces termes) : nous avons entendu votre éminence dire que cette denrée ne suffit pas apparemment. Dès lors, nous espérons que vous daignerez être plus claire sur le sujet.
Voici sa réponse : «Vous affirmez m’avoir entendu dire qu’il ne suffit pas apparemment de donner du blé comme petite zakat. Nous avions prononcé ces propos à l’adresse de gens dont le blé ne constituait pas la nourriture de base. C’est parce que la sagesse qui dicte la prescription de la petite zakat est de permettre de nourrir les pauvres. Ce qui ne se réalise pas avec l’offre d’une denrée qui n’est pas couramment consommée par les gens. La désignation de la datte et du blé dans le hadith d’Abdoullah ibn Omar n’est pas due à une cause intrinsèque mais au fait qu’ils constituaient la nourriture locale prédominante à l’époque. Ceci s’atteste dans ce hadith cité par al-Bokhari dans un chapitre intitulé procéder à l’aumône avant la Fête. Abou Said al-Khoudri (P.A.a) :Du temps du Messager d’Allah (Bénédiction et salut soient sur lui) nous offrions au jour de la Fête un saa de denrée alimentaire. Il poursuit : nous consommions couramment de l’orge, du raisin, du fromage et la datte que. » Extrait de Madjmou al-fatwas (18/282).
Le musulman doit prélever la petite zakat de la nourriture locale courante pour qu’elle réponde mieux à sa vocation qui de rendre le pauvre assez riche pour ne pas solliciter les autres le jour de la Fête.
