السؤال

ما الحكم فيما يفعله كثير من أولياء النساء الآن من المبالغة في طلب المهر وتكليف الزوج بأكثر مما يستطيع ، مما يجعله يتحمل الديون الكثيرة من أجل الزواج ، وقد أعرض كثير من الشباب عن الزواج بسبب هذا ؟.

نص الجواب

الحمد لله
سبق في إجابة السؤال رقم :10525، بيان أن الشرع جاء بتخفيف المهر وتيسيره ، وأن ذلك من مصلحة الزوج والمرأة جميعاَ . كما قال النبي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ "خير النكاح أيسره" . رواه ابن حبان . وصححه الألباني في صحيح الجامع :3300 .
وقد تكلم العلماء في هذه المسألة كثيرا وبينوا الأضرار المترتبة على المغالاة في المهور ، ومن هؤلاء العلماء الشيخ محمد بن إبراهيم فله فتوى مطولة في هذه المسألة جاء فيها :
"إن من الأشياء التي تمادى الناس فيها حتى وصلوا إلى حد الإسراف والتباهي - مسألة التغالي في المهور- والإسراف في الألبسة والولائم ونحو ذلك وقد تضجر علماء الناس وعقلاؤهم من هذا لما سببه من المفاسد الكثيرة التي منها بقاء كثير من النساء بلا زوج بسبب عجز كثير من الرجال عن تكاليف الزواج، ونجم عن ذلك مفاسد كثيرة متعددة . . . وبحثت الموضوع من جميع أطرافه وتحرر ما يلي :
1- أن تخفيف الصداق وعدم تكليف الزوج بما يشق عليه مأمور به شرعا باتفاق العلماء سلفا وخلفا، وهو السنة الثابتة عن النبي صلى الله عليه وسلم .
2- أن الزوج إذا تكلف من الصداق ما لا يقدر عليه ولا يتناسب مع حاله استحق الإنكار عليه؛ لأنه فعل شيئاً مكروهاً، ولو كان ذلك الصداق دون صداق النبي صلى الله عليه وسلم ، فقد روى مسلم في صحيحه :1424.

عَنْ أَبِي هُرَيْرَةَ قَالَ : جَاءَ رَجُلٌ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنِّي تَزَوَّجْتُ امْرَأَةً مِنْ الأَنْصَارِ . فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : هَلْ نَظَرْتَ إِلَيْهَا ، فَإِنَّ فِي عُيُونِ الأَنْصَارِ شَيْئًا ؟ قَالَ : قَدْ نَظَرْتُ إِلَيْهَا . قَالَ : عَلَى كَمْ تَزَوَّجْتَهَا ؟ قَالَ : عَلَى أَرْبَعِ أَوَاقٍ . فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : عَلَى أَرْبَعِ أَوَاقٍ ! كَأَنَّمَا تَنْحِتُونَ الْفِضَّةَ مِنْ عُرْضِ هَذَا الْجَبَلِ ! مَا عِنْدَنَا مَا نُعْطِيكَ ، وَلَكِنْ عَسَى أَنْ نَبْعَثَكَ فِي بَعْثٍ تُصِيبُ مِنْهُ . قَالَ : فَبَعَثَ بَعْثًا إِلَى بَنِي عَبْسٍ بَعَثَ ذَلِكَ الرَّجُلَ فِيهِمْ . .
قال النووي في شرحه لهذا الحديث: معنى هذا الكلام كراهة إكثار المهر بالنسبة إلى حال الزوج اهـ.
3- ومما لا شك فيه أن الزواج أمر مشروع مرغوب فيه، وفي غالب الحالات يصل إلى حد الوجوب، وأغلب الناس لا يتمكن من الوصول إلى هذا المشروع أو المستحب مع وجود هذه المغالاة في المهور. ومن المعلوم أن ما لا يتم الواجب إلا به فهو واجب ، ومن هذا يؤخذ مشروعية إرشاد الناس وردعهم عن التمادي في هذا الأمر الذي يحول دون المرء ودون فعل ما أوجبه الله عليه، لا سيما والأمر بتقليل المهر لا يتضمن مفسدة، بل هو مصلحة محضة للزوج والزوجة، بل هو أمر محبوب للشارع مرغب فيه كما تقدم.
4- إن امتناع ولي المرأة من تزويجها بالكفء إذا خطبها ورضيت به إذا لم يدفع ذلك الصداق الكثير الذي يفرضه من أجل أطماعه الشخصية أو لقصد الإسراف والمباهاة أمر لا يسوغ شرعا، بل هو من باب العضل المنهي عنه الذي يفسق به فاعله إذا تكرر .
قال الشيخ ابن عثيمين :
"ولقد أوجد أهل العلم تذليلا لهذه العقبة حيث قالوا إن الولي إذا امتنع من تزويج موليته كفؤا ترضاه فإن ولايته تزول إلى من بعده فمثلا لو امتنع أبو المرأة من تزويجها كفؤا في دينه وخلقه وقد رضيته ورغبت فيه فإنه يزوجه أولى الناس بها بعده فيزوجها أولى الناس بها ممن يصلح للولاية من اخوتها أو أعمامها أو بنيهم" .
5- أن كثرة المهور والمغالاة فيها عائق قوي للكثير من التزوج ولا يخفى ما ينجم عن ذلك من المفاسد الكثيرة وتفشي المنكرات بين الرجال والنساء، والوسائل لها حكم الغايات، والشريعة المطهرة جاءت بتحصيل المصالح وتكميلها، وتعطيل المفاسد وتقليلها، ولو لم يكن في السعي في تقليل المهور إلا سد الذرائع المسببة فعل المحرمات لكفى.
6- لا يخفي ما سببته المغالاة في المهور من المفاسد، فكم من حرة مصونة عضلها أولياؤها وظلموها فتركوها بدون زوج ولا ذرية
وكم من امرأة ألجأها ذلك إلى الاستجابة لداعي الهوى والشيطان فَجَرَّت العار والخزي على نفسها وعلى أهلها وعشيرتها مما ارتكبته من المعاصي التي تسبب غضب الرحمن!!
وكم من شاب أعيته الأسباب فلم يقدر على هذه التكاليف التي ما أنزل الله بها من سلطان فاحتوشته الشياطين وجلساء السوء حتى أضلوه وأوردوه موارد العطب والخسران، فخسر أهله، وفسد ا تجاهه ، بل خسرته أمته ووطنه ، وخسر دنياه وآخرته!!
7- من أضرار المغالاة في المهور : حدوث الأمراض النفسية لدى الشباب من الجنسين بسبب الكبت ، وارتطام الطموح بخيبة الأمل .
8- ومنها : أن تكليف الزوج فوق طاقته يجلب العداوة في قلبه لزوجته لما يحدث له من ضيق مالي بسببها ، والهدف هو السعادة وليس الشقاء .
9- أن كثرة الصداق لو كان فيها شيء من المصلحة للمرأة وأوليائها فإن ما يترتب على ذلك من المفاسد يربو على تلك المصلحة إن وجدت ، والقاعدة الشرعية أن درء المفاسد مقدم على جلب المصالح.
10- أما القصة المروية عن عمر بن الخطاب رضي الله عنه أنه لما نهى أن يزاد في المهر عن أربعمائة درهم اعترضته امرأة من قريش فقالت:يا أمير المؤمنين نهيت الناس أن يزيدوا في مهر النساء على أربعمائة درهم ، فقالت : أما سمعت قول الله تعالى: وآتيتم إحداهن قنطاراً النساء /20 .
قال : فقال : اللهم غفرا كل الناس أفقه من عمر ، ثم رجع فركب المنبر فقال : أيها الناس إني نهيتكم أن تزيدوا النساء في صداقهن على أربعمائة ، فمن شاء أن يعطي من ماله ما أحب فليفعل .
فاعتراض المرأة عليه له طرق لا تخلو من مقال فلا تصلح للاحتجاج ولا لمعارضة تلك النصوص الثابتة المتقدم ذكرها ، لا سيما وأنه لم ينقل عن أحد من الصحابة مخالفة عمر أو الإنكار عليه غير ما جاء عن هذه المرأة . انتهى كلام الشيخ محمد بن إبراهيم بتصرف واختصار وبعض زيادات عليه .

The negative and harmful consequences of exaggerating concerning the dowry

Question

What is the ruling on what many women's guardians do nowadays of making excessive demands regarding the dowry and asking the husband for more than he can afford, which makes him take on many debts in order to get married, and which may put many young men off getting married?.


Answer




Praise be to Allaah. We have already explained in the answer to question no. 10525that Islam teaches that the dowry should be reduced and made simple, and that this is in the interests of both the husband and the wife. As the Prophet (peace and blessings of Allaah be upon him) said: “The best of marriage is that which is made easiest.” Narrated by Ibn Hibbaan, classed as saheeh by al-Albaani in Saheeh al-Jaami’, 3300.

The scholars have spoken a great deal about this issue and explained the harm that results from exaggerating concerning the mahr. For example, Shaykh Muhammad ibn Ibraaheem issued a lengthy fatwa on this matter, in which he said:

One of the things that people have gone too far in, until they reached the level of extravagance and excess, is the matter of exaggerating concerning the mahr, and being extravagant in clothing, wedding feasts, and so on. The knowledgeable and wise people have started to complain about this because of the many evil consequences to which it leads, such as many women remaining unmarried, because many men cannot afford the expenses of getting married, which leads to many kinds of evil consequences…. I have researched this matter from all angles and reached the following conclusions:

1 – Accepting a moderate dowry and not demanding more of the husband than he can afford are enjoined by sharee’ah, according to the consensus of the scholars of the earlier and later generations. This is the Sunnah that is proven from the Prophet (peace and blessings of Allaah be upon him).
2 – If the husband takes on payment of a dowry that he cannot afford and that is beyond his means, he deserves to be denounced for that, because he has done something makrooh, even if that dowry is less than the dowry given by the Prophet (peace and blessings of Allaah be upon him). Muslim narrated in his Saheeh (1424) that Abu Hurayrah said: A man came to the Prophet (peace and blessings of Allaah be upon him) and said: “I have got married to a woman from among the Ansaar.” The Messenger of Allaah (peace and blessings of Allaah be upon him) said to him: “Have you looked at her? For there may be something in the eyes of the Ansaar.” He said: “(Yes) I have looked at her.” He said: “For how much did you get married?” He said: ‘For four uqiyahs.” The Prophet (peace and blessings of Allaah be upon him) said: “For four uqiyahs! It is as if you are getting this silver by digging it up from the side of this mountain. We do not have anything to give you, but perhaps we will send you on a campaign from which you might get something.” So he sent a campaign to Bani ‘Abs, and he sent that man among them.
Al-Nawawi said in his commentary on this hadeeth: what this means is that it is makrooh to make the dowry too much in relation to the husband’s situation.
3 – There can be no doubt that marriage is something that is prescribed and encouraged in sharee’ah, and in most cases it reaches the degree of being obligatory. Most people cannot manage to do this thing that is prescribed or mustahabb when there is this exaggeration concerning the mahr. It is well known that whatever is essential to doing something obligatory is also obligatory, from which we may understand that it is prescribed to make people aware of the seriousness of this matter and stop them from going to extremes in this matter which is preventing men from doing that which Allaah has enjoined upon them (i.e., getting married), especially since the command to reduce the mahr will not lead to any evil consequences, rather it is wholly in the interests of both the husband and the wife, and is in fact something that is liked and encouraged in Islam, as stated above.
4 – There is no shar’i justification for the woman’s guardian to refuse to marry her to a compatible man if he proposes marriage to her and she is pleased with him, because he cannot pay the large dowry that the guardian demands because of his personal greed or for the purpose of extravagance and showing off. Rather this comes under the heading of preventing marriage for which the one who does it is regarded as a faasiq (evildoer) if he does it repeatedly.
Shaykh Ibn ‘Uthaymeen said:
The scholars found a way around this obstacle when they said that if a guardian refuses to marry his female relative under his care to a compatible man with whom she is pleased, then that guardianship passes to another. For example, if a woman’s father refuses to marry her to a man whose religious commitment and character are suitable and with whom she is pleased and whom she wants to marry, then the closest of people to her after him, among her brothers, paternal uncles or cousins, should marry her to him.”
5 – Increasing the mahr and exaggerating concerning it forms a strong obstacle to marriage, and the many evil consequences that result from that and the spread of evil actions among men and women, are well known. The means come under the same ruling as the ends. Islam came to achieve and complete people’s best interests, and to do away with and reduce evils. Even if reducing dowries were to do no more than block the ways that lead to haraam things, that would be sufficient.
6 – The evil consequences of exaggerating concerning dowries are well known. How many free, chaste women have been prevented from marrying by their guardians, who have wronged them and left them without husbands and children.
How many women has that led to respond to the calls of their own desire and the Shaytaan, so they have committed evil actions and brought shame upon themselves and their families and clans, because they have committed sins that anger the Most Merciful?
How many young men have been unable to meet these demands for which no authority was sent down by Allaah, so the devils and evil companions took control of them, until they led them astray and caused them to lose out, so they lost their families and lost their way, and they became lost to their ummah and homeland, and they lost out in this world and in the Hereafter.
7 – Another harmful effect of exaggerating concerning dowries is the appearance of mental illness among young people of both sexes, because of having to suppress their natural urges and because of the frustration they encounter when they try to get married.
8 – Making demands of the husband that he cannot meet may stir up enmity in his heart against his wife, due to the financial difficulties that he suffers because of her. But the aim (of marriage) is happiness, not hardship.
9 – Even if there is any benefit in a large dowry for the women or her guardians, the evil consequences outweigh any such benefits. The basic principle in sharee’ah is that warding off evil takes precedence over achieving benefits.
10 – With regard to the story narrated from ‘Umar ibn al-Khattaab (may Allaah be pleased with him), that when he forbade increasing the mahr to more than four hundred dirhams, a woman from among Quraysh objected to that and said: “O Ameer al-Mu’mineen, you have forbidden increasing the mahr of women to more than four hundred dirhams, have you not heard the words of Allaah (interpretation of the meaning): ‘…and you have given one of them a Qintaar (of gold, i.e. a great amount as Mahr)…’ [al-Nisa’ 4:20]?”
He said: “O Allaah, forgive me. All the people have more understanding of religion than ‘Umar.” Then he went back and ascended the minbar, and said: “O people, I forbade you to increase women’s dowries to more than four hundred. But whoever wants to give as much as he wants of his wealth, let him do so.”
But this story may be understood in different ways, and cannot be used as evidence or to oppose the proven texts referred to above, especially when there is no report of any objection to ‘Umar or denunciation of him on the part of any of the Sahaabah apart from this woman.

Comment juger tendance de bon nombre d'hommes assurant la tutelle sur des femmes à exiger des dots qui dépassent les capacités des prétendants et les poussent à s'endetter pour se marier, ce qui a fait que beaucoup de jeunes se détournent du mariage?

Louanges à Allah
Il a été expliqué dans le cadre de la réponse donnée à la question n° 10525 que la loi religieuse est venue alléger la dot et la faciliter, compte tenu des intérêts des futurs mariés. Le Prophète (Bénédiction et salut soient sur lui) a dit : Le meilleur mariage est le plus facile. (Rapporté par Ibn Hibban et jugé authentique par al-Albani dans Sahih al-Djami',3300)
Les ulémas ont abondamment abordé cette question et expliqué les méfaits de l'exagération des dots. Parmi ces ulémas figure cheikh Muhammad ibn Ibrahim. Il a émis une longue fatwa sur cette question. On y lit: «Certes , parmi les pratiques que les gens ont poussée au point de tomber dans le gaspillage et l'ostentation (la question de la hausse de la dot) dans les vêtements, et l'organisation des cérémonies familiales et d'autres (manifestations). Les ulémas et les gens raisonnables se sont sentis perturbés par les nombreux méfaits (de la hausse de la dot) notamment l'impossibilité pour bon nombre de femmes de se marier à cause de l'incapacité d'un grand nombre des hommes de supporter les frais du mariage. Ce qui aboutit à de nombreux dégâts.. J'ai fait des recherches sur les différents aspects de la question et retenu ce qui suit:
1.L'allègement de la dot de manière à ne pas imposer au prétendant une charge qui lui est pénible est une exigence religieuse de l'avis unanime des ulémas ancien et contemporains, car c'est la Sunna reçue de façon sûre du Prophète (Bénédiction et salut soient sur lui).
2.Quand un mari accepte de supporter une dot trop lourde qui dépasse ses moyens, il mérite d'être réprimandé pour avoir commis un acte répréhensible, même si la dot qu'il a versée est inférieure à celle offerte par le Prophète (Bénédiction et salut soient sur lui). Mouslim a rapporté dans son Sahih (1424) que selon Abou Hourayra un homme se présenta au Prophète (Bénédiction et salut soient sur lui) et dit:
-J'ai épousé une femme issue des Ansar.
-« L'avez-vous bien regardée…Les Ansar ont quelque chose dans les yeux!"
-Je l'ai bien regardée.
- Combien l'avez-vous offert pour le mariage?
- quatre onces.
-quatre onces! On dirait que vous être en mesure d'extraire de l'or de la montagne voisine! Nous n'avons rien à vous donner. Peut-être allons –nous vous associer à une expédition et vous permettre ainsi de gagner quelque chose.»
Puis il envoya une expédition vers les Bani Abs et l'intéressé y participa.»
Dans son commentaire de ce hadith, an-Nawawi dit: Ces propos impliquent la réprobation de l'augmentation de la dot par rapport à l'état du mari.
3.Nul doute que le mariage est une chose désirable. Il est même dans la plupart des cas une obligation. La plupart des gens ne parviennent pas à réaliser ce projet désirable à cause de l'exagération de la dot. Or, on sait bien que ce qui est nécessaire pour l'accomplissement d'une obligation devient une obligation. De là, on comprend qu'on doit orienter les gens et les empêcher de perpétuer cette tendance qui fait que certains ne pourront pas accomplir un devoir qu'Allah leur a prescrit. L'on sait , de surcroit, qu'un ordre allant dans le sens de la réduction de la dot n'entraîne aucun désavantage. Bien au contraire, il comporte un intérêt pour le futur couple. C'est même une chose désirable et aimée par le Législateur, comme il a été dit plus haut.
4.Le refus par le tuteur légal de la femme de la marier à un prétendant approprié et accepté par l'intéressée elle-même, dans le seul but d'amener le fiancé à verser une très importante dot qu'il ne demande que pour satisfaire des ambitions personnelles ou verser dans le gaspillage ou l'ostentation n'est pas légalement acceptable. Cela constitue une obstruction subjective interdite et dont l'auteur est jugé dévoyé s'il persiste. Cheikh Ibn Outhaymine a dit: Des ulémas ont trouvé un moyens de déjouer cet obstacle. Ils disent: si un tuteur légal refuse de marier sa protégée à un partenaire digne et accepté par l'intéressée, il perd son droit de tutelle au profit du tuteur suivant. Par exemple, si le père de la femme refuse de la marier à un prétendant accepté par l'intéressée et satisfaisant aussi bien pour sa religiosité que pour sa moralité, le plus proche parent de la femme parmi ses frères , ses oncles paternels et leurs fils pouvant exercer la tutelle légale s'en occupe.
5.L'exagérations des montants de la dot constitue un obstacle de taille pour bon nombre de ceux qui veulent se marier. Il est évident qu'il y a là la source de beaucoup de méfaits et la cause de comportements répréhensibles constatés chez les femmes et les hommes. Or les moyens sont jugés selon les objectifs qu'ils permettent d'atteindre. La charia est conçue pour réaliser et développer des intérêts, mais aussi pour éradiquer ou amoindrir des dégâts. Si les efforts visant à alléger la dot ne permettaient que de barrer la route aux actes interdits, cela suffirait.
6.Il est évident que l'exagération de la dot a eu de mauvaises conséquences. Que de femmes chastes sont victimes du comportement de tuteurs légaux injustes qui les ont laissée sans mari ni progénitures! Combien sont les femmes que cette situation a poussé à s'adonner à la passion et à Satan au point d'entraîner la honte pour elles-mêmes, pour leurs familles et pour leurs clans à cause des péchés qu'elles ont commis et de la colère divine qu'elles ont provoquée! Combien sont les jeunes incapables d'assumer ces frais qui ne reposent sur aucune révélation divine sont tombés dans le piège de Satan et des mauvais compagnons qui les ont égarés et plongés dans de dangereux lieux de perdition de sorte qu'ils ont fini par perdre leurs familles, leurs repères, leurs nations, leurs patries, bref leurs vies d'ici-bas et celle de l'au-delà!
7.Parmi les méfaits de l'exagération des dots figurent des maladies psychologiques apparues chez des jeunes des deux sexes à cause de l'inhibition et de la déception.
8.Le fait d'imposer au prétendant une charge qui dépasse ses moyens lui inspire de la haine pour son épouse à cause des difficultés financières qu'elle aurait occasionnées dans une affaire entreprise pour réaliser le bonheur et non le malheur.
9.أ€ supposer que l'exagération de la dot comporte un intérêt pour la future épouse et ses parents, elle entraîne des dégâts qui l'emportent sur ces intérêts potentiels. Or, la règle religieuse veut que l'élimination des dégâts soit préférée à la recherche d'avantages.
10.Quant à l'histoire selon laquelle, quand Omar ibn al-Khattab (P.A.a) fixa le montant de la dot à 400 dirham, une femme qureichite s'opposa à lui en disant: ô commandeur des croyants! Tu interdits aux femmes de recevoir une dot supérieure à 400 dirham alors que tu as entendu la parole du Très Haut : Si vous leur avez donné un quintal… (Coran,4:20).. Omar dit: Mon Seigneur, pardonne, tout le monde comprend mieux qu'Omar. Puis il revint et monta sur chaire et dit: أ” gens! Je vous avais interdit de donner aux femmes plus 400 dirham à tire de dot. Que le fasse quiconque voudrait donner davantage. Le hadith évoquant l'opposition de la femme a fait l'objet de versions discutables. Ce hadith ne peut, par conséquent, servir d'argument ni être opposé aux textes authentiques susmentionnés. En outre, il n'a été rapporté d'aucun des compagnons du Prophète qu'il se soit opposé à Omar ou ait remis en cause son avis, à l'exception de cette femme.» Extrait remanié, et résumé des propos de cheikh Muhammad ibn Ibrahim (10/187-199) plus quelques ajouts.
